Federal Judge Shuts Down Trump’s Latest Travel Ban Nationwide

Again
Politics • Views: 36,364

Hawaii Attorney General Doug Chin

Donald Trump’s second attempt to impose an un-American Muslim ban on the United States has been blocked by a federal judge in Hawaii.

Yes.

A federal judge in Hawaii issued a nationwide order Wednesday evening blocking President Trump’s ban on travel from parts of the Muslim world, dealing a political blow to the White House and signaling that proponents of the ban face a long and risky legal battle ahead.

The ruling was the second frustrating defeat for Mr. Trump’s travel ban, after a federal court in Seattle halted an earlier version of the executive order last month. Mr. Trump responded to that setback with fury, lashing out at the judiciary before ultimately abandoning the order.

Judge Derrick K. Watson had a few choice words for Trump’s lawyers, who tried to argue this isn’t a “Muslim ban” even though Trump himself and his cronies have explicitly said it is, on numerous occasions.

Administration lawyers argued in multiple courts on Wednesday that the president was merely exercising his national security powers and that no element of the executive order, as written, could be construed as a religious test for travelers.

But in the lawsuit brought by Hawaii’s attorney general, Doug Chin, Judge Derrick K. Watson appeared skeptical of the government’s claim that past comments by Mr. Trump and his allies had no bearing on the case.

Are you saying we close our eyes to the sequence of statements before this?” Judge Watson, who was appointed by former President Barack Obama, asked in a hearing Wednesday before he ruled against the administration.

Meanwhile, Pumpkin Pinochet is upset. I don’t know why; he should be starting to get used to having his ugly executive orders blocked.

In a nutshell, why I love Truman.
H.R. 5678 was named after its sponsors, Senator Pat McCarran (D-Nevada), and Congressman Francis Walter (D-Pennsylvania).

President Harry Truman, a Democrat, vetoed the Act because he regarded the bill as “un-American” and discriminatory. His veto message said:[1][2][3]

Today, we are “protecting” ourselves as we were in 1924, against being flooded by immigrants from Eastern Europe. This is fantastic. … We do not need to be protected against immigrants from these countries-on the contrary we want to stretch out a helping hand, to save those who have managed to flee into Western Europe, to succor those who are brave enough to escape from barbarism, to welcome and restore them against the day when their countries will, as we hope, be free again….These are only a few examples of the absurdity, the cruelty of carrying over into this year of 1952 the isolationist limitations of our 1924 law.

In no other realm of our national life are we so hampered and stultified by the dead hand of the past, as we are in this field of immigration.

That rally is Exhibit A for the next time Trump attempts a Muslim travel ban, because he says explicitly it’s an attempt to be a Muslim ban.

Intent, purpose. Unconstitutional as applied.

Yeah, he’s not very good at this.

Every AG that wants to sue the Admin over a travel ban need only refer to this (or Miller or Giuiliani) when claiming that this is anything other than a Muslim ban.

I volunteer at the local humane society. A year or two ago there was a cat and a chihuahua brought in together. Since they were abandoned, they had to be separated for medical reasons after intake. When they could finally see each other again, they were crying. They stayed together in their adoption pod, and went to their true forever home together.

It’s actually to our nation’s credit that we have done a better job assimilating Muslims than say France for example because for the longest time, we didn’t make Muslim immigrants out ot be pariahs. I’ve had Muslim friends, teammates, classmates, co-workers, medical professionals, patronized their businesses, etc.

Further undermining their case:

1) Iraq was in original EO, not the second one.
2) Original EO was implemented immediately because of imminent threat, 2d had a delay to allow orderly implementation (undermining intent of original).
3) If purpose was to stop terrorists as they claim, where’s Egypt, Saudi Arabia, Afghanistan, and Pakistan on the list since those four countries not only included 9/11 terrorists (and 1993 WTC bombing) plotters, but gave sanctuary to at different times (Afghanistan/Pakistan).
4) DHS report found that nation of origin is poor indicator of terrorism risk.
5) Refugees are vetted to greater degree than anyone entering on a regular visa, even from a place like Syria.
6) Risk from a refugee engaging in terrorism is still lower than other ordinary risks, including being the victim of a garden variety mass shooting (3+ shot) in the US, which occurs essentially daily.

The people who are most vocal in demanding a Muslim ban are also those least likely to ever have encountered a Muslim, or visited anywhere outside their states, let alone a foreign nation.

Yeah, that’s been my observation too. Remember when Oklahoma tried a Shariah ban and we pretty much uncovered that nearly all Oklahoma’s Muslims were university students at OU. I’ve known Muslims my entire life pretty much. I’ve known Muslims from Iran, I’ve known Muslims from Arab nations, and Muslims from Afghanistan and Pakistan too.

2. First Price claims not to have even heard about this CEO tax break. Says he’ll have to look into it

3. Dana Bash isn’t having it, says she has the language of the bill right in front of her. Suddenly Price remembers!

4. Price launches into a passionate defense of CEO tax break, saying it would be UNAMERICAN to do anything else

Speaking of healthcare (as we sort of were) one reason we don’t have enough doctors, especially primary care physicians is a shortage of residencies. Most are funded by the government and the sequester has prevented the expansion of openings, even though there are more spaces now available in med schools. So, if you get out of med school and don’t get a space, you have a really big debt, and you can’t practice medicine. Oh, and we won’t have a doctor to fill a need in some community somewhere.
What a great way to save money!

On a related note, Trump has inspired new graffiti in my area. I am literally seeing spray painted stencils on the sidewalks that say ANTI-FASCIST AREA and ANTIFA. And I’ve seen signs up on the telephone poles around here warning about some Neo-Nazi douchebag handing out propaganda.

I’ve been in Austin for almost 20 years and have never seen this until just recently. Wow.

It hits home in odd ways. My brother, a year younger than me, which is old, has never seemed political at all. Never, as far as I know, even registered to vote. Some of his opinions are conservative, some liberal, some in between. As we speak, he’s in Mexico, which he’s never visited, with his wife, looking to buy a home in a town near Guadalajara that has a modest population of American ex-pats. That’s how strongly he feels about Trump and the dangerous idiocy that surrounds the man.
