Basically nothing is surprising anymore.

And since I blew it on the tweet about “left wing media setting Sean up” I think it best to go to the let it all play out method of watching this stuff.

But it is always fun to speculate…

Very true, but most good/smart lawyers would do a conflicts check and if someone came to them later on the same case would refer it out to avoid even the potential. I make it a general rule not to tell anyone about the specifics of any conversation I have that even comes close to triggering the privilege.

But the existence of the attorney-client relationship is not privileged and confidential - in part because you can not assert the privilege unless it is known to exist. This would be like saying the marital privilege exists (one spouse can not be compelled to testify against the other) but not disclosing that you are married.

The taint team will review the documents related to those conversations (assuming Cohen kept proper records), and if they are privileged, they will not be turned over to the investigators/prosecutors.

I suppose it might depend on the area of practice. Someone drafting estate plans is probably far less likely to use it. I’ve been mostly a litigator, and worked on things like landlord-tenant warranty of habitability cases, employment law (harassment, wage and hour, etc), some mortgage fraud cases, and then some general business contract disputes… profusive use of profane language was the only way to deal with it (well that and the bottle of vodka in my desk drawer).

Ok, we need to break this down. Hannity is saying that he was not Cohen’s client. But that he had asked him about legal matters for his input and perspective. If some sort of privilege applied, it would either be under the attorney-client privilege or under the journalist source privilege. But by making these conversations public, then he’s just waived the source privilege and the only other privilege would be attorney-client. But by saying he wasn’t a client, he has effectively waived the privilege (if it existed)…

Exactly. He might be technically correct but it’s also pretty obvious that he’s had dozens, probably hundreds of non privileged conversations with Cohen about Trump, Clinton and the election. Their texts, emails and other correspondence, if it still exists, will be a treasure trove implicating Sean and FOX in creating the narrative smokescreen around Russian collusion. Everything between Cohen and Hannity’s producers just became fair game, everything shared with Roger Stone, just brutal. Murdoch’s entire business empire is, at least theoretically, now at risk.

A former Daily Progress photographer’s picture of a car slamming into a crowd of counter-protesters after the Aug. 12 Unite the Right rally in Charlottesville has won the 2018 Pulitzer Prize for breaking news photographs.

The photo, taken by then-staff photographer Ryan Kelly on his last day at the paper, showed the car hitting the crowd and tossing people into the air.

Judges gave Kelly the award “for a chilling image that reflected the photographer’s reflexes and concentration in capturing the moment of impact of a car attack during a racially charged protest in Charlottesville.”

The crash just south of the Downtown Mall killed 32-year-old Heather Heyer and left more than a dozen injured.

Rep. Gerry Connolly (D-Va.) said Monday that Fox News should fire Sean Hannity following the revelation that he is a client of President Trump’s personal attorney, Michael Cohen.

“I think he is so into this like a pig in the mud he can’t get out of it. And I think he deserves to be fired. His word can never again be trusted,” Connolly said on CNN.
Connolly said Hannity’s involvement with Cohen represents a conflict of interest, calling it “a big stain on Hannity and Fox News.”

He also hit Hannity for spreading conspiracy theories about former President Obama, former Secretary of State Hillary Clinton and slain Democratic National Committee staffer Seth Rich.

According to Haberman watching those that surround Trump is key. She described it as being like flying when there’s a problem on the plane. If the flight attendants are calm, then everything is fine. When they’re panicking, however, it’s time to worry. Haberman explained that those that are around Trump are panicking for the first time.

“The lawyers are not calm,” she said. “That is your hint about what is going on here. It may not end up mattering, but there are few people who know as much as Michael Cohen. It is true he has been he very loyal to the president over a long period of time. It is also true that the president has often treated him pretty poorly as he often treats employees. It is hard to ask people to give up their life for you.”

1. Two of Cohen’s clients will crash and burn. Neither is called trump
2. The ONLY way trump will leave the white house is in a box, or being voted out - the latter may take some time - he will not go quietly if defeated at the polls. Expect 2000 style recounts and appeals to SCOTUS

Consider this: We in the First World love elephants, and rightly so. They’re amazing creatures, intelligent, powerful, just generally awesome. We think it’s terrible if even one gets killed by a hunter.

However, elephants tend to live in poorer countries, where humans are expanding their range. Elephants are next to impossible to keep out of farms. Elephants eating the food you are growing to support your family are not awesome. They’re awful.

If you’re a poor country with limited revenues, limited economic opportunities, and substantial elephant/human space conflicts, you could spend your limited resources trying to relocate elephants. At the same time, there are people willing to pay money to, shall we say, address the situation. They’ll not only pay to shoot an elephant, they’ll pay for a guide, accomodations, etc.

If you hate trophy hunting - and I’m not defending the people who do it! - you need to find a way to make live elephants more valuable to poor countries than dead elephants.

SAN DIEGO (AP) — The Trump administration said Monday that California Gov. Jerry Brown rejected terms of the National Guard’s initial deployment to the Mexican border, but a state official said nothing was decided.

“The governor determined that what we asked for is unsupportable, but we will have other iterations,” Ronald Vitiello, U.S. Customs and Border Protection’s acting deputy commissioner, told reporters in Washington.

Brown elicited rare and effusive praise from President Donald Trump last week for pledging 400 troops to the Guard’s third large-scale border mission since 2006.

But the Democratic governor conditioned his commitment on his state’s troops having nothing to do with immigration enforcement, even in a supporting role.

Brown’s announcement last week did not address what specific jobs the California Guard would and would not do and or answer the thorny question of how state officials would distinguish work related to immigration from other duties.

Vitiello said the governor decided California will not accept terms of an initial troop rollout for the state that was similar to plans for the other three border states, Arizona, New Mexico and Texas.

According to two U.S. officials, the initial jobs for those troops include fixing and maintaining vehicles, using remote-control surveillance cameras to report suspicious activity to U.S. Border Patrol agents, operating radios and providing “mission support,” which can include clerical work, buying gas and handling payrolls. The officials spoke to The Associated Press on condition of anonymity because they were not authorized to discuss the matter.

California National Guard spokesman Lt. Col. Thomas Keegan said “state officials have not rejected anything” since Brown proposed a formal agreement Wednesday with the Homeland Security and Defense Departments that prohibits any involvement in immigration.

“The federal government has not yet responded,” Keegan said in an emailed statement.
