O’Reilly asserts that Las Vegas is the price of freedom; and every one of them believes this; even if they lose a loved one, they don’t reconsider their position. The one band member who lived through the attack and changed his mind is the rare exception.

The only reason the NRA is not the most evil organization in the US today is because it is in servitude to a greater evil — the GOP and ultimately the GOP plutocrats that have owned the party and set its strategy for decades.

The takeover of the NRA by a mob of second amendment zealots was one of the first success stories for the US hard right as it made its long march through the institutions of power. This has led to a total blockade of gun rights reforms, which is a perpetual source of anger, conflict and resentment all of which ultimately benefits the right.

Even as I see the pattern, I cannot hide my absolute contempt for the second amendment, which just fuels the resentments of gun rights advocates.

I’m facing a tough question in the US gun public policy mess. We have two commonly used wingnut arguments at times like these:

1) What’s the big deal with guns? Cars, knives, potato peelers, limp noodles etc. can all be lethal weapons as well.

2) The justification of the second amendment is that it is supposed to guarantee to the people the right to sufficient weaponry to overthrow the government, if necessary.

Which of these two arguments more thoroughly self-beclowns anyone who makes it? (to be fair, omit the potato peeler and limp noodle from option #1)

Of course this is a completely frivolous bit of mindless entertainment that I engage in to momentarily distract myself from the fact that absolutely nothing will be done about this mess.

I’m finding myself very detached, clinical, and analytical about this whole thing. If I’m angry, it’s more annoyed not boiling anger. Maybe all my adrenalin got used up. Maybe this just feels like one more thing on top of the shitpile that America is trying really hard to become.

But I find myself getting annoyed by people saying this guy ‘snapped’. This assumes far too much. ‘Snapped’ to me implies a crime of passion. This was cold, ruthless, almost mechanical in its efficiency. He planned this a long time. He paid attention to details. He was a monster, but not an out-of-control crazy loon.

The descriptions I’ve read of his lifestyle seem to imply a guy who basically ‘had it all’ but had no roots, no attachments. He lived in hotels, or in houses he barely furnished.

Broken, not snapped. Something missing inside, possibly his whole life. His Dad was, after all, psychopathic, according to the FBI, right? Perhaps he’d spent his whole life feeling little or no connection or empathy for anyone, and was restrained only by the knowledge of what happens when you get caught.

I’ve commented before that if you’re only good for fear of punishment, you have the moral development of a young child. Ethics, morality, whatever you call it - it’s how you behave when you know you can’t get caught. If you don’t have that, if it’s all just ‘what you can get away with’ you’re not moral.

Which, sadly, reminds me of the President.

Meanwhile, I give the doggies walks and scritchies, and hugs because they love them. I hug the boys, and laugh at their jokes. I listen to Mrs. FBW bitch about the people she works with, and remind her she already decided to leave, so fuck ‘em if they can’t take a joke. Then I snuggle up to her as she sleeps and fall asleep listening to her snore.

And there are little things like the Praying Mantis in the parking lot, so tough and threatening as I tower over him. And knowing that tomorrow is ride day, and I will put in 18 miles or so on my oldest bike, the one that I still like best.

Life is actually mostly good.

The fevered swamps are convinced that the massacre in Las Vegas was fake or staged. Claims of ads for crisis actors in Vegas two weeks prior, a crisis actor allegedly being ID’d, the real shooter on the 20th floor and the millionaire was set up to look like the real killer and so on. One nut from Vancouver B.C. is convinced that this was a combination of a real attack and crisis actors brought in to make it look worse than it really was. When one member came in and said that someone in his extended family was in the crowd and lost their life, another nut was “disappointed’ that someone was killed because he was hoping this was all fake. The he went right back to thinking this was all faked. Others are talking about people standing around like nothing is going on while cops are near them, hiding behind their cop cars. What I have stated above isn’t even beginning to scrape the top of the steaming fetid shitpile these fucks reside in.

Knowing that we are going to have more of these shootings, can karma please arrange for these worthless fucks to be in the line of fire?

