Breaking: Jury Awards Hulk Hogan $115M in Damages in Gawker Libel Suit

Law • Views: 67,057

Just coming in: the jury has sided with Hulk Hogan in his lawsuit against Gawker for publishing a sex tape, and awarded him $115 million in compensatory damages.

This is going to send shivers down the spine of the US journalism business. As someone who’s been dishonestly slimed by them myself, I’m not crying for Gawker, but the implications for the media business are huge.

I assume Gawker will now appeal this verdict, because this award is wildly excessive; gigantic enough to end them.

The verdict breaks down at roughly half for economic damages, and half emotional damages.

The jury seems set on making a point, but it just seems excessive on both parts.

I don’t know how much this cost Hogan economically, I don’t think it’s anywhere near $60 million (and considering how many people have actually gotten their start with a sex tape - Kardashian comes to mind), I wonder about economic losses beyond what the WWE contract was.

As for the emotional distress, that could be plausible, but it’s still on the high side. I just don’t know what similar cases have brought.

Hogan’s last employment was as a judge on WWE’s last season of Tough Enough, a show only on their own branded network, and certainly a gig that was only worth a pittance compared to his big paydays decades ago.

Otherwise, whatever royalties Hogan would have received from WWE were not affected by him being dropped.

Hogan… er, Terry Bollea, had no other big deal since WWE would have him on an exclusive contract regarding any “sports entertainment”.

So unless Bollea had some movie, or book, deal that somehow fell through, I don’t know how much income he really would have lost.

I bet very little.

Gawker are not nice people, but I think the jury went overboard with their award of actual damages.

I am not so sure about this point. Just because someone is a public person, does not mean that they give up all right to privacy. I find it hard to believe that a Hulk Hogan sex tape falls into the “free flow of ideas and opinions on matters of public interest and concern” that the Courts have traditionally protected in cases like Hustler Magazine v Falwell (where the court voided a jury award for emotional distress due to a parody run in the magazine).

That’s been my thought as I’ve watched him in this election and read up on his past, that beneath that “kindly old grandpa” facade is an egotistical jerk who thinks he’s the center of the “revolution.” Which means he’ll take every possible step he can to contest the nomination and, when all that fails, proceed to stomp off while insisting that it was “stolen” from him by the party leadership.

I’m seeing a lot of people lazily compare the Hulk v. Gawker case to that of Erin Andrews. This is patently ridiculous because Hulk wasn’t stalked, he wasn’t in his own paid for hotel room, and nobody involved in this particluar lawsuit had any real fiduciary duty to protect his privacy.

You can plausibly argue that he had a reasonable sense of privacy in his friend’s bedroom, consensually boning his friend’s wife with his friend’s knowledge, whether or not he knew he was being recorded. That still doesn’t make this case remotely like Andrews’ lawsuit. Which is what makes the disparity in jury awards so egregious, in Andrews’ case her health and safety were put in literal jeopardy by the hotel employee who gave the stalker her schedule and booked him a room next to hers.

And to be honest, I’m not sure what the right answer is - celebrities and public figures deserve the right to privacy as much as anyone else does; but limiting the press is always dangerous.

Part of the thing that bothers me about this case is that it feels a lot like paparazzi cases. There really doesn’t feel like there’s anything newsworthy in this story, it’s all… for lack of a better term… purient interest stuff. I don’t see any value in seeing pictures of [insert famous person here] without makeup or out of shape getting a cup of coffee in sweatpants. Yet that gets the same protection as an investigative journalist seeking out corruption in government.

The piece is called Azalea, and when my parents bought their current house, Mom planted some azalea bushes in front of the porch. Every year for Mother’s Day, we’d have a picture taken with her and us girls behind the azalea bushes, which were almost always in bloom.

I don’t get home for Mother’s Day anymore, and I think my parents are going to sell the house in a year or two and it’s going to be really sad for my mom, so my hope is that she’ll always be able to look at this and remember.

I have to go to bed, but this brings back a memory. My brother had just married a German woman and moved to Hamburg in the late 1980s. He asked me to visit—implored, really—and I had a bit of money saved in the 1991, so I went to visit. His wife had him doing all kinds of home improvement jobs and the fucker virtually had no time for me, so I just went wandering around Hamburg. One night I went in a bar in my stock American jeans and polo shirt and khaki jacket. Two guys in leather jackets were deep in conversation down the bar, but after 15 minutes or so I recognized English: “too much too soon” ha ha and some exaggerated German. I smiled and said “New York Dolls!” They burst into smiles and, as they ordered “korn” for me, explained that they were thinking of kicking my ass (they spoke nearly perfect English, so who knows how “working class” they really were) until I spoke the magic words.

The funny thing is, I only knew a few NY Dolls songs. But I had recently seen David Johansen’s “Live it Up” tour show, and that kicked ass.

I’m seeing a lot of people lazily compare the Hulk v. Gawker case to that of Erin Andrews. This is patently ridiculous because Hulk wasn’t stalked, he wasn’t in his own paid for hotel room, and nobody involved in this particluar lawsuit had any real fiduciary duty to protect his privacy.

