Lawsuit Filed Against Chuck C. Johnson, Jim Hoft, Paul Nehlen, Gavin McInnes and Others for Falsely Linking Michigan Men to Charlottesville Attack

Consequences for spreading malicious fake news

After last year’s white supremacist rally in Charlottesville, Virginia, at which counter-protester Heather Heyer was murdered when one of the racists deliberately drove a car into a crowd, we reported that a slew of right wing sites immediately and recklessly rushed out articles identifying the wrong person as the perpetrator of the attack.

These irresponsible bloggers included our old pal Chuck C. Johnson (who is NOT ME, and is not really my “pal”) and Jim Hoft (the fabled Stupidest Man on the Internet). And from those two sites the fake story quickly spread throughout the right wing noise network.

Both of these far right bloggers soon deleted their posts, but of course they know very well that once they put this malicious nonsense out on the Internet, the right wing mob will take it and run with it, and there’s nothing anyone can do to stop or debunk it from that point; it becomes an article of faith and takes on a life of its own.

The young man falsely identified by these dishonest bloggers and his father were advised by Michigan State Police to leave their home and go into hiding, after they were flooded with death threats.

And this week, they filed a lawsuit against an entire group of these people, including Chuck C. Johnson, Jim Hoft, Gavin McInnes and Paul Ryan’s white nationalist primary challenger Paul Nehlen, seeking damages for defamation, invasion of privacy and intentional infliction of emotional distress.

Courthouse News reports:

Joel Vangheluwe and Jerome Vangheluwe named GotNews and its editor and founder Charles Johnson as defendants in a complaint filed Wednesday in Detroit federal court. They are represented by Dallas attorney Andrew Sommerman and Clinton Township, Mich., attorney Raechel Badalamenti.

The lawsuit claims GotNews falsely reported that Jerome’s son Joel was the driver of the Dodge Challenger used to plow into anti-fascist protestors at the “Unite the Right” rally last August in Charlottesville, Va.

In fact, James Fields Jr. of Maumee, Ohio, was the suspect. Fields faces a second-degree murder charge in connection with the attack that killed 32-year-old legal assistant Heather Heyer and injured 19 others.

At the time of the attack on Aug. 12, 2017, the Vangheluwes say they were hosting a family wedding at their home when their social media and email accounts were inundated with messages after GotNews published a story that falsely linked Joel to the attack.

“Defendants used the Vangheluwes as political pawns, shifting the blame from alt-right extremists to an innocent 20-year-old boy who never owned or drove the car in question,” the filing states.

GotNews reported it had obtained evidence that Joel, who the outlet described as an anti-Trump drug user, was the owner of the Dodge Challenger. The publication made the tenuous link after searching for the license plate number of the Dodge Challenger and discovering it was under Jerome Vangheluwe’s name. It then scanned social media and leaped to the conclusion that Joel owned the car based on an image of the vehicle found on Facebook.

“Joel likes taking drugs and getting stoned, a look at his social media shows. What [sic] he under the influence when he crashed into the crowd at Charlottesville?” the article stated, according to the lawsuit.

It’s about time these far right operatives faced some consequences for their malicious and reckless behavior. I applaud the Vangheluwes for taking this step; they have a very good chance of winning the suit because they’re not public figures and this was a clear act of pure malice.

At Snopes, reporter Bethania Palma has a quote from the attorney for the Vangheluwes, who’s really not OK with this right wing fake news thing that’s going around:

We’ve all recently heard about this concept of ‘fake news.’ This is the real fake news, trying to tie wrong party affiliations with political acts. Jerome Vangheluwe sold the car years before the attack, and the car had passed through multiple buyers. Both of my clients are residents of Michigan, and the car in question had an Ohio license plate. The incident occurred in Virginia. There was no credible evidence to even suggest the Vangheluwes were responsible … My clients received death threats and feared for their safety and the safety of their family. The alt-right media was trying to create a narrative that someone other than a member of an alt-right organization was the one behind this terrorist attack.

