EPR-radar  Sep 28, 2018 • 12:26:21pm

This may have been mentioned before, but Kavanaugh’s partisan rant of an opening statement yesterday is just another example of Republican privilege.

Imagine if Hillary Clinton had gone into her 11 hour marathon Benghazi meeting and started out with a partisan rant about Republicans using their investigations to ‘search and destroy’ etc.

Even if every word she said in that rant was true, she would have been crucified in the mainstream media. Most likely that would also have been a mortal wound to her presidential run in 2016, since she wouldn’t have even survived the primaries.

It’s just amazing the different standards to which Democrats and Republicans are held, especially when amplified by the similarly different standards applied to men and women.

That’s something the Framers never intended because they didn’t consider culturally diversity and that we would have some states that grew so big and others that are in fact smaller than what the largest state was in 1787, Look it up, more people in Virginia in 1787 than there are in Wyoming now.. I also think the House should grow too. We have less House members than the House of Commons yet we have 5 times as many people. It would also help third parties grow.

As you’ve said DM, evading doesn’t speak to you as a good person. I always think about those old Nazis they would find and still do granted not as much since they keep dying off but I think about the people who defend them and say “Well they’re old men, let them live out their final days in peace.” Their victims never got that. The men and women whose portraits I saw plastered on the halls of Auschwitz never got to be old. To quote my favorite poet, they never got to comb gray hair.

Kavanaugh the past 35 years has lived the good life: The best schools, top job on the Starr team, close adviser to a Presidential Campaign and later a President, and presently a federal judge. When has he faced accountability for this? If he did this, Maryland law suggests he does need to be punished for this. I don’t know for how long but our law says you don’t get to come out of hiding after murdering someone and say “Hey, I did it but I’ve been a great guy since then!” I can’t help but to think of the one Patti Hearst kidnapper who lived that after her SLA involvement. This isn’t like hide and seek where you emerge from hiding after the game is long over and everyone’s impressed you hid so long without anyone finding you. This is evading justice.

He’s also giving a speech in New Hampshire Monday evening.

MANCHESTER, NH - U.S. Senator Jeff Flake (R-AZ) will return to the New Hampshire Institute of Politics for his talk, “After the Deluge: A Rejection of Destructive Politics and a Return to Principle,” on October 1 at 6 p.m.

I made the mistake of making today my bi-weekly facebook check. A law school colleague who started off as a DA had a post about Ford and Kavanaugh, about how society doesn’t always treat people the same, used an example from her early career when a group of young white guys got probation for a string of burglaries and the next case was a similarly aged black guy who got prison for basically the same crime. There was then some talk about Kavanaugh’s rant and how it wouldn’t be acceptable for a non-white, non-male person. Another law school colleague chimed in to say how he disagreed with her premise and that Kavanaugh was justified in acting the way he did “if he was innocent.” Friend number two is a straight white guy, and sees nothing wrong in Kavanaugh acting like a loon and still getting on the Supreme Court.

Oh I don’t know, I was assuming Collins, Flake and Murkowski were on the fence.

OK: I thought that particular clown-posse had got tired of scraping their crotches on the fence rails, and had lined up behind Commissar Mitch to confirm Kavanaugh (though with expressions of “concern”, of course). If I’m proved wrong, I won’t feel too bad. Promise!

ALSO: I see the notice says the SJC has “requested the Administration” to conduct a further investigation - what if Trump tells them to go pound sand?

I need a shower after reading this: Man who claims he slept with 6,000 women dies during sex

A legendary Italian playboy has died at age 63 while having sex with a 23-year-old tourist.

Maurizio Zanfanti, dubbed the Romeo of Rimini, claimed to have slept with more than 6,000 women after becoming famous as a nightclub promoter in the beach-side city in the 1970s.

He was entertaining a tourist from Romania in the back of a car Tuesday night when he suffered a fatal heart attack.

The shocked woman called paramedics, but Zanfanti could not be revived.

It’s not even a question of loyalty. I’ve no problem with a candidate saying they wouldn’t support a nominee if they believed that person wasn’t qualified or had some disqualifying position/characteristic. Also I’m pretty sure there’s no rule stating that once the statute of limitations expires that people can be forced to testify about past crimes they’ve gotten away with. At least I’ve never seen or heard of it happening. And even with a firm statute of limitations in play, cases like this involving two or more co-assailants would still be open to conspiracy charges if the last overt act in furtherance of the conspiracy occurred within the conspiracy statute’s own timeframe.

re: #184 EPR-radar

I think Kavanaugh will not survive the investigation.

His prior interactions with the FBI were professional background checks with no specific issues to deal with. This time it’s getting into real law enforcement territory, and the Kavanaugh we saw yesterday is most unlikely to get through a professional interrogation without incriminating himself.