He was at a friends house and was not aware he was being recorded. His privacy was certainly violated illegally and Gawker took advantage of it and profited from it. How would you feel if Gawker had been the ones that released the naked images of Jennifer Lawrence that were obtained through hacking?

I have to go to bed, but this brings back a memory. My brother had just married a German woman and moved to Hamburg in the late 1980s. He asked me to visit—implored, really—and I had a bit of money saved in the 1991, so I went to visit. His wife had him doing all kinds of home improvement jobs and the fucker virtually had no time for me, so I just went wandering around Hamburg. One night I went in a bar in my stock American jeans and polo shirt and khaki jacket. Two guys in leather jackets were deep in conversation down the bar, but after 15 minutes or so I recognized English: “too much too soon” ha ha and some exaggerated German. I smiled and said “New York Dolls!” They burst into smiles and, as they ordered “korn” for me, explained that they were thinking of kicking my ass (they spoke nearly perfect English, so who knows how “working class” they really were) until I spoke the magic words.

The funny thing is, I only knew a few NY Dolls songs. But I had recently seen David Johansen’s “Live it Up” tour show, and that kicked ass.

“What’s the password?”

“Too much too soon.”

“OK, you’re all right then. Come in!”

Proud, maybe…but sorry to say he has had money problems for decades. The fact his house in Hawaii has been in danger of foreclosure means he is touring harder in his late 60s than he was in his 30s & 40s.

He sold his points in Bat Out of Hell to buy his pad in Hawaii, and he had to sell much of his publishing in the 80s to settle a tax bill. That means whenever you hear “Hello It’s Me” selling Tums or “Bang The Drum” selling cruises, he is making next to no money. It’s really sad, especially for his kids.

There’s also the question of the “journalistic necessity” of publishing the videos. It might be newsworthy — maybe — if Hulk had sex with another man’s wife. (Actually, it’s only “news” because a semi-famous person was doing it.) But there’s no need for a news agency to publish videos of the act itself. Most of the world does not need to see Hulk Hogan’s junk to imagine what was happening.

It’s just a couple of degrees removed from the act of hacking celebrities’ photo accounts and publishing them online, and still an invasion of privacy. Neither is journalism., in the sense that the Fourth Estate should be acting in the public interest.

That’s why I doubt this excessive award to Hogan will affect the first amendment rights of a free press. The Gawker “story” was clearly an invasion of Hogan’s privacy and was published outside the context of a clear public interest issue. For example, let’s assume Hogan had become some kind of Bible-thumping preacher, who condemned extra-marital sex and porn. If he had been filmed having sex with his best friend’s wife while publicly preaching this line, then maybe Gawker could have been justified in publishing evidence of the videos. Not the entire videos, though. As it is, they published the vids because it was Hulk Hogan having sex on camera, and for no other reason. (Other than to attract web traffic.)

Gawker is a stain on the Fourth Estate and this verdict should serve as a wake-up call to other rumor and gossip mills that there are limits to what they can publish. No laws have been passed to limit their free press rights, but potential of a huge financial penalty would serve a similar purpose.

It won’t stop idiots like Rage Furby and Pax Dickinson from trying to shame people, though. Rage Furby published a story alleging some big donor to Kasich was an Ashley Madison client. AFAIK, it’s gained no traction anywhere but in CCJ’s small circle of believers and re-posters.

I hung out with the wedge rats a bit, some overlap in the social circles. I only LARPed once, wasn’t really my thing, I was a theater geek, but more of a backstage set building, lighting and sound guy. We were pretty close together, probably know some of the same folks if you were there the year before I got there.

Place has changed a lot, the wedge isn’t the wedge anymore. They put buildings on part of the quad, and the lower Higgins lawn. They finally built that campus center they had been talking about forever.

I actually haven’t been on campus in years though, so not sure what else has changed. I should swing by sometime and take a look.

Certainly not true across the board (see Gene Simmons and Mick Jagger, et al), but musical talent and business sense have a way of being mutually exclusive.

Todd’s case is unique. He was a prodigy in his late teens and got hired by Albert Grossman (one time manager of Bob Dylan & Janis Joplin) as studio staff for the label he was starting. That meant he was under no real commercial pressure with his own music, as he was earning his keep first as an engineer, then as a talent scout and producer. When he started having tremendous success with all of the above, he naturally began to think he could do no wrong.

He sunk a scandalous amount of money into a video studio at the end of the 70s, assuming his genius would easily translate to that medium. A recent book stated that the monthly cost just to keep it up and running was $40,000 (in 1980 money!). MTV was still a year from going on the air, hardly anyone had a home video player and the studio was located 4 hours from NYC. I don’t think he ever fully recovered from that fiasco.

It’s possible that if he’d had more common sense, he couldn’t have created so much of the art I have loved for most of my life. Even so, I genuinely feel bad for his 3 sons who only ever saw him a few weeks at a time growing up and are destined to be left with next to nothing.

Not sure how far this analogy flies since A.) he wasn’t hacked but voluntarily placed himself in a compromised situation, B.) I have quite clearly only questioned the amount of the award, in particular in the comparative context of other civil judgements, and not the verdict itself, and C.) the degree to which the racist tirade contained in the tape possibly plays into the recording having more than just prurient interest in relation to his status as a public figure.

