The Latest Idea From the National Review Brain Trust: Stop Hillary by Impeaching Her Now

Lolwut?
WTF • Views: 41,924

Here’s today’s measure of the derangement that has the conservative movement in a death grip, as National Review “intellectual” Andrew McCarthy tries to argue that Hillary Clinton should be impeached before she’s even elected.

The Constitution does not limit impeachment to incumbent officials. Article I endows the House of Representatives with the “sole Power of Impeachment” — i.e., the power to file articles of impeachment. It further empowers the Senate with “the sole Power to try all Impeachments.” Significantly, in prescribing the standard for conviction in the Senate, Article I, Section 3 states that “no Person shall be convicted without the Concurrence of two-thirds of the Members present” (emphasis added).

Note carefully: The Constitution does not say the impeached person must be a current officeholder. As we shall see, that makes perfect sense: The point of impeachment is to deny power to any person — not necessarily an incumbent official — whose high crimes and misdemeanors have demonstrated unfitness for a high public trust.

One thing conservatives are great at: coming up with hare-brained schemes to nullify the voters of the Democratic Party. With Barack Obama they tried to do it by spreading conspiracy theories that he wasn’t even a US citizen. But this new concept of impeaching the Democratic nominee before she’s even elected — well, that wins our Right Wing Derangement Prize of the Day.

I wonder why they don’t suggest doing that to Trump? Didn’t they put out an entire issue dedicated to showing why he is unfit for the job?

Since he knows the Senate wouldn’t come close to enough votes to convict Hillary, the clear purpose of implementing his proposal would be to generate a mountain of negative publicity for her leading up to the election.

They’ve fallen so far down the rabbit hole of “All Democrats are corrupt criminals!!” that they can’t see daylight any more. Nobody but Republicans can be allowed to rule. Ever. Because reasons.

Wow. That’s just…wow.

But it’s like I say anytime a wingnut says, “Why hasn’t Obama been impeached?”: On what charge, and based on what evidence.

And BENGHAZII!!! doesn’t count as a criminal charge.

Dear Andrew McCarthy,

Remember the 1998 election, when the Noot told you guys that impeaching Clinton was a surefire way to increase your majorities in the House and Senate? How’d THAT work out for you?

10
Lidane  Sep 6, 2016 • 1:21:51pm

Benghazi didn’t work.

The 11 hour interrogation on live TV failed.

No one gives a shit about Hillary’s emails. At worst, she comes across like a clueless grandma about email. That’s not an impeachable offense.

The FBI cleared Hillary of wrongdoing.

Despite her having a cough, which never ever ever happens to people who spend a lot of time on the road talking to people, she’s relatively healthy.

All the GOP has left is impeaching her before she takes office. WOW.

The Constitution does not limit impeachment to incumbent officials.

That’s some rather impressive legal gymnastics, since the Constitution also says this:

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

-Article II, Section 4.

I’m fairly certain that a plain reading of that bit makes it clear that impeachment can only be invoked for sitting officers/judges. Especially since impeachment does not protect against criminal liability:

Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

-Article I, Section 3

Beyond that, there’s the whole problem of them not being able to get 67 votes in the Senate (even assuming they could pass articles of impeachment in the House). All this would do is fire up Democratic voters, turn off independents and moderates, and likely demoralize Republican voters.

This kind of behavior by young people is actually something of a tradition in some Amish communities, “Rumspringa.” It is part of the process of exploring whether they want to commit to the community and its lifestyle, or go out into the larger world (though not usually to jail).

Police raid Amish party in Ohio field and arrest 73 people

MILLERSBURG, Ohio (AP) - Authorities in the heart of Ohio’s Amish country say they arrested more than 70 people in a raid at a weekend party in a field that was expected to attract hundreds of Amish youth.

More than 40 officers converged Saturday on the Hardy Township field after concerned parents notified the Holmes County sheriff’s office of a large party expected to attract over 1,000 Amish from Ohio and neighboring states.

Investigators say 73 people, including 35 juveniles, were taken into custody and charged with underage consumption of alcohol.

Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States: but the Party convicted shall nevertheless be liable and subject to Indictment, Trial, Judgment and Punishment, according to Law.

indictment trial etc is still on the table - why not just go there?

I think they actually want a fucking civil war. I’m not sure what other conclusions can be drawn if the House were to essentially void the election of the POTUS. It would be the actual end of the Republic in her present form if the legislature took to upending election results and replacing them with their own guy.

The goddamned libtards didn’t get the message! WE OWN THE WHITEHOUSE and Hillary fucking Clinton is going to rot in jail before she ever sets foot in it again!!

It would also mean American cities would burn…and I would be cheering them (and joining) in that case. Our democracy would be effectively dead.

Actually, Quayle made one of the most cogent remarks of the 2000 election campaign:
He appeared on he Tonight Show just after his own hopeless primary campaign had ended and Jay Leno asked him why he had given up. The audience laughed but Quayle answered, “We just could not match the Bush money machine.”

Every night the local gentry

But then, Trump was fighting his own personal Vietnam at Studio 54.

Report: Trump wasn’t in NYC on 9/11 as he’s claimed, but was in Florida?

The source, who did not want her name used because she feared being targeted by Trump supporters, saw his remarks and offhandedly said to her daughter-in-law: “Well, I know he didn’t see that happening from his window because he wasn’t even in New York. He was in Florida with Neal and Tolly.”

Her friends Neal Travis—founding editor of the New York Post’s Page Six—and his wife, Tolly, were at Trump’s Palm Beach getaway, Mar-a-Lago. The source says she knew this because Neal called her from Florida after the attacks and asked whether there was any information about when planes would be allowed to land in the city again. Neil said, “Here’s Donald; talk to him,” she recalled to me last week. “Then I just heard this brusque voice going, ‘Have you heard anything?’ And I’m thinking, ‘Why are you asking me?’ I told him the same thing: I saw something in the [New York] Times about easing up on plane traffic.”

The article she saw, published online on Sept. 13, 2001, announced that commercial air traffic had resumed that morning “on a case-by-case basis.” If Trump were in Florida on 9/11, Sept. 13 would have been the first day he could have returned to New York. Indeed, the first visual evidence I’ve seen of Trump in New York City post-9/11 was on Sept. 13, 2001. He gave an interview near Ground Zero to a German television station.

Crain’s looked into the source’s claim, but Neil Travis passed away in 2002 and we were unable to reach Tolly, who the source said does not remember the details of that day clearly. We compiled a list of aircraft owned by Trump or his businesses and sent the information to FlightAware. The flight-tracking company told us that none of those planes were in Florida at that time.

Matt Yglesias wrote an article suggesting that emails are more like phone conversations than letters and should be treated like we treat phone calls, and is now getting pummelled on Twitter as Orwellian.

But to me, it makes sense. So much of even my work email is comprised of brief conversations, bits of snark, etc. Sure, we also send each other data and analyses, because it’s easier to do that and present it as a piece than to try and find someone and show them a few sheets of paper, but still. You email what you’d say in a phone call, but with email, you don’t have to worry about whether the person is there and has time to talk, or whether YOU’LL have time to talk when they return your call.

We don’t feel entitled to listen to every phone conversation within a government, and the law similarly won’t give us access to them. So why are we entitled to all the emails?

Rush Limbaugh pointed out today that Phyllis Schlafly had supported Nixon early in his administration but split with him over the ERA. Of all the evil this woman did, her almost single-handed defeat of the ERA might well be the worst.

Actually, there had been an earlier split: Schlafly first came to national prominence when she led a “revolt” against the civil rights plank of the GOP platform at the 1960 party convention. She reminded the delegates that the GOP had not received a majority of the “negro” vote since 1928, and they were alienating a (then) much larger southern segregationist vote by trying for it. The plank stayed but Nixon and the party did come around to Schlafly’s view in 1968. As such, Schlafly was a very early and crucial instigator of the southern strategy. Like anti-feminism, this remains a bedrock component of the Republican strategy to this day.

re: #69 Shiplord Kirel

Huh. I only new her as a horrible person from the anti-ERA stuff in the 1970s. I didn’t realize she’d been horrible for a long time before that.

