The Supreme Court Is Now Poised to Fall Into Right Wing Control for Decades

The 2016 election will be seen as the biggest disaster for liberal politics in the history of America: Justice Kennedy to retire from Supreme Court.

Here’s what’s very likely to happen next.

With Kennedy gone, the Court’s decisions on issues where he’s a down-the-line conservative — like campaign finance and corruption, most business regulation and voting cases, gun rights, religious liberty, etc. — likely won’t change. There’s already a 5-4 conservative majority on those, so conservative rulings like the ones Kennedy wrote or joined in DC v. Heller, Citizens United, or Hobby Lobby will continue apace.

What will change are rulings on issues where Kennedy has helped maintain a shaky 5-4 center-left consensus. Because of the court’s longstanding principle of stare decisis, or obeying past precedent barring a compelling reason not to do so, some liberal Court achievements are likely to stay. But a Court without Kennedy is substantially more likely to:

  • Overturn Roe v. Wade and allow states (and maybe the federal government too) to ban most or all abortions.
  • Reject challenges to capital punishment and solitary confinement.
  • Rule in favor of religious challenges to anti-discrimination law, and perhaps, in an extreme case, reverse some past Supreme Court rulings on gay rights.
  • Bar government actors from engaging in explicit race-based affirmative action.

The most unfit-for-office president in history now has a chance to hand over control of the Supreme Court to the far right, for decades to come. I feel like I’ve been kicked in the stomach.

The GOP will howl. The difference is that the media will go along with the con and that may be enough to keep Dems from getting even the minimum needed in Congress to stop things up.

Unless Dems absolutely run the table his November, Trump is getting his way with no walls that can be erected to stop him.

You know, it doesn’t really matter if you lose the game 5-4 or 6-3. Honestly, I can’t think of anything that Kennedy did besides same-sex marriage that I would applaud. He has been a reliable corporate toad and anti-civil rights justice. We know that the Warren court was as conservative as this, and somehow decent rulings came to pass from them over time. We have experienced conservative judges who became more liberal as they aged. We haven’t had a court that would put out a progressive ruling since the 60’s, and still we have progressed in many areas. The current Supreme Court is not our friend, it was not our friend when Scalia and Sandra Day O’Connor was there. The Supreme Court has NEVER been our friend, they blocked FDR’s program. Fuck the fucking Supreme Court, we have always won without (or in spite of) them.

Rather than dive right into the latest entry in this week’s Supreme Court Parade of Horribles, let’s state for the historical record that Barack Obama’s decision to nominate Merrick Garland to replace Antonin Scalia will go down through the years as the last in a series of doomed and useless attempts to demonstrate that our politics were in any way normal, and that the American people were too smart and too good to put up with a Republican Party the brains of which were being cored out by the prion disease of which it had been Patient Zero for the previous four decades.

Not that Garland wouldn’t have been a decent justice, or that what was done to him was anything within hailing distance of normal. It’s just that the strategy—find such a nice centrist that the Republicans would look silly in opposing him—was futile, being too clever by half, and being based on Obama’s destructive belief that everyone was as reasonable about the country as he was. It is now clear that he might as well have nominated 50 Cent, Zombie William Brennan, or Flipper. It would have made no difference. On Wednesday, we saw the final payoff.

There’s a lot more than just what is happening in the moment.

I used to think that - that non-rich white people voting for Trump and the GOP were voting against their own interest. And it’s still true, economically. The thing is, those voters define their “interest” separately from their economic interest. They define their interest as the preservation of white political ascendancy, though they don’t perceive it that way.

Someone said yesterday that Trumpkins will still love him when they lose their homes and eat out of dumpsters. That’s true, as long as nonwhites are denied access to those dumpsters.

Exactly. Remember, Gorsuch is only 50. He’s going to be in that chair for 2 decades minimum, and the consequences of rulings extend far forward. Kennedy was appointed at 51 and just jumped over the 30-year service mark this year. Clarence Thomas has been in his chair for 26 years. Another 20+ years of his kind of ‘jurisprudence’ would be a death knell with the pattern we’re currently seeing.

I know it will be unpopular…but right now is the time we all need the never-Trumpers.

If they can help get the message to some of the Republican Senate members how dangerous Trump putting a radical right member on the court they might be able to muster up a body or two to stop the nomination.

They probably won’t disallow it nationally, at least not at first. That would cause too much blowback. What they’ll do instead is legally balkanize the US, allow red states to erect ever stronger bans on abortion and gay marriage / adoption in the name of religious freedom and States rights. Then they’ll make it illegal for underage women to cross state lines to have an abortion, then all women will be subject to that restriction. It’ll be a slow but steady cranking down and movement of the Overton Window to the right.

You can check my posts on Obama all the way back to the beginning of 2008, and you’ll see I often bemoaned that he was not aggressive enough ideologically.

