At this point, given the upcoming elections, I expect 10-15 Republican Senators to vote against Kavanaugh.

I could be completely wrong, of course, but I think at this point he is so toxic to the brand, and so toxic to the structure of the House and Senate, that he is dead meat.

I wish that was true but then I see the latest Quinnipiac poll showing the Republican base energizing over this. And Republican women are marching lock step with the Party to put this ass on the Court.

What about those leaving i.e. Flake? But unfortunately, I think you’re right ultimately. The country is against Kavanaugh but the GOP base firmly with him and that’s our paradox and why we haven’t been able to get real progress and why Mitch is the shitbird he is. The fucking Republican base. Not that I’m excusing the Republican leadership at all in making them the way they are. They own this by not being honest about them that Barack Obama wasn’t a threat to them. They instead played that shit for all it’s worth and it’s why we have a lot of the misfit toys we do in Congress.

If he’s thinking of getting a lucrative banking or DC lobbying job, and that absolutely is what he’s thinking, then his job market value diminishes considerably if he’s perceived as having stabbed Trump and the GOP in the back. He also wants to keep the door open to a GOP Presidential run down the line, and so again being the guy whose attack of conscience just before a midterm election he was too cowardly to participate in also cost Republicans a solid medium term SCOTUS majority doesn’t help him with that. Wasn’t Kavanaugh’s “character” supposed to be one of his strengths going in too. Don’t get me wrong. I doubt Judge Barrett’s personal life is nearly as full of that kind of shit as his is but I’m definitely concerned that with her religious views, she may not be able to separate them from secular law. I’d grudgingly take her though. Perhaps the least evil of the people Trump would probably pick at this point.

That’s an interesting thought. In some ways, Scalia really surprised sometimes. I just hope if faced with a 4-4 tie on Roe, she wouldn’t see it as her “Christian duty” to break it. But I definitely think from what I’ve seen, she’d be the least bad which is probably why she wasn’t picked for this. Well that and she doesn’t have extensive writing on why the President needs protected nor is she a quid pro quo recipient for years of service for the GOP. She’s definitely conservative but in a different way than Kavanaugh is. Kavanaugh is a GOP hack. Barrett actually seems to be from what I know fairly apolitical.

To be perfectly clear I actually meant the Nicole Wallace interview, because, again, I’m slightly drunk. Also I think she is the the only one of those I listed above who was genuinely honest about themselves. What I really liked was despite personally knowing and deeply liking Kavanaugh, Wallace said she found Ford 100% credible and said she felt it was impossible to know what to think about the nomination without a full FBI investigation. Added to that, she’s the only one of Preet’s guests that I mentioned above who I actually felt had a soul. So it’s fairly easy for me to look beyond her past in the Bush administration, and the accompanying deep misgivings that past generates about her associations and her ability to judge character, and feel like deep down she’s still a good person.

The ruling issued late Wednesday by U.S. District Judge Edward M. Chen Wednesday affects more than 300,000 immigrants enrolled in TPS from El Salvador, Nicaragua, Haiti and Sudan.

TPS was created by Congress in 1990 to allow people from countries suffering civil conflict or natural disasters to live and work in the U.S. temporarily.

Wednesday’s ruling came in response to a lawsuit filed by the American Civil Liberties Union (ACLU) alleging the Trump administration violated constitutional protections of due process and equal protection when it announced it would terminate the program, beginning with immigrants from Sudan next month.

Honestly, now that we’ve decided science is just a matter of who shouts loudest, why the hell not?

Supporters of the EPA’s new proposal argue the government’s current no-tolerance rule for radiation damage forces unnecessary spending for handling exposure in accidents, at nuclear plants, in medical centers and at other sites.

“This would have a positive effect on human health as well as save billions and billions and billions of dollars,” said Edward Calabrese, a toxicologist at the University of Massachusetts who is to be the lead witness at a congressional hearing Wednesday on EPA’s proposal.

Calabrese, who made those remarks in a 2016 interview with a California nonprofit, was quoted by EPA in its announcement of the proposed rule in April.

Those people understand the risks and their exposure is closely monitored. These proposals, like every other deregulation move by Republicans, only benefit the corporations responsible for the radioactive sources at the expense of public safety.

As for the claim that some exposure to ionizing radiation might be beneficial to human health, that’s total bullshit. Why is a toxicologist commenting on a subject that a radiologist or a nuclear scientist would be better qualified to serve as an expert witness about?

In the mail today, I got yet another pitch from a charity for veterans. This one’s mission statement says it helps disabled veterans as they separate from the military.

The particular charity in question sent both a t-shirt (which doesn’t fit because I’m a tiny guy) and a cheque for $2.50 (that’s novel, usually they send a nickel taped to the return card).

It is always worthwhile to check out any charities on how they use their money, but there are a lot of grifters who like to wave the flag and “support the troops” to pull at your heartstrings and wallet.

In this case, research shows this charity I never heard of before was incorporated in 2007, fundraising and administration expenses which exceed 75%, and an debt to asset ratio of 192%. They have less than 0.01 years of working capital on hand.

If I cashed that $2.50 cheque, it might bounce.

I get part of where that “a little radiation is good for you” stuff is coming from now.

It turns out part of Operation Plowshare was to release so-called “tight gas” (natural gas locked in shale). An experiment was conducted near Grand Junction, Colorado with three nuclear weapons. It was considered a failure because the blast chambers didn’t connect as the experimenters hoped, and the natural gas in question was deemed made so radioactive it could never be burned.

Fast forward to today. Over thirty permits for fracking have been issued within three miles of the blast site, and eleven within one mile.

