The Latest Idea From the National Review Brain Trust: Stop Hillary by Impeaching Her Now

Here’s today’s measure of the derangement that has the conservative movement in a death grip, as National Review “intellectual” Andrew McCarthy tries to argue that Hillary Clinton should be impeached before she’s even elected.

The Constitution does not limit impeachment to incumbent officials. Article I endows the House of Representatives with the “sole Power of Impeachment” — i.e., the power to file articles of impeachment. It further empowers the Senate with “the sole Power to try all Impeachments.” Significantly, in prescribing the standard for conviction in the Senate, Article I, Section 3 states that “no Person shall be convicted without the Concurrence of two-thirds of the Members present” (emphasis added).

Note carefully: The Constitution does not say the impeached person must be a current officeholder. As we shall see, that makes perfect sense: The point of impeachment is to deny power to any person — not necessarily an incumbent official — whose high crimes and misdemeanors have demonstrated unfitness for a high public trust.

One thing conservatives are great at: coming up with hare-brained schemes to nullify the voters of the Democratic Party. With Barack Obama they tried to do it by spreading conspiracy theories that he wasn’t even a US citizen. But this new concept of impeaching the Democratic nominee before she’s even elected — well, that wins our Right Wing Derangement Prize of the Day.

That’s some rather impressive legal gymnastics, since the Constitution also says this:

The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

I’m fairly certain that a plain reading of that bit makes it clear that impeachment can only be invoked for sitting officers/judges. Especially since impeachment does not protect against criminal liability:

Report: Trump wasn’t in NYC on 9/11 as he’s claimed, but was in Florida?

The source, who did not want her name used because she feared being targeted by Trump supporters, saw his remarks and offhandedly said to her daughter-in-law: “Well, I know he didn’t see that happening from his window because he wasn’t even in New York. He was in Florida with Neal and Tolly.”

Her friends Neal Travis—founding editor of the New York Post’s Page Six—and his wife, Tolly, were at Trump’s Palm Beach getaway, Mar-a-Lago. The source says she knew this because Neal called her from Florida after the attacks and asked whether there was any information about when planes would be allowed to land in the city again. Neil said, “Here’s Donald; talk to him,” she recalled to me last week. “Then I just heard this brusque voice going, ‘Have you heard anything?’ And I’m thinking, ‘Why are you asking me?’ I told him the same thing: I saw something in the [New York] Times about easing up on plane traffic.”

The article she saw, published online on Sept. 13, 2001, announced that commercial air traffic had resumed that morning “on a case-by-case basis.” If Trump were in Florida on 9/11, Sept. 13 would have been the first day he could have returned to New York. Indeed, the first visual evidence I’ve seen of Trump in New York City post-9/11 was on Sept. 13, 2001. He gave an interview near Ground Zero to a German television station.

Crain’s looked into the source’s claim, but Neil Travis passed away in 2002 and we were unable to reach Tolly, who the source said does not remember the details of that day clearly. We compiled a list of aircraft owned by Trump or his businesses and sent the information to FlightAware. The flight-tracking company told us that none of those planes were in Florida at that time.

Matt Yglesias wrote an article suggesting that emails are more like phone conversations than letters and should be treated like we treat phone calls, and is now getting pummelled on Twitter as Orwellian.

But to me, it makes sense. So much of even my work email is comprised of brief conversations, bits of snark, etc. Sure, we also send each other data and analyses, because it’s easier to do that and present it as a piece than to try and find someone and show them a few sheets of paper, but still. You email what you’d say in a phone call, but with email, you don’t have to worry about whether the person is there and has time to talk, or whether YOU’LL have time to talk when they return your call.

We don’t feel entitled to listen to every phone conversation within a government, and the law similarly won’t give us access to them. So why are we entitled to all the emails?

Actually, there had been an earlier split: Schlafly first came to national prominence when she led a “revolt” against the civil rights plank of the GOP platform at the 1960 party convention. She reminded the delegates that the GOP had not received a majority of the “negro” vote since 1928, and they were alienating a (then) much larger southern segregationist vote by trying for it. The plank stayed but Nixon and the party did come around to Schlafly’s view in 1968. As such, Schlafly was a very early and crucial instigator of the southern strategy. Like anti-feminism, this remains a bedrock component of the Republican strategy to this day.

I’m loath to ascribe malice. I’m just curious what their LV screen is, and why this sample looks so different from the 2 previous months in party affiliation. It LOOKS LIKE their sample skewed far more Republican than previous months, and the LV screen took voters from Clinton almost exclusively, according to what I’ve read.

Another poll came out to day with Clinton +6 among RV, so there’s also that datapoint.

Overall, it would not be surprising to find the race narrowing considering just how hard the media have been working to find any signs of a pivot from Trump, and how much has been made of nothing on the Clinton Foundation side, with the NYT’s “This raises new questions” from Eric Lichtblau being especially execrable.

Even so, the woman was a historical figure, even more significant in my opinion than is commonly realized today. Her influence is everywhere. A stroll through any inner-city neighborhood will reveal the subtle effects of the southern strategy. I, personally, raised two female scientists. The failure of the ERA figured in that process, and not in a positive way.
The real nature and pervasive influence of her activism is a legitimate; indeed, very necessary; subject for discussion.

Given all she has done, the only way to avoid speaking ill of this person would be to assume a false neutrality, or to abandon my own principles.

I understand, and respect, that she was someone’s beloved grandmother (and great grandmother) but that does not give her a pass for the monstrous damage she has done to this society over the last 50 years.