I’m loath to ascribe malice. I’m just curious what their LV screen is, and why this sample looks so different from the 2 previous months in party affiliation. It LOOKS LIKE their sample skewed far more Republican than previous months, and the LV screen took voters from Clinton almost exclusively, according to what I’ve read.

Another poll came out to day with Clinton +6 among RV, so there’s also that datapoint.

Overall, it would not be surprising to find the race narrowing considering just how hard the media have been working to find any signs of a pivot from Trump, and how much has been made of nothing on the Clinton Foundation side, with the NYT’s “This raises new questions” from Eric Lichtblau being especially execrable.

Gay marriage and the alleged danger of unisex restrooms were key talking points for Schlafly’s anti-ERA campaign; over 40 years ago. She was decades ahead of the base in many respects and it is no exaggeration to say that the Republican Party as we know and loathe it today was her creation more than anybody else’s.

Given CNN’s actions in reporting in the last few weeks, such as Tussisologist* Newt Gingrich on this afternoon, along with the other recent actions by the major media, I think we’re at the point where we can no longer ascribe their actions to stupidity. They (and the AP, Fox News, MSNBC, NY Times, etc.) want President Trump to appoint them as the Official Media of his State. Why they haven’t figured out how quickly he tires of his toys I don’t know, but it’s stupidity they demand that we all pay for.

*Tussisology = expect in the field of coughing, from Latin tussis or cough.

Laid out explicitly in this article (also linked on the previous thread):

[…]

“A Choice” was nominally a book in support of Barry Goldwater’s presidential bid. But it was really a broadside against the Republican establishment. In it, she accused “a small group of secret kingmakers” of denying conservatives opportunities in the GOP for thirty years. Party elites, she argued, had used newfangled advertising techniques to manipulate voters into picking the establishment’s preferred candidate. And the goal of all this backroom dealing? To enact their “hidden policy of perpetuating the Red empire in order to perpetuate the high level of Federal spending and control” that would fill their personal coffers.

As the dust-up with National Review showed, it wasn’t just the Republican establishment Schlafly was fighting. She was intent on battling conservatives who sought to “clean up” conservatism by policing the movement’s boundaries. As Buckley and other editors at National Review sought to purge the Birchers after Goldwater’s loss - fearing that the group’s nutty conspiracism was tainting the entire conservative cause - Schlafly continued to support the society. If Buckley was intent on dividing conservatives between “responsibles” and “irresponsibles,” Schlafly was siding with the latter.

If those fissures sound familiar, they should: They’re visible, and widening, […]

Ohio Amish have had a few situations over the years that wouldn’t be considered typical Amish behavior. Several of them have involved alcohol and younger people.

Amish go wild!!!

Oh yeah, Millersburg is like ground zero for the Amish in Ohio. It is a town made for “the English” to visit and get their Amish experience. If you go in about a 60/80 mile radius all around Millersburg on the back roads you will see real Amish farms and small communities…like Shreve. Some areas around there look like the early 1900s. I think I’ve mentioned it before, but Ohio has more Amish folks than Pennsylvania…something explained to me by Mennonites.

I am finding that a simple discussion of the facts of Phyllis Schlafly’s career puts a strain on my “don’t speak ill of the dead” policy.

Even so, the woman was a historical figure, even more significant in my opinion than is commonly realized today. Her influence is everywhere. A stroll through any inner-city neighborhood will reveal the subtle effects of the southern strategy. I, personally, raised two female scientists. The failure of the ERA figured in that process, and not in a positive way.
The real nature and pervasive influence of her activism is a legitimate; indeed, very necessary; subject for discussion.

Given all she has done, the only way to avoid speaking ill of this person would be to assume a false neutrality, or to abandon my own principles.

I understand, and respect, that she was someone’s beloved grandmother (and great grandmother) but that does not give her a pass for the monstrous damage she has done to this society over the last 50 years.

