Holocaust Denier Chuck C. Johnson Loses Lawsuit Against Twitter on Anti-SLAPP Motion

Boom
Law • Views: 43,251

Holocaust denying Rage Furby Chuck C. Johnson (who is NOT ME) is having a really bad day.

Johnson foolishly thought he could sue Twitter for banning him. He was wrong.

Today in Fresno his lawsuit crashed and burned spectacularly, as the Court ruled in favor of Twitter’s anti-SLAPP motion. This means that unless it’s reversed on appeal (which is unlikely), Johnson will have to pay Twitter’s attorney costs — and that’s going to be a lot of very real money.

Anyone could have seen this coming, because Johnson’s suit was a classic example of a Strategic Lawsuit Against Public Participation (SLAPP), exactly the kind of case anti-SLAPP statutes are designed to prevent.

Couldn’t happen to a nicer guy.

Here’s the document; the ruling on Johnson’s case starts on page 27.

UPDATE at 6/6/18 12:39:09 pm by Charles Johnson

Johnson’s lawyer Robert Barnes is claiming on Twitter that they were victorious despite the fact that they, um, lost.

Techdirt’s Mike Masnick explains why this is a ridiculous claim.

The key points that Barnes declares “victory” over both appear to involve a somewhat twisted interpretation of what the court is saying. On the first point, of the court declaring Twitter to be a “public forum,” that is true, but specifically in the context of California’s anti-SLAPP law. I mean, the ruling says that explicitly:

In the instant case, the parties appear to agree that (1) Twitter is a public forum for purposes of the anti-SLAPP statute…

The fact that it is a public forum for the purposes of California’s anti-SLAPP statute has no bearing at all on whether or not Twitter is a “public forum” in the sense of spaces created by the government in which speech regulations are limited under the First Amendment. They both use the words “public forum” but they mean totally different things.

The second point, about Twitter’s control over its platform being a “matter of public interest,” is also specific to California’s anti-SLAPP law, which requires the speech in question to be about a matter of public interest. That doesn’t help Johnson’s case at all, unless you’re twisting this specific point concerning anti-SLAPP laws into believing it refers to the government having an interest in regulating how Twitter runs its website. But that would be a totally nonsense interpretation. Though it appears to be the one that Johnson’s lawyer wants to go with. The fact that Twitter agreed to both of the points that Barnes is now celebrating (as is necessary under California’s anti-SLAPP law) should show you why neither of these points is even remotely damaging to Twitter. And, no, this is not Barnes using 9th dimensional chess to get Twitter to admit to something that harms it elsewhere. This is just nonsense.

I have no idea how much Twitter’s legal team charges per diem or even per hour.

Suffice it to say, I’m pretty sure Rage Furby’s gonna have to do some cyber-begging to raise the funds.

Or declare bankruptcy. Maybe get himself a job at Taco Bell - who knows, with any luck, he might work himself up to shift manager.

I can’t take credit for this, but someone on Twitter compared Trump to a toddler running amok.

Let a kid run amok in your house and you’ll quickly see how you need to child proof your home.

Letting Trump run amok on the federal government shows how you need to idiot proof government at all levels against insidious and complicit politicians whose intentions are to fleece taxpayers, ruin the social compact, and sell the government to the highest bidder for their personal profit and gain.

OCONUS could mean two things when referring to an FBI agent: a) stationed outside the Lower 48, or b) a brand of fishing lures. I’m guessing it’s not the latter.

Therefore, Derpland is going with c) There were “lures” in the Trump campaign a year before there was an FBI investigation.

One brand of ciggies I really miss from the USA (totally unavailable here): Nat Sherman’s MCD.

Pretty much everything here is either Marlboro, Winston, Camel, Lucky Strike. I roll my own, using Winston light tobacco and a local brand of papers (with 6mm Mascotte brand filters). That’s another thing I miss that’s not found here: Top rolling papers and Zig Zag papers.

I alternate between cigarettes and vaping.

Although Dana Rohrabacher came in first in a multi candidate field, he only recieved about 30% of the vote which is pretty sad for a long time incumbant. He may be in big trouble head to head against a D.

Conversely and sadly, Nunes got about 55% in a multi candidate field which implies he will be tough to beat in Nov.

“… According to the sources, Trudeau pressed Trump on how he could justify the tariffs as a “national security” issue. In response, Trump quipped to Trudeau, “Didn’t you guys burn down the White House?” referring to the War of 1812.

The problem with Trump’s comments to Trudeau is that British troops burned down the White House during the War of 1812. Historians note the British attack on Washington was in retaliation for the American attack on York, Ontario, in territory that eventually became Canada, which was then a British colony. …”

Notice how he’s only going after cities (most of which despise him).

Say for the sake of argument he came after my county with the same threat. One sheriff, one deputy, two cars (the county just bought another one).

I presume there are a few undocumented migrants in my county, out of the three thousand or so people here.