So, another 24 hours has gone into the books and we find out that Jared and Ivanka were being investigated for felony fraud in NYC relating to sales of condo units at the Trump SoHo. The prosecutor, Cy Vance, dropped the case after Trump lawyer Kasowitz donated $25,000 to Vance’s election campaign.

This reeks.

On May 16, 2012, Kasowitz visited Vance’s office at One Hogan Place, in downtown Manhattan—a faded edifice made famous by the television show “Law & Order.” Dan Alonso, the Chief Assistant District Attorney, and Adam Kaufmann, the chief of the investigative division, were also at the meeting, but no one from the Major Economic Crimes Bureau attended. Kasowitz did not introduce any new arguments or facts during his session. He simply repeated the arguments that the other defense lawyers had been making for months.
Ultimately, Vance overruled his own prosecutors. Three months after the meeting, he told them to drop the case. Kasowitz subsequently boasted to colleagues about representing the Trump children, according to two people. He said that the case was “really dangerous,” one person said, and that it was “amazing I got them off.” (Kasowitz denied making such a statement.)
Vance defended his decision. “I did not at the time believe beyond a reasonable doubt that a crime had been committed,” he told us. “I had to make a call and I made the call, and I think I made the right call.”
Just before the 2012 meeting, Vance’s campaign had returned Kasowitz’s twenty-five-thousand-dollar contribution, in keeping with what Vance describes as standard practice when a donor has a case before his office. Kasowitz “had no influence, and his contributions had no influence whatsoever on my decision-making in the case,” Vance said.
But, less than six months after the D.A.’s office dropped the case, Kasowitz made an even larger donation to Vance’s campaign, and helped raise more from others—eventually, a total of more than fifty thousand dollars. After being asked about these donations as part of the reporting for this article—more than four years after the fact—Vance said he now plans to give back Kasowitz’s second contribution, too. “I don’t want the money to be a millstone around anybody’s neck, including the office’s,” he said.

And it is something that NY AG Schneiderman should take a very good look at and potentially bring charges against Vance for corruption/bribery.

Wilson mentions Trump not being able to deliver “political wins”, but the Republicans still seem to be able to manufacture those “wins” - whether because or in spite of Trump seems irrelevant - where they count: i.e. in Congress and in many Statehouses. Despite the crowing from from the port blogosphere every time some Democrat wins a State-Assembly special election in some R+whatever district*, the GOP still maintains a semi-solid majority in the House (i.e. still legislatively hostage to its extremist fringe), a majority in the Senate, and a seemingly unshakable control over all too many State Legislatures. There may be instability (i.e. HIDEOUS FAIL) at the top in the Executive Branch, but until at least one house of Congress slips out of Republican control, nothing positive in this country is likely to be accomplished.

*Of course, the Admin’s nomination of Congresscritters from solid-red states/districts is a considerable factor. Case in point: Ossoff v. Handel in GA-06.

I think the dynamic there was a bit complicated. Putin owns Trump. Tillerson works for Trump. Putin needs Exxon to drill and in order to do that, sanctions have to be removed. So Putin is more dependent on Tillerson than the other way around. But, since neither Trump or Tillerson can lift sanctions, the relationship is weaker than it once was.

Love Band of Brothers. Malarkey - the real person - who did the intros (with other WWII vets that were being portrayed in the show) was amazing.

If memory serves in the show Malarkey was the one, when Easy Company was back in Brittan, went to the laundry service and saw all of the finished clothing for all the friends he had lost and started to gather it up to send back to the families. That scene still sticks with me.

Once the WWII generation dies fascism’s evil will be forgotten and those ignorant of the past will become the evil personified by the those we once fought.

I’m still a little bit leery of Jennifer Rubin, but she truly captured the yam’s Puerto Rico visit:

The visit was off-key, cringe-worthy and embarrassing (for those capable of embarrassment). It did him no political good, serving only to break his “streak” of one day in a row of acceptable public rhetoric. The visit was in every respect true to Trump’s nature. He can read a script but not generate his own genuine empathy; he is always the worst victim in any disaster — but also the superhero. He is incapable of rising to a situation, eschewing partisanship, displaying magnanimity or demonstrating empathy.

