Federal Judge: Confederate Emblem on Mississippi Flag Is “Anti-American”

African-American attorney Carlos Moore has filed a federal lawsuit in Mississippi seeking to have the state flag declared unconstitutional, because it includes a Confederate battle emblem (shown above). Yesterday the judge in the case said the Confederate flag is “anti-American,” a fact that’s hard to deny since it’s a symbol of a pro-slavery rebellion that seceded from and declared war against the United States. If that isn’t anti-American, what is?

Reeves didn’t say when he will rule on the arguments he heard Tuesday, but he noted they took place on the anniversary of the first shots of the Civil War being fired in 1861 at Fort Sumter, South Carolina.

“We’re still arguing about a flag in 2016 and arguing about a flag that is anti-American,” Reeves said. He said the Confederate battle flag was one symbol of those who fought to secede from the United States.

The judge also said the battle emblem is a symbol of the Confederacy, “which is anathema to anybody who lives within the 21st century.”

It doesn’t take a psychic to predict that this will drive the right wing media nuts (a short drive).

US Constitution, Article III, section 3:

Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.

So by constitutional definition the flag is a treason flag.

If I’m remembering my Civil War history correctly, the confederates tried to fight under the Stars and Bars, but in an era where troops still used flags to recognize positions, the Stars and Bars were too close to Old Glory to be easily identified. So, I was having a somewhat brief political conversation with my dad yesterday. He’s moved into the “I don’t believe any of those liars, they’re all full of crap” camp of politics. When I mentioned that economists evaluating Trump’s policies basically said that it’d lead to a trade war with Mexico and China his response was “I don’t think it’d be that bad, I think they depend on us a lot more than we depend on them.” I wasn’t really sure how to explain that it’d be much worse for us, but I found it interesting that he’s basically reached the “fuck em all” level of politics.

China and the US are part of the WTO. Anything we do to China would get challenged there, and if the US refused to cooperate, both China and other countries could retaliate.

NO. This is a standard practice and has going on since the beginning of the Cold War, possibly earlier. They aren’t going to Pearl Harbor us with a dumb bomb released at eyeball range. Clicking through to look at some of the numbers, it looks like China and Mexico are the biggest destinations for our exports, so starting trade wars with them would be less than good. The other thing is that we run trade deficits with a lot of countries, mostly because we are the largest economy in the world (meaning we tend to have the most disposable wealth) so we buy lots of stuff from lots of people who are more than willing to sell to us.

I have returned…

Took a well deserved vacation down to Music City - Nashville, and hit Mammoth Caves and Great Smokey Mountain National Parks. Caught some live music, enjoyed honky tonk row, and got skunked with the weather for a bit. We also saw the Hermitage, and visited James Polk’s family home (his homes were knocked down more than 100 years ago, even though his will called for it to be protected).

Got to see quite a bit of wildlife too - black bears with cubs, deer, wild turkeys, Jack Daniels, and the street scene downtown in Nashville.

And apparently the TN legislature has some wild ones working there too. Apparently one of the GOPers is way too hands on and engages in harassment. He’s been banned from state grounds except when on official state business at the legislature while the investigation continues. Sounds like a real charmer.

We also passed through some Civil War sites, including at Franklin, and there were some folks who were proudly showing their confederate colors. Umm, they do realize they’re celebrating not only the losing side, but the side that specifically stated their terms for insurrection was due to protecting the institution of slavery.

What we found particularly interesting is that Jackson put down insurrectionists during his term in office. He also owned slaves, so it’s an interesting juxtaposition. Add to that the fact that Jackson’s children later fought for the confederacy even though their father ended up believing that the Union must be preserved. How quick things change in a span of 30 years.

That has tremendous relevance to the current situation with the GOP. It doesn’t take much to watch a party go completely off the rails. And the GOP truly has gone off the rails.

One person is dead in a HazMat situation near the University of Texas campus in Austin, according to a UT spokesperson.

Did it take Donald Trump and Bernie sanders for EVERYONE to suddenly question the entire primary election process?

All I have seen today is all the media questioning the whole process. It is like all of a sudden the process stinks. This has been the process for how long now? Sure, some aspects have changed (the rules) but it is the parties that are making those changes.

