Wow.

They fought tooth and nail to avoid revealing it in court today, but the judge ordered Michael Cohen’s attorneys to say out loud the name of the “mystery third client” they were trying to hide — Fox News demagogic slab Sean Hannity!

UPDATE at 4/16/18 1:00:48 pm by Charles Johnson

Hannity’s already out with a ludicrous excuse…

A source familiar with Hannity’s legal relationship with Cohen told CNN that “Michael Cohen has never represented Sean Hannity in any matter involving a third party. Hannity has occasionally asked Mr. Cohen questions concerning the law that Mr. Cohen indicated would be privileged.”

“And that’s why we fought tooth and nail to keep this hidden, because we didn’t want to waste the court’s time.”

“I never paid legal fees” doesn’t mean Hannity didn’t compensate Cohen in other ways, like via what he talked about on his show.

He’s digging the hole deeper.

If Hannity never paid Cohen, then there is no Attorney Client privilege because Sean was not technically a client, right?

Also, as I pointed out at the end of the last thread, a client doesn’t even need to pay an attorney for the attorney-client relationship to exist. It can form, even for limited purposes, based on a five minute conversation.

The next generation of legal textbooks, especially on ethics and presidential power, is going to be a doozy.

Then again, Trumpworld’s going to generate so many legal cases that we’ll have our choice to pick from the identify pretty much every basic legal concept, from evidence and civil procedure to criminal procedure, ethics, contract law, torts, and constitutional law.

And before this is over, property law and trusts and estates.

I asked at the end of the last thread if Hannity allowed his name to be used to count as a client and make Cohen a “real” lawyer. You know to help a brother out.

Basically nothing is surprising anymore.

And since I blew it on the tweet about “left wing media setting Sean up” I think it best to go to the let it all play out method of watching this stuff.

But it is always fun to speculate…

Very true, but most good/smart lawyers would do a conflicts check and if someone came to them later on the same case would refer it out to avoid even the potential. I make it a general rule not to tell anyone about the specifics of any conversation I have that even comes close to triggering the privilege.

re: #48 b.d. (Untruthful Slime Ball)

Here’s the thing, those conversations are most likely privileged and confidential. That is always going to be the assumption. But the existence of the attorney-client relationship is not privileged and confidential - in part because you can not assert the privilege unless it is known to exist. This would be like saying the marital privilege exists (one spouse can not be compelled to testify against the other) but not disclosing that you are married.

The taint team will review the documents related to those conversations (assuming Cohen kept proper records), and if they are privileged, they will not be turned over to the investigators/prosecutors.

I suppose it might depend on the area of practice. Someone drafting estate plans is probably far less likely to use it. I’ve been mostly a litigator, and worked on things like landlord-tenant warranty of habitability cases, employment law (harassment, wage and hour, etc), some mortgage fraud cases, and then some general business contract disputes… profusive use of profane language was the only way to deal with it (well that and the bottle of vodka in my desk drawer).

Ok, we need to break this down. Hannity is saying that he was not Cohen’s client. But that he had asked him about legal matters for his input and perspective. If some sort of privilege applied, it would either be under the attorney-client privilege or under the journalist source privilege. But by making these conversations public, then he’s just waived the source privilege and the only other privilege would be attorney-client. But by saying he wasn’t a client, he has effectively waived the privilege (if it existed)…

In other words, you done fucked up a-a-ron.

My personal takeaway is that Lumpy has an extramarital affair problem that he hired Cohen to make go away, and that hasn’t been revealed yet. Am I right? Or is it just simply Lumpy has been pimping Cohen on his show without disclosing he’s been working with Cohen.

Because I really, really want it to be the first one.

So Cohen’s claiming Hannity is a client, a client whose name he wanted to protect, but Hannity’s saying it was all just answering legal questions of no great importance.

Okay.

Quick question for the Lizard Lawyers - don’t people ask you legal questions ALL THE TIME, when they find out you’re a lawyer? It’s like finding our somebody’s a doctor - you ask them about medical stuff, hoping to get access to free professional expertise.