1956: Eisenhower/Nixon
1968: Nixon/Agnew
1972: Nixon/Agnew
1980: Reagan/Bush
1984: Reagan/Bush
1988: Bush/Quayle
2000: Bush/Cheney
2004: Bush/Cheney

I was born in 1978, 2012 was the first (and thus far, only) presidential election in my life time where neither a Bush nor a Clinton ran for president/vice-president.

Ditto.

She was the topic of my first political argument (that I recall) between my mother and me. Mom said that one should ALWAYS vote for the woman. I asked, ‘Even if it were Phyllis Schlafley?’ Mom said yes. I said, ‘That’s ridiculous. There are plenty of men who are more feminist than she is.’ Mom’s position was that people needed to see women in positions of power. I saw my mom in a position of stupidity. Now I can see her point, but I still disagree, and Mom has only grown more stupid, in my humble and totally disrespectful opinion.

O. M. G.

Federal, state and local authorities are investigating the cause of Saturday’s natural gas pipeline explosion that killed five adults and five children and left two other people in critical condition in southeast New Mexico.

The victims, members of two extended families, were camping early Saturday morning near the Pecos River, about 200 to 300 yards from the below-ground explosion.

The two adult survivors were in critical condition in a Lubbock, Texas hospital.

The 30-inch pipeline exploded around 5:30 a.m. Saturday, and left a crater about 86 feet long, 46 feet wide and 20 feet deep. Police say the resulting fire probably lasted 30 to 40 minutes. It reportedly was visible about 20 miles to the north in Carlsbad, N.M.

Authorities said one end of the ruptured line became a virtual flame-thrower, showering fire on the victims camped beneath a bridge about 200 yards away.

“The evidence out there at the scene indicates it was horrendously hot,” State Police Capt. John Balderston said. “It incinerated everything in its path. If it burned for as long as we think it burned, that explains the extensive damage to the vehicles and to the property and people.

Fuck this company:

Could Have Been Anything

Dunn said the explosion could have been touched off by anything — from a spark generated by rocks striking each other, someone lighting a cigarette or coal from a barbecue.

The pipeline supplies gas to power plants in Texas, New Mexico, Arizona and California, she said. Somerholder said crews were working today to get the line back in service because it is a major supply line.

Somerholder said the line was installed in 1950, but said there did not appear to be any correlation between the age of the pipeline and the explosion.

“Most of our pipelines in this age range are in very good shape,” he said.

Dunn said the line was last checked Aug. 2.

I think this happened in 2000:
August 19, 2000

(A) 30-inch diameter El Paso Natural Gas pipeline rupture and fire near Carlsbad, New Mexico killed 12 members of an extended family camping over 600 feet (180 m) from the rupture point. The force of the escaping gas created a 51-foot (16 m)-wide crater about 113 feet (34 m) along the pipe. A 49-foot (15 m) section of the pipe was ejected from the crater, in three pieces measuring approximately 3 feet (0.91 m), 20 feet (6.1 m), and 26 feet (7.9 m) in length. The largest piece of pipe was found about 287 feet (87 m) northwest of the crater. The cause of the failure was determined to be severe internal corrosion of that pipeline. On July 26, 2007, a USDOJ Consent Decree was later entered into by the pipeline owner to perform pipeline system upgrades to allow better internal pipeline inspections.

Two of the victims died later, one in Lubbock University Medical Center and the other at the Shriner’s Burn Institute in Galveston.

A big fricking hole had rusted through the 50-year-old pipe, rupturing it and and sending a giant jet of high pressure gas spewing over hell and gone. The pressure had to have been down for some time before the major rupture but nobody noticed. I remember this so well because a friend of mine, a doctor who also happens to be a volunteer firefighter, worked the scene. He said most of the victims were literally cremated where they stood, or lay, since some of them were asleep when the blast hit. ID was by dental records, since the heat had destroyed every trace of DNA.

Skew/unskew the CNN poll.

The CNN poll is problematic on so many levels, the first being that it’s an outlier on its face - 5-7 points in favor of Trump when all the others show Trump down by 3-5 points. That’s how he ends up with a narrow lead.

