Trump Says He Can’t Be Sued for Inciting Violence at Rallies Because He’s the President

Donald Trump is being sued by several protesters who were assaulted by his followers at a rally last year in Louisville, Kentucky, after he screamed “Get ‘em outta here!” from the stage. And one of those supporters has now filed his own suit against Trump, saying he shouldn’t be held liable for the assault because he was acting at Trump’s urging.

But Trump’s lawyers are trying to claim he can’t be sued for inciting violence at all — because he’s the president. And they’re also trying to claim he never incited violence at all. Even though he’s on tape doing it.

Donald Trump’s lawyers in a Friday afternoon federal court filing argued that he cannot be sued for inciting his supporters to hurt protesters because, as the president, he is immune from civil lawsuits.

The lawsuit was brought by three protesters who allege they were roughed up and ejected by Trump supporters from a March 2016 campaign rally in Louisville, Kentucky, after Trump barked from the stage “get ‘em out of here!”

The lawsuit seeks damages from two Trump supporters who confronted the protesters, as well as Trump’s presidential campaign and the president himself, since the protesters argue the Trump supporters were acting at his direction.

In Friday’s filing, the president’s lawyers contend that Trump was not ordering his supporters to rough up the protesters — or to do anything. “The Trump Defendants deny that Mr. Trump directed his statement to the crowd,” the lawyers wrote.

Anyone can release their own returns, even when they’re under audit.

Unfortunately the Clinton ruling isn’t exactly as on point as people think, because Clinton was sued in Federal Court and the current action against Trump was filed in NY State Court. That might not seem like a big difference but the 1996 SCOTUS ruling specifically left open this question. Imani Gandi & Jessica Mason covered this awhile ago over at Rewire.

“Get out of State Civil Court” anyway. The thing is there’s a certain logic to it, the idea that a sitting President shouldn’t be subject to constant personal civil badgering in the civil courts of State he/she lost in the general election.

It’s not a particularly good or compelling logic, just saying I can see that argument being made by Trump’s lawyers and accepted by Thomas and Alito at the least.

The Zerfos lawsuit in question was filed in New York, so that will be the jurisdiction whose impartiality comes under attack.

Like I said it’s not particularly compelling logic, but I’m not sure what other differences his team can cite in response to why the 1996 decision shouldn’t be heavily weighted against them.

She is seeking sole custody of their 14-year-old son and 9- and 12-year-old daughters.

I could not agree more. I recently de-activated and then deleted my account. Being in constant contact with relatives on FB was changing the way I feel about people I *want* to love. I need to catch up with my relatives at weddings and on holidays, not on a daily basis.

Felix Randomkitty update:

Felix is in the kitty hospital.

He is on an IV for rehydration … the veterinarian noted that it was a worthwhile attempt to try to force the cat to take water via a syringe, but a diabetic cat passes water a lot, and there is really no way to keep up with that.

Felix’s sugar count today was 625 (the normal range for a cat is the same as a human - 80-120). She noted that human glucose meters can sometimes screw up measuring the blood sugar of a dog and cat.

The veterinarian could find no injury or other overt physical problem, though Felix is down to eight pounds. (A couple weeks ago he was around fourteen and putting on weight.)

She also noted that his white blood cell count was very high … her preliminary diagnosis is feline pancreatitis, hence the kitty hospital stay. (I’m guessing he doesn’t get an adjustable bed and TV remote.)

Its kind of a moot point though because I genuinely think it’s psychologically almost impossible for a person to “method act” for so long without genuinely changing who they are and what they believe. So Jones’s sin in the eyes of the White House isn’t that he doesn’t believe, but that he believes too much. He went too far down into the 911 Truther, Chemtrail, Sandy Hook Hoaxer, making the frogs gay rabbit hole and never came out.

Certainly Stone is a kook, but he’s always been a cynical mercenary kook. Trumps people can look at him and see someone who won’t confuse the script with reality.

The doc says via telephone the provisional diagnosis is still pancreatitis. Felix is resting comfortably on a kitty bed listening to Country & Western music. (Really.) She found no indication of infection in a urinalysis exam, however infection still seems indicated due to an extremely elevated white blood cell count, so he’s getting an antibiotic drip in his IV. She thinks he should do okay.

I can feel myself getting sucked into a vinyl vortex. amazon.com is suggesting that I might be interested in a two-record reissue of Sgt. Pepper, remastered (messed with) by George Martin’s son with a second album of alternate takes (stuff that they didn’t think was good enough back then), on 180 gram vinyl (and probably rush pressed so that quality control is non-existent). I already have at least seven different versions of Sgt. Pepper and I can feel this one clawing at my wallet.

Most new vinyl albums suck. There aren’t enough pressing plants for the current demand so quality is often dismal, a lot of reissues are made from digital masters anyway so it kind of defeats the purpose, and they’re too freaking expensive.