It’s all that and more. Don’t know if it’s an extramarital affair that Cohen was fixing for Hannity, or whether Hannity, Trump, and Cohen tried to use Cohen as the go-between to try and protect their coordination of messages about Mueller and the Trump investigations.

If it’s the latter, Trump, Hannity, and Cohen are truly fucked.

Although, as an aside, it’s kind of funny that they’re eliminating the character of Frank Underwood, a thoroughly vile and reprehensible person, because he was portrayed by Kevin Spacey, who as it turns out is a thoroughly vile and reprehensible person.

Exactly. He might be technically correct but it’s also pretty obvious that he’s had dozens, probably hundreds of non privileged conversations with Cohen about Trump, Clinton and the election. Their texts, emails and other correspondence, if it still exists, will be a treasure trove implicating Sean and FOX in creating the narrative smokescreen around Russian collusion. Everything between Cohen and Hannity’s producers just became fair game, everything shared with Roger Stone, just brutal. Murdoch’s entire business empire is, at least theoretically, now at risk.

Serial sexual misconduct was a bridge too far in the O’Reilly case. I think that unless there are similar revelations about Hannity - and maybe there are, since “fixing” such things is Cohen’s specialty - he won’t be fired.

Given that was his assignment for his other two clients, it isn’t unreasonable to expect that he did the same for his third client.

I seem to recall some time early last year rumors that a woman or women were going to come forward with accusations of sexual harassment against Hannity. This was right before he got in hot water over Seth Rich.

A former Daily Progress photographer’s picture of a car slamming into a crowd of counter-protesters after the Aug. 12 Unite the Right rally in Charlottesville has won the 2018 Pulitzer Prize for breaking news photographs.

The photo, taken by then-staff photographer Ryan Kelly on his last day at the paper, showed the car hitting the crowd and tossing people into the air.

Judges gave Kelly the award “for a chilling image that reflected the photographer’s reflexes and concentration in capturing the moment of impact of a car attack during a racially charged protest in Charlottesville.”

The crash just south of the Downtown Mall killed 32-year-old Heather Heyer and left more than a dozen injured.

Evening Lizardim from the post-snowpocalyptic wild north country. I would like to take this opportunity to remind everyone that no matter how much it may seem necessary, or a fun idea, please don’t try to drive when there is a blizzard advisory. I passed a car this morning that had slid off the road, down a steep 15’ embankment, and ended up on the surface of a (thankfully still frozen) lake. Just Don’t Do It, Folks.

How go things among the lizardfolk? I saw this headline on the TVs at my new workplace and I had to surreptitiously pick my jaw up off the floor as I was being guided around the facility. I TOLD YOU Hannity had some major skeletons in the closet that were related to why he so vehemently went after Mueller and Co. It seemed way too personal to be just another right-wing nutjob lashing out.

Again? AGAIN?

Rep. Gerry Connolly (D-Va.) said Monday that Fox News should fire Sean Hannity following the revelation that he is a client of President Trump’s personal attorney, Michael Cohen.

“I think he is so into this like a pig in the mud he can’t get out of it. And I think he deserves to be fired. His word can never again be trusted,” Connolly said on CNN.
Connolly said Hannity’s involvement with Cohen represents a conflict of interest, calling it “a big stain on Hannity and Fox News.”

He also hit Hannity for spreading conspiracy theories about former President Obama, former Secretary of State Hillary Clinton and slain Democratic National Committee staffer Seth Rich.

in a Monday conversation about the FBI raid of President Donald Trump’s attorney Michael Cohen, New York Times reporter Maggie Haberman explained why this incident is different.

According to Haberman watching those that surround Trump is key. She described it as being like flying when there’s a problem on the plane. If the flight attendants are calm, then everything is fine. When they’re panicking, however, it’s time to worry. Haberman explained that those that are around Trump are panicking for the first time.

“The lawyers are not calm,” she said. “That is your hint about what is going on here. It may not end up mattering, but there are few people who know as much as Michael Cohen. It is true he has been he very loyal to the president over a long period of time. It is also true that the president has often treated him pretty poorly as he often treats employees. It is hard to ask people to give up their life for you.”