I’m not making any predictions. Anything could happen from an inconclusive investigation which leads to confirmation, or him withdrawing, or a damning report which causes the WH to withdraw his name. All I’m sure of is that McConnell won’t put it to a vote if he doesn’t have 50 locked down.

Not sure how you would go about breaking up Facebook. Would you prohibit people from joining it and make them use other social media companies, because there are already quite a few of them; Facebook is just the biggest.

You can spin off Instagram and Whatsapp as separate companies, for one.

But there are no criminal charges. Pleading the Fifth would be meaningless, wouldn’t it?

It would be stoooopid.

A nominee for a judge pleading the fifth should* be a killer.

Shutting up and not saying anything after yesterday’s display of how he wants to tell everyone how good a man he is and he needs to get his name back…would also be stoooopid.

Brett Kavanaugh has two choices: take the FBI grilling with many other witnessed weighing in or refuse the nomination.

I think the discussion is about Mark Judge, not Kavanaugh. Kavanaugh refusing to speak to the FBI would probably be grounds not only to reject his nomination but to open an impeachment inquiry regarding his current seat on the bench. Mark Judge is a witness and possible co-conspirator, and has every right to assert a Fifth Amendment right in this situation. How a senator then uses that information in their vote for or against Kavanaugh is between them and whichever deity they claim to believe in.

201
BlueSpotinAL  Sep 28, 2018 • 2:46:39pm

What a real investigation would entail is interviewing everybody from back then, not just “accuser” (however many that will be) and Kavanaugh. You cannot tell somebody is lying by facial expressions, or apparent sincerity. You catch them by getting them to say things that are at variance with known facts or statements by others.

I am so glad this week is over.

This was the first time I went public that I was a rape survivor to anyone but my husband and a couple of very close friends. I did not hesitate. I did not think of how many coworkers are on Facebook with me. I have over 500 people attached to me on Facebook. I posted my story online to all of them.

Because it wasn’t my fault and people need to know it’s personal. It’s their friend, colleague, relative. I talked about why I never told and why I never pressed charges. I told it all.

The outpouring of support has been so gratifying to see. But it wasn’t support I wanted. It was for someone to DO SOMETHING. Don’t just shake your head at the tragedy of it all, DO SOMETHING ABOUT IT. And that was visceral, that need for someone, anyone, to make it stop.

I feel like I have worked through something and I am too tired to reflect on it and find wisdom. I just want to feel normal again. That’s all.

Nah. The only real thought behind picking Kavanaugh was that he was the only one on the list with such an expansive written view of executive power and immunity. That’s why Trump desperately wants him and the GOP is in lockstep with Trump, there is no deeper strategy at play.

Also the ones who are worse on abortion like Amy Coney Barrett also make it harder for Murkowski and Collins to confirm, though the fact that she’s a woman might make that bitter pill easier for them to swallow.

Remember when Howard Dean was ruled disqualified to be President because he got excited and yelled yeeargh in a slightly weird way?

Mark Kavanaugh went on a bizarre 45 minute screaming rage rant where he cried about liberal conspiracies, how much he likes beer & lifting weights.

5:04 PM - Sep 28, 2018

1. Dean is a Democrat. Although the media played it up, the issue was that Dean came in third in the Iowa caucuses, which probably indicated that he wasn’t going to win it anyway. I don’t think the yell actually led to future losses; it was just the late night comedians who had a field day.
2. In the age of Trump, for Republican candidates, no behavior is so vile that it turns off the Republican base. Kavanaugh let loose his inner Trump — lying and browbeating the opposition. It worked for Trump.

Right, for a time, I thought he might be because the social conservatives were a little untrusting of him when Trump first made the pick but they’ve gone all in with him and Trump and McConnell definitely like him for their own reasons. Trump because of the exec power stuff and McConnell because they know he’s at heart a good little GOP foot soldier. That’s why W is trying to get support for him too behind the scenes. In a way, I’m almost glad he did that because we forget that W was awful too and he’s the one who brought Kavanaugh into the Exec branch.

Our best hope is probably either that Merkley’s lawsuit stops the confirmation process (super unlikely) or that someone at the National Archives leaks unequivocal proof that Kavanaugh perjured himself and the Trump Administration tried to hide it. Then the midterms put Democrats in firm majorities in both chambers (pretty unlikely) and buoyed by a massive string of strong conspiracy indictments and a report recommending impeachment from Mueller’s team (hard to judge likeliness of this) they have the political capital to hold the seat open through 2020.

Absent all those holes in the swiss cheese lining up sooner or later Trump is absolutely going to fill that seat with an abject monster.

About the internal polling: Yep.

