White House counsel Don McGahn is preparing an all-out attack on federal agencies

Yes, it can still get worse, folks. Today we have news from TIME’s Zeke Miller that the Trump Horror is assembling a high-powered legal team that will launch an all-out attack on the regulatory powers of federal agencies.

One White House aide described the group of lawyers hired by McGahn as a conservative answer to “Nader’s Raiders,” a small group of liberal activists organized by Ralph Nader in the 1960s and 1970s, who successfully fought for greater federal regulation of consumer goods like automobiles and food.

McGahn said he had specifically chosen his staff because of their expertise in working inside federal law. “They understand the regulatory agencies, several are appellate lawyers who have spent their careers fighting regulatory and government overreach, or worked on Capitol Hill conducting oversight,” McGahn said in an interview with TIME. “A number of people in the office actually have sued the government over regulatory over reach, and have won.”

The group, which reports to McGahn, includes Greg Katsas, a deputy White House counsel, who ran the Department of Justice’s Civil Division during the Bush administration and challenged the Affordable Care Act at the Supreme Court while in private practice. Stacy Cline Amin, an associate counsel, was the Chief Counsel to the U.S. Senate Committee on Health, Education, Labor and Pensions. Associate Counsel John Bash has argued 10 cases before the Supreme Court, clerked for Justice Antonin Scalia and D.C. Circuit Judge Brett Kavanaugh, a hero of conservatives in the fight against the regulatory system.

Stephen Bannon was recently quoted saying his goal was to “deconstruct” the federal government, and that effort is now well under way. They’re laying the groundwork for a complete takeover of the US by rapacious corporations unconcerned with climate change, the environment, or workers’ rights — just to name three important areas that are on the chopping block.

The same idiots who think a 66 page bill can easily handle national health care reform also think that there’s too much regulation.

It’s much more than page size and goes to content of the legislation, and what agencies must do in order to administer the law as written by Congress.

Take the IRS for instance. Look at 501(c). Deals with nonprofit entities, but how do you figure out what it means and how to make sure that only entities entitled to benefit from that status are approved? There’s regulations for that.

Across the federal government, agencies are given latitude to administer the law as written, and those regulations go to how an agency works, policies, procedures, audits, etc., including how persons (taxpayers, etc.) can get satisfaction - like say when an audit occurs or the Interior Dept fines someone for trespass or failing to pay grazing rights, etc.

On the bright side, I think the CBO report was the final nail in the coffin of Trumpcare. Even if they can get it passed in the House over Freedom Caucus opposition, there are too many Senators who don’t want to face voters in 2018 or 2020 after taking away insurance from tens of millions of them, or who think Trumpcare is “Obamacare lite” like Paul and Cruz.

The CBO reported that the individual market is stable, because the subsidies and the mandate keep enough young healthy people in the market to prevent death spirals. I had $50-dollar-a-month policy with a $5,000 deductible that was basically just bankruptcy insurance in case I got hit by a truck or something…but that was back when I was young and strapping and had not even seen the inside of a doctor’s office for years…

Twenty years of propaganda (FOX News, Right Wing and Christian hate radio) plus every GOP politician since Reagan saying you can’t trust the government will have an effect - propaganda is a helluva drug, especially when you repeat it over a whole generation.

Nixon wanted a GOP TV, but the laws and regulations at the time didn’t allow it. So, the GOP worked to overturn those laws and regulations and convince people the government itself was untrustworthy. They hit the jackpot with Reagan.

And when the content of the policies is mandated (at least in part) by statute, the fact that there is only one option is even less meaningful.

But none of this matters when you have a GOP that choice, in and of itself, is a virtue. Having two shitty options is a better outcome than having one good option.

To add: Ryan’s argument is almost like saying there’s only 1 utility company per county. Oh noes!

Finally, the slimy “Obamacare is collapsing” line aggravates me when the story is that the areas that have issues are those where the GOP deliberately sabotaged ACA’s efficacy. Just a continuation of the age old GOP play book:

1. Gov’t is the problem.
2. Enact bills/regs to prevent effective governing.
3. See, gov’t is the problem.

The ACA allows insurance to be sold across state lines if the policies are comparable to those offered in state. So, someone in NJ could conceivably could put together an insurance plan for NY that NY could approve if they’re comparable.