I don’t have the answers to all of these questions and don’t argue that his privacy was violated to some actionable degree. But comparing his case to that of Andrews and Lawrence ignores the acts he took that substantially differentiate his case from theirs.

Yet he’s the one who waw given by far the largest award, why?

The wedge rats and theater groups had a lot of overlap. When a bunch of us would go see the plays, we would often help tear down afterwards.

My favorite was Macbeth set in a dystopian future. They actually got the back half of a car for the stage.

Gawker’s sin was not leading with the racist tirade, posting that first and completely divorced from the sex and nudity. They could have blurred out body parts if necessary or simply released the audio of that section. That would have been far more newsworthy and relevant to the public discourse, if no less a violation of his privacy.

Leading with the sex was a massive blunder. We know why they did it, Gawker’s collective mind is in the gutter, and that’s why the jury slapped them down so hard.

But let’s not pretend that there isn’t a massive amount of bias that played into the award. After all the Judge allowed the Jury to ask a female editor if she fucked her way into her position:

Throughout the day, the judge encouraged members of the jury to submit questions to witnesses on the stand, a practice that some attorneys said was unusual. In one particularly astonishing moment, the jury asked Emma Carmichael, 26, editor-in-chief of another Gawker Media website, Jezebel, whether she had slept with either Daulerio or Denton, while working for them.

If you dig you’ll notice that they didn’t ask any of the male defense witnesses if they’d whored their way to the top, but they saw fit to ask a woman that, because to their minds women can be little more than talentless sluts.

I haven’t met these ones, to be honest. I have met a fair number of conspiracy theorists, but considering how the Pakistani Government operates, it is understandable.

So, yeah, in one of the the Doctor Who stories by Titan Comics, they have the Goddess Kali as a member of extra-dimensional beings that showed themselves as Gods to Lesser Beings, and extracted the energies through their followers, or something similar. Kali, in Doctor Who got her energy through the actions of the Thuggees.

Before this particular story, it is mentioned that the Time Lords had wiped out most of her kind.

However, in that story, the Scindia family, in the year 2314, work to revive her, and then please her by dropping a space colony on the city of Mumbai. Of course, the Doctor stops this, and this was only a very brief summary.

Strange thing is Moffat exercises a huge amount of editorial control in regards to the Expanded Universe of Doctor Who, and has vetoed decisions for things in Books and Comics in the past. He has generally been respectful of Christianity and Islam during his time, and seems to be fine with the Buddhist underpinnings that have appeared off an on.

But then, he seems to have gaping blindspot.

I get testy around the subject of Hinduism. It’s a weird aspect of my life that my family is divided between Muslims and Hindus, and there’s this endless friction of living entirely around Christians who are kind of aggressively dismissive.

Those same trade routes contributed to the spread of the Black Death, so there’s a downside to all that mobility, as we’ve seen lately with ebola, zika and other diseases.

It’s a good pitch for the reason the last one was completely dickish: It ends with conceding that no matter who wins nomination, we should throw our support behind them against Trump. It’s not a “If I don’t get my way, then this country can go to Hell!” tantrum, it’s a “I’d really like Bernie to win, but I’d settle for defeating Trump” sales pitch.

About the DF derp about GOP congressional support of mental health issues, I could not help but notice a page right here at LGF.

Most Republicans cite mental illness as the core cause of gun violence and mass shootings.

What does not make sense, however, is that in direct contradiction of this view, Republicans routinely slash funding for mental health programs. The House Republican budget for 2013 proposed to decrease federal funding for mental health treatment.

Since then, systemic cuts have continued. President Obama recently proposed an additional $500 million in spending on mental health care as an answer to Republican calls for a solution to mental health issues.

Despite this, Republicans continue to oppose additional spending. Not only does this create a contradiction, but it serves to put millions of lives at risk.

I think that if one takes their views on this seriously, one should also take seriously their religion-based devotion to Israel-as-such. After all there are plenty Bible verses they cite as proof of the need to support Israel in non-apocalyptic contexts.

Now, it’s not a “true” devotion on the human level, it’s still on the “Bible says it, I believe it, that settles it” level. But limiting it to Apocalypse-only seems like a cafeteria approach to me.

The true test of Freedom of Speech and the Press and its limitations are not how well regarded a person or organization is with the mainstream, but how far out of whack or even vile they are considered. I’m afraid this verdict will give the likes of Trump ammo to go after anyone he considers his enemy- which is about 90% of the mainstream press.

And even though the Republican candidate is an unknown ‘we can be sure that under the deft leadership of Mitch McConnell and Paul Ryan there will be control of the President to assure me that all that True Conservatives stand for will go forward.’

And of course ‘even though Obamacare was an attempt to fix the healthcare system, it is a failed approach and we will need to shut it down until Republicans can put in a conservative answer that works for everyone.’

So, ‘even though I have reservations and unknowns, I cannot in good conscience vote for a Democrat because I know the damage that will be done to true conservatives and all that we have accomplished since Reagan and Bush 1’