So the crosstabs show that CNN’s pollster picked an electorate that is outside what one would consider to be expected in 2016. In fact, it favors Trump because it’s whiter than what other pollsters expect.

I wouldn’t go so far as to claim that the adjusted figures are legit - only that the poll itself is not legit because it’s based on faulty assumptions. It’s the faulty assumptions that drove the results, and trying to rectify those results could introduce other errors/issues.

It’s an outlier. Treat it as such. And watch as all the rest of the polls continue to reinforce a 3-5 point lead for Clinton. Or more. And then the first debate will throw all that out the window.

In fewer words:

This poll is an excellent argument for polling compilations, vs individual polls, especially the ones that don’t throw out outliers, because throwing out an outlier assumes you know what the reality being measured is.

1. a day has passed
2. Some people are so bad that you can only state the truth or shut up - so in those instances you are quiet for at least a day.
3. Some people are so intrinsically evil that you can say things about them the day they die. E.G. I had no problem cranking out “the Death of an Evil Man” posts immediately following terrorist deaths. Phyllis was in a grey zone between “bad” and “intrinsically evil”.

Phyllis brings to mind this quote from CS Lewis:

Hence Theocracy is the worst of all governments. If we must have a tyrant a robber baron is far better than an inquisitor. The baron’s cruelty may sometimes sleep, his cupidity at some point may be sated; and since he dimly knows he is doing wrong he may possibly repent. But the inquisitor who mistakes his own cruelty and lust of power and fear for the voice of Heaven will torment us infinitely more because he torments us with the approval of his own conscience and his better impulses appear to him as temptations.

Phyllis brings to mind this quote from CS Lewis:

The thing that I don’t get is when people want people not to speak ill of the dead is that in this case the dead was fine with speaking ill of people. I mean this isn’t even Margaret Thatcher, another person whom the attempted whitewashing of their negative legacy bothered me. This is someone who was a racist and sexist and made a career of it. My thoughts go out to her family for their loss but she really was a hateful person and I’m not sorry for saying that the world of politics will be better off without her contribution.

Many GOPers, including Trump, seem to think that rally attendance = votes, but it’s a shortsighted and flawed way of counting votes. “And the electorate could be even more minority heavy this time.”

I’ve read that @ 50,000 Hispanics/Latinos reach age 18 every month. I also read that American Muslims have also begun actively registering voters. Many GOPers, including Trump, seem to think that rally attendance = votes, but it’s a shortsighted and flawed way of counting votes. I read, too, that not everyone who has attended, or will attend, a Trump rally, will vote, and that some of them aren’t even registered to vote.

Kind of the same problem Bernie had.

Hey—I’m all for them seeing every rally as equivalent to 40,000 door knocks. Let them keep thinking that, while we knock on the 40,000 doors.

What. The. Fuck. is wrong with this country?

Some people believe the filthy rich successful businessman hype. They’ve also been conditioned to view the wealthy as more worthy and somehow better. So when the “successful” person tells them their financial problems are someone else’s fault, and he’s got the answers and will fix things, it reduces the cognitive dissonance between “wealthy means good” and “I’m not wealthy”.

When Trump speaks, his sales banter meets a receptive target so blinded by the Trump hype that their brains ignore the obvious fact that the man is barely literate. And when he validates their hates and scapegoating, tells them they’ve been victimized by the evil libruls and POC and reinforces the Fox propaganda, it makes them feel good.

One can only hope that enough people will see Trump for the preening, vain narcissist that he is and vote accordingly.

But it is sad that so many people are falling for the con. Bigly.

Rude Pundit points out that Pam Bondi has dropped investigations in return for campaign contributions before the one she got from Trump.

For instance, Bondi’s predecessor, Bill McCollum, had sued travel agencies like Expedia who were trying to get out of paying certain taxes in Florida. A few junkets and some money funneled through the Republican Attorneys General Association later, and, in 2014, Bondi said that there was no need to continue the lawsuit.

