Donald Trump Thinks He’s Above the Law - Now He Wants to “Break Up” the 9th Circuit Court of Appeals

You’ll have to excuse my language here, folks, but this one is absolutely fucking outrageous. After ranting earlier that the Ninth Circuit Court of Appeals had blocked his “sanctuary cities” executive order (and he was wrong — it was the US District Court in San Francisco), our Narcissist in Chief gave an interview to right wing propaganda outlet Washington Examiner and threatened to “break up” the Ninth Circuit Court.

President Trump said Wednesday that he has “absolutely” considered proposals that would split up the 9th Circuit Court of Appeals, where judges have blocked two of his executive actions.

“Absolutely, I have,” Trump said of considering 9th Circuit breakup proposals during a far-ranging interview with the Washington Examiner at the White House. “There are many people that want to break up the 9th Circuit. It’s outrageous.”

Trump is now talking openly about destroying the parts of the judicial system that won’t rubber-stamp his bigoted executive orders. He’s openly scorning the rule of law. This way lies dictatorship, folks.

Trump and his cabal of cronies are actively ignoring the rule of law.

Period.

That’s the bottom line.

The District Court in SF is the court of original jurisdiction. That’s where the case proceeded, and the court issued its order lawfully.

If Trump wants to appeal it, that’s his privilege and right. It’d then go to the 9th Circuit, and if he loses there (3 judge panel and then en banc), he could then appeal it to the Supreme Court.

There’s no great mystery here. There’s no secret sauce.

Well, it’s all a mystery to Trump who thinks he can do as he pleases, but he’s ticking off all the wish list items from the extremists guide to gutting the judiciary.

Never mind that he’s yet to nominate any replacements to the federal attorney positions he demanded resignations more than a week ago. Those are unfilled positions, and Trump and the GOP don’t care.

It’s all about sabotaging government, and his supporters don’t care about the facts or how the rule of law operates.

That’s what they like about Trump and it’s going to turn ugly for a lot of people when Trump’s actions hit at his own believers’ hardest.

The reality is that the 9th does have one of the largest caseloads in the nation, and quite a few cases do end up in the Supreme Court. Some are as a result of split of authority. A few are cases of original jurisdiction in the 9th.

And Trump’s claims that they’re reversed more than other Circuits simply isn’t true (go figure).

(CNN)Threats against more than one judge involved in legal challenges to President Donald Trump’s executive order on immigration have prompted federal and local law enforcement agencies to temporarily increase security protection for some of them, according to law enforcement officials.
CNN did not learn how specific the threats were, but law enforcement agencies treated them seriously and out of an abundance of caution, the US Marshals Service and local police increased patrols and protective officers to provide security for some of the judges, the officials said.

Its power is based almost entirely on respect for rule of law and the appearance (mostly gone these days) of being above politics. Even though Trump himself can’t break up the 9th Circuit, the GOP legislature would be giddy at the prospect of doing this - there is/was already one bill aimed at doing just that. Creating compliant, pet courts is just another vehicle (along with gerrymandering and voter suppression) that the GOP wants to use to re-write the rules to ensure their permanent majority. They have the power now, and have zero intention of letting anything pry it from their grasp.

Every plutocrat in the country would immediately form a corporation having himself/herself as the only stock holder. Next all assets owned by the plutocrats would be turned over to their little piggy-bank corporations.

I say this with all honesty. People who took up arms for the CSA are lucky that they were not hanged for what they did. The CSA rebels got far more lenient treatment than any rebellion to that point and up there since then too.

Too many Americans don’t care to do it and that is why we have what we have in Trump and the GOP.

The ultimate control of the voting is really education.

The GOP doesn’t want a true informed and educated society, they know it would be the death of them.

All of their other tricks come from ignorance of the political process.

Not enough people are sharp enough to know why a trade deal is good or bad they let politicians and the media tell them and we know what that is worth.

They don’t have a clue about gerrymandering.

They don’t understand taxation other than they are getting ripped off.

They have no idea of separation of the branches of government and who does what on the most basic levels.

And they don’t really care.

America’s biggest problem is our own ignorance about so much and we don’t want to do anything to change it. We aren’t really engaged in our own existence.

And here we are.