I only can’t believe there aren’t more of them given the demonization of Islam by the Anti-Christian right wing in America. There’s hundreds of years of romanticism of the Crusades at work here too but the reality is kind of ironic. Much like America with too many pretend religious gunhumpers, so too did Europe of 1090 CE have too many almost religious warriors killing each other and civilians so the pope, Urban II, thinking he could get rid of them and help Byzantium against the Turks, tried to point them at an external enemy instead. The historical results should horrify anyone (see the fall of Jerusalem in 1099) but we have too many romances about the crusades instead.

Agreed, guaranteed notoriety can be a motivator for psychopaths. I suggest naming these incidents in honor of the victimized cities, as it is truly an assault on communities at the local and national scales.

Someone earlier said that we don’t remember the victims’ names, only the killer’s. But in most cases, that doesn’t last long either. Hell, maybe it’s just my aging brain, but I don’t remember the names of the Columbine assholes, or the Aurora creep, or the Virginia Tech nutcase, or even the Sandy Hook madman. I doubt that anyone who wasn’t a national security professional remembers the name of any of the 9/11 doers except for Mohammad Atta. In a year or two, I believe, the most recent slaughter will be recalled simply as the Las Vegas shooting, and the name of the gunman removed to the fuzzy edges of particular memories, for example those of the victims’ families. So in a way, your suggestion is already pretty much established in actual practice.

Crusaders eventually sacked Constantinople … and were much more brutal to those living in Jerusalem than the Muslims (as the Crusaders killed everyone - and the people of different religions were living in peace at the time during Muslim rule).

Life in the Middle Ages was good only for the upper nobility, if they managed not to die of disease. The middle nobility (knights, especially) had the additional threat of being killed in battle if their lord decided to wage war with some other lord. Everyone but the king was at the beck and call of the person above him, and even kings had to ingratiate themselves with the church and the Pope.

I long ago lost patience with fantasy novels that glamorize medieval life as some kind of simple, idyllic existence. GRRM portrays a much more believable version of feudal society in Game of Thrones, if you set aside the magical aspects of the story.

When I spent a month in Mexico, the most careful guy in the group was a biologist who avoided anything that couldn’t be peeled or opened with a device. I ate from all the street vendors. He got the sickest.

Once you get past the preamble, the US Constitution is a very businesslike document. There are no comments, parenthetical asides, vision statements, explanations or justifications in its following text.

That means that the RKBA as expressed in the Constitution must have some link (unspecified) to the militia, to give the first part of the second amendment meaning. Had the founders intended just “The right of the people to keep and bear Arms shall not be infringed”, that is what they would have written. They did not do that, so anyone who takes the text of the Constitution seriously is stuck with the militia.

That’s a difficult problem, since the militia as understood by the founders is a legal fossil with practically zero real world relevance today.

The Heller court simply said to hell with the militia language in the second amendment. That might be a rational response to having an enumerated right tied to a legal fossil, but conservatives really shouldn’t claim that Roe v Wade is judicial activism and Heller is not.

Taking unenumerated rights seriously enough to decide a hotly contested issue is a bold act of judicial interpretation, but it pales in comparison to simply ignoring inconvenient text of the Constitution itself.

No, not really close. The Militia was the force of a single state that was made up of all the adult white males who could be called out to defend the state/nation against invasion, rebellion, or worse, slave uprising. The Sheriff was, much as in England, the local law enforcement authority and would deputize individuals only as necessary.

The militia as the defense of the US instead of a standing Army was the single greatest failure of the Constitution, driven by the fear of the standing armies of both King & Commonwealth during the English Civil War, and it’s ironic that the militia’s only noticeable successes were against the Whiskey Rebellion (lead by Washington himself) and against an utterly nonmilitary foe in Black Hawk’s War.

But as a result of that fear of standing armies, we have the legacy of a piss poorly written 2nd Amendment and modern nation ignorant of it’s historical origin.

Can I say again, I really want the Czech gun licensing system dropped into America? There is nothing incompatable with the actual 2nd Amendment in that system: Pass the tests, have a license? Good to go. Fail the tests? No license & no pew pew for you.

