BREAKING: Federal Judge Issues Stay Against Trump’s Executive Order Banning Muslims From Entering the US

Finally, some good news to report. A federal judge in Brooklyn, New York, has issued a nationwide stay against Donald Trump’s disgusting un-American executive order banning Muslims from entering the US, even if they have green cards.

Need I mention that we can now expect a glorious 3 am Twitter freak out from the orange fascist? He’s been in office for one week, and his far right edicts are already getting shut down by the judicial system.

A “stay” is only temporary, of course, but I wouldn’t be the least bit surprised to see this go all the way to being declared unconstitutional and revoked permanently. It’s wrong.

It depends. If it is upheld in appeal, and then deadlocks, it is upheld. If the appellate court turns it down, then that holds on deadlock. I do not see SCOTUS taking it direct from Brooklyn so there will be at least one appellate level first.

I agree. And I think even the conservative justices on the Supreme Court will have to agree. Scalia was the worst one, and he’s gone. If Trump gets to appoint justices, though, we’re in big big trouble. The current court is still pretty much traditionally supportive of the constitution. Any justices Trump appoints are going to be far right crackpots who’ll do what he tells them.

Not exactly clear. As long as they retain their otherwise valid visas and can get on a flight before the temp order expires they should be fine. It’s the getting on a flight at this point that might be tricky since the stay specifically enjoins further “removal” actions from the United States. A stickler might read that as saying you need to actually make it here before it applies.

My uncertainty revolves around the focus on the term “removal.” Does denying someone at a foreign airport a seat on a flight constitute removal, and for that matter do US Constitutional Rights even apply to aliens refugees with US issued documents in foreign airports. This is why I think the current ruling may only really apply or even be enforceable with regards to those who’ve somehow made it to US soil.

Reading the judge’s order, it applies to anyone with a green card, a valid visa,and/or anyone from the seven countries Trump specifically mentions in the EO. So, I reckon it means all those stranded at airports, in the air now, and awaiting embarkation elsewhere in the world, and perhaps people in the process of traveling to the USA, but without tickets yet.

Yes, they should, just as the military does.

There is a caveat: if official guidance does not cover the situation at hand, the supervisor (commander in the military) is free to improvise to complete their mission.

Without guidance, passport control/immigration has never faced the situation of thousands being banned mid-route. Since they are still charged with border control, they must improvise if not given guidance. They really have no other choice.

The Federal court ruling now gives them guidance that the Aryan House did not.

It is similar to E-mail scam: It costs virtually nothing to run a program to hack accounts. Once the account is hacked, the tweet is also negligible in cost.

Bannon’s role as Rasputin seems to be solidifying. I don’t think that’s a stretch anymore. He’s pushing the nation headlong into conflict, and he’s using diktat to make it happen and to solidify power in and around him.

Reading about the the custom’s officials not knowing what to do and not getting any guidance from Washington, it’s made me thing about two things: what the custom’s agents need to do, and what the green card people will need.

With the stay, the customs agents could choose not to enforce, but it would be haphazard without orders from higher up. They still have a customs job to perform, and now they have a gaping hole in enforcement.

As for the green card people, if they are let go, they are going to need a safe place and lots of legal representation. Preferably some people who are as aggressive about going after the administration as they are about protecting the people. This is one of those times where the best defense is a good offense.

As was noted the other day, one of the groups that Hitler purposefully ignored, marginalized, and outright overrode were the generals because many of them had come from the aristocracy who he blamed for Germany’s defeat in WWI. Well, apparently every one in my village except eight voters for Clinton, three for Johnson, and two for Stein. His surrogate came to campaign in this remote place. No other candidate bothered with us.

I wouldn’t recommend using my village as a statistical sample for the nation (which why no polling organisations ever call here). Clinton won by three million votes.

The only reason we lost is because the Democrats competed for votes, and the Republicans competed for electoral votes. The Republican strategy of a fifty-state scheme worked.

Funny how that used to be our scheme, until the party abandoned the Great Plains. So sorry for us; all those Plains states electoral votes add up. Too bad they were ceded without a fight.

I have had this argument before here and been shouted down. The complaints amount to either a) we don’t need the bigot vote or b) pick yourself up by your own bootstraps or c) we need to target the right states/districts/cities because money/can’t compete anyway/don’t want to put forth the effort/name your excuse.

You have a lifelong Democrat here telling you there is a reason Sanders won this state (and I supported him before I went to Clinton). That reason is he (or his surrogates) campaigned for every vote. Clinton campaigned once in Omaha and we never saw her or her surrogates again. Funny why she lost this state and so many independent voters decided the Democrats didn’t care about our five electoral votes.

I am not saying we should have run Sanders. Clinton won. We should have run an election for all fifty states, for the hundreds of millions of people Democrats have deemed are too much trouble, too isolated, too whatever to bother with.

We had a Trump surrogate stumping in Scottsbluff (population 14,000). The GOP may have heartless policies, but they care enough to talk to the damn voters.

While the Dems make fun of the GOP reps “running” from town halls, at least they show up. A voter will always take the illusion of “I want you to believe I care about you” over “I never heard of your candidate because you don’t care about us enough

And the Dems even managed to lose NE2, which was a district Obama won and we had a Dem house member. (NE2 is Omaha. Nice job.)

The electoral college math is inescapable: There are not enough electoral votes in the liberal-concentrated states to win an election. The Democrats must compete in all states (the “we don’t have enough money” argument or the “we need to compete where we are competitive” arguments are why we are losing.

Does the Democratic Party want to represent the whole country or just part of it.