Why all of a sudden is everything in question? Again…because of Trump and Sanders?

Both have really had nothing to do with the parties they are running under…but suddenly they have the power to call into question everything. And the media is helping them.

I just do not get this.

If you think it is all of a sudden a screwed up way to elect candidates, where were you all the last how many elections delegates chosen by the states has been the process?

And I am not saying it is a perfect process or a screwed up process. All I am saying is this IS the process.

And where is the media to question so much other political stuff that needs questioned? They usually tuck their tails and let politicians run rampant. Now they call everything in question.

And yes, I know…it is to drive ratings. It is about to drive this country crazy.

Most of 2015: Maybe he’ll help pull the Overton Window back to the left and out of Far Wingnutistan.

Late 2015: I like much of what he’s saying. Things have gotten so bad that we need a little bit of Socialism sprinkled in there to save our system from collapse and/or revolution, like a New-New Deal. GOP and the Glibertarians have been yammering about trickle down for decades and it’s never worked as claimed. Far too many people have been bullshited into believing it too.

Going into Primary season: Hmmm. He doesn’t have any real plan to get anything done just a “how to pay for it plan” that seems way too optimistic and still is going to fuck everyone over a little. Also, how do you figure out the costs of something when you have no implementation details? His followers are fucking loonies too. Like Paulians.

Now: I wouldn’t vote for the guy for dog catcher. All my fears about where this could go have come true and worse. His supporters actually want the world to burn, so he can have his revolution, the very revolution we need to avoid by fixing some of the issues he’s brought up. He’s a bitter old asshole who’s using the DNC for all the advantages he can get but refuses to take on any of the responsibilities or disadvantages that come with it. He doesn’t truly understand the issues he claims to be an expert about. His presidency would be as giant of a mess as Trump’s would be.

He’s the left’s Donald Trump.

I largely followed the same thought process, though I started to notice a stench right around January, just before Iowa. Up to that time, I’d had a favorable opinion of him, thought he was a bit overly optimistic about his proposals, and that his more rabid fans were the exception rather than the rule to his support base. Then the hacking incident happened and his handling of it sent up red flags. Followed by his decision to overturn months of “the emails aren’t important” to suddenly decide they were a “serious issue” just before New Hampshire clued me in that he was allowing his good fortunes to sway his campaign. The final straw really became the “You can’t be progressive and a moderate” statement that signaled to me and a lot of others that he was going to drop his focus on the issues and make the primaries a purity test. From that point forward, my opinion of him only soured further to the point now that I’d like to see him face a real challenge in 2018 from the DNC for his Senate seat.

Zephyr Teachout is much the same as Flores, but she does have a campaign page which she explains her position on some issues, but nothing on international politics or many other topics. Just Anti-Money in Politics, Small Business, Schools, and Water & Renewable Energy. No Immigration either, and nothing on even the most basic level of Gun Control.

One of the defining characteristics of Sanders is that his policies are broadly aligned with the Democratic Party’s, even though he very carefully pretends to be something exciting and new, and he appears to have a substantial and surprising degree of cross-ticket appeal. His appeals for economic justice seem to resonate with a non-trivial number of voters who would self-identify as independent or even republican, and he seems to do characteristically well with young folks who don’t necessarily recognize how hard the party has fought to win the victories that it has. It’s LUAPNOR to a T.

Trump is a doubled-down appeal to an extremely narrow cut of the GOP base, is stunningly, historically unpopular with indies and Democrats, and is really all over the map in terms of putative positions. He really has no parallel in modern American politics, and when one attempts to shoehorn one, it’s really just an exercise in pulling the wool over your eyes.

I don’t. If he were honest, he’d have run in the primaries against Obama in 2012. He spent months saying “Let’s you and him fight” to anyone who’d listen.

I think that’s a little far. I think Sanders is legitimately better on some issues than Hillary Clinton. I do think she’s a little more cozy with the investment banking scene than I’d prefer. I do wish she’d been a little more skeptical of the Exciting Iraq Adventure. These are legitimate criticisms.

