He only need recuse himself if he was on the panel at the court of appeal. But I don’t think any of the decisions were even in his circuit. That’s the reason that Sotomayor had to recuse herself early in her tenure. Kagan had to recuse herself a couple of times because as SG she was involved in some cases coming before the court.

Good comment on dKos re the Montana election fiasco:

That is a very dangerous idea. This is fascism.

If he wins despite assaulting a reporter, it sets a precedent and sends a message that violence and thuggery against the press is a winning tactic—that the majority of the electorate approves of it. You will see a massive escalation of brute force, bare-knuckle violence by Republican politicians—real brownshirt tactics.

Whether Gianforte wins or loses, whether or not he is convicted, he has already achieved a great victory. Reporters, even courageous ones, will now think twice before covering Republican politicians. That makes it easier for them to get away with criminality and corruption.

We all know Gianforte will never see the inside of a jail cell. He’s a well-connected billionaire, there is a certain dollar figure that will be sufficient to make this go away, he will easily pay it, and that will be that.

If he wins, he’ll be seated in the House without objection and they’ll simply stonewall any questions until the media spotlight moves elsewhere (which it will, since there’s a new Trump outrage every day). They’ll suffer no consequences whatsoever from the scandal.

I think people are still not grasping that we’re dealing with a radical, violent totalitarian movement that seeks to fundamentally transform our entire society and culture. The ethical norms of civil society won’t stop them—indeed they are openly at war with those norms. Their goal is to do away with those norms and replace them with a tribal, white supremacist, Old Testament ethic of smiting the tribe’s enemies. Giving up any ground to them, however trivial-seeming, is a bad idea; if they win even a small victory, they will leverage that into more and more significant victories.

If you give them enough rope, they may or may not hang themselves. But they’ll hang us for sure.

Except, give the large percentage of votes cast before last night’s outrage, it may only reflect the problem that arises when people vote early before all information is available. On the other hand, it is a disgrace that so many Montana papers originally endorsed Gianforte, given what was already known about him. Many voters decide based on endorsements for races at this level.

I got to go to a Persian Restaurant in a nearby ‘burb this week. (yes, you CAN be jealous—OMG! the flavors!)

Anyway, this area of Chicagoland is one in which you see alot of headscarves —etc. And, you know what? IT IS NO BIG FUCKING DEAL.

I’ve been in ME restaurants in which my girlfriend and I were the only women and the only white faces and you know what? IT’S NO BIG FUCKING DEAL.

We are welcomed and served with a smile. Other patrons don’t seem to notice us.

This is the part of capitalism I grew up with. My bad for thinking it was normal.

We are welcomed and served with a smile. Other patrons don’t seem to notice us.

Some of the best entertainment I’ve seen recently is in the comments to the RedState article on this decision.

One of the commenters is engaging in the Sisyphean task of explaining to the rest why the administration is losing these cases. It’s not a difficult argument: 1) The executive is presumed to be acting constitutionally (deference at law), 2) if there is evidence that the executive’s motives are impure (which potus* 45 has provided in abundance), the courts can’t ignore this, 3) If this evidence is substantial enough, it can overcome the deference owed to the executive, therefore trump loses.

The counter argument is the argument from incredulity: So a president that did the exact same EO without the other stuff would get the EO through the courts?

It’s like reading a transcript of a heated debate on how many sides a triangle has. Motive matters everywhere in the law.

I think another factor in this is that we’re not reluctant to confront our own party members about their nonsense. Right-wingers, on the other hand, tend to hang together on every issue, and I think it’s because those who would be compelled to speak against certain things are dissuaded from doing so for fear of the backlash they’d receive. Take Bruce Bartlett for example, when he decided to speak out against trickle-down economics, he became the GOP’s “traitor,” causing him to lose jobs with right-wing organizations, access to high-level GOPers, and he became a kind of “wanted man” with a target on his back in his own party.

Only if the improved version doesn’t support diversity. Republican voters really don’t support the stated economic policies of the Republican party nor the health policies of the party. They would happily vote for someone who wants to bring down the capitalist system, as long as it doesn’t benefit minorities or, for many of them, women.

That has been the stated position of 90% of Southern white politicians since European settlement. My state has been lucky enough to have one (Huey Long) who actually meant to deliver social benefits to all of the state’s people, and John Bel Edwards follows him in that (hopefully not in the massive corruption or getting shot parts).

Of course, the real position is to serve the plantation/ bourgeois class while telling the poor wypipo that at least they’re not Ns. Sadly, this now appears to be the default position for Northern whites as well, from Spokane to Harrisburg.

It really feels to me that most people in my generation are either Bernie fan boys and convinced Bernie was robbed of the nomination- doesn’t matter if you point out to them that clinton lost to Obama with the same party and a similar electorate. Or the part that really worries me is the attraction to the alt right I see with many in my generation too. In a way, I feel like an outsider as a centrist liberal. Just eight years ago, I probably would been considered quite lefty and honestly I still am.

I want to address this since I’m a retired high school teacher. When I began teaching in 1974, I could focus on teaching critical thinking skills, but as the years passed, state lawmakers in GA got more involved in public education, then our state legislature became more right-wing. The result was a move away from teaching critical thinking skills to covering a specific amount of material in a specific way with the final goal being having as many students as possible pass state-mandated tests. No Child Left Behind hurt our kids because instead of a classroom teacher having the power to teach material in a certain way, it moved us toward using a “cookie-cutter” approach to teaching those subjects. When I retired, it wasn’t because my certificate had run out, it was because we got a new principal who was more of a politician than an administrator. I also suspected he was racist as h*ell because shortly after he got comfortable in the school system, he began “finding” ways to remove teachers who were Persons of Color out of the school. In his third year the state handed down a mandate called Class Keys. All of the teachers who were POC were formed into one group, and that group was supervised by him. I left before I, too, would have become a member of his group. He had no qualms about letting all teachers at the school know which teachers he considered to be his favorites and the best teachers in the building, and no POC were members of his in-crowd.

He just seems so fake. I read somewhere that he dedicated an etire chapter in one of his book to how much he ates the movie, Fargo. Being that’s my favorite Coen Bros movie, I don’t think John and I would get on that well. Funnily enough we do have some very superifcial stuff in common not related to politics at all.

I don’t think it’s all that, because most of the people making decisions and voting right now are those of us who predate a lot of the changes you are talking about. Most of this, on both sides, is about whites, and especially Christians, losing their status as the “one true people.” They are being told the changes are happening without their permission, and that they are suffering because of others. And they accept it without examining and determining how much of their suffering is because of their choices (being bigots has allowed the rich to rob them blind). I see plenty of older people who do not have any critical thinking skills, but most importantly, don’t have or want to update their own knowledge when new facts come in.
