Donald Trump, Looking Guiltier Than Ever, Announces on Twitter He Has “The Absolute Right” to Pardon Himself

Politics • Views: 28,289

Our so-called president is ranting away like a lunatic on Twitter again, as he feels the walls closing in. Today he announced to the world that he has the “absolute right” to pardon himself. “Numerous legal scholars” agree!

While the US constitution does not seem to place limits on who the president may pardon, “numerous legal scholars” do not actually agree with Trump on this. The prevailing opinion is that nobody really knows; it’s never been tested in court, since we’ve never had a president so thoroughly corrupt as Donald Trump.

However, in the bad old days of the Nixon presidency, the Department of Justice issued a statement that directly contradicts Trump’s rant.

Under the fundamental rule that no one may be a judge in his own case, the President cannot pardon himself.

And the constitution does clearly state that the pardon power does not apply to cases of impeachment.

…he shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.

Trump should consider that accepting a pardon is an admission of guilt. The fact that he’s talking about it at all shows where this is headed.

Note too - the DOJ doesn’t say that the president can’t be pardoned. It’s just that the president can’t pardon himself for his own actions.

Some other president could do it (or if he’s removed/resigned, his successor could do it), which is exactly what Ford did to Nixon.

Trump can’t pardon himself. If he attempts to do so, the immediate response should be impeaching not only him but Pence on down and include Ryan for good measure since they all enabled and were complicit in these actions to subvert the democratic process.

They knew or had reason to know of Trump’s criminal acts, and did nothing.

They violated their oaths, which itself is an impeachable offense. They put party above nation and undermined our very security.

re: #9 Kragar

Can a president be impeached for admitting guilt by accepting a pardon which he illegally gave himself?

Preet Bharara yesterday:

“I think if the president decided he was going to pardon himself, I think it is almost self-executing impeachment. Whether or not there is an argument that is not what the Framers could have intended.”

The obvious problem with Trump pardoning himself is that it sets up a self-reference paradox where he turns himself into a kind of legal singularity. His lawyers have already stated in that letter to Mueller that Trump is metaphysically above the law while he’s President and since pardons are exclusively defined in the Constitution as being for “Offenses against the United States” he’d be officially excusing himself as head of the government for acts intrinsically damaging to the country. In a way it even goes beyond the imperialistic “l’etat c’est moi” and instead just says “there is no State there is only me.”

It always surprises me when Sanders refuses to answer a question, ignores requests for follow-up, and the next reporter called on doesn’t pick up where their colleague left off.

they did it in MASH back in S02E12:

Hawkeye: General, can you tell us why MASH units never get any incubators?

General: Our people have this question under scrutiny at the moment. Now, if this scrutinization should yield negative, then I feel that we must maximize our efforts.
Next.

H: Sir, I don’t want to minimize your maximize, but why aren’t field hospitals properly supplied with incubators? Hospitals which surprisingly attract a great number of wounded people.

G: That question has a lot of buckshot in it.
H: I’m sure the answer will too.
G: Let me say this. The United States Army is the best equipped fighting force since the Roman legions crossed into Spain, each man carrying his mess kit full of gazpacho. Let’s move on. I think we’ve let enough fresh air into this incubator picture.
In any case, I wouldn’t want to dwell on it for - Security reasons.
- Exactly.

Why don’t you answer his question?

re: #89 Sir John Barron

You keep using that term. It does not mean what you think it means.

Sadly, not knowing what the fuck you’re talking about doesn’t preclude winning beyond all measure. I mean, we have a Dept. of Justice intent on perpetrating injustice after injustice against families, a Dept. of Education intent on making profit mean more than educating, an EPA that decided the ‘P’ in its name meant ‘Plunder’, and all sorts of shit undermining the very names and missions of their agencies.

And they’re getting away with it, and may very well continue to get away with it because they’ve successfully leveraged away any possibility of holding them accountable or undoing the damage for fucking generations.

Who Will Rid Us Of This Meddlesome Clenis?