According to the video, the family was merely doing their part to ensure that Senate candidate O’Rourke upsets incumbent and second-in-charge of presidential scrotum-handling when Sen. Lindsey Graham isn’t available, Ted Cruz. That’s when a white man, who didn’t happen to give his name, told them to get out of his neighborhood.

“Yesterday, while doing this ‘American as apple pie’ activity within walking distance of my mother’s house, a man approached my mother and daughters and (among other choice words) demanded that they ‘go back where they came from’ because this is HIS neighborhood,” the young girls’ mother wrote on Facebook, Fox 26 reports.

The mother added: “In 2018, some people are emboldened enough in their hate to accost a 70-year old grandmother and her 8- and 10-year-old granddaughters. Please let this be a wake-up call of how real and unhinged the hate has become. We must call it out, and we must demand better.”

“This submission’s references do not show that the subject qualifies for a Wikipedia article,” said the moderator.

At this point, given the upcoming elections, I expect 10-15 Republican Senators to vote against Kavanaugh.

I could be completely wrong, of course, but I think at this point he is so toxic to the brand, and so toxic to the structure of the House and Senate, that he is dead meat.

Thomas was the closest vote in modern times, you can go back much further and find a couple of confirmations that were decided by one vote in either direction. Also, in modern times, Gorsuch is the second closest vote at 54-45.

In a lot of ways, the Court is an anti-majoritarian entity. The majority was opposed to interracial marriage when the Court said, “no, that’s protected.” The majority was (and probably still is) against flag burning when the Court said, “no, that’s protected.” The majority was against same sex marriage when the Court said, “no, that’s protected.” Our system is designed to promote majority rule while protecting minority rights, and the Court is often a backstop to ensuring that minority rights are protected. In fact, much of our system isn’t really majoritarian at the national level - more people voted for Democrats in the House last time, yet the GOP has a majority; we’ve talked about how half the Senate represents only 30% of the Country or so; and of course, the popular vote doesn’t mean much of anything with respect to the presidency. Hell, if a State tried to elect a governor by something like the electoral college, it’d be struck down under the republican guarantee clause and/or the equal protection clause - for the same reason States can’t have legislative bodies based on county lines like they used to.

The majority was opposed to interracial marriage when the Court said, “no, that’s protected.” The majority was (and probably still is) against flag burning when the Court said, “no, that’s protected.” The majority was against same sex marriage when the Court said, “no, that’s protected.” Our system is designed to promote majority rule while protecting minority rights, and the Court is often a backstop to ensuring that minority rights are protected. Interesting you bring that up. Mississippi has exactly that, not only must you win the popular vote, you must win the majority of the districts. It hasn’t been challenged because a Republican has been winning, but there’s a possibility that a Democrat could win the popular vote in 2019.

Seems to me that so much that is wrong with a lot of state laws goes back to that. I’ve been reading on the SPLC about an attempt to repeal Louisiana’s only allowing a 9-3 majority to convict someone of a felony. It’s definitely resulted in a lot of innocent people being convicted of murder and yes it’s mostly racial. Too many white people think the Civil Rights Movement ends with MLK being shot and white people realizing “Hey that MLK guy was all right, we’ll give him a holiday.”

The Democrats should read into the record every time Kavanaugh lied, deceived, or evaded questions during the panel inquiry. It is terrible what has been done to Renate; her name would never have become public if the panel had done its job during the original hearings and rejected Kavanaugh based on his dishonesty and the lack of release of documents on his WH years.

Renate would never have known about how the Georgetown Prep thugs treated her. Now she has to carry this new scar for the rest of her life. It certainly appears that the Georgetown Prep administration did not instill morals or decency in their charges. I hope they are doing better today.

Welp, we all learned (or rather, re-learned) a very valuable lesson out of this:

There’s a fucking reason why women tend not to report: it often ends with them not only reliving the trauma, not only watching their attacker go free, but having their own name equated with ‘liar’ at all levels for daring to come forward. I hope so. I really do. I just think sometimes the nation gets Amnesia which is how not even 2 years after the Financial Crisis we rewarded them with the House and then four years later with the Senate. Of course, a lot of that is on Dem voters who do not vote in midterms.

I did not vote in 2008 for President Obama (or anyone at all) due to my previous homelessness that ended, followed by Oklahoma’s restrictive laws on requiring documentation I was unable to obtain before the cutoff for registration. I am not a big fan of voting by mail. There is no way to validate who actually completed the form; a parent can vote for a child, a husband can vote for a wife. I know personally of a case years ago where a son voted for his mother with Alzheimer’s and was totally incapable of making any decisions; his vote was the opposite of what his mother would have done when she had her faculties. When our mother had Alzheimer’s and was voting, she still had very strong opinions and we followed her wishes even when we disagreed.

There is also the problem that the vote cannot be made confidential; a domineering spouse can force the other to vote their wishes.

That’s the reality. When the new term starts, Roberts will have 4 justices to his right and 4 to his left, and that means he not only decides who wins every case, he gets to write the majority opinion, or appoint the person who will. As of now, the Constitution will mean exactly what Roberts wants it to mean.

That is a problem. Ballots can also be stolen from mailboxes.

The same can be argued for an absentee ballot, and there’s really not much way for citizens abroad or deployed military to vote other than by mail ballots.

Here the requirement is the outer envelope is to be signed by the voter, with a witness signature. The voter’s signature can be compared to the registration card kept on file by the county clerk.

But even in private voting booths, a spouse or another person can offer undue influence (take a picture of your ballot and it better be the way I told you to vote).

Ultimately, any balloting system can be manipulated. The question is how much: To steal ballots from mailboxes for example, you’d have to steal a lot of them to really influence a statewide election. For a Federal election such a campaign of theft would have to be so vast it would be nigh impossible to hide.
