Donald Trump, Looking Guiltier Than Ever, Announces on Twitter He Has “The Absolute Right” to Pardon Himself

Our so-called president is ranting away like a lunatic on Twitter again, as he feels the walls closing in. Today he announced to the world that he has the “absolute right” to pardon himself. “Numerous legal scholars” agree!

While the US constitution does not seem to place limits on who the president may pardon, “numerous legal scholars” do not actually agree with Trump on this. The prevailing opinion is that nobody really knows; it’s never been tested in court, since we’ve never had a president so thoroughly corrupt as Donald Trump.

However, in the bad old days of the Nixon presidency, the Department of Justice issued a statement that directly contradicts Trump’s rant.

Under the fundamental rule that no one may be a judge in his own case, the President cannot pardon himself.

And the constitution does clearly state that the pardon power does not apply to cases of impeachment.

…he shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.

Trump should consider that accepting a pardon is an admission of guilt. The fact that he’s talking about it at all shows where this is headed.

Members of the House or Senate cannot be impeached. They can be expelled by a two-thirds majority vote of the relevant branch of the legislature. Ryan is safe.

All other president’s justice departments do not count.

Preet Bharara yesterday:

“I think if the president decided he was going to pardon himself, I think it is almost self-executing impeachment. Whether or not there is an argument that is not what the Framers could have intended.”

The obvious problem with Trump pardoning himself is that it sets up a self-reference paradox where he turns himself into a kind of legal singularity. His lawyers have already stated in that letter to Mueller that Trump is metaphysically above the law while he’s President and since pardons are exclusively defined in the Constitution as being for “Offenses against the United States” he’d be officially excusing himself as head of the government for acts intrinsically damaging to the country. In a way it even goes beyond the imperialistic “l’etat c’est moi” and instead just says “there is no State there is only me.”

The Prime only content is I’d guess only about 5% of their stuff, mostly weekly big think pieces. They’ve had Prime for about 5 years, so obviously you can be a frequent site reader and not even notice. YMMV. Pax.

I don’t go there nearly as often as I come here or other sites.

My gripe is not the prime membership per se, it is the hundred-word essay you have to give to justify your poverty to them.

I said my piece to them, I presume they will either ignore it or respond back.

Back in 1974, Watergate special prosecutor Leon Jaworski issued a subpoena ordering Richard Nixon to turn over some papers and tapes relevant to the investigation. Nixon turned over some material, but not all, hoping that would satisfy Jaworski. It did not. Nixon’s lawyer, James St. Clair, went to the DC Circuit, and specifically to Chief Judge John J. No cell phone here. I do have Bluetooth software on my computer, but I don’t know what it does.

As I promised last night, I called both Senators Murray and Cantwell’s offices this morning. I had pretty much the same discussion both places. I was assured that this was at the top of their concerns right now and that a delegation was one of the things being considered.

That ex-sailor is going to get nowhere. Even if Obama was involved in his criminal case, a president cannot be civilly sued for actions taken while he is in office. (Nixon v Fitzgerald, 1982, clarified by Clinton v Jones, whic allows for civil suits against the president for actions taken before he was president). In other words, the president has absolute immunity against civil lawsuits for official actions.

ETA Obama was likely not involved at all.

I’m not sure how that works in a state legislature. In the federal legislature, representatives and senators are issued lapel buttons that identify them as a member of the US House or Senate.

If the state legislator failed to wear some sort of identification (a badge or something like the lapel buttons), or have some sort of identification card, that might justify a search (up to the point the guard determines the legislator is in fact a legislator).

That would be the only instance I can see where the case would not be harassment (it is quite possible not every guard knows who every legislator is).

“You don’t look like a legislator,” the officer reportedly said, then clarified: “You look too young.”

I suppose she might take that as a compliment.

Once when I was on a midnight watch at NAS Oceana, I denied entry to the base executive officer when he tried to enter our building. My supervisor (a senior chief in another room) heard the conversation and immediately started dressing me down. The XO told him to stop, that I had done precisely what I was supposed to do (challenge anyone who did not have proper identification and who I did not personally know).