The Clenis is back in the news, because the media will always find a way to make the news about the Clenis, even when NOBODY IN THE WORLD was curious what the Clenis was up to these days. Also, Bill Clinton and his Clenis have a book to promote, and this last year has been pretty earth-shaking with the #MeToo movement, so when you put all those things together, what do you get? You get NBC News interviews where journalists are like “Oh hey what up, Big Clenis?” and ask Clinton if he thinks he and his Clenis should have behaved differently during the Monica Lewinsky scandal, or if they would have behaved differently had the #MeToo movement been around back then.

Let’s be clear here: Bill Clinton needs to shut the fuck up. And if journalists insist on asking him questions about this, he needs to either ACTUALLY take some responsibility for what he did, or ACTUALLY try to talk about the differences between the 1990s and now, or really, just say anything besides what he said when NBC’s Craig Melvin started inquiring as to the life and times of the Clenis:

Let’s start with the DC Circuit Court. And this is delicious. Bear with me.

Back in 1974, Watergate special prosecutor Leon Jaworski issued a subpoena ordering Richard Nixon to turn over some papers and tapes relevant to the investigation. Nixon turned over some material, but not all, hoping that would satisfy Jaworski. It did not. Nixon’s lawyer, James St. Clair, went to the DC Circuit, and specifically to Chief Judge John J. Sirica, who became a household name in that year of 1974, to quash the subpoena. Sirica refused.

We can easily imagine something similar happening in the future. In which case the question becomes relevant. Who is the current chief judge of the DC Circuit?

Answer: Merrick Garland.

Watch out, Republicans. You may wish you’d have let him get to the Supreme Court after all.

Connecting Bluetooth stuff generally involves:
1. Turn device on, probably holding the power button down to put it in Bluetooth connect mode.
2. Go to Bluetooth on phone, tell it to scan for devices.
3. See new device, say connect.
4. Optional: Punch connection code into phone. This might be given in the docs.

“…The amount is nearly seven times what the average nonprofit CEO makes, according to a 2016 study by Charity Navigator, which found that the average nonprofit chief makes just over $120,000.

Of course, Charity Navigator also noted that the bigger a nonprofit’s budget is, the greater the CEO’s compensation will be.

Hendrix noted that the nonprofit had nearly a quarter-billion dollars in revenue in 2015, adding that the high amount “gives you some sense of the scale of these government contracts.”

An audit from 2015 showed that SKP received a total federal award of $227,582,409 that year, with $193,948,228 of that going toward the nonprofit’s “unaccompanied alien children” program.

According to data released by the U.S. Department of Health and Human Services, which oversees the ORR, the department has awarded SKP a combined total of $310,824,288 in fiscal year 2018 so far, the most recent awards being granted on May 10 in three installments amounting to $99,679,090.

The funds would have been awarded just days after Attorney General Jeff Sessions announced the Trump administration’s new policy of separating parents and children at the border.

They aren’t rated by Charity Navigator though they are a 501(c)(3). That in itself isn’t bad, just that they haven’t been evaluated by that group.

Jeff should go back to the facility and wait for the police to be called. He should then tell the arriving officers that he can smell smoke coming from the building, have the police call the fire department to access the building. That’s one way to get around these rent-a-cops.

I think he should enlist the CEO of SKP to come down to Brownsville (where the guy is from) and meet with him face to face to explain what’s going on behind the closed doors.

Plenty of chowderhead conservatives arguing there was no “intent” in the seaman’s selfie to take pictures of a classified space, so he’s not guilty of anything.

“Intent” is not necessarily required for completion of a crime.

Mishandling classified information is one example of that. Another might be reckless driving (officer, I just wasn’t paying attention is not intent). So is negligent homicide (officer, I didn’t mean to kill him when I was plinking with my bow and arrow).

We’re going to see Frank Turner and the Sleeping Souls this Wednesday. This is the first track from his new album, ‘Be More Kind.’ He wrote it after he read a newspaper article that said the alt-right was punk rock.

‘That filled me with a mixture of incredulity and anger,’ he said. ‘The idea that Breitbart or Steve Bannon think they have anything to do with punk rock makes me extremely angry.’