But man, it sure is telling how often I see “what concessions could presumptive-nominee Clinton make to bring Sanders supporters on board” and how little I see the converse. The implicit understanding that Clinton supporters would, to a man, line up by default behind a guy who hijacked the party… it’s something that ought to be said aloud more often. Sanders’ labored, understated hints toward unification behind the eventual victor offend me on a very deep and fundamental level, and I would be lying if I said personal disgust was far behind.

I am not saying that it is sexist to think that a strong primary challenger has helped Hillary Clinton re-hone her skills and prepare for the general. I am also not saying that Sanders, or any specific supporter of his, has said those things as a sexist dog-whistle. Let me be clear about that.

But it should not come as a surprise if many Clinton supporters (particularly but not exclusively women) might hear these sorts of claims, claims that I don’t remember having been made about any male candidate, and interpret them in a sexist light. The Sanders campaign’s apparent inability to recognize or understand these second-order effects* is kind of damning, particularly in light of the fact that he would be running the first nakedly socialist serious campaign for the first time in generations. He needs to be demonstrating fabulous message discipline right now, and it’s just not there at all. Not in the least.

One dead, 11 injured in gas leak near UT

One person was dead and 11 others were injured Wednesday afternoon after a poisonous gas leaked at high-rise apartments near the University of the Texas campus.

Authorities said the name of the dead man, who was in his 20s, was being withheld pending notification of next of kin. Attempts to resuscitate him at the scene were unsuccessful, fire officials said.

Austin Fire Department Batallion Chief Palmer Buck said fire units were called to the 21 Pearl Apartments in the West Campus neighborhood about 3:20 p.m. after residents reported finding a man unconscious and a strong odor permeating parts of the 136-unit building.

Officials said the odor appeared to be hydrogen sulfide, a chemical that can release fatal fumes.

Some of you might find this survey from November of interest as it covers American attitudes towards Jews & Israel as well as Muslims & Islam (the odd part being that people seem to have a largely favorable opinion of Muslim people (67% favorable, 31% unfavorable) while holding a largely unfavorable view of the religion of Islam (37% favorable, 61% unfavorable).

How does that work? Is it like, “Oh, we like you guys just fine, but we’d like you even better if you stopped that whole ‘Islam is our religion’ thing.” O_o

I just made the mistake of looking out the front window and seeing both of my cats crossing the street. Freaked me the fuck out. I went out and stood crossing guard since calling them in is senseless.

Here they are enjoying a home office day with me today…happiest three hours of my day, having them sleep beside me while I worked. Even left the TV off so I wouldn’t disturb them.

Upon reflection, I think my husband and friends used that to exact revenge on a crooked game at a fair when they were teenagers. They sprinkled some aluminum sulfate in front of the booth (outdoors, obviously) and in a humid climate it started to produce a little H2S, so the guy did what anyone would, tried to wash it down…
Apparently it wasn’t good for his business.

It works because of the “Christian Nation” filter so many Americans see things through. They can see people, they have a hard time understanding a religion. Add in the way politicians and media have played on the religion and you can see how it works in their heads.

I also think you have been victimized by Hillary’s packed bags. It is easy to get sick of hearing it, but don’t let that get in the way because so much of it has been blown way out of proportion.

Remember…a whole RWNJ Hate Industry was formed and matured by Bill and Hillary. Their might not even be a Fox, Rush, Glenn, etc. if not for The Clintons.

That which makes you stronger…is how I look at it. That is why I called her a honey badger. She don’t give a shit.

And she has wanted this from the beginning. Her whole career has been a preparation. I think that helps a lot for the crap a “first woman president” will get should she become elected. It’s time.

That’s a big fucking deal.

Since Governor Bevin has stated that he will not call a special session, this could potentially result in a shutdown of much of state government starting July 1 and lasting until the G.A. can pass a budget sometime next year.

Yeah…that’s money the DNC could have used. Again, the primary isn’t the end of the world. Just look at the GOP. One of those assholes will be given 200 electoral votes out the gate and will be treated as a viable alternative to Hillary by the media as soon as he’s got the nomination.

It is not celebrated as such, at least not as part of a revisionist history, nor has it been wielded as a symbol of racial oppression in the way others have. It’s kind of a neutral declaration that they were in the Confederacy and for good or ill that’s history. Perhaps it could be considered a badge of shame.
Ultimately, what a flag means is in the eye of the beholder.
