Tonight in the Shitshow: Trump Threatens to Sue Steve Bannon for Defamation

Politics • Views: 28,889

This is really getting good now: Trump attorney sends Bannon cease and desist letter over ‘disparaging’ comments.

Trump attorney Charles Harder said in a statement, “This law firm represents President Donald J. Trump and Donald J. Trump for President, Inc. On behalf of our clients, legal notice was issued today to Stephen K. Bannon, that his actions of communicating with author Michael Wolff regarding an upcoming book give rise to numerous legal claims including defamation by libel and slander, and breach of his written confidentiality and non-disparagement agreement with our clients. Legal action is imminent.”

In the letter to Bannon, Harder, writes, “You [Bannon] have breached the Agreement by, among other things, communicating with author Michael Wolff about Mr. Trump, his family members, and the Company [the campaign], disclosing Confidential Information to Mr. Wolff, and making disparaging statements and in some cases outright defamatory statements to Mr. Wolff about Mr. Trump, his family members.”

In the letter, Trump’s attorney says that “remedies for your breach of the agreement include but are not limited to monetary damages” though no dollar amount is disclosed.

The lawsuit is a bluff and Bannon should be so lucky to get sued by trump.

Has Bannon already been interviewed by the Mueller team in regards to Russia and Trump’s obstruction of justice? From what little has been revealed by the book so far, it sounds like he would be one hell of a witness for the prosecution.

Heh, guy on Lawrence just hinted at what I said in the last thread…this move from Trump and his lawyers all gives the book some gravitas and validity.

Heh, now the lawyers are saying “legal action is imminent” which Lawrence says means no action is coming.

And Lawrence is saying the damage is done, the book is the book and can’t be undone.

This is ripe stuff.

Be nice if Bannon is the one who blows up the Trump NDA ban. There must be thousands of people who would love to open up about Trump. Just do it.

re: #177 makeitstop

That particular cow has exited the barn, no?

What’s gonna do, block the release of the book?

Actually, the book can’t be blocked. That’s prior censorship and is almost completely inimical to the First Amendment. There is an argument which could be made about national security, but I don’t think this book qualifies. Plus, that horsie’s out of the barn; some of the press have the book already. (Note: If you work or worked for a three-letter agency, one of the conditions of your employment includes review of your books, but that’s not prior censorship.)

I’m personally wondering if the non-disclosure agreement Bannon signed with “Donald J. Trump for President, Inc.” is void as a matter of public policy? Also, the letter talks about libel but fails to note that Trump is the quintessential public figure and would have to demonstrate “actual malice” to be able to win any damages. (Which is nearly impossible to do.) Also, considering how awful Trump is (and this can be demonstrated on the record), I’m thinking it’s literally impossible to libel the guy.

I’ve asked one of my more astute lawyer buddies in New York about the NDA but it will be tomorrow before I hear back from him, I’m thinking. Just as a side note, one of our Republican (!) Arizona legislators filed a bill for consideration in our “meth lab of democracy” to make NDAs for sexual harassment illegal.

An old lefty named Bartcop hipped me to the concept of discovery after a web site I owned got hit with a SLAPP suit by Michael Savage. When our lawyer delivered the list of questions we’d be asking in discovery, Savage dropped the suit like a hot rock.

Amazingly, Bill Kristol and John Dean both seem to be on the same side: the right one, for a change. All those NDA’s for anybody and everybody that Trump has depended on to keep the embarrassments (and hinkier stuff) quiet about his businesses (and political crap)? I’m guessing the Trump Organization has used its considerable legal resources to enforce them - via threats, I’m sure. I’m NOT so sure, though, that that’s going to be enough when the Asshole-in-Chief is now POTUS, and a considerable amount, one presumes, of the “non-disclosable” stuff is, or may soon be, the subject of criminal investigations.
And if one “Trump NDA” can be legally invalidated, why not all of them?*

* IANAL, clarification will be gratefully accepted

washingtonpost.com

Newly returned search warrants reveal a harrowing scene inside a home in Reston, Va., where police say a couple were shot and killed in late December by a 17-year-old who they believed was espousing neo-Nazi views to their daughter.

Investigators wrote that they recovered 10 cartridge cases, a knife and hammer from the home of Scott Fricker, 48, and Buckley Kuhn-Fricker, 43. They also found what appeared to be blood stains on a hallway wall, on a bedroom wall, on a bedroom door and on a hallway floor, among other locations.

One search warrant states bullet fragments and holes were found in an office, in a ceiling and in a hallway.