I see that the Right is fastening onto the FBI’s failure to follow up on on tips about Nikolas Cruz, as the Reason This All Happened.

Here’s what I want to know:

1) How specific was the tip?
2) How many tips do they get?
3) Where would the tip(s) about Cruz go, on the spectrum of all tips received?

I presume these run the gamut from obvious prank calls to “Holy shit! This guy’s about to go kill a bunch of people!” And it’s really easy in retrospect to find all the signs that this was going to happen. Maybe it’s the Scientist in me, but this is an N of 1, and we know what happened. How many others have a similar social media history and history of acting out, but never, ever go kill a bunch of people. Based on my experience of social media, there are LOTS AND LOTS of people out there making threats of all kinds of violence, right down to very specific threats against specific individuals.

Then there’s the question - what would the FBI have done? Come to his door to question him? Almost certainly they couldn’t get a warrant to search his place, and if they did, would they find anything illegal? And if they didn’t find anything, would any of this have prevented him legally buying an AR15? They almost certainly don’t have the manpower to watch every armed grumbler with a history of violent outbursts but no criminal record.

So, what would the FBI have done, even if the tip had percolated up to higher levels?

Where’s the money coming from? GOP has dismantled every option. THAT is where the fingers need to point and stay pointed.

I pointed out he was advocating getting rid of any mechanism for doing that.

He said, “No, I’m not”.

That pretty much was the end of that conversation.

i advocate a sort of no fly list system
with specific rules about how someone gets put on it

i think once you’re on, once you lose your 2A privileges, you don’t get off

when im going to privately sell a gun i have to be able to determine if the person buying is allowed to own. otherwise the whole system is a sham.

i should keep that proof, so i can demonstrate later that i took reasonable care when i sold

i am not required to do a check. its my risk not to. and i may be judged negligent later and responsible for whatever that gun does, because i gave up (lost) control of it recklessly. i did not take even minimal reasonable care.

i’d be an idiot to do a check and not keep the proof - but i can do that too.

there must be a system. its use is strictly voluntary. and you accept the consequences of your decisions.

finally - with whatever i learn or dont from the check, i am not required to sell you a gun - even if im a dealer. you may have the “right” to keep and bear. No one has an obligation to sell to you. (public accommodation rules excepted)

I will always prefer a nice brown barley malt, a fair bit of hops and enough time to smooth the rough edges (which is what hops really gives it :)

Michael Pollan’s “The Botany Of Desire” has a great section on that. The eating and baking varieties we all know are all clonal, grown from cuttings taken from happy accidents of pollination and breeding. Trees grown from seeds are a total crap shoot, often nothing even remotely like the sweet, crispy apples they came from.

But good for cider!

I had a really interesting sampler of Scottish beers using a mix of hops and older bittering agents. One was spruce tips, and it was actually alright. Another was some variety of seaweed…which I don’t remember being remarkable (which is crazy in its own right, because—fuckin’ seaweed beer). But then again, I like spruce-y gin and spruce-tip syrup, plus piney-y stuff like juniper and huajiao, so it may just be preference.

It you ever get the chance there’s a Japanese beer brand called Hitachino Nest. They do a beer that’s aged in a spruce cask, and it’s great. Kind of like an unusual IPA.

Ohio has some great apple orchards. Some years the trees are almost breaking the branches are hanging low with so many apples.

I used to do some advertising work for a company that distributed glass, metal and plastic packing such as bottle, cans and other containers.

It was all started on the need to have a supply for their apple orchards cranking out all the cider they made in the fall. Then they started to sell to other Ohio orchards and suddenly they had a good sized business. Then they of course sold to other businesses.

LeBron James has no plans to ‘shut up and dribble’

LeBron James reiterated his position that he will not use his platform as an NBA superstar to just dribble a basketball, saying he will continue to “talk about what’s really important.”