Per Article II, Section 2:

The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States

Also, keep in mind the US didn’t really have much of a standing army in the early years. Which is why the forces used during the Whiskey Rebellion were mostly militia forces.

It certainly is no problem with anyone here - it’s considered common-sense. Most Czechs would tell you that you have to go to driving school and pass that, and once that’s done, you can get your driver’s license. If that’s done for a car, why not a firearm?

When DF was here, I raised the point that inherent in our citizenship or residency in this country, we all have a fundamental/constitutional right to move freely about the country. A car is, arguably, the most effective way of exercising that right. But you still have to pass a written test and a behind the wheel test to get a license, you have to have insurance if you own and operate a car, your license can be revoked if you violate certain sections of the law - even if its not a misdemeanor (get enough speeding tickets and you can have your license suspended or revoked). Those seem like entirely reasonable things with cars, and should be with guns as well.

And that doesn’t even get into the fact that there’s no reasonable purpose for a private citizen to own a semi-automatic or fully automatic weapon. Those are military grade weapons, as far as I’m concerned, and just like you can’t own an Abrams tank or RPG or an ICBM, I don’t see why you should be able to own those types of rifles. Especially when there are apparently very simple modifications or tools that turn semi-auto weapons into full auto weapons.

Quite the opposite. One of Congress’ enumerated powers is to call up the militia to suppress rebellion, which is exactly what they did during the Whiskey Rebellion.

As I recall, the discussions on that point here also noted that in the early years of automobiles in the US, that right of free transit was invoked to oppose any regulation of driving at all, leading to an “If it fits, I drives” model for cars that was carried out in practice for some years. The resulting carnage eventually led to the demise of this legal theory and to the current regime of license, registration and insurance.

Legally, restricting driving is much easier than restricting guns, because there is no enumerated constitutional right that bears on driving.

Guns and abortion seem to be the most polarizing issues of all. I can see this for abortion, but the fanaticism on guns seems bizarre to me.

I think 50% of the fanaticism entails sticking it to Democrats, Liberals, Progressives and Leftists.

As I recall, the discussions on that point here also noted that in the early years of automobiles in the US, that right of free transit was invoked to oppose any regulation of driving at all, leading to an “If it fits, I drives” model for cars that was carried out in practice for some years. The resulting carnage eventually led to the demise of this legal theory and to the current regime of license, registration and insurance.

Legally, restricting driving is much easier than restricting guns, because there is no enumerated constitutional right that bears on driving.

Even enumerated constitutional rights have limits and restrictions… human sacrifice isn’t going to be allowed based on freedom of religion; nor do we allow multiple marriage based on freedom of religion; there are time/place/manner restrictions on free speech (not to mention fighting words and defamation).

The freedom of movement has been recognized under the privileges and immunities clause since the early days of the constitution. And the right was last adjudicated in 1966, when the Court recognized the federal government’s power to protect the right against state action in US v Guest.

My point is: just because there’s a right, doesn’t mean it is not subject to some regulation. In the case of the second amendment, if we are going to recognize the right to bear arms as an individual right - and I’m more or less okay with that principle - it doesn’t mean we have to give up the ability to place reasonable limits on that right.

When DF was here, I raised the point that inherent in our citizenship or residency in this country, we all have a fundamental/constitutional right to move freely about the country. A car is, arguably, the most effective way of exercising that right. But you still have to pass a written test and a behind the wheel test to get a license, you have to have insurance if you own and operate a car, your license can be revoked if you violate certain sections of the law - even if its not a misdemeanor (get enough speeding tickets and you can have your license suspended or revoked). Those seem like entirely reasonable things with cars, and should be with guns as well.

And that doesn’t even get into the fact that there’s no reasonable purpose for a private citizen to own a semi-automatic or fully automatic weapon. Those are military grade weapons, as far as I’m concerned, and just like you can’t own an Abrams tank or RPG or an ICBM, I don’t see why you should be able to own those types of rifles. Especially when there are apparently very simple modifications or tools that turn semi-auto weapons into full auto weapons.

Actually you can. Just takes a butt load of money and the proper FFL license (class 1 I believe). As for an ICBM, if you have the money you could PROBABLY find yourself a demilitarized one from some collector as well.
