Breaking: Jury Awards Hulk Hogan $25M in Punitive Damages From Gawker

That was an awfully expensive sex tape
Law • Views: 53,040

More bad news today for Gawker in the privacy invasion suit by wrestler Hulk Hogan; in addition to the $115 million compensatory damages awarded three days ago, the Florida jury has now awarded another $25 million in punitive damages, $10 million of which is owed personally by Gawker’s owner Nick Denton.

Denton said immediately after the first judgment that he plans to appeal this ruling, of course.

I wish I could tap-dance on Gawker’s grave for a better reason than a wrinkled ex-pro-wrestler’s dong.

I’ve also seen a lot of legal chatter that suggests they’ve got a good chance on appeal.

Somewhere I’ve read that these kinds of suits usually have the award damage significantly dialed back down in over 50% or more of cases; plus Gawker was stopped from having the actual perp (Bubba Clem, who did the recording) brought up to the witness stand. Not only that, but there was the fact that the video was out in the open before Gawker got its paws on it should favor heavily in Gawker’s favor of getting the judgement overturned. (Damming with faint praise and all, but still….)

Yeah, the appeal case has good odds, especially in light of the outrageous sums involved (which exceed what has been given by courts in cases involving deaths, FFS)…

Maybe the reason why “Hillary’s violence” is being “overlooked” might have something to do with the fact that it doesn’t exist? I tend to follow most campaign news, but any instance of Hillary Clinton commenting on campaign violence in ANY way other than condemnatory seems to have escaped me…

Trump’s stupid foreign aid statement really drives home how much the so-called business mogul knows jack about deals. The US aid Israel gets seems like such a nice gift until you realize that it’s use is rather limited and about 77% of that aid is used to acquire US systems and products, as well as to develop technologies that the US and other Western allies later obtain. It’s not a ‘donation’ so much as an investment, and it’s one that’s proven worthwhile considerably over the years.

I didn’t follow the case, at all. I am curious to see what the issues are on appeal, my guess is that there will be several. How it ends will depend on which issues Gawker is successful on. If Gawker wins on witnesses being excluded instead of on First Amendment grounds, it probably settles before retrial.

Gawker’s appeal looks to me like a slam dunk in their favor. They always knew, and openly said, they’d lose the jury trial - especially given the way the prosecuting attorney relied almost exclusively on disparaging ‘New York values’, in the most cliched manner possible. Remember, it’s a Florida jury. And they sure lived up to the cliches of their state; asking the Jezebel editor if she had slept with her superiors being one example. The judge encouraging such questions being another.
Anyway - the below article gives a good run-down of all that’s happened so far, and why the appeal is almost already won:

If Trump was hoping to convince any actual Israelis abroad via AIPAC, then I think it’s safe to say he failed spectacularly.
Israeli media generally slows down after 10:00PM, halts to a grind at around midnight and resumes only at around morning time unless there’s been something truly exceptional (usually disasters). Right now, the main headline on all the media websites is the same as it was before midnight - with trump’s seemingly hostile statement about ending the US aid to Israel. And it’s not going to change until the morning, when his statement is pretty much going to remain the main thing and the speech highlights hidden deep within the body of the article/s.
So for the next 24 hours, all anyone in the country is going to really hear or see about US politics is how Trump effectively told Israel to take a hike, his teleprompted speech later be damned.

We went out yesterday afternoon looking for a lamp for our living room, and stopped at an antiques place near our house.

We walked in, and right in front of us was a display case with bumper stickers for sale - Trump, ‘Hillary for Prison,’ ‘Obama - Not my president.’

I showed my wife and she said ‘Nope, no money for these people.’ We didn’t buy a lamp at all, but when we do it won’t be from that store.

re: #102 cinesimon

Gawker’s appeal looks to me like a slam dunk in their favor. They always knew, and openly said, they’d lose the jury trial - especially given the way the prosecuting attorney relied almost exclusively on disparaging ‘New York values’, in the most cliched manner possible. Remember, it’s a Florida jury. And they sure lived up to the cliches of their state; asking the Jezebel editor if she had slept with her superiors being one example. The judge encouraging such questions being another.
Anyway - the below article gives a good run-down of all that’s happened so far, and why the appeal is almost already won:

capitalnewyork.com

Most people who live in that part of Florida are from the Mid-West. South Florida Americans tend to come from the Northeast. I know this is hard to imagine, for the many who enjoy believing in stereotypes, but most Floridians are not country pumpkins, trailer trash, swamp rats etc.