One search warrant also states the suspect in the case was a juvenile offender, but does not detail his conviction or convictions. The Washington Post generally does not name juveniles charged with crimes, unless they are charged as adults.

Slow news day, eh?

The White House is going to blow up tomorrow. Trump’s reaction to bad news is to punch people in the mouth.

He just can’t let this go. If his people were smart, they’d have hit him with a dose of aerosol Thorazine and wrapped him in a white coat. But they didn’t.

Dog help us all, as this is getting really tense. The maniac in the White House is a cornered wolverine. There is no indication his staff can control him. And he’s got a mouthful of teeth and fears nothing because he’s also a fucking idiot.

I’m off for the rack. Sweet scaly dreams. What a day.

Return expected sometime around March

“… According to reports, there is only a 1-in-10,000 chance that the massive space lab will actually crash into a populated area and damage buildings. While the odds are slim, scientists have only been able to narrow the crash zone down to between the 43° North and 43° South latitudes; an area that still includes parts of every inhabited continent on Earth. …”

The author of the new Trump exposé taped many of the interviews.

axios.com

Axios also claims that Wolff hosted a dinner with Roger Ailes and Steve Bannon as guests, and that’s how he knows what they talked about.

Some journos are going to claim that the book research is sloppy or that Wolff plays loose with the facts, but IMO Wolff has covered his ass as much as possible, given that the main focus is the litigious Donald Trump. If anything, he has forced Trump & Co into the uncomfortable position of refuting the book with something approaching facts, which a variety of others can easily contradict.

So, now Trump can fret about two things: the Mueller investigation and the Wolff exposé.

Good.

It would have been a journalist’s dream gig. For the most part, Trump’s staff are a collection of undisciplined, inexperienced dodo-heads, with no awareness of how careful one must be in Washington, DC, about what you say, how you say it, and to whom you say it. It’s safe to say many of those people will never get a government job again, and may find other career paths (other than wingnut welfare) cut off. Why? Because they blabbed too much. Competence is a separate issue, which has never prevented dodo-heads from getting jobs as pundits or Fox News “experts.”

Hollywood Reporter’s got a piece by Michael Wolff this morning. Holy crap.

There was some effort to ascribe to Trump magical powers. In an early conversation — half comic, half desperate — Bannon tried to explain him as having a particular kind of Jungian brilliance. Trump, obviously without having read Jung, somehow had access to the collective unconscious of the other half of the country, and, too, a gift for inventing archetypes: Little Marco … Low-Energy Jeb … the Failing New York Times. Everybody in the West Wing tried, with some panic, to explain him, and, sheepishly, their own reason for being here. He’s intuitive, he gets it, he has a mind-meld with his base. But there was palpable relief, of an Emperor’s New Clothes sort, when longtime Trump staffer Sam Nunberg — fired by Trump during the campaign but credited with knowing him better than anyone else — came back into the fold and said, widely, “He’s just a fucking fool.”

Part of that foolishness was his inability to deal with his own family. In a way, this gave him a human dimension. Even Donald Trump couldn’t say no to his kids. “It’s a littleee, littleee complicated …” he explained to Priebus about why he needed to give his daughter and son-in-law official jobs. But the effect of their leadership roles was to compound his own boundless inexperience in Washington, creating from the outset frustration and then disbelief and then rage on the part of the professionals in his employ.

The men and women of the West Wing, for all that the media was ridiculing them, actually felt they had a responsibility to the country. “Trump,” said one senior Republican, “turned selfish careerists into patriots.” Their job was to maintain the pretense of relative sanity, even as each individually came to the conclusion that, in generous terms, it was insane to think you could run a White House without experience, organizational structure or a real purpose.

Morning!

So, with the Bannon book revelations I figured I’d tune in to Morning Joke to see what Joke and his guests had to say about it.

They pretty much say the book is true. Joke reveals they have heard much of this since March of ‘17. Bannon and others have been saying this stuff about the chaos in the White House and how much of a dunderhead Trump really is.

Here is the opening of the show. It’s good stuff, even if I don’t like Joke, it’s good to know he and other Republicans seem very aware of the issues.

I hope this forces the Republican congressfolk who all know it too, to stop covering for it. It’s in the public now and there will be no more cover.

If Bannon was such a nonentity, why did Trump put him on the National Security Council?

Also, who says this (from Trump’s official statement)? “often described as the most talented field ever assembled in the Republican party” Now that’s a laugh.

Bannon put himself on the National Security staff. He was removed soon after.

And as far as the most talented field ever assembled I think Trump is going with numbers. 17 entrants. More is better! There had to be some talent somewhere.