This was part of her cozy relationship with the now-defunct law firm Dickstein Shapiro, which contributed nearly $25,000 to Bondi’s campaign war chest (which seems to be the going rate for her). Bondi didn’t pursue cases against the firm’s clients, like Herbalife and, hey, a for-profit college. Dickstein Shapiro was eventually cleared when it was investigated for trying to buy influence with Bondi, but, shit, if we use Republican standards for what lengthy investigations prove, then everyone involved was guilty as fuck. The Florida press started calling Bondi’s m.o. “pay to look away.”

But, hey, Trump’s spokesjerk says everything is ‘squared away,’ so don’t worry your pointy little heads, mainstream media.

One of the things I love most about President Obama is that if he has something to say to someone, he doesn’t talk sh*t behind the person’s back, he says it to his/her face. I also love his confidence. I know quite a few people made a lot of noise about China not rolling out the red carpet for him, but I don’t think it matters to him one whit. Why? Because he knows he’s the #1 mf*king leader on the planet, and there’s not a d*mn thing they can do about him except talk sh*t. Duterte has been talking lots of sh*t about the president, but he never expected him to un-invite him to the U.S., but that’s exactly what the president did. Reuters is reporting today that the Philippines is scrambling to “soothe tensions” with America. Duterte is learning soon in his tenure in office that it’s not a good idea to talk sh*t to President Obama. I can’t imagine Trump keeping his cool if Duterte had called him the son of a *hore/b*tch. No way. He’d be on Twitter acting like a two year old, no, make that a newborn.

re: #203 HappyWarrior

I think what you will see happen in Texas is the best showing by a Dem since Bill Clinton in 1992. I don’t know if Texas will go Dem in 2020 but I think it will in 2024 or 2028.

Having been immersed in TX Republican circles (of the highly educated and intelligent variety - yeah, I know, but bear with me) the past weeks, I’m seeing some very interesting dynamics. None of them can tolerate Trump and all acknowledge that the GOP has gone insane, taken over by fringe lunatics. (They also share a disgust of the likes of Cruz, Gohmert, Abbott, etc.) Not a one claims a willingness to vote for top ticket GOP. A couple are supporting Clinton outright, reluctantly of course but hey, cool. Perhaps strangely, those votes are coming from men. It seems the women who hate Clinton REALLY hate Clinton and her husband - they seem to always bring him up when they tell me why they hate Hillary. This is bad news. It’s gut-level and intensely personal.

I’m seeing a definite and increasing lean towards Johnson and a newfound affection for Libertarianism. We have actually been able to find considerable common ground in our debates. They know I’m a strong liberal but as an essential cog in the project we’re working on (if I go, the project craters), they gotta put up with me and be nice and I get to say anything I damn well please. Since I go fucking ballistic when I hear a right wing talking point/CT and they’ve learned they can’t support those against my fact-laden arguments (thanks Lizards! seriously, I could only instantly zap out the bullet point facts thanks to you guys) the discussions now center on issues rather than nebulous Hillary/Democrat hate. It’s kinda wonderful.

So TL:DR… though my sample is very small and doesn’t include knuckle-draggers, I think Hillary does have a real shot at taking Texas. It won’t be due to Republican votes for Clinton, but votes for Johnson if they vote top ticket at all.

You know what. I had a bad cold earlier in the summer. It fucking happens. We had a president that had Polio that got us through WWII and the Depression. We had another that had Depression that gout us through the Civil War.

As I mentioned I saw Hillary back at the end of July here in Columbus on the bus tour right after the convention. She did not cough once. Of course, it was hot, dry day and no where near fall allergy or late summer mold allergy seasons.

So…

The use of Mar-a-Lago alone was a donation of some value. Space at the resort is expensive to rent. Trump has charged his own presidential campaign roughly $140,000 an event for use of the resort.

In contrast, the Republican Party of Florida paid only $4,855.65 for the Bondi fundraiser, cutting a check on March 25, 2014. It was a “small event on the lawn … featuring snacks and refreshments, attended by about 50 people,” a Bondi campaign staffer told The Huffington Post.
