I guess I’m in a mood to take a break from posting about politics today (and also dealing with iPhone upgrade issues for way too long), because I stumbled across this incredible version of one of my favorite Bob Schneider songs, with a gorgeous string arrangement played by Tosca Strings.

The title of the song is deceptively positive.

They’re desperately trying to unpaint themselves from the corner. I think the idea is:

A.) they realize that the contract is void if there’s no compensation from Trump to Daniels. So they’re trying to tie Trump in to preserve the NDA. This still doesn’t get around the fact that he never signed the contract and repeatedly asserted that he knew nothing about it.

B.) That if the money ultimately came from Trump that the campaign finance limits don’t apply. Unfortunately for them the campaign finance reporting requirements still do apply and Trump never declared these payments.

Can I ask the lawyers here a question about some lawyery stuff that I’m dealing with? I hired a lawyer through an employee-help service at work to do an expungment of a misdemeanor from 15 years ago. It’s the only time I’ve ever been in the court system.

I’ve been given a flat fee by the lawyer plus a few bucks for supplies and a filing fee. How much of the fee is usually paid up front? Is there anything detrimental about paying the full fee up front? Will she feel better about working for me if she’s already got the full funding to move ahead with the case?

The whole case should only take a couple months to (oh please god hopefully) resolve, so it seems like it might be kind of cheap to dole out the fee over every week or two. I hope that the courts can throw their mercy on the stupid mistake I make one time and never again afterwards,

That’s not the point. Either Cohen made a contribution that should have been reported, or Trump did, using Cohen as his agent. At least one is in big (jail-time) trouble, and very likely both.

My guess is that there are things in the papers seized from Cohen that prove Trump paid for it, so he’s getting ahead of that story with his fingers crossed. But there could be all kinds of stuff in there.

Yes, that was exactly the point of his entire spiel. But as I mentioned earlier, that opens up a whole batch of other problems for Drumpf. If it was Drumpf money, it had to be declared. And it should have showed up on Cohen’s returns, also, if it was reimbursed over a calendar year (and Rudy said it was spaced out over time, i.e. from 2016 through 2017).

So, depending on what they filed, even if it had nothing to do with the Campaign money, it should have shown up on both Drumpf and Cohen’s 2016 and 2017 personal tax returns. Because it was, you know, money paid to a third party by Cohen and then reimbursed to Cohen by real money from Drumpf. My understanding is that those transactions had to be declared, or they were both guilty of tax fraud.

So Rudy helped Drumpf by killing the concept that the hush money came from the Campaign and screwed both Drumpf and Cohen by saying that it was “funneled” personal money which I can promise you did not show up on any tax filing.

Let’s all say this together, shall we? “Illegally Laundered Hush Money.”

I read a great article the other day (I forget the source) that analyzed GOP 2018 midterm ads and found the top Democrats mentioned in the attack ads are Obama, Hillary and Nancy Pelosi. Hillary is second, over 3000 ahead of Pelosi.

Also interesting: Obama is feature in over 3900 democratic ads. Hillary is featured in…8.

What this really tells you is the GOP has no strategy except screeching about the same 3 boogeymen they’ve been screeching about since 2009.

Mitch McConnell is sitting on HR 3897, a bill to correct a problem with Gold Star Children having access to military bases for their benefits if their surviving parent remarries (losing access to the base). The bill was introduced by Rep. Don Bacon (R-NE2) and sponsored by four Republicans and four Democrats.

Ensuring access to benefits is not on Mitch McConnell’s radar. As leader of the Senate, he and his cronies don’t give a crap about us.

My opponent says some families have value, while others don’t count. He wants to pit us against each other in order to gain power for himself and kickbacks for his donors.”

And from there, it’s so easy to go to a discussion on the issues voters are labeling most important (health care, economy, etc) and point out how Democratic policies are infinitely superior to what’s coughed up by GOPers.

It makes sense that Trump is worried about Ivanka going down, because on some level even he recognizes that she’s the “best and brightest” of that clan. So Rudy went on TV to tell Trump not to worry about her getting caught up in this mess. But it’s too late.

I know where those buildings are: we had friends who lived in one them a while back: this was one of those BFD “developments” Trump used to crow about for years. The (8? 10?) residential buildings were built on the site of the old Penn Central railyards: he bought the development rights from the bankruptcy trustee for what was basically pocket-change: waited out the inevitable challenges for something like 15+ years, but eventually got the rights to develop the site for residences (and block the river views of the older buildings just inland, but them’s the breaks).

This raises a few possibilities: 1) Cohen is going to get disbarred in the near future; 2) Cohen wasn’t wearing his “lawyer hat” at the time of the payment, thus putting another dent in his privilege claim; or 3) he wasn’t wearing his lawyer hat and he’s still getting disbarred.

Democrats here have a couple of winning issues to run against Republicans.

There was discussion about the idea of “running against Trump” being a bad idea.

Trump’s tariff war with China will likely cause targeted retaliation against soybean farmers in this state, and perhaps corn farmers as well. Once they lose those markets to another nation they’re gone.

In addition, Trump’s trade war with Mexico (wanting to scrap NAFTA) takes away one of the biggest markets ranchers in this state have.