Yet it is wrong to think that he did not accomplish much. Being President is not about being a superman. Rather, it’s about serving the country (compare to the current example.)

Obama did as much as the country allowed.

We have to remember that the US has always been among the most religious, and morally conservative, “first world” nations.

That the Obamas became the target of so much bigotry did reveal exactly the character of this country.

Here’s one right here. I wrote Bernie off during his first debate with Hillary. Totally pissed at the asshole and his parade of bros.

So how does Alexandria look to me? She looks pretty damn promising. A young, idealistic Latina who has excited her district enough to vote for her by large margin over the “safe” man who took his re-election for granted. Unlike Bernie, she knows the working class isn’t just white - in fact, she embraces all and represents all. She is a DEMOCRAT and has made it clear that it is a big tent and that there is a place for all.

She is also a talented fund raiser and campaigner, willing to do the hard work it takes to represent her district. She is the future of the Democratic party and I applaud her win with enthusiasm. Are her goals unrealistic? Pfft! If you don’t shoot for Mars you’ll never get to the moon. She has already proven herself to be pragmatic (see fund raising and campaigning against an intrenched incumbent). I see a young woman with a very bright future.

Look, the last Democrat that I probably really liked was Hubert Humphrey.

But that doesn’t mean that national level Democrats since then have not done good.

I reckon the rise of the contemporary reactionary movement that we see, which came out of the 1960’s with Civil Rights Era changes, the Vietnam not-quite-a-war, etc., really is at work here.

Sure, the hate-right has roots all the way back to the Civil War, but I encourage us to think of the current state of affairs as a direct result of the change in the Republican party after 1965.

I remember Turd Blossom Rove saying “we create reality”. I remember Katrina. I remember tax cuts that squandered the economy. BUT, after a disastrous war, cratering the economy and failing on Katrina, they were replaced. So the message I take is, prepare yourself for the shitstorm because it is coming, pay down debt, sell your house while the market is high, whatever you can do to insulate yourself from the shitstorm. But I don’t fear the end of the Republic, we’ve seen this movie before. I wish the dumbshits didn’t always have to suffer before they wised up (just to go back to being dumbshits), but this is what we got in this supposedly great country.

Of course, the WWC will be up in arms that a white man was defeated by a woman of color. OTOH, her victory may inspire other young people to get out and vote. Hopefully the Democrats will be able to terrify their voters into coming to the polls, assuming they haven’t been purged from voting lists by their GOP governors. I like what I’ve seen so far of her and think she represents an essential part of the Democratic base.

Well, from a legal perspective, this would be difficult because medical procedures, licensing, etc., are managed by the states. (This is why you could get abortions in NY and CA before Roe.) Of course, Congress could attempt to make a power grab, but states like California and New York would resist strenuously. But this would bring it to the Supreme Court, eventually.

I would just remind everyone that even if abortion were to be made illegal in this country, abortions will still happen. What will change is that women will get dangerous and unsanitary abortions which put their own lives at risk. Which pro-lifers simply do not care about, because those women were sluts and deserve to die. No sarcasm here, remember Kevin Williamson wanted to hang all women who had had an abortion.

So we know SCOTUS is set to be stuffed with trump toadies. Ergo, the highest level of the Judicial branch will soon be just as useless and complicit as Congress.

What can you actually do about it? I’d say (in addition to GOTV activities, etc) it’s definitely time to look into serious civil disobedience and other forms of protest that will hit the scumbag enablers of this regime where it hurts (e.g. boycotts, sabotage, etc). A Lysistrata-style denial of things they value most.

Is a general strike possible in America? I don’t know. But something close to that in scope clearly needs to be considered. I’ll also repost this thread on WWII-era resistance, which describes subtle, non-violent, yet highly effective forms of sabotage:

We also have a lot more going for us than the women did pre-Roe, i.e. abortion pills. They will become easier to get than grass in states where it is still illegal. They may be already - I know they are in areas that are under-served by women’s health clinics. The underground network will become ever stronger. And women will be even more pissed!

LGBT folks will never go back and most of the country is well behind them now. All that reversing equality laws will do is inspire those pitchforks to be further sharpened.

Don’t know…as soon as I heard that I raced to shut it down. It’s a little more difficult with streaming Directv Now.

As satisfying as it would be to slow down the confirmation till after the election, I think that would be a mistake. Speaking strictly tactically here, it would be better for Democrats to allow Trump’s nominee to replace Kennedy to be confirmed quickly. Here’s why:

1) McConnell is completely shameless. There is no rule or precedent in the Senate that will stop him bringing a nominee to a vote. There’s pretty much nothing we can do to stop it now.

2) Once the new Justice is confirmed, Republicans won’t be able to use the nomination to get their voters to go to the polls.

3) Maybe this time, the lazy fuckers who sat out 2010 and 2014 and gave us Majority Leader McConnell, and thus Justice Gorsuch, will get off their asses and VOTE!!!!

