Judge Rules That Lawsuit Against Trump for Inciting Violence in Louisville Can Proceed

In addition to all the other bad craziness surrounding everything Donald Trump does, we’re about to be treated to the spectacle of a sitting US president being sued by several black protesters for inciting violence against them last March at his rally in Louisville, Kentucky.

A federal judge has rejected President Donald Trump’s free speech defense in a lawsuit in which he is accused of inciting violence against protesters during his campaign.

Trump’s lawyers contend that when the candidate said “Get ’em out of here”, he didn’t intend for his supporters to use force.

Two women and a man say they were shoved and punched by audience members as Trump directed them from the podium. Much of the scuffle was captured on video and widely broadcast during the presidential campaign.

Judge David J Hale in Louisville ruled on Friday that the suit against Trump, his campaign and three of his supporters can proceed. Hale found that there were ample facts supporting the allegation that the protesters’ injuries were a “direct and proximate result” of Trump’s actions.

“It is plausible that Trump’s direction to ‘get ’em out of here’ advocated the use of force,” Hale wrote.

One of the Trump supporters named in the suit is infamous neo-Nazi Matthew Heimbach, who for some reason was evidently attracted to Donald Trump’s messages of hatred and bigotry.

An early projection by independent pollsters indicates that Prime Minister Aleksandar Vucic has won Serbia’s presidential election in the first round.

The Ipsos Strategic Marketing agency projected that Vucic received more than 55 percent of the votes cast during Sunday’s election.

The polling agency has a representative sample of votes from different polling stations and issued its projection with nearly half of the vote sample tallied.

If confirmed during an official count Monday, the result would mean Vucic has won the presidency outright and there will be no runoff election.

A strong showing would boost his already powerful position as Serbia’s undisputed leader.

So Trump ran afoul of the Brandenburg test, finally? Good.

(Short version for those un-knowing, Brandenburg vs Ohio, 1969. It is the test for when speech implying advocacy of violence crosses the line from free to prosecutable. Quoting from the Legal Information Institute:

The standard developed determined that speech advocating the use of force or crime could only be proscribed where two conditions were satisfied: (1) the advocacy is “directed to inciting or producing imminent lawless action,” and (2) the advocacy is also “likely to incite or produce such action.”

You can burn a flag and split a bible and yell that ‘we oughta march on Washington and hang all the [party] Senators’ you want, and you can’t be prosecuted. That last is definitely directing imminent lawless action, but it’s not LIKELY to do so, and that’s the buffer in place.

Trump, because it had happened before, had reason to believe it would happen again. Meet Brandenburg.

It cost me something like seven grand total to move, and that’s about average from what I understand… I just now got enough money to pay off the transfer tax for importing my car from out of state, and I had to cash out my old HSA to do it.

It’s been my experience and observation that the financial ass-kicking just doesn’t stop for anybody on their own making less than 50K a year, and that’s if they’re healthy and don’t have any debt.

The author of this infographic covered all three. For rent, you’re supposed to up and move to a city with low rental fees (i.e. urban hellhole), get the slumlord to include utilities in the rental fee, and also look into getting a roommate or three to split costs.

Health insurance? Get a plan with a high deductible. Not included in that advice? Pray to God you never get so sick that you have to actually utilize that plan.

And telecom? Get an antenna to watch local stations, get a Netflix subscription, and…well shit, I guess they expect you to use smoke signals for communication, because they didn’t include a cellphone in their calculations.

Oh, and for your commute? Try to find a place that’s within biking distance of your job so you can ditch your car…then just give up on ever traveling away from your apartment for 10 years, because their calculations didn’t include spending for vacations.

I did not read the article because I have been through advice like that before. Therefore I can only say that I talked to my accountant and he helped me save a little money while I was in bankruptcy. Business Insider is only repeating general advice that most people cannot follow. For any true solution you must talk to a professional who understands your particular situation.

Oh, and that great “high deductible” insurance plan $ doesn’t mention anything about funding the HSA to cover the deductible, so I guess it’s a “don’t get sick” policy.

That’s ~$2.50 a day. Hell, when I was in the Army, and they paid me Basic Allowance for Sustenance (BAS) they allocated me around $5 a day. And, that would not cover the costs if I decided to buy my three meals a day in the Mess Hall.

I would say, that a single person needs to realistically budget in at least $10 a day for sustenance. That per-person cost should go down a little if you have multiple people in the household.

The author of this infographic covered all three. For rent, you’re supposed to up and move to a city with low rental fees (i.e. urban hellhole), get the slumlord to include utilities in the rental fee, and also look into getting a roommate or three to split costs.

Health insurance? Get a plan with a high deductible. Not included in that advice? Pray to God you never get so sick that you have to actually utilize that plan.

And telecom? Get an antenna to watch local stations, get a Netflix subscription, and…well shit, I guess they expect you to use smoke signals for communication, because they didn’t include a cellphone in their calculations.