Right, Trump just sort of waved Wolff away, neither approving his presence nor forbidding it, and since the WH is in total chaos, everyone else just figured NBD.

A tightly run, professional executive branch would not have let that happen.

Good point on the volume of possible book writers.

As for Omarosa, she’s actually got the most experience of Trump’s team. She’s done reality TV. (That counts as experience in Trump’s WH). She won’t write a book - she is looking for a TV gig and nothing less.

Here is an interesting article arguing that the GOP tax bill isn’t as bad as it looks, especially since the tax cuts for the middle class which are suppose to be temporary probably won’t be. Though that doesn’t change the fact that it should have had more relief for low income Americans, and less for the 1%. I’ve never believed the deficit hawks argument that the US is dangerously in debt, and I agree that in reality US budget deficits play a valuable role in the world economy by providing an ultra-safe investment in the form of US Treasury Bonds. And when Democrats come back to power they should realize they can borrow to help low and middle income Americans, just as Republicans borrow to help the rich.

Trump & Co are trying to halt publication of the book.

A lawyer representing President Trump sought Thursday to stop the publication of a new behind-the-scenes book about the White House that has already led Trump to angrily decry his former chief strategist Stephen K. Bannon.

The legal notice — addressed to author Michael Wolff and the president of the book’s publisher — said Trump’s lawyers were pursuing possible charges including libel in connection with the forthcoming book, “Fire and Fury: Inside the Trump White House.”

The letter by Beverly Hills-based attorney Charles J. Harder demanded the publisher, Henry Holt and Co., “immediately cease and desist from any further publication, release or dissemination of the book” or excerpts and summaries of its contents. The lawyers also seek a full copy of the book as part of their investigation.

The latest twist in the showdown came after lawyers accused Bannon of breaching a confidentiality agreement and Trump denounced his former aide as a self-aggrandizing political charlatan who has “lost his mind.”

The excerpts from the Wolff book confirm my suspicions expressed here several times, that Trump did not expect to win and did not really want to win. He was going to use the campaign as a marketing gimmick. Now, his pride prevents him from leaving the job. Face it Trumpy. You are fucked.

I spent part of the weekend watching a series of doom-and-gloom financial videos by a gold-bug. He’s one of those Austrian economics fans, but I have to admit that his charts showing the boom-and-bust cycles of the financial markets are compelling. He noted that regulators and financiers learned absolutely nothing from the 2007-8 bust, and went back to business as usual as soon as the government bailed out the big banks.

Regardless, bull markets do not continue indefinitely. There will be a correction, perhaps while Trump is still in office.

What’s with Magoffin County, I wonder? Unemployment 50% worse than the next worse County in the state!

Relatively small population in part of coal country. Generally poor ($19,421 median income), average age is 34, and 66% of adults have a high school diploma.

Also a small factoid: There is a significant Melungeon or Black-Dutch population in Magoffin County, known locally as the “Brown People of Magoffin County”. In a 2007 study by the U.S. Census Bureau, Magoffin County, along with Mitchell County in Iowa, was cited as the U.S. county having the largest percentage of individuals in the demographic category of “Non-Hispanic white alone.

Most of those counties are very rural, with limited employment opportunities. The ones with the lowest rates are more urban. Oldham County, for example, is a bedroom county for professionals working in Louisville.

Of course, I was just wondering why Magoffin County’s unemployment rate is so much higher than all of the other poor rural counties in the state.

There really should be visible snow on our mountains. There is none. I can shirtsleeve drive to ski resorts near Los Angeles. Mt Baldy, Mt Wilson etc. In this pattern, look out for February and March rains here. Can be a threat to burn areas. Of which we had a lot. Record breaking lot. The patterns are changing to the more robust or extreme side. wet, dry, hot or cold. Scary in it’s own “climate” way, but of course not life threatening like the cold zones.

Well, “market corrections” are always possible (i.e. inevitable, and often well-predictable in advance), but unlike 2008, I wonder how much impact a 2018 “crash” is going to have on the general economy? The Great Recession of a decade ago (Jeez, has it been that long already??) had a greater impact on the populace at large, as the biggest collapse (AFAICR) came in an overheated and over-borrowed-on real-estate sector: one where there were a lot of individual players, whose loss of buying power magnified the problems throughout the economy. And I’m not sure that’s the case now.
However, one thing is probably a pretty sure prediction: when Black Friday Comes this time around, our Moron-In-Chief will be sure to have a tweet ready blaming Obama/Democrats/Crooked Hillary…

I’m not expecting a recession or stock market crash this year. The global economy is growing strongly, there isn’t a bubble like housing was, there is no sign that hiring is slowing or firings are rising, the economy isn’t overheating, corporate profits are strong, and there is still room for employment to grow despite a low official unemployment rate because we still have a relatively low employment to population ratio. No, those are being slow-rolled. No mass deportations, but cuts in legal immigration and a drop in undocumented. And fewer high-skilled immigrants coming in because they feel like they’re not welcome.