Problem is, no one wants it. Not the insurers, who’d have to create a network in-state, which is costly, and therefore isn’t worth the effort. And if there’s no in-network in state, then the costs are that much higher because out of network always is.

It’s a scam the GOP is pulling, same way they think HSAs will be the silver bullet here.

The ACA allows insurance to be sold across state lines if the policies are comparable to those offered in state. So, someone in NJ could conceivably could put together an insurance plan for NY that NY could approve if they’re comparable.

Problem is, no one wants it. Not the insurers, who’d have to create a network in-state, which is costly, and therefore isn’t worth the effort. And if there’s no in-network in state, then the costs are that much higher because out of network always is.

It’s a scam the GOP is pulling, same way they think HSAs will be the silver bullet here.

HSAs are just another tax dodge for the very wealthy who already have millions socked away, because if middle class (we won’t even count people living paycheck to paycheck) had more money to save they would choose a higher-yielding option than HSA.

I wonder if some people who want health insurance sold across state lines are thinking in terms of policies where if you get cancer, the insurer sends you X amount of money and then you get to go bargain with your local cancer center to try and get treatment for that amount? Because everyone with cancer has lots of time and choices for their care.

Finally, the slimy “Obamacare is collapsing” line aggravates me when the story is that the areas that have issues are those where the GOP deliberately sabotaged ACA’s efficacy. Just a continuation of the age old GOP play book:

1. Gov’t is the problem.
2. Enact bills/regs to prevent effective governing.
3. See, gov’t is the problem.

Rinse, repeat.

And no one ever brings up the fact that so many states messed up the ACA from the get-go. If all 50 states would have gotten involved in setting up exchanges and spent some time explaining the advantages of the program and how it all works and why we wouldn’t be where we are.

The GOP wanted it dead from the get-go. How many times did they try to kill it. Last number I remember was around 70 attempts or so.

The most realistic way to interpret Sean’s remark about how it becomes much harder to repeal Obamacare without this bill is that reality is not cooperating with their talking points, that the ACA isn’t in a “death spiral” and is popular enough that people want to see it reformed rather than repealed. So they need this poison pill to advance their cause, else they’re stuck where they’ve been the past 8 years: Trying to come up with an “alternative” when their best ideas have already been taken.

Not much use if your state has only one provider (usually 100+ miles away) because state government managed to shut down all of the rest via bogus health safety regs that have nothing to do with either health or safety, and they make you have an ultrasound and wait 24-48 hours before having the procedure.

Or voter suppression efforts where they shut down DMVs so you have to travel 100+ miles to get a state-approved photo ID. (And hope you have all of the required documentation, which you probably won’t.)

I couldn’t figure out why it wasn’t showing on my phone but it said “Playing to Samsung 50” on the Youtube app window, and I looked up and the golf game on the main TV was now live kittens. The bartender had to turn the TV off and back on again to clear it.

I’m tempted to abuse this power, except they know who did it, so I couldn’t get away with it again. And I have no idea how it happened; I was on the bar’s Wifi but I didn’t select their TV on purpose.

Edit: Point being, somebody in the ops center might be on break in the next room, wondering why a cat video isn’t loading on their phone…

Yeah I had BDS for Bush’s first term for sure. The thing that disturbed me was BDS leading people on the left to embrace people like Chavez and Lukashenko. Lou Dobbs and others on the Right who are railing against the GOP healthcare bill need to Shut Up. They’re the reason RW members of Congress started that “repeal and replace” mess in the first place. Instead of informing RW Americans about what was actually in the PPACA, Dobbs and his buddies decided that because Dems passed the bill and a Dem president signed it into law, it was not legitimate from the start. They riled up the nuts, promised them rainbows , lollipops, and a pony, and now that they can’t deliver on what they promised, they’ve become head-hunters. Let them eat each other alive. I’m going to get immense pleasure from seeing them turn on each other. They’re reaping the consequences of their relentless campaign of lying, propaganda and conspiracy theory peddling, and BSing. They were so sure that if they had control of Congress and the WH, it would be smooth sailing all the way. It’s not looking like that for them since Ryan unloaded a huge pile of healthcare BS on the nation and is calling it terrific. If Dobbs doesn’t know Ryan has always been a media creation, he’s pitiful. If he ever possessed any enduring principles and/or values, he sold them to the GOP a long, long time ago.
