There’s plenty of space to observe that as a Supreme Court Justice, Antonin Scalia held wretched, backward views that had life-altering (and regularly ending) negative consequences for thousands if not millions of people, without actually resorting to personal attacks or saying he was a bad enough person to have his grave danced upon.

Better men than I have tried to actually thread the needle between those two observations, but I’m pretty sure there’s daylight in there somewhere.

Actually, AFAICR, Scalia was one of those Justices for whom the ups and downs of any health issues he might/might not have had wasn’t fodder for the glorified gossip-columns that pass for political reportage in this country. His health, whenever the subject came up, was generally thought to be OK. Unlike, say, Ruth Bader Ginsburg or Anthony Kennedy: every cold or dizzy spell is taken as an impending visit from The Reaper (whom we know keeps to his own schedule!).

One of the talking heads actually asked the Cruz rep a hard question… about those mailers. She didn’t really have an answer.

The talking head asked from where the Cruz campaign pulled those voting % numbers in the mailers. Cruz rep just said “we stand by those numbers.”

I think we can all say we’re happy Scalia is off the court. It would have been better if he had resigned, but I’m not hugely surprised that he died. I wonder if how long the GOP will try to stall the confirmation of a replacement.

Scalia did have some moments of lucidiy where he wasn’t in 100% lockstep with the conservative worldview-but they were few and far between, and he definitely was a hypocrite in his application of his Catholic faith on his rulings.

Kennedy was submitted to the Senate in November of ‘87 to be fair after Reagan’s first was rejected and the second withdrew but as you got at it is a rare event. And LBJ actually did nominate two in 1968. FDR in 1940 also. No Republicans have but none of the Republicans have had a vacancy come up like this either and I think if they had, it’s fair to assume they would have too because that’s the President’s fucking job. I really am so sick of the GOP’s obstructionist bullshit. God just admit that you don’t want him to do his job because you don’t respect him. It would be honest at least.

Actually, AFAICR, Scalia was one of those Justices for whom the ups and downs of any health issues he might/might not have had wasn’t fodder for the glorified gossip-columns that pass for political reportage in this country. His health, whenever the subject came up, was generally thought to be OK. Unlike, say, Ruth Bader Ginsburg or Anthony Kennedy: every cold or dizzy spell is taken as an impending visit from The Reaper (whom we know keeps to his own schedule!).

So was the Mates. Then just shortly after Xmas, she had a heart attack. Three weeks later she had a pulmonary edema and i damn near lost her. Death come for you when it wants, generally when it’s least expected.

Oh and I did find an example of a Republican appointing someone in a presidential election year. Hoover submitted Benjamin Cardozo to the Senate in February of 1932. So yeah as I said, I have no doubt if Nixon, Reagan, or the Bushes had this come up in an election year, they would have done the same Obama’s about to do. This is just sour grapes from a party and ideology that knows that things are going to change with Scalia off the court and it scares the crap out of them.

Though it must be noted that LBJ had to withdraw Abe Fortas’ nomination to be chief justice and Fortas resigned from the Court under a cloud soon after. Earl Warren remained Chief Justice until 1969, when Nixon’s nominee, Warren Burger, was confirmed.

Okay check this out guys. This is a list of all nominations to the court including nominees that were voted down or dropped out ala Miers. Benjamin Harrison nominated someone in July of 1892. So yeah I think Grassley’s blowing smoke big time since this is such a fairly rare event.

For those who may have forgotten, Bork was the hit man for Nixon during Watergate as the key participant in the Saturday Night Massacare.

Although he was a Republican, my Senator John Warner voted against that asshole. Oh and our current VP can be given a lot of credit for stopping Bork. Scalia, Bork, Alito, Thomas, and Roberts all on the same court. Holy crappola dude.