Frank Turner - 1933

“Stop asking musicians what they think”
He said softly as he poured himself a second drink
And outside, the world slipped over the brink
We all thought we had nothing to lose
That we could trust in crossed fingers and horseshoes
That everything would work out, no matter what we choose

The first time it was a tragedy
The second time is a farce
Outside it’s 1933 so I’m hitting the bar
But I don’t know what’s going on anymore
The world outside is burning with a brand new light
But it isn’t one that makes me feel warm
Don’t go mistaking your house burning down for the dawn
Don’t go mistaking your house burning down for the dawn

If I was of the greatest generation I’d be pissed
Surveying the world that I built slipping back into this
I’d be screaming at my grandkids: “We already did this”
Be suspicious of simple answers
That shit’s for fascists and maybe teenagers
You can’t fix the world if all you have is a hammer

The first time it was a tragedy
The second time is a farce
Outside it’s 1933 so I’m hitting the bar
But I don’t know what’s going on anymore
The world outside is burning with a brand new light
But it isn’t one that makes me feel warm
Don’t go mistaking your house burning down for the dawn
Don’t go mistaking your house burning down for the dawn
For the dawn

Aren’t you ashamed of this?
I surely hope that you are
We live in a society that’s maybe heading for Mars
But down here we still have a shower of bastards leading the charge
Outside it’s 1933 so I’m hitting the bar
But I don’t know what’s going on anymore
The world outside is burning with a brand new light
But it isn’t one that makes me feel warm
Don’t go mistaking your house burning down for the dawn

OMG this fucking shit has got to stop.

I’m not sure how that works in a state legislature. In the federal legislature, representatives and senators are issued lapel buttons that identify them as a member of the US House or Senate.

If the state legislator failed to wear some sort of identification (a badge or something like the lapel buttons), or have some sort of identification card, that might justify a search (up to the point the guard determines the legislator is in fact a legislator).

That would be the only instance I can see where the case would not be harassment (it is quite possible not every guard knows who every legislator is).

“You don’t look like a legislator,” the officer reportedly said, then clarified: “You look too young.”

I suppose she might take that as a compliment.

Once when I was on a midnight watch at NAS Oceana, I denied entry to the base executive officer when he tried to enter our building. My supervisor (a senior chief in another room) heard the conversation and immediately started dressing me down. The XO told him to stop, that I had done precisely what I was supposed to do (challenge anyone who did not have proper identification and who I did not personally know).

I think there was a Nazi espionage thriller (Name/document format) in which a spy was tied to a dolphin which was then released at sea.

Ron Rockwell Hansen, 58, was arrested by the FBI on his way to a Seattle airport to catch a flight to China.

The delicious irony is that the Administration’s efforts to sabotage the exchanges have actually made them better for the 80% of enrollees who get subsidized insurance. The people who are getting screwed are the older upper middle class who aren’t subsidized; IOW, Republicans. Meanwhile, Medicaid expansion for low income people is so popular its gradually being enacted by more and more red and purple states.

Auntie Beeb says that at the Apple WWDC that they will put the squeeze to Facebook in Safari:

Apple will attempt to frustrate tools used by Facebook to automatically track web users, within the next version of its iOS and Mac operating systems.

“We’re shutting that down,” declared Apple’s software chief Craig Federighi, at the firm’s developers conference.

He added that the web browser Safari would ask owners’ permission before allowing the social network to monitor their activity.

The move is likely to add to tensions between the two companies.

Apple’s chief executive Tim Cook had previously described Facebook’s practices as being an “invasion of privacy” - an opinion Facebook’s founder Mark Zuckerberg subsequently denounced as being “glib”.

At the WWDC conference - held in San Jose, California - Mr Federighi said that Facebook keeps watch over people in ways they might not be aware of.

“We’ve all seen these - these like buttons, and share buttons and these comment fields.

“Well it turns out these can be used to track you, whether you click on them or not.”

Speaking of Facebook, their attempts to even more completely allow for epistemic closure are going to be quite troublesome for us, I think.

Entire subsets of our population now can consume “news” that is all propaganda, without it being challenged.

Unless by means of being in a network of relatives, someone on Facebook may never ever come across anything with which they may disagree, or find conflicting sources of information.

My grandfather’s last name and that of his brother were spelled differently, courtesy of the government officials at Ellis Island who decided on the appropriate spelling when they immigrated here at the beginning of the last century. So while Hansen and Hanssen are probably not related — it’s still possible.

So Trump disinvited the Eagles from the WH.

Trump’s such a special snowflake that he can’t brook dissent or opposing beliefs or thoughts (let alone facts and logic).