If the sheriff and the deputy were out and about beating the bushes for people to turn over to ICE on the threat of the county losing federal funding (we do get a little bit), they wouldn’t have any time for the important stuff they do here (like rounding up loose cattle).

My county sheriff (though a Republican) has better stuff to do than harass people for papers. (He still says he’s keeping his eye on me though when he sees me.)

I have no idea how much Twitter’s legal team charges per diem or even per hour.

Or declare bankruptcy. Maybe get himself a job at Taco Bell - who knows, with any luck, he might work himself up to shift manager.

Heh.

Assuming Chuck’s attorneys can’t change the judge’s mind (narrator: they won’t)…

I’d guess the going rate in Fresno county (where the case was filed) is probably somewhere around $500/hour (that’s about what judges will go for in cases like this in LA/OC/Riverside). I’d also assume they’re probably looking at a justifiable billing of 20-25 hours on this (reviewing the complaint, researching the issues, meeting and conferring with opposing counsel, drafting the motion, reviewing the opposition, drafting the reply brief, preparing for and attending the hearing; and then the fee motion), so they’re probably looking at somewhere around $10-15k.

For what it’s worth: I’ve actually brought and defended these types motions, having won and lost on them. It sucks losing one as the plaintiff (thankfully it wasn’t my firm that wrote that particular cross-complaint, but still… no fun).

I would say the FFs did that, but they never anticipated a party as corrupt as its leader. And I’m not sure how we can provide for that.

I’m not quite sure how the calculate the absentee ballots. Some counties start counting those as they come in (which is why on election night we get early returns with 0% reporting), so they might be counted. The 22% is what the Secretary of State is showing, as of this morning. Might tick up a bit, but I doubt there’s enough to get us up to 30% turnout

Looking at the historical data on the CA map page:
vote.sos.ca.gov

I doubt that the final turnout county will be less than the 2010 Primary.

Current SD count is 24.1%, but the uncounted ballots are almost one half of those counted. So if the uncounted ballots are not yet part of the “turnout”, that means the latter indicates that final figure will be a bit higher than the 2010 figure.

Someone probably told him. I guarantee you he didn’t know about Canada’s the United Kingdom’s part in burning the White House.

Battle of Bladensburg has been called “the greatest disgrace ever dealt to American arms” and led directly to the capture and burning of Washington.
The American force, 6500 state militia and 420 regulars, was commanded by a political hack named Winder, but it had a decent position and a large numerical advantage. The position collapsed at almost the first shot, though, when the state militia contingents fled in panic. A British observer quipped, “Seldom have men with arms in their hands made better use of their legs.” The panicked militia actually fled through the streets of Washington and President Madison barely escaped capture.

Maybe it’s tied to the alliance between Ayn Rand and the GOP. Ayn was famously a promoter of smoking, especially in her magnum opus “Atlas Shrugged” . When she developed lung cancer, she did stop smoking personally but she never warned her disciples that she was wrong about this behavior. A terrible person who has damaged much of American politics

Also, tobacco growing states were coming under fire just as the main parties’ positions flipped and Dixie went with the GOP. The GOP defended the tobacco companies during the congressional hearings about the dangers of tobacco.

I’d love to know how much Twitter has spent responding to Chuck’s bullshit lawsuit. They have a team of lawyers on this, and they don’t use inexpensive lawyers. The total has to be in the tens of thousands already at least. And if Chuck appeals and loses, which he probably would, he’d also be on the hook for MORE legal costs. This is going to really hurt him.

Kellyanne Conway Moves Trump-Russia Goalpost to Over There, Where Ivanka Isn’t (Wonkette):

Two tiny little scooplets today, nothing to see here really: A Cambridge Analytica director told friends she sent “third party” funds to Wikileaks via Dogecoin (probably not Dogecoin). Is that a big deal? And Ivanka Trump yelled at Michael Cohen for turning down a Russian Olympic weightlifter’s offer — fow which she’d done the intro — to set up a Trump-Putin meeting to grease Trump Tower Moscow. Is that bad, do you think?

NO DUMMY, THOSE ARE NOT BAD, OR A BIG DEAL, because Kellyanne Conway went on the Weak Loser Fake News CNN this morning to point out that it is NO COLLUSION unless Russia actually changed the vote tabulations, in the computers! (We will look forward to how that hypothetical is also NO COLLUSION once Mueller lays down some tiny news about Russia monkeyin’ around in the voter rolls.)

One of the few building the British spared during the sacking of DC was the Marine Barracks and the Commandant’s home. The traditional story is that this was out of respect for the Marines standing their ground during the Battle of Bladensburg while the rest of the troops fled.

Look, not of fan of KK or, obviously, Trump, but it appears this was a good commutation.
I think it is a bad look to suggest something sexual here.

I would certainly prefer Trump go through the proper legal procedures for pardons, but not gonna trash K Kardashian for doing a good thing by bringing attention to this. I am glad this woman will be out of prison.