That’s the whole point of Trump’s pardon-gig. He’s sending messages to the likes of Manafort that they can go ahead and do what is needed because in the end they will get a get-out-of-jail card.

The logical response to a Manafort pardon is for the prosecutors to try his case in the media, especially if the pardon comes before any trial. That may start to scare Congressional Republicans into thinking of their reelection chances as affected by Trump’s crimes.

Before Trump, one usually had to be sentenced and 5 years had passed since the sentencing to be considered.

This business of making the norms more explicit isn’t really helpful. By the time you’re seriously thinking of writing down “the president cannot pardon himself for his own crimes, nor can he use pardons to block investigations of his own crimes”, you’ve already lost.

Democracy dies when enough voters want a dictatorship, no matter what has been written down, and the US is very close to that tipping point with the total corruption of the Republican party.

He was supposed to put up $10 million bond. He hasn’t been able to provide sufficient assets. That’s due in part to fact that so many of his properties are collateral against other properties already in dispute.

And now it looks like the judge can revoke the bond, which means he loses the money he was able to put up.

Charles, I have to disagree. Pence is a weirdo and not many people in politics really like the guy. Have you really heard anyone say anything about him that is positive since January 2016?

Indiana is a conservative state and he was on his way to the dung heap there before Manafort helped recommend him as VP. I have a feeling that was done because he is a lightweight and wouldn’t be any kind of hindrance or threat to Trump.

And a savvy politician doesn’t try to force through legislation against same sex marriage as Governor that makes you hated by 2/3 the state and the business community. A move the state’s largest newspaper had to call out and tell him to stop it before you kill the state’s businesses and education facilities. A Republican paper.

I think he can be dealt with. Also, he is going to be stained by Trump too. He would be lucky to get anything done in the remaining time in office and I think he would have a hard time running for president. Where was he in 2016 anyway? Why wasn’t he running then if he was such a hot shit Republican?

Trump has got to go. And his going will send a message to America to be more focused on a decent President for the future. And it is going to deeply hurt the Republicans politically.

Here’s why: New York has laws that closely mirror the federal ones Cohen stands accused of breaking. Under the state’s double jeopardy statutes, New York prosecutors couldn’t go after Cohen if Trump pardoned him for a specific federal crime. But they could go after him for related ones.

Take federal wire transfer and banking laws, which Cohen may have broken if he lied about the reason he got a loan to pay off one of the women and transferred her $130,000. That would also be illegal in New York, which outlaws both bank and wire fraud. New York prosecutors could go after Cohen for bank fraud even if Trump pardoned him after a conviction for federal wire fraud charges. The big difference would be that Cohen would have no White House protection.

It’s been noted that Mueller hasn’t charged Manafort with a number of crimes it would seem a no-brainer he could charge him with. Mueller is aware of the double-jeopardy problem in New York State law, and speculation from people smarter than me are arguing those crimes are currently being left open so New York can charge them if Trump pardons Manafort.

White Snapdragon - Sairocarpus coulterianus - is an annual with a spike of flowers. This plant has numerous hairs (none at the base but certainly on the end where the flowers appear). this may be the only Snapdragon with a basal rosette. Compared to the Rose snapdragon, this plant has smaller flowers and is often found using one of its stalk like tendrils around other plants. You can see the beginnings of a tendrils reaching out for the support of another plant.

A picture of Jesus applied over the flag is a violation of the US Flag Code. Another conservative “patriot” who claims to love the flag but does not know how to display it. (On the side of a car is also no bueno.)

She appears to be standing on a curb, so subtract 3 or 4 inches.

Well, I guess she’s a real nut all right. The lettering is still Photoshop, though.

Since it’s from her personal Instagram account, it seems a lot more likely that it’s just a badly applied decal. Given all the other crap she has stuck on her car, it seems unlikely she would go to the lengths of getting someone to take a picture of her car, then editing that picture to add yet another ugly piece of agitprop, and then uploading the edited photo as though it were real. Sometimes clumsy looking stuff looks clumsy not because it fake, but because it actually is clumsily done in real life.

I mean, does she look like the kind of person who even knows what a layer mask is?