From last August:

From January:
observer.com

Given this, we need to ask questions about Hannity’s relationship with the Kremlin, considering his track record of pushing rancid Russian disinformation on his Fox News program. Hannity is a propagandist, not a journalist, by his own admission, but if he has served as a witting conduit for lies crafted by Russian spies, Fox News needs to explain why they are airing Kremlin Active Measures aimed at the American public and calling it “news.” Intelligence Community friends have told me that Sean Hannity has been under counterintelligence investigation for some time, based on his clandestine ties to Moscow. Now we know why.

re: #325 KGxvi

more from the wikipedia page:

The following month, Clinton’s choice of federal judge Kimba Wood for the job was leaked to the press, but within a day it became known that she too had employed an undocumented immigrant to look after her child. Although Wood had done so at a time when this was legal, and had paid Social Security taxes for the worker, the disclosures were enough to cause the immediate withdrawal of Wood from consideration.

God, if only things were that simple again. Also, it’s comforting (on some level) to know that we have always been this stupid.

And then the militia types for years blamed Clinton and Reno for not only the Davidians’ self-immolation, but also for the Ruby Ridge mess that happened under GHWB. Why? Because that’s how they remember it, just like they remember that deep, deep recession that lasted the first 2 years of Reagan’s first term as happening under Carter.

Related is how the Obama administration got attacked for the memo that said far right groups were likely to recruit veterans. The right wingers in Congress and the media spun it as the Obama administration hates vets and thinks they’re dangerous. They were right that veterans are prime plucking for right wing extremists. We-e-ellll…..

Consider this: We in the First World love elephants, and rightly so. They’re amazing creatures, intelligent, powerful, just generally awesome. We think it’s terrible if even one gets killed by a hunter.

However, elephants tend to live in poorer countries, where humans are expanding their range. Elephants are next to impossible to keep out of farms. Elephants eating the food you are growing to support your family are not awesome. They’re awful.

If you’re a poor country with limited revenues, limited economic opportunities, and substantial elephant/human space conflicts, you could spend your limited resources trying to relocate elephants. At the same time, there are people willing to pay money to, shall we say, address the situation. They’ll not only pay to shoot an elephant, they’ll pay for a guide, accomodations, etc.

If you hate trophy hunting - and I’m not defending the people who do it! - you need to find a way to make live elephants more valuable to poor countries than dead elephants.

SAN DIEGO (AP) — The Trump administration said Monday that California Gov. Jerry Brown rejected terms of the National Guard’s initial deployment to the Mexican border, but a state official said nothing was decided.

“The governor determined that what we asked for is unsupportable, but we will have other iterations,” Ronald Vitiello, U.S. Customs and Border Protection’s acting deputy commissioner, told reporters in Washington.

Brown elicited rare and effusive praise from President Donald Trump last week for pledging 400 troops to the Guard’s third large-scale border mission since 2006.

But the Democratic governor conditioned his commitment on his state’s troops having nothing to do with immigration enforcement, even in a supporting role.

Brown’s announcement last week did not address what specific jobs the California Guard would and would not do and or answer the thorny question of how state officials would distinguish work related to immigration from other duties.

Vitiello said the governor decided California will not accept terms of an initial troop rollout for the state that was similar to plans for the other three border states, Arizona, New Mexico and Texas.

According to two U.S. officials, the initial jobs for those troops include fixing and maintaining vehicles, using remote-control surveillance cameras to report suspicious activity to U.S. Border Patrol agents, operating radios and providing “mission support,” which can include clerical work, buying gas and handling payrolls. The officials spoke to The Associated Press on condition of anonymity because they were not authorized to discuss the matter.

California National Guard spokesman Lt. Col. Thomas Keegan said “state officials have not rejected anything” since Brown proposed a formal agreement Wednesday with the Homeland Security and Defense Departments that prohibits any involvement in immigration.

“The federal government has not yet responded,” Keegan said in an emailed statement.

I can actually see tRump doing it when he loses in 2020. That’s if he makes it till 2020 and just refuses to leave office after being impeached and removed—and he’d have 40% of the population supporting him in that.