I agree — this is the only pardon/commutation that is justified. Of course L’etat c’est moi Trump would never think to go through proper protocol.

That would be the so-called liberal NY Times with their breathless reporting of Trump’s numbers, which are virtually indistinguishable from Obama’s figures.
2:19 PM - Jun 6, 2018

Old aphorism: “There are 3 kinds of lies: lies, damned lies, and statistics” attributed to various persons in the 19th century.

Unless you know something about the population, the numbers are meaningless. Granted, there probably isn’t a big difference between 2015 and 2018, but you do have to know who is included in the denominator and what type of jobs are included in the numerator. A part-time job of 10 hours per week is very different from a full-time job of 40 hours per week; annual pay of $25,000 without benefits differs from annual pay of $75,000 with benefits.

Trump, the media, and right wingers spent years talking down Obama’s economy and economic policies, claiming they were socialist, they were destroying the economy, etc.

Trump gets the same numbers (same kind of context - headlines, ledes), and the tone of the Times is that things are going awesome.

Had the Times given Obama that level of credit, he would have been able to accomplish even more. Instead, he was left defending rather than taking the offensive. The Times and others were pushing a false proposition then, and now they’re reaping the rewards.

This common perennial spreads via rhizome, which is thick and woody. The flowers do have not true petals, but rather each flower is subtended by an involucre bract 1-3 cm long that is white, often tinged reddish. There are about one hundred flowers to each conical-shaped flower head. The conical spike is stout, 1-3 cm long and is subtended by 4-8 unequal white petal-like bracts, 1-2 cm long and rounded. The fruit is a capsule. The leaves have a spicy smell.

Ok, I wasn’t sure if the image thing was right or if I was confusing flags and the Weeping Angels.

Right, but I feel like if we tried to burn the flag that that guy was wearing, we’d need a stake to keep him there.

We are on the same wavelength. My first thought was of the Weeping Angels!

Speaking of Flip Wilson. I wish there was video of the Flip Wilson Show routine with Dom Deluise and a human-like muppet named Marcus Welby. I’ll never forget it.

First time I think there was a full size human muppet. I remember the muppet taking a shot and the whole face pulled in causing the forehead to meet the chin and then it popped out and did a faceplant into the bar. At least that is what I remember. Sadly…no YouTube.

But I did find a black and white image!

Lots of the monthly variation has to do with the larger movements in ocean/air couplings.

For example, if the currents are just right off the coast here we get an eddy churning up cold water, which cools off coastal southern California.

Now, I have a very low opinion of deserters, somewhere above looters, ear collectors, and head choppers and way ahead of torturers and rapists, but still a low form of life. The lack of prison time is appropriate, I think, since his time with the Taliban should count as a kind of time served. Republicans of course think we should have left him to his fate with them. There must be something in the bourbon in Kentucky…

Two stories:

Kentucky woman said she found human bones. Sheriff says she was hiding stolen artifacts.

A Carroll County woman was arrested Tuesday after the county sheriff’s office said she made a false report about bones she said she discovered under an abandoned trailer.

Tammy Sculley, 40, told authorities last month that a dog dug up the human bones and brought them to her, Carroll County Sheriff Phillip Marshall said in a press conference Wednesday morning. Following an investigation, it was determined that those bones were archaeological antiquities that two separate people stole from an unspecified building, Marshall said.

[…]

Kentucky man going to prison for stealing Indian bones, selling them

A Simpson County man faces federal prison time after stealing Native American bones from Mammoth Cave National Park and other locations across the country.

Gary Womack, 60, was sentenced this week in U.S. District Court in Louisville to 15 months in federal prison.

The U.S. Attorney’s Office said the sentence is related to three felony violations of the federal Archaeological Resources Protection Act. Womack pleaded guilty to those offenses in March.

Federal Judge not only dismissed the Cassandra Fairbanks/Robert Barnes lawsuit against Emma Roller, but called Fairbanks a troll in the very first line of the Opinion

But also called Fairbanks and Cernovich journalists, so it’s a wash.

Well, the court kind of had to, since the White House had issued them press credentials as “journalists”

Oh good. More stuff for the Freeze Peach! brigade to blow up. They handled that really well, though—and promptly.

There must be something in the bourbon in Kentucky…

Two stories:

Kentucky woman said she found human bones. Sheriff says she was hiding stolen artifacts.

Kentucky man going to prison for stealing Indian bones, selling them

A movie called American Animals is about to be released. It’s about the plot by college-aged kids to steal an original Audubon book held in Lexington’s Transylvania University library (I’ve seen the book as I worked there for awhile). The book is huge and apparently worth a lot. When I lived in Lexington I went to an expert on Audubon who talked about the huge toll his work took on the subjects he painted. He had to have dozens, if not hundreds, of each bird so that they could be each be taxidermied into the pose he was aiming for. I guess it was worth it for the nature love he inspired.

The blue wave is getting stronger - but the media wants to remove any thought of a Dem win.