He and his supporters continue lying about why players kneeled during the anthem.

It wasn’t about the anthem - it was always about protesting police brutality and police discrimination.

Trump wants it to be about him and spin the protests as being anti American.

And yet that’s the least bad thing he’s done, not when Trump’s responsible for the deaths of thousands of Americans in Puerto Rico due to his depraved indifference to their plight.

Trump’s continued his efforts to undermine and destroy health coverage for 50 million Americans.

Trump continues to hike costs for all Americans by imposing tariffs on goods imported as though he thinks the ones paying for it are foreign nations.

It only means that Americans will pay more for those goods and it wont generate jobs. In fact, it’ll cost Americans jobs the longer those taxes are in place.

Go directly to jail. Do not pass go. Do not collect $200.

Trump’s in real trouble. Manafort’s in even deeper trouble than before, and the prosecutors aren’t kidding around. I had thought that Mueller was being too kind by not perp walking Manafort and the rest. I get that there’s strategy in playing out the best approach to get these guys to cooperate, but Mueller may now turn to hardball and throw down the gauntlet against any all all remaining Trumpworld because Manafort thought he could break the law even after getting indicted.

Manafort’s gone and done what Trump has been doing - trying to manipulate potential witnesses and influence testimony.

re: #419 Eclectic Cyborg

Based on Trump’s actions to date, he could.

Before Trump, one usually had to be sentenced and 5 years had passed since the sentencing to be considered.

. Five-year waiting period required

Under the Department’s rules governing petitions for executive clemency, 28 C.F.R. §§ 1.1 et seq., an applicant must satisfy a minimum waiting period of five years before he becomes eligible to apply for a presidential pardon of his federal conviction. The waiting period, which is designed to afford the petitioner a reasonable period of time in which to demonstrate an ability to lead a responsible, productive and law-abiding life, begins on the date of the petitioner’s release from confinement. Alternatively, if the conviction resulted in a sentence that did not include any form of confinement, including community or home confinement, the waiting period begins on the date of sentencing. In addition, the petitioner should have fully satisfied the penalty imposed, including all probation, parole, or supervised release before applying for clemency. Moreover, the waiting period begins upon release from confinement for your most recent conviction, whether or not this is the offense for which pardon is sought. You may make a written request for a waiver of this requirement. However, waiver of any portion of the waiting period is rarely granted and then only in the most exceptional circumstances. In order to request a waiver, you must complete the pardon application form and submit it with a cover letter explaining why you believe the waiting period should be waived in your case.

That’s what made the Arpaio pardon so unusual.

He was supposed to put up $10 million bond. He hasn’t been able to provide sufficient assets. That’s due in part to fact that so many of his properties are collateral against other properties already in dispute.

And now it looks like the judge can revoke the bond, which means he loses the money he was able to put up.

If Trump pardons Manafort for suborning perjury and he accepts it, then Manafort can be compelled to testify as to what it was he was trying to subvert.

Why do you think the likes of Ryan and McConnell seem so willing to bend over backwards to allow Trump to wreck the government (besides McConnell’s wife being part of the Administration.)

The ugliness that is coming out and will come out will be very damaging to the Republican party. Already we see local Republican candidates around the country who not only avoid Trump but who also are not advertising that they are Republicans.

This all the more should encourage us to keep pressing on all fronts, because many elections locally are close, and getting non-Republicans into local offices and legislatures is as important as removing the guy at the top.

With the talk of impeachment increasing in volume, I hate to be a buzz-kill, but remember - Mike Pence might be even worse, because he’s a cleaned-up, smooth, politically savvy, religious fanatic version of Donald Trump.

8:54 PM - Jun 4, 2018

Charles, I have to disagree. Pence is a weirdo and not many people in politics really like the guy. Have you really heard anyone say anything about him that is positive since January 2016?

Indiana is a conservative state and he was on his way to the dung heap there before Manafort helped recommend him as VP. I have a feeling that was done because he is a lightweight and wouldn’t be any kind of hindrance or threat to Trump.

And a savvy politician doesn’t try to force through legislation against same sex marriage as Governor that makes you hated by 2/3 the state and the business community. A move the state’s largest newspaper had to call out and tell him to stop it before you kill the state’s businesses and education facilities. A Republican paper.