James made his first public comments Saturday since Fox News host Laura Ingraham criticized the Cleveland Cavaliers star for speaking out on the state of race relations in America and his view of the leadership in the White House.

“I will not just shut up and dribble,” James said after All-Star practice. “… So, thank you, whatever her name is. … I get to sit up here and talk about what’s really important and how I can help change kids.”

Ingraham had said James should “keep the political commentary to yourself. Or as someone once said, ‘Shut up and dribble.’”

James initially responded with an Instagram post that contained a photo with the words “I am more than an athlete” and was captioned with #wewillnotshutupanddribble.

“It lets me know that everything I’ve been saying is correct for her to have that type of reaction,” James said of Ingraham. “But we will definitely not shut up and dribble. I will definitely not do that. I mean too much to society, I mean too much to the youth, I mean too much to so many kids that feel like they don’t have a way out and they need someone to help lead them out of the situation they’re in.”

Saying he doesn’t mind being a symbol, James referenced past outspoken sports figures Muhammad Ali, Jim Brown, Bill Russell and Jackie Robinson and said they all were not looking for rewards for their political commentary.

“We know it’s bigger than us. It’s not about us,” James said. “I’m going to continue to do what I have to do to play this game that I love to play, but this is bigger than me playing the game of basketball.”

James also discussed the impact that the new Marvel film “Black Panther” could have on African-American children as a possible inspiration. He then expressed his remorse for the victims of the school shooting in Parkland, Florida, saying there have been too many tragedies like that in the past 10 years without change.

Stocks were up Thursday for American Outdoor Brands, the company that makes the AR-15 rifle used in the Florida school shooting that claimed 17 lives.

The company’s shares closed up 1.49%, netting the company an additional $8.8 million on the day.

The Associated Press reported that accused gunman Nikolas Cruz used a Smith & Wesson M&P15 rifle - a variant of the AR-15 - during his allegedly shooting spree at Marjory Stoneman Douglas High School in Parkland, Florida, on Wednesday.

Both those statements are misleadingly false, aren’t they? “Homicide rates” and “gun bans” don’t exactly correlate, and Switzerland’s “requirements to own guns” would be considered an unacceptably high level of “government interference” by US gun nuts; assuming they knew anything about Swiss laws/customs/practices re firearms*, which is highly doubtful.

Most 19th century western towns prohibited the open carry of firearms. Actual cowboys and farmers often did carry guns on the job, as many (including my humble self) still do, but it would not cross their minds to head into town with the iron still on their hip. In the real Dodge City Kansas, arriving cowboys were required to turn their guns in at the town marshal’s office and pick them up on the way out. Violators were fined, jailed, and sometimes shot down in the streets. Yet the routine display of the big handgun in its holster is an integral part of nearly every TV western, every trip to the general store, the sheriff’s office, the telegraph station; even churches, weddings, and funerals required a holstered handgun.

I read your suggestion that current assault rifle owners (particularly of AR15 rifles or derivatives) might begin to recognize that the they don’t actually need to own such a weapon and possibly even turn them in.

I happen to own two similar weapons myself, and I readily admit that I do not need them. They are pleasurable to shoot, which I do not do all that often. Other than that, they lay in the top of my closet. My Revolutionary War reproduction Brown Bess musket gets far more use.

It also happens that I am a school teacher. I spent yesterday afternoon in class assuring 14 year old students it was okay to text their parents that all was well, after I observed several students earlier in the day replying to anxious missives from parents.

I told them their parents were a little freaked out. I told them I was a little freaked out also.

I did not tell them that I was livid with anger. I did not tell them I had not been able to sleep the last two nights because I was alternating between depression and rage. I did not tell them that otherwise rational adults were now insisting that I and other teachers should now bring handguns into our classrooms and pretend to be infantrymen on a potential battlefield in school every day, because it was even more unthinkable to simply not sell any more weapons of war to civilians!