She was the topic of my first political argument (that I recall) between my mother and me. Mom said that one should ALWAYS vote for the woman. I asked, ‘Even if it were Phyllis Schlafley?’ Mom said yes. I said, ‘That’s ridiculous. There are plenty of men who are more feminist than she is.’ Mom’s position was that people needed to see women in positions of power. I saw my mom in a position of stupidity. Now I can see her point, but I still disagree, and Mom has only grown more stupid, in my humble and totally disrespectful opinion.

Federal, state and local authorities are investigating the cause of Saturday’s natural gas pipeline explosion that killed five adults and five children and left two other people in critical condition in southeast New Mexico.

The victims, members of two extended families, were camping early Saturday morning near the Pecos River, about 200 to 300 yards from the below-ground explosion.

The two adult survivors were in critical condition in a Lubbock, Texas hospital.

The 30-inch pipeline exploded around 5:30 a.m. Saturday, and left a crater about 86 feet long, 46 feet wide and 20 feet deep. Police say the resulting fire probably lasted 30 to 40 minutes. It reportedly was visible about 20 miles to the north in Carlsbad, N.M.

Authorities said one end of the ruptured line became a virtual flame-thrower, showering fire on the victims camped beneath a bridge about 200 yards away.

“The evidence out there at the scene indicates it was horrendously hot,” State Police Capt. John Balderston said. “It incinerated everything in its path. If it burned for as long as we think it burned, that explains the extensive damage to the vehicles and to the property and people.

I think this happened in 2000:
August 19, 2000

(A) 30-inch diameter El Paso Natural Gas pipeline rupture and fire near Carlsbad, New Mexico killed 12 members of an extended family camping over 600 feet (180 m) from the rupture point. The force of the escaping gas created a 51-foot (16 m)-wide crater about 113 feet (34 m) along the pipe. A 49-foot (15 m) section of the pipe was ejected from the crater, in three pieces measuring approximately 3 feet (0.91 m), 20 feet (6.1 m), and 26 feet (7.9 m) in length. The largest piece of pipe was found about 287 feet (87 m) northwest of the crater. The cause of the failure was determined to be severe internal corrosion of that pipeline. On July 26, 2007, a USDOJ Consent Decree was later entered into by the pipeline owner to perform pipeline system upgrades to allow better internal pipeline inspections.

Two of the victims died later, one in Lubbock University Medical Center and the other at the Shriner’s Burn Institute in Galveston.

Two of the victims died later, one in Lubbock University Medical Center and the other at the Shriner’s Burn Institute in Galveston.

A big fricking hole had rusted through the 50-year-old pipe, rupturing it and and sending a giant jet of high pressure gas spewing over hell and gone. The pressure had to have been down for some time before the major rupture but nobody noticed. I remember this so well because a friend of mine, a doctor who also happens to be a volunteer firefighter, worked the scene. He said most of the victims were literally cremated where they stood, or lay, since some of them were asleep when the blast hit. ID was by dental records, since the heat had destroyed every trace of DNA.

I wouldn’t go so far as to claim that the adjusted figures are legit - only that the poll itself is not legit because it’s based on faulty assumptions. It’s the faulty assumptions that drove the results, and trying to rectify those results could introduce other errors/issues.

It’s an outlier. Treat it as such. And watch as all the rest of the polls continue to reinforce a 3-5 point lead for Clinton. Or more. And then the first debate will throw all that out the window.

I am finding that a simple discussion of the facts of Phyllis Schlafly’s career puts a strain on my “don’t speak ill of the dead” policy.

Even so, the woman was a historical figure, even more significant in my opinion than is commonly realized today. Her influence is everywhere. Having been immersed in TX Republican circles (of the highly educated and intelligent variety - yeah, I know, but bear with me) the past weeks, I’m seeing some very interesting dynamics. None of them can tolerate Trump and all acknowledge that the GOP has gone insane, taken over by fringe lunatics. (They also share a disgust of the likes of Cruz, Gohmert, Abbott, etc.) Not a one claims a willingness to vote for top ticket GOP. A couple are supporting Clinton outright, reluctantly of course but hey, cool. Perhaps strangely, those votes are coming from men. It seems the women who hate Clinton REALLY hate Clinton and her husband - they seem to always bring him up when they tell me why they hate Hillary. This is bad news. It’s gut-level and intensely personal.

I’m seeing a definite and increasing lean towards Johnson and a newfound affection for Libertarianism. We have actually been able to find considerable common ground in our debates. They know I’m a strong liberal but as an essential cog in the project we’re working on (if I go, the project craters), they gotta put up with me and be nice and I get to say anything I damn well please. Since I go fucking ballistic when I hear a right wing talking point/CT and they’ve learned they can’t support those against my fact-laden arguments (thanks Lizards! seriously, I could only instantly zap out the bullet point facts thanks to you guys) the discussions now center on issues rather than nebulous Hillary/Democrat hate. It’s kinda wonderful.

So TL:DR… though my sample is very small and doesn’t include knuckle-draggers, I think Hillary does have a real shot at taking Texas. It won’t be due to Republican votes for Clinton, but votes for Johnson if they vote top ticket at all.

He’ll come out wearing a wire and be fed answers from backstage. I doubt if there’s even a rule against it, because nobody could ever have imagined such a thing. Nobody will call him on it, but I bet his delivery will be so wooden it’ll be obvious when he’s just parroting. Not to mention when he repeats the answers wrong.

I have no doubt that Trump will have a receiver in his ear during the debates, assuming he shows. That’s why he doesn’t feel like he needs to prepare.