Say whatever else ill you will about the GOP: They want to win all the states. So they won. (See my entire blank ballot I turned in except for President. Like the lotto, you can’t win if you don’t play. I don’t care how many people here will argue against me like they have in the past, that is the math. Math is supposed to have a liberal bias.)

Start counting ceded votes and tell me how many of these millions of people you don’t want to represent: AK, ID, MT, ND, SD, WY, NE, KS, OK, TX, WI, MI, KY, TN, AL, MS, LA, AR, FL, GA, SC, NC, NH, ME.

Ceding those states without a fight means the Democrats are not a national party, and I don’t care how much you try to convince yourself otherwise.

Don’t look away. Don’t move the goalpost with “it costs too much” or “it’s too hard.” The GOP competes in every state and every seat they can, even seemingly hopeless seats cause you never know. You might pull out a victory in a low-turnout election.

That is why the Dems have lost so many elections even though the they won the popular vote. Since the Electoral College will be repealed next Sunday after never, either we compete for electoral votes (the only ones that matter) ore we continue to fade.

I have put it here before: Who’ll run for school board here? City Council? Cemetery or Library Board? All I ever get: I’m too busy. I don’t think I’d do well. I think phone banking for an hour and a half is just as good as being on my town board.

In other words, you are not willing to do whatever it takes to stop the American Fascist Party because (insert reason here). I swear, Democrats are special snowflakes at least when it comes to excuses to get out of public duty. I’ve seen better excuses used to avoid jury duty.

Don’t move the goalpost. “I can’t, I don’t have time, I yadayadayada” everything but coming up with a damn candidate or running yourself. If you can’t come up with time, then you really don’t care about your town/county/state.

I don’t get paid a penny for my seat. I do it because I care about my town.

I won a seat in my city council in what Nate Silver rates as the reddest state in the nation, with no party help. The GOP ran ads for village trustee candidate on the radio and newspapers for a town of 124 people. I knocked on doors. I was reëlected beating a gun shop owner in an open-carry state.

We now have two liberals on our board.

Do not whigne to me about why we lost the election. We lost because millions and millions of people just like me had a ballot with only one Democratic ticket on it, Hillary Clinton and Tim Kaine.

I’ll bet if you live in a blue state nearly every seat is competitive, with a D and an R and maybe a Lib.

We can’t get state party help in red states. The Dems don’t care if I lose my seat in 2018. Democratic state parties do not coordinate with county parties. The national party doesn’t care if Great Plains states drop off the map.

Refer again to all those state abbreviations up there. That is why we lost. Not Wisconsin and Michigan and Pennsylvania. We lost because the party does not care about the middle: It does not compete nor run candidates.

Don’t move the goalposts and claim “we don’t want to pander to bigots or racists.” That is a red herring. Millions of people in the Great Plains are not racists or bigots.

The Democratic Party does not want to do the work. That is why we lost.

We don’t want you to run our state and county parties. We want a leg up, so in the future maybe we can give you a leg up.

If instead the Party’s response is “we don’t need you and we won’t help you,” then I refer you to that list of people the Democratic Party officially Doesn’t Give a Diddly Damn to Represent.

The Democratic Socialists in ninety thousand square miles of Nebraska Panhandle are better organised than the Democratic Party; they want me to come and speak since I managed to get elected and reëlected here by myself with no help from anyone, competing against GOP paid adverts on radio and in newspapers.

I am tired of the navel-gazing here with endless litigation as to why we lost. We lost because we did not carry a message of hope and progress with the most qualified candidate of the age. We lost because we competed for votes, not electoral votes.

Trump or his surrogates appeared in every state multiple times. Clinton and her surrogates: Well, they managed a few swingy districts.

I am not blaming this on Hillary Clinton. I am blaming this on an ossified party that is more resistant to change than the GOP.

I have been fobbed off here with statements that amount to “what do you want, a participation trophy?” No damn it, I want a party that competes. It doesn’t have to support me in particular (though I am literally the only elected official from the Dems in one third of an entire state).

The Dems don’t care. That is the message in the middle of the country. If the Dems cared, they would run candidates. They would come talk to us.

The GOP sent a representative to speak at our village Memorial Day service last year in a town of 124.

Rant off. Be a fifty state party, or be no party. If I get no support in 2018 I will not file for reëlection. Why bother? NE seats don’t matter.

Hard to argue with that. So many of the problems that plagued us and ultimately led to our defeat in 2016 - voter suppression, gerrymandering, draconian anti-abortion and anti-LGBT laws, etc. - came about as a result of Dems not running candidates at every level of government. A tree can’t stand if it’s too top-heavy and has a weak trunk.

That said, though, this election was abnormal in many senses. Interference from within and without can’t be discounted.

IIRC, the US Marshals Service is responsible for enforcing federal court orders; someone needs to get them on the horn pronto. If CBP refuses to comply, have the US Marshals place them under arrest for contempt of court.

One of my immigration lawyer friends says that Customs and Border Patrol are refusing to obey orders from two federal judges. One of them is Virginia federal judge Leonie Brinkema. Based on past experience, Judge Brinkema is not going to be happy with the disobedience, if it keeps up.

I’ve posted this before, and I’ll post it again. They saw how 9/11 boosted Dubya’s popularity and forced a “rally around the flag” rush into the Iraq War, so they’ll seek out a similar event to serve as pretext for going full fascist:

Operation Northwoods, counter-intuitively, actually disproves 9/11 trutherism for one simple reason: if it were a false flag, Iraq would have been framed from the get-go. But since trump and co. pal around with truthers and are prone to projection/DARVO, well…