Don’t know…as soon as I heard that I raced to shut it down. It’s a little more difficult with streaming Directv Now.

I have not been watching him. I watch Ari and then quickly change. I do the same after watching some of Nicole (because of her slant and guests because of her being Republican) before Chucky comes on..I go back later to catch Rachel and Lawrence.

As soon as I take my new FireTV out of the box and set it up, I’ll learn (hopefully) some new streaming skills. Of course, I said that about my InstantPot, which is still sitting on my counter waiting for its first use. I guess I like buying and looking at gadgets more than actually using them. All in good time…

As satisfying as it would be to slow down the confirmation till after the election, I think that would be a mistake. Speaking strictly tactically here, it would be better for Democrats to allow Trump’s nominee to replace Kennedy to be confirmed quickly. Here’s why:

1) McConnell is completely shameless. There is no rule or precedent in the Senate that will stop him bringing a nominee to a vote. There’s pretty much nothing we can do to stop it now.

2) Once the new Justice is confirmed, Republicans won’t be able to use the nomination to get their voters to go to the polls.

3) Maybe this time, the lazy fuckers who sat out 2010 and 2014 and gave us Majority Leader McConnell, and thus Justice Gorsuch, will get off their asses and VOTE!!!!

Could suppress D turnout if they dont at least see a fight
But yes, in the end red state Dems will (in most cases) have to vote for Trump’s pick and there are not enough (any) Rs to pick off.

It was very easy. It just comes down to having an Amazon account and a streaming service. Type in passwords with the little FireTV controller (that hardest part of the process) and it was on and working.

DirecTV Now has some issues, but it has gotten better since I’ve had it about 4 months now. When it works 100% it is very good. Sometime you get 80% and frustrated. But that isn’t happening as frequently.

Strange thing…NBC related properties seem to be their biggest problem network to stream. For some time people all over the country were throwing a fit about not getting MSNBC.

Public Service Comment: If you type in the name of a service provider into Google followed by the word ‘down’ you will get a link to downdetector. com and you can see how many others are suffering and what they are saying. It even maps the area of the country/world affected.

Shared anger as it were. I learned that with ATT Yahoo Email Down. It was a sure way to know it wasn’t my connection. One thing about digital and the ‘net. If you are having a problem others will be too.

I imagine she isn’t going to have much interest in uber-conservative issues, and is very likely to win NY-14. So if she should give up her just-won primary, why not all the Democrats resign, despite the blue wave of special elections that have flipped places such as a Wisc. state senate seat, a Penna. US House seat, and an Ala. US Senate seat, along with two governorships and a whole slew of local elections?

We’re going to need her education in foreign affairs after the Dumpster fire in the White House.

Last week a neighbor’s untrained, aggressive bully dog got loose and went on attack mode on a sweet little Scottie being walked in front of my place while I was out watering the plants. I saw what was happening before the bully dog got there and flew out to get between that dog and his innocent prey, not even thinking, just reacting to protect the little guy from sure injury or worse. I went full banshee on that bully dog.

I never disliked Clinton. I don’t know who’s heaping blame on Clinton (other than rodent copulators on social media and the view-from-nowhere beltway media). A perfect storm of crap hit her campaign (the ever-present purity ponies - see Nader, plenty of foreign interference, a whole bunch of people who didn’t vote at all, Anthony Wiener’s cell phone which gave James Comey another chance to throw sand in the gears - Huma Abadein should have strung up Wiener by his wiener over that, the structure of the Constitution which gives the power of elections to the Electoral College rather than the biggest vote winner).

Congrats on your retirement). The case will come up in court in August and I don’t want to do anything to fuck up my case. I think I’m feeling like a lot of people who’ve had brushes with the law, but I’m also feeling like a wuss for hesitating to protest for these kids and parents.

I’ve donated a shitload of money (for me) to RAICES and other aid groups this week. That may be the best thing I can do until after August.

PS: It was a victimless crime. I didn’t hurt anybody. It was incredibly stupid and I still feel like shit when I think about it.

A lot of them are turning to scooters because they’re cheaper and easier to use in town. If they’re going to take a road trip, they’ll take a car.

I was thinking about getting a motorcycle during one of my mid-life crises, but I decided on a scooter instead. It was one of the most fun decisions I’ve ever made. It was a 300cc so it had enough power to get me out of trouble without getting me into trouble.

There’s a Harley on the bulletin board at work that’s selling for more than my scooter cost new and it only has 5000 miles on it. Why would someone spend all that money on a motorcycle and then only ride it 5000 miles? I put over 7000 miles on my scooter in the first season I owned it.

I just got Hulu last week and only was able to watch the first episode yesterday. I think this is going to be a difficult thing to watch. But probably not as difficult as Jesus Camp, which took me several days to get through and I winced the whole way.
