I’d want to look for a silver lining in seeing how it’ll affect the next few election cycles, but I’ve been burned too much by assuming the best in people and situations. Especially when it’s clear that rape culture may just end up becoming all but law (and may well become law outright) with Kavanaugh ascending.

The GOP don’t care. They’ll get their eternal win, and sail to total control because nothing fucking matters except the win and perpetual power.

Not just “commonplace”, but a firmly-established legend of martyrdom: it has always been accepted as a Foundational History of RW judicial meddling that Poor Old Robert Bork was the undeserving victim of an outrageous and unprecedented campaign of “personal vilification” which tragically denied him the SCOTUS seat that was his due as a just reward for a lengthy and illustrious career pioneering “Judicial Originalism”: the purest form of Constitutional interpretation.

Which, stripped of its whiny bullshit, meant simply that Bork was the archetype of the RW “political judge”: a jurist utterly blinkered by a restrictive and inflexible ideology - and who made it abundantly clear that he would be crafting every ruling he made solely on the basis of his ideological prejudices. And indeed, he and his backers felt that that was the main reason he should (as a matter of right) be confirmed.

The national campaign against his confirmation was fairly unprecedented - though that butthurt-generating “vilification” seems to have consisted of just one speech by Ted Kennedy which was a bit over-orated - and the Right have never gotten over the fact that it was successful.

I’m gonna repost this from downstairs where I hit the CL threshold, mainly just because it sums up my thoughts on the matter. (Thoughts, not feelings. My feelings would probably attract official attention.):

It’s just this simple to me: I believed her. I didn’t believe him.

She had no reason to lie. He had every reason to lie.

He’s a Trump nominee and Trump hasn’t dumped or trashed him yet. That’s better than any polygraph. They’re both born to lie.

Most of all, for me, his whole BS story about his drinking and his lack of sexual experience well into his college years rang like a cracked gong.

He and I had a lot in common in high school. We were both jocks, we were both at or near the top of the class academically, and we both drank mucho beer (which I guarantee you means plenty of harder stuff than beer too). The only major difference was that I was twenty years ahead of him, quite a generational gap. I might have barely bought at least some bits of his story if he’d been in high school in the very early sixties, as I was. In the eighties? Fuhgeddabout it.

What happened to Bork is what the Founders intended the system to be. The Senate debated Bork’s merits as a SCOTUS judge and they decided Nope and that included some Republicans too. It’s beyond pathetic that they keep on dragging out his judicial carcass as a victim. Meanwhile we never got to learn about Merrick Garland’s philosophy. His lefty detractors painted him as a mere centrist but we never got to learn about that since McConnell was determined to sink him because Obama had the nerve to appoint him and to replace Scalia to boot.

It would be interesting to see how Roberts votes on these things he’s the guy “leading” the court right now, and he showed some semblance of dignity back when he helped preserve the ACA, it is a slim branch to hold onto but a possible one that he does not want to have his court known for such blatantly naked partisanship.

That or we can place our hopes in a certain lawyer having a few cards left to play over the next few days, something tells me he will not just sit and wait while K gets confirmed.

I think the take away that we all need to have at the moment is that nobody knows fucking anything about what just happened today, the hearings took up the entire day more or less, and outside of our deeply political blogs, we have no idea exactly how this played, even if we can make some guesses.

For the moment the only thing we can really do is wait and see what kind of a knock on effect this will have, what other accusers it shakes loose, what other legal action certain people take to demand a chance to testify and what the public has to say in the wake of these testimonies.

Rebellions are built on hope, and Doctor Ford gave us that if nothing else.

After all, the reason that Republicans want to jam through Kavanaugh’s nomination is that as a member of the Supreme Court he’ll be able to help create the mechanisms that determine which kinds of Americans have rights, protections, autonomy, and power.

By building a court that can reverse precedent—around affirmative action, reproductive autonomy, fair wages, voting and collective bargaining—Republicans believe that they can push back the populations that threaten the dominance of the white patriarchy. The right kind of court, so to speak, could turn back social movements that have succeeded to the point that old white men like Orrin Hatch can’t just ignore the Anita Hills and Christine Blasey Fords and Kamala Harrises and Mazie Hironos. To regain the court is to regain the power, to perhaps build a future in which powerful white men do not have to put up with all this kind of stuff anymore.

And we White American Males are so caught up with the culture of white males as the real victims that we never think about how so much of our existence is a given. Of course the President is a white guy or if you get into sports, of course the QB or coach should be white or pop culture, of course Santa is white. That’s the real identity politics when you’re convinced that you can’t accept a person in a position of importance not being like you.