So, SMOTI was busy saying how Trump killed it with his AIPAC speech. How exactly did he kill it? Were there chickens slaughtered? Did his goose stepping moron of a campaign staffer kill an ISIS terrorist in front of a live audience (or a CAIR member stand-in)?

No. He said mostly the same tired BS that politicians state at AIPAC confabs. Strong support for Israel. Yeah, except that in the same day Trump says that he’s going to basically tear up the NATO arrangement in place since 1949.

Trump’s said the same thing about moving the embassy to Jerusalem most other presidents and candidates have said - knowing full well it isn’t going to happen anytime soon, because that would be taking sides in the conflict that we’ve claimed to be neutral in.

He says he’d prevent the UN from imposing its will on Israel.

Just like Hillary did while as Secretary of State - where she was the head of the US diplomatic corps making sure that attempts to go after Israel at the UN were rebuffed.

So tell me again how Trump killed it?

Oh, and in a contest between deranged foreign policy experts, you’ve got Ted Cruz with Frank Gaffney in his corner, squaring off against Donald Trump’s Walid Phares.

Both are Islamophobes, but Phares gets the edge because of his direct and proximate relationship with militias that engaged in war crimes in Lebanon.

The rest of their respective foreign policy teams are the worst that US foreign policy has wrought over the past 20 years. Extreme right wingers, but note too that Phares was on the Romney foreign policy team too.

This is yet another indication that Trump’s differences from the other candidates is style, not substance.

Trump’s batcrap crazy foreign policy team member: Joe Schmitz. Worked for Blackwater. And his notions about law and personal responsibility had a certain amount of “flexibility”:

Another adviser is Joe Schmitz, who was both a former inspector general at the Department of Defense and a former Blackwater employee. According to a 2011 Jeremy Scahill report in the Nation, Schmitz once tried to argue that lawsuits regarding actions in Afghanistan against Blackwater could not go forward because Afghanistan was governed by Sharia law:

In 2008, in attempting to have the case thrown out of federal court in Florida, Schmitz argued that because the crash occurred in Afghanistan, Sharia law should be applied. Conveniently, Sharia law does not hold a company responsible for the actions of employees performed within the course of their work.

In his spare time, however, Schmitz managed to co-author, yes, “Sharia: The Threat to America,” a Center for Security Policy “report.”

George Papadopoulos was a Carson adviser, which tells you just how useful he was.

Figures that another foreign policy expert is a guy who is an energy trader, Carter Page.

re: #134 Ziggy_TARDIS

Why do you care about Palestinians?

OK first things first, my line was me posting in response over what seemed to be a truly moronic and totally wrong statement by Trump, which sounded like he believed that ISIS itself was in control of 50% of the Gaza Strip (which couldn’t be more detached from reality, and implied considerable ignorance of the region and the situation).

Secondly… Um, why wouldn’t I? I’ve known some outstanding Palestinians over the years and even if I hadn’t, why should I not have a modicum of concern for hundreds of thousands of men and women who are in a situation they never asked for and can barely influence, if at all?

With all the stuff being spouted at AIPAC today, not a single one brought up (that i’m aware of at least) the fact that Gaza is under the control of a militarized junta who seized control of the entire Strip by way of violent, murderous coup d’etat almost a decade ago. This is a state of things that has not changed, is not expected to change internally (no elections after all) and represents the REAL reason any and all negotiations are doomed at this point (Abass can’t do jack in the Bank while Hamas is in control of the Strip, and Hamas will never recognize Israel since they want it eradicated). While things in the Strip are not as bad as they’re portrayed to be, the average Palestinian citizen is nonetheless merely trying to survive - not Israel but its very own leadership.
Now, obviously none of this in any way justifies the incitement and certainly not the violence (to which i have been both a witness and a survivor on multiple counts - and yes, I have a bottle of high-quality alcohol reserved for the day Hamas falls and the leadership hangs). However, if we held entire populaces guilty for the crimes of the few of its people, the total number of humans on this planet would be smaller by a digit or two…