And on trade, Trump’s killing of TPP and his idiotic approach generally will, over time, reduce that.

So, no crash, just a slow strangling.

There were very few people predicting a crash in 2007. I mean very few. I pulled all my money out and begged my friends and family to do the same. I remember how lonely I felt. Almost no one did. It wouldn’t even be so bad if it was just Haberman. But it seems like every single NYT employee short of Charles Blow and Paul Krugman have become endless apologists for this kind of coverage and keep wanting to get credit for ‘exposing Trump’ while endlessly normalizing him.

I thought Maggie was arguing the book was false yesterday. How can it be an accurate depiction of the WH, one the Times has already reported and also false?

— Neera Tanden🖖🏼

I hate vague references like this. I wish Neera would quote what Maggie said specifically.

That said, Maggie does seem rather defensive about the Wolff book, wants to claim that Wolff is dependent on actual journalism from Wash Post/NYT. Specifically Maggie says “Wolff is pretty reliant on reporting from NYT, WaPo and others - which he derided in real time — throughout the book”.

Shameless page promo: Fire and Fury:’ AKA ‘Stampede to the Panic Room”

Ya know, I seriously thought we’d get a few days into 2018 with a little relative peace and quiet. But noooo - while 2017 was a bumpy ride in a creaky old airplane, it turns out that 2018 is that same plane strapped with 10 rocket engines, and they’ve all fired off at once on the first business day after New Year’s Day, and what was once a moderately discomforting display of turbulence and dodgy engineering has unexpectedly turned into the thrill ride of the century.

Michael Wolff’s ‘Fire and Fury’ has gone into previews, and Trump World has flown into a blind, sweaty panic.

There were very few people predicting a crash in 2007. I mean very few. I pulled all my money out and begged my friends and family to do the same. I remember how lonely I felt. Almost no one did. Pigs get fed, hogs get slaughtered. If the things that were going to crash the market were obvious, it would never get that high. FWIW.

Housing Panic and Flippers In Trouble were spot on.

Keith, the force behind Housing Panic later shuttered that site and launched Soot and Ashes in the dark days of 2009. He was cited by the LA Times and others for calling the subprime insanity back in 2005. I started following him in ‘06, and was appalled down to my bones at seeing a smart, financially literate analyst just work the numbers.

So, today: work the numbers. Listen to what the voices from outside the Greed Bubble are saying.

Yes. Stock market up? Where is that money coming from? Has to come from somewhere, its not just laying in the street to be picked up. Bailing out of bonds? Okay, borrowing will get more expensive, rates go up, business borrowing gets expensive, banks get squeezed. Borrowing against real estate to buy stocks? What can go wrong when real estate is over leverage? Look out if overall margin requirements get lowered. Wealthy tax cut money being used to buy stocks? Aside from the fact that they don’t have it yet, a big chunk of that money is from increasing the deficit which means increased interest rates which affect housing prices which squeezes people who borrowed against equity to buy stocks. Always remember, the sharks are ALWAYS in the water, like Goldman shorting the very stocks they were pushing clients to buy. If you aren’t a shark, you’re the chum.

This story just gets better every time new stuff comes out…

“It’s all lies!!”
I have dozens of hours of tape.

“I thought we were off the record!”
Did I SAY we were off the record?

“How’d he get access like this?”
Trump gave it to me, after liking a picture attached to a negative article I wrote.

“How come Murdoch didn’t tell the WH staff to stop this?”
I was waiting for that, but it never happened.

“How can he know what was said at that dinner party between Ailes and Bannon?”
I hosted it. They just talked.

I also think he’s more shocked now than he’s ever been in his life. He’s spent more than 50 years describing himself as “the smartest person on the planet” and having his specially-selected toadies repeat it. Now that he’s president, he’s finding out how many, even his closest friends, really feel about him, and he’s freaking out and trying to change the subject to his non-existent economic success. The tool and the 1st Daughter seem to think that tweeting about the stock market reaching a new high means every citizen will suddenly have more money appear in their bank accounts/paychecks.

The next day’s aftermath encouraged my softspoken Christian roommate to ask, “Did you have to sacrifice a small animal in there?”