Farmers and ranchers both here are justifiably worried about all this trade nonsense, and it is all self-inflicted by Trump and supported by Republicans. My own representative is trying to straddle the fence (support Trump and distance himself from a trade war with Mexico and China).

His Democratic challenger (yay! we have one this time!) Paul Theobald intends to run on those issues. NE-3 was rated by FiveThirtyEight in the last election as the most GOP leaning district in the nation.

Really, you could read Rudy and Cheeto Benito’s remarks over the last 16 hours as an effort to back the bus over Cohen. They’re saying that while Trump was aware of the payment, they’re implying he only found out because Cohen basically sent a bill for “services rendered” and Trump worked out a payment plan “on the down low” to avoid Cohen’s actions from becoming public. You could read their argument now as the beginnings of an effort to suggest that Cohen extorted money from Trump by saying “I did you a solid, now you do me a solid.”

Josh Marshall’s got a pretty good take from a reader who apparently has experience with anti-corruption enforcement…

now we have Giuliani confirming that this is exactly how Trump and Cohen operated. Hush money to Stormy Daniels is one thing and certainly raises potential serious campaign finance violations, but she is not a public official. What I find most significant about Rudy’s admission is what it says about the nature of the relationship between Trump and Cohen and how it suggests an M.O. for other more serious crimes.

Trump is a major real estate developer in NY who has openly bragged about his ability to cut through red tape and get politicians in his pocket. We now have serious SDNY public corruption prosecutors and FBI agents in possession of a massive amount of electronic data from his bagman. They likely already have all of his financial records as well. And Rudy has now given them the roadmap for how Trump may have laundered bribes through Cohen as purported legal fees or retainer payments. Every invoice Cohen has ever issued to Trump is suspect. Every corrupt payment Cohen has ever made or facilitated to building inspectors, councilmen, pornstars, or whomever can potentially be tied back to Trump. In addition, I suspect Trump and his kids had a false sense of comfort that their communications with Cohen would be privileged. I am convinced this is why Trump and his family are freaking out about the Cohen raid and the possibility he could flip. The SDNY is sitting on the mother lode of evidence and Rudy has given them the connection between purported legal fees and payments by Cohen to third parties.

This is why they’re likely freaking out right now.

Remember when Vanky and Junior almost got indicted for fraud, but were saved when Sekulow had a ‘talk’ with Manhattan DA Cy Vance (along with a campaign contribution)? This graf would bear out the idea that the Trumps thought they were bullet-proof:

In one e-mail, according to four people who have seen it, the Trumps discussed how to coördinate false information they had given to prospective buyers. In another, according to a person who read the e-mails, they worried that a reporter might be on to them. In yet another, Donald, Jr., spoke reassuringly to a broker who was concerned about the false statements, saying that nobody would ever find out, because only people on the e-mail chain or in the Trump Organization knew about the deception, according to a person who saw the e-mail.

They’re freaking because it’s dawning on them that the law does apply to them.

(Also, SDNY. Here’s hoping for a massive asset seizure.)

if you paid a retainer, thats income to cohen - did he report it? if cohen paid out of those funds, then it’s still cohen’s personal disbursement

if it was “through reimbursement” - did you know at the time of the disbursement to daniels that this was being done? did you agree? did you receive an invoice from cohen for reimburseable expenses?

as we understand this “retainer” was structured after the 130k was paid was it your intention to make cohen financially whole with regards to this transaction and the 130k to have been a disbursement from you?

finally, and to repeat, is there any invoice or documentation from cohen or on your payments that separately designate retainer fees for professional services from the reimbursement of the 130k?

im not even going to go into when and how did you make these payments and does mr cohen have contemporaneous deposit records that will agree?

Things like “All of them, Katie” are memes…I haven’t seen a shop for that. Memes are designed to get a certain relatively simple idea across easily and quickly, and to reinforce that idea in those who already have that idea.

They can be done in text, visual or audio or some combination.

I first heard the word “meme” from, believe it or not, Richard Dawkins. This was back in the late 1980s, way back before his head expanded. He presented this documentary, on BBC2’s “Horizon” science series, about evolutionary biology. I’m pretty sure this documentary is YouTube somewhere. This would be around the time of his book “The Blind Watchmaker”.

In one segment, he has a simple evolutionary model running on a computer- this being the UK in the late 80’s, it’s an Acorn BBC Master 128. After this, Dawkins points out, that, if you can demonstrate evolution in what we would today a virtual environment, then evolution does not necessarily need to apply to purely physical attributes, it can also apply to abstract concepts, such as thoughts and ideas. He refer to these evolutionary traits as memes. (Dunno if he he came up with the word, but he was certainly using it like he owned it in his books of the time.)

So that’s how I understand the word: basically an idea or concept subject to evolutionary selection that manages to catch on. Doesn’t matter the format- it could be argued any religion or political stance is a meme.

Of course, the thing about memes as evolutionary traits is that most evolutionary traits are ephemeral in the long run. In terms of memes, “Maybe we should be nice to each other” seems to have held up pretty well. Not too sure, on the other hand, about Rick-Rolling.

Indeed, most of the memes you hear about don’t actually last even the short term. Which is exactly how you expect it to work in evolutionary terms. Hence I observe all those right-wing memes being subsumed into a cultural evolutionary process, and spat out not long afterwards, and I have to bite my lip when they go on about evolution being a myth.