Abso-goddam-lutely right on this one. They’re seeing the numbers coming in from suburban WHITE WOMEN - the ones that they can’t quite figure out how to cleanse from the voter polls or trick into not voting without affecting their own base of knuckle-dragging dipshit white men. Those numbers are showing that not only are the white women not buying the GOP lies, they are infuriated enough to actually get off their asses and vote democratic in November.

Even in deep-red districts, this kind of a wave of pissed-off white women could flip a few seats. In “Leans Republican” seats, you’re looking at a goddam landslide. In Senate seats, if the white women show up as passionate as these numbers reflect, Texas is gone, Arizona is gone, Nevada is gone.

And that’s even without the carry-on effects on black, latino, gay and college-educated (the democratic coalition).

All the GOP will have left is stupid old rural white men. That’s enough to carry the Dakotas and the Deep South, but not much else.

A federal court jury in Los Angeles two years ago found Led Zeppelin did not copy the famous riff from the song “Taurus” by the band Spirit. But the three-judge panel of the 9th U.S. Circuit Court of Appeals ruled unanimously that the lower court judge provided erroneous jury instructions. It sent the case back to the court for another trial.

A phone message left with an attorney for Led Zeppelin, Peter Anderson, was not immediately returned.

A trustee for the estate of late Spirit guitarist Randy Wolfe filed the law suit against Led Zeppelin in 2015.

Jurors returned their verdict for Led Zeppelin after a five-day trial at which band members Jimmy Page and Robert Plant testified.

Randy California’s family gets another shot.

re: #265 Khal Wimpo (the extinguisher of tiki torches)

This is the nightmare scenario for the GOP, since every GOP gerrymandered house district in the nation is in jeopardy if the GOP takes a big hit in its support from white women — precisely because of the gerrymandering.

re: #4 EPR-radar

Only a white man could have said this without being pilloried by the media.

How a senator then uses that information in their vote for or against Kavanaugh is between them and whichever deity they claim to believe in.

for lindsay, that’s brian boitano.

Now my brain is racing to create a list of people I’d be surprised to see depicted on a liquor bottle, and what message they’d convey about the contents.

But there has to be a separate list for serial killers, because otherwise they just dominate the ranks. I mean, put Ed Gein on the outside of anything….

I never understood why there is a celebration of blackouts (think “Last Friday Night” by Katy Perry or “The Hangover” movies. It’s weird to me.

But, I also wanted to point out that there are a number of components to blackout drunk (and genetics play a part), so it’s not as simple as “drink enough and you will be blackout drunk”. I’ve been drunk enough that I was stumbling kissing every single person at a party, threw up multiple times in my dorm, and was still drunk at my 9 AM physics class, but I never stopped forming memories.

And some people can have two drinks in rapid succession on an empty stomach and immediately blackout.

You start using money and influence to buy sex when it’s offered, and to cover up for yourself when it’s not. The Brock Turners of yesterday become the Donald Trump’s of the future, rich white assholes who can buy women and then buy their silence.

We might get our first rain in months. The trees around here are really suffering.

The models have long differed on Rosa. The GFS model first predicted the storm almost 10 days ago and had it coming into Northern Baja, which now looks likely.

And you there in Colorado should prepare for another former hurricane come by shortly afterwards, as a couple of models show the currently developing storm in the East Pacific to come into Baja a few days after Rosa.

It crashed about a half hour up the road from where I work, right around lunchtime. Weather was mostly clear and calm, a pretty quiet, nice Friday, nothing stressful going on. My guess is mechanical failure shortly after takeoff (probably something to do with that cockamamie lift fan system). My boss was in Beaufort around that time, I don’t know if he saw anything. I’m on a 4-9s-and-a-4 schedule this week and was already back across the border in civilization (Georgia) when I heard the news.

I love things with wings, but the F-35 is The Plane That Should Not Be. I can’t like them or give a shit about them, really… Big freaking waste of expertise and $ as far as I’m concerned. I’m glad the pilot got out, and that no rich white people were harmed in the making of this crater.

Really no plane since…the F-15 maybe…has been flyable at all without computer assistance, but they’re really carrying that to an extreme with ever more complex, ever more failure-prone flight control systems. It’ll bite them on the ass someday.

I believe that I owe AnyMouse an apology. He was correct on this and I was not.

Why Maryland police aren’t investigating the Kavanaugh allegations

“The most serious allegation that authorities could pursue, given the sworn testimony provided by Ford, would be attempted rape. But that was considered a misdemeanor in Maryland in 1982, and that would be the relevant legal standard.”

Also

“Among the other challenges: Kavanaugh’s age at the time. Any investigation and prosecution might have to be done under the rules of juvenile proceedings.”