I think he can be dealt with. Also, he is going to be stained by Trump too. He would be lucky to get anything done in the remaining time in office and I think he would have a hard time running for president. Where was he in 2016 anyway? Why wasn’t he running then if he was such a hot shit Republican?

Trump has got to go. And his going will send a message to America to be more focused on a decent President for the future. And it is going to deeply hurt the Republicans politically.

Indiana provides that a child’s parent or legal guardian commits the crime of “dangerous control of a child” if he or she knowingly, intentionally, or recklessly permits the child (defined as a person under age 18;1 ) to possess a firearm, either:

While aware of a substantial risk that the child will use the firearm to commit a felony; and

While failing to make reasonable efforts to prevent the use of a firearm by the child to commit a felony; or

When the child has been convicted of a crime of violence or has been adjudicated as a juvenile for an offense that would constitute a crime of violence if the child were an adult;2

In addition, an adult who knowingly or intentionally provides a firearm to a child for any purpose other than those specified3 commits “dangerous control of a firearm,” a Class C felony. (more)

“Posing”??

I had the wrong word, but the message is the same. They used “claiming.”

Here is the official statement:

“United States Senator Jeff Merkley (OR-D), along with five other individuals, attempted to enter an unaccompanied alien children’s (UAC) shelter unannounced and broadcast live via social media last night in Texas. Thankfully for the safety, security and dignity of the children being cared for there, they were denied access. The Department of Health and Human Services takes the legal mandate to care for these children seriously. No one who arrives unannounced at one of our shelters demanding access to the children in our care will be permitted, even those claiming to be U.S. Senators. Senator Merkley should respect the UAC program and engage in the appropriate processes, as many of his colleagues have done before him, to visit ORR facilities. We would welcome him to engage in that process so that he may visit the facility to make headway on this important issue, rather than just headlines.”

— — —

Here’s why: New York has laws that closely mirror the federal ones Cohen stands accused of breaking. Under the state’s double jeopardy statutes, New York prosecutors couldn’t go after Cohen if Trump pardoned him for a specific federal crime. But they could go after him for related ones.

Take federal wire transfer and banking laws, which Cohen may have broken if he lied about the reason he got a loan to pay off one of the women and transferred her $130,000. That would also be illegal in New York, which outlaws both bank and wire fraud. New York prosecutors could go after Cohen for bank fraud even if Trump pardoned him after a conviction for federal wire fraud charges. The big difference would be that Cohen would have no White House protection.

vox.com

It’s been noted that Mueller hasn’t charged Manafort with a number of crimes it would seem a no-brainer he could charge him with. Mueller is aware of the double-jeopardy problem in New York State law, and speculation from people smarter than me are arguing those crimes are currently being left open so New York can charge them if Trump pardons Manafort.

White Snapdragon - Sairocarpus coulterianus - is an annual with a spike of flowers. This plant has numerous hairs (none at the base but certainly on the end where the flowers appear). this may be the only Snapdragon with a basal rosette. Compared to the Rose snapdragon, this plant has smaller flowers and is often found using one of its stalk like tendrils around other plants. You can see the beginnings of a tendrils reaching out for the support of another plant.

Makes me feel good that the only nut on wheels I have to deal with is a guy who drives around Koreatown in a Jesus SUV blaring that I got to have a personal relationship with a 2000 year old zombie

A picture of Jesus applied over the flag is a violation of the US Flag Code. Another conservative “patriot” who claims to love the flag but does not know how to display it. (On the side of a car is also no bueno.)

She appears to be standing on a curb, so subtract 3 or 4 inches.

re: #602 The Very Reverend Battleaxe of Knowledge

Well, I guess she’s a real nut all right. The lettering is still Photoshop, though.

Since it’s from her personal Instagram account, it seems a lot more likely that it’s just a badly applied decal. Given all the other crap she has stuck on her car, it seems unlikely she would go to the lengths of getting someone to take a picture of her car, then editing that picture to add yet another ugly piece of agitprop, and then uploading the edited photo as though it were real. Sometimes clumsy looking stuff looks clumsy not because it fake, but because it actually is clumsily done in real life.

I mean, does she look like the kind of person who even knows what a layer mask is?