Luckily there are a lot of used record stores in the Twin Cities. All of the boomer collectors are downsizing (and dying) so there’s a lot of good stuff to be found. I’m just about to turn 63 and I realize that anything I buy is just something I (or my sisters) will have to dump sooner or later, but it’s still fun to look, and I still love the routine of playing records.

I did some pretty good pencil drawings in my art student days and all I can say is that dude is really freaking good. He has control over all the different weight pencils and knows his stroke pressure, etc. Really incredible work to do what amounts to a black and white photo…in pencil.

The beams didn’t need to be melted, just annealed & the air flow would have increased the temperature of the jet fuel like air flow allows a coal foundry to melt several different metals.

That’s one of the Twoofers’ favorite talking points. Because apparently, aircraft-grade aluminum should not have made a dent in the steel columns that comprised the Towers’ outer skeleton. Let’s leave aside the velocity at which the planes were moving, and also the density and mass behind that velocity, impacting a (relatively) very small area across the face of each column.

Oh, yeah - I’m home from fish country. It was an extremely uneventful visit, without even the traditional political rant that I have come to expect from my folks. I gave my dad some assistance with his ‘72 Chevy, and he bought me a tank of fuel for the fishmobile for the trip home. All in all, it was amicable and pleasant, marred only by a little bit of emergency work that had to be done to save a project on the verge of cancellation.

This is the worst aspect of CT - it makes stupid people stupider. Anyone who’s ever seen a campfire, or a barbecue knows that more oxygen will make the fire hotter. There’s no one ‘burning jet fuel temperature’, just as there’s not one ‘burning charcoal temperature’. If there were, there’d be no point in a bellows for a forge. And people KNOW THIS, they understand it.

But, give them a ‘Gummint was in on it!’, and they turn their brains off.

I debated the nutjobs for a while. The highlight of my fun was a Twoofer who claimed to be an engineer whose “expert analysis” consisted of an MS Paint diagram of how he thought the fires should have spread through WTC 7, comparing them with the NIST fire simulations, and declaring the whole thing a fraud. As a computer scientist with some background in simulation, I laughed in his face, told him where he was wrong, and sat back to watch the fireworks.

Here’s what the Supreme Court said in Clinton v Jones about this issue before a State court:

First, because the claim of immunity is asserted in a federal court and relies heavily on the doctrine of separation of powers that restrains each of the three branches of the Federal Government from encroaching on the domain of the other two, see, e.g., Buckley v. Valeo, 424 U.S. 1, 122 (1976), it is not necessary to consider or decide whether a comparable claim might succeed in a state tribunal. If this case were being heard in a state forum, instead of advancing a separation of powers argument, petitioner would presumably rely on federalism and comity concerns, [n.13] as well as the interest in protecting federal officials from possible local prejudice that underlies the authority to remove certain cases brought against federal officers from a state to a federal court, see 28 U.S.C. § 1442(a); Mesa v. California, 489 U.S. 121, 125-126 (1989). Whether those concerns would present a more compelling case for immunity is a question that is not before us.

That footnote is kind of important, and says:

Because the Supremacy Clause makes federal law “the supreme Law of the Land,” Art. VI, cl. 2, any direct control by a state court over the President, who has principal responsibility to ensure that those laws are “faithfully executed,” Art. II, §3, may implicate concerns that are quite different from the interbranch separation of powers questions addressed here. Cf., e.g., Hancock v. Train, 426 U.S. 167, 178-179 (1976); Mayo v. United States, 319 U.S. 441, 445 (1943). See L. Tribe, American Constitutional Law 513 (2d ed. 1988) (“absent explicit congressional consent no state may command federal officials … to take action in derogation of their … federal responsibilities”).

I think a fair reading of Clinton v Jones and 28 USC 1442(a) gives the state court a solid basis for ruling that the case can go forward. Under section 1442(a), a defendant who heads a federal agency that is sued in state court, either in an official capacity or as an individual may remove the case to federal court. It is the defendant’s option to do so. But the code, I think, makes clear that such a person can be sued. In light of Clinton v Jones, such cases against the president should be able to proceed in state court.

Also, keep in mind, the concerns of prejudice are rather suspect. Perhaps, in 1790, when people considered themselves more Virginian or New Yorker than American, that might make sense. But today, when the vast majority believe their primary allegiance is to the United States of America? I find it hard to believe that such prejudice would exist, especially among judges.

Ultimately, whether this case proceeds in Kentucky state courts or in the federal system, it will be Kentucky tort law that is (mostly) applicable. It will be Kentucky judges (either state or federal) who oversee the litigation. The threat of prejudice is close to nil.

I once stayed overnight in Wendover UT, having gotten there in the first day of driving from San Francisco to PA. I woke up at 8 in UT, and asked the desk clerk where we could get breakfast. He said, the Casinos back across the border in NV. So, we went and had breakfast half an hour before we woke up, then set out at just the time we woke up, but were almost immediately an hour behind.