I used to be a soldier. I served, mostly in the US Army Cavalry, from 1992 to 1996. I was on guard duty at the front gate of our post in Tongducheon, South Korea, the night we went on war alert that we getting read to attack the North Korean reactor complex at Yongbyon. I carried an M60 machine gun while I was there, and I was the door gunner for my helicopter. That was a long time ago: before I was badly and permanently injured working on a civilian jet passenger liner, before earning geology and history degrees, before earning a lot of grey in my hair. I turned 50 last year.

Like I said, I enjoy shooting my rifles. I also said they mostly sit in my closet untouched. I don’t need them. Nobody needs them. Many other people, like me, simply enjoy the hobby aspect of shooting them as I do. However, Red Dawn Wolverine fantasists who dream of Civil 2.0, and unreconstructed racists fending off the hordes of Michael Brown teens who menace their fever dreams are a very large part of the equation. They are the ones who largely drive the extreme margin of the gun rights debate.

In any event, we know the truth. The truth is the gun lobby, many of their supporters, and their lap dogs in government will willingly sacrifice our children…my students…and me as well…to their atavistic god of American military myth rather than just live with only a lever action rifle or a bolt action deer gun. This is the sheer insanity of it. They want me to go back to being a soldier. They want my colleagues who never even went to boot camp to now be soldiers with me on the new classroom battlefield so that they do not have to even stop selling any more of these things. This is how deranged and perverse our debate has become.

It won’t do any real good to unilaterally turn my weapons into police at this point, although I would do so if that is what we decide to do as a society without hesitation. Few other owners of similar weapons would do so. All too many have been prepping themselves for their guerilla war against gub’mint tyranny for 35 years and they will certainly not cheat themselves of their shabby uprising if we hand them the opportunity.

However…

We cannot dissuade ourselves that we must, at the very least, stop additional sales now! No more AR platforms in gunshops. No more Kalashnikovs or H&K carbines or whatever. No more detachable magazines of more than ten rounds. No more pandering to the nuts who dream of their own movie that they star in every night. No more attention paid to their sophist arguments on how to define what an assault rifle means, or insistence that killers will always find a way, or that silly liberals don’t know the difference between a real military weapon and (insert whatever AR clone here)…*

My 17 year old son is not up for the gun sacrifice lottery. My students are not up the gun sacrifice lottery. My colleagues and I are not up for the gun sacrifice lottery. I am not going to go back to being a door gunner in the hallway of my school so that an 18 year old unstable kid, or a 30 year old angry man, can buy a weapon, come to my place of mentorship and learning and then kill my students and my friends.

I’m not going to do that for you, fellow gun owners. I’m not going to do that for you, gun makers. I did my rifle carrying bit for the US of A. I am not going to do it now. My colleagues are not going to do it now. My students deserve a classroom where the threat is kept away in the first place. So do I and every other teacher.

We are not going to shut up. We are not going to go away. We are not going to be nice or polite. That cow left the barn.

We are angry, and we are going to make sure you know that we are angry. We are going to make sure you know that your right to buy a weapon of war does not outweigh our right to live and work in our classrooms. I can already hear the cries of hypocrisy directed at me, and maybe they are right. But I say I don’t need the assault rifles I have, and I say that if we all need to turn them in, then we need to turn them in. That is a decision we need to discuss and make. We already banned sales once before however, and we can do that right now if we have the will. Whatever we do from here, though, we are going to be in your faces and telling you that it is time to stop the insanity.

I mentioned previously in conversation with Wendall that I recently listened to a podcast featuring an expert on Russian and Chinese journalism. Actually, I still had about 15 minutes to go. I just got done. She explained that for a long time now the goal in Russia has been to just create an “alternative reality” with many “journalists” just trying to survive by doing Putin’s bidding. They first exported that to neighbors like Ukraine and now have brought it to the US where we already have a major player, Fox, (that’s my edit) that has been doing the same for years. She recommended a book called Losing Pravda. I’m going to pick it up. The thesis is that in late Soviet period and early 1990s there was a push for truth, but that’s hard to come by now. The podcast guest says that she personally knows several couples in Russia who have divorced over fake news….