Oh, and for your commute? Try to find a place that’s within biking distance of your job so you can ditch your car…then just give up on ever traveling away from your apartment for 10 years, because their calculations didn’t include spending for vacations.

The response? “It’s better than it would be with Clinton!”

My response: Really? In what way? I’m pretty sure a Clinton White House could have found the blue bulbs, too. That, and she wouldn’t have sacrificed autistic kids’ services to give a giant tax cut to the top 1%, or cut money for autism research to build a stupid wall when illegal immigration is declining.

Today’s ride - well, today’s DEMI-ride - led to me learning a new term: Heat Syncope

This is a condition, less severe than heat exhaustion, wherein if you’re not acclimated to heat and you exercise, your body shunts all your blood to your skin, and the rest of you - like your brain - doesn’t get enough. You get lightheaded, sweaty, elevated pulse, maybe nausea. Stop exercising and cool off and it fades within minutes.

So, that happened.

I’d just done the climb from Crystal Springs in Hillsborough up Polehemus to the Ralston Trail (according to Strava, a Cat 4 climb!). No problems on the climb. No problem on the following descent. Got to Cañada Rd., felt…okay. Rode 1/2 mile, stopped. Felt woozy. Called Mrs. FBW, told her to meet me 4 miles down the roadl.

Felt worse. Sat down leaning against the guardrail. Considered whether this was what dying feels like.

1 minute later, wondered why the hell I’d been wondering THAT.

2 minutes later, felt 90% of normal.

2 more minutes later, felt fine getting back on the bike, and riding to the pickup point.

Ride to pickup point was completely fine. Mrs. FBW, OTOH, was PANICKED!!, even though I’d been real casual when I called - “Hi hon. I’m just not feeling it today. Can you come and pick me up?”

Got home, looked up heat-related problems. I kept seeing heat exhaustion and heat stroke, but both those are MUCH worse than what I had. Finally found ‘Heat Syncope’.

I’ve had it twice before. Once, when it was a HOT day, after a summer of not riding much, so no heat acclimatization. The other time, like today, on the first warm - not hot - spring day one year. I decided to do a local climb. Halfway up, it hit me. I sat down, sweated like mad for a few minutes, felt better and rode back down.

Next week, same temp. Same climb. Passed the place where I’d bailed 1 minute ahead of the previous week’s time.

In the meantime, yesterday was 60 degrees F here. I would have had the ‘79 out of the garage, if fishfolk weren’t here. OH, on that topic. Thankfully, it was a quiet visit on the political front. My parents did not make much noise about political topics, thankfully. They were happy to just celebrate elder fishspawn’s impending birthday and play outside in the sun while we had it.

I had my scooter (not a motorcycle) out for the first time of the season. Last year was such a crappy year for riding that I only added a couple hundred miles. I want to make up for that this year.

Indeed. Mrs. FBW’s flat two weeks back cost $133 to replace (torn sidewall, no repairing it!).

Lucky it was just one. I destroyed a tire on my old Subaru Outback, with ~30,000 miles on the set. Had to replace the set, because on an all-wheel drive car the tires can’t be too different in diameter.

I, in the meantime, am aiming to try and get a full season’s worth of driving on the ‘79 without having any major mechanical issues. We had snow yesterday. Twice. I went jogging today, without my heart rate monitor. Felt naked, covered from head to toe.

I’ve had some weird issues with my HRM, like I think the jacket I bought recently blocks the signal. After fiddling with it for 5 minutes while trying not to wander into the traffic lanes, I gave up and just switched it to clock mode, because I was pretty sure that my HR going up a climb was NOT 78.

Reminds me of the time I was headed out for a ride and noticed my cell phone was discharged. “Oh, no! Now I can’t ride!”, I thought.

Then I remembered that before I had a cell phone, I rode anyway. So I rode anyway.

Garland didn’t get a hearing OR a vote, because he was mainstream and would have been confirmed. Gorsuch just got a hearing, and may get a vote, even though he’s an extremist.

But more than that, there’s no excuse for what the Republicans did. No historic precedent, no custom. They did it because they could. And to simply let them go forward like that never happened? No. Fucking. Way.

Roger Ver relinquished his US citizenship, to avoid paying income taxes on his billions. Moved offshore. No one misses him.

When he applied for a US visa to attend some tech conference, it was denied. LOL

The flaw in Rand’s premise is assuming no one from the Moochers and Takers would rise up to replace the absent John Galt types. She somehow believed that M&Ts are predestined to be M&Ts, and so they would never rise above their station. Real world societies do not act like that at all. Once there is a power vacuum, someone steps in to fill it. If a John Galt took all his basketballs and moved to some remote aerie to avoid the M&Ts, at least one of them would open a basketball-making factory and life for everyone else would go on.

See also, Europe after the Black Death. Losing so many people in the top levels of society enabled social mobility in the lower levels.