We had this last week.

Every time I watch it I have to remind myself that it’s not just the characters choking up at La Marselleise because they didn’t know if the French Republic is gone for good.

The extras in that scene were French refugees in the U.S. for the duration; it was real for them. And the audiences who saw it in the theater as a first run movie. None of them knew if France would ever be liberated.

I picked up the 40th anniversary edition of Close Encounters of the Third Kind in 4K UHD with HDR - I swear the BluRay was BETTER that what I saw at the theater….

He was just reëlected, so getting voted out will be a while.

He’s old enough he might die in office, though.

As for impeachment, that doesn’t apply to Senators or Representatives. In theory his colleagues could throw him out, but I wouldn’t hold my breath on that one.

I’m not so sure… I think in following the money from Russia, that we’re going to be discovering a good portion of it ended up being filtered/washed/laundered into GOP campaign coffers and we’re also going to find out (I think) how much the GOP coordinated with outside agencies (i.e. Russia) on their social media campaigns in targeting voters.

I would also not be shocked to find out that because of his actions (and Ryan’s) that they could very well be found guilty of treason by aiding and abetting activities that they knew about and let pass because they were beneficial to their agenda…

specific crimes could probably be found under campaign finance law violations, Hatch Act and the crimes of not reporting crimes against the country that they knew were taking place.

You could be right though, Bobby Three Sticks may not have Mitchy on his agenda, but right now, there’s not a lot I wouldn’t say that the GOP is not guilty of.

Gunsmoke held the body count record for some time. We were still getting it on AFKN in B&W in 1981.

Well, to be fair, the opening sequence of Gunsmoke opened with the classic fast-draw-shootout on Main Street (a scenario that rarely if ever happened in the real West), so one guy was gunned downed before each episode actually started, and the show ran for, what, something like 24 years? I don’t know if it’s true, but I heard that the actor who played the bad guy in that confrontation, who is barely visible and is on screen for maybe five seconds, made a not-so-small fortune for the royalties from that single gig alone.

In a bizarre cosmic coincidence, I was surfing the cable menu earlier tonight and came across Gunsmoke on an extremely obscure outlet, and watched Marshal Dillon for probably the first time in 50 years. And yeah, he killed a guy on the street in a sixshooter contest.

Hm. I live in what’s termed “The Old West.” My town had a marshal for many many years (until about 2010). No marshal here ever killed anyone, and only once called up a posse.

Local crime story behind the hide bar:

A couple of people who’d robbed a bank in Omaha were traveling up the then-unpaved US-26 and stopped at the S&S restaurant in Oshkosh [still in business today] to rob it.

They went in with a rifle and pointed it at the proprietor yelling at him to open the till. The proprietor was deaf, and could not hear them. They killed him, and robbed the till.

His wife noted the direction the car sped off (west) and called the marshal in my town to try to stop them (along with calling the Garden County Sheriff in her county).

The marshal here gathered a posse of anyone who could hold a gun, and blocked US-26 at the town line. When the murders reached our town, they faced about fifty rifles and shotguns, and immediately surrendered. The village held them in our lone jail cell until the Morrill County Sheriff could come by and pick them up to return them to Garden County for the murder charge.

As far as I know from my town’s history, that is the only time the village marshal ever used a gun at all (other than hunting or something).

You know that a decent majority of Americans favor stricter gun control laws.

We know that Republicans received nearly $6 million in campaign contributions in 2016 from gun rights groups including the NRA.

Everybody sees that you aren’t willing to do anything to keep guns out of the hands of people like Nikolas Cruz. Suggesting more guns in schools is a worthless solution.

We also see that your reliance on “thoughts and prayers” is a meaningless gesture. We see that you are not acting to save lives.

Bring back the assault weapons ban that was passed in 1994 with the support of Ronald Reagan. DO IT NOW! DO IT TODAY!
