The Justice Department today told the U.S. Supreme Court that businesses can discriminate against workers based on their gender identity without violating federal law. Solicitor General Noel Francisco told the high court that a civil rights law banning sex discrimination on the job doesn’t cover transgender bias. That approach already has created a rift within the Trump administration, contradicting the Equal Employment Opportunity Commission’s view of the law it’s tasked with enforcing.

A Michigan funeral home wants the high court to overturn a U.S. Court of Appeals for the Sixth Circuit decision finding that the company violated federal workplace discrimination law when it fired Aimee Stephens, a transgender worker. The EEOC successfully sued on behalf of Stephens in that case, but the Justice Department has the sole authority to represent the government before the Supreme Court. The DOJ told the high court that the Sixth Circuit got the case wrong.

They didn’t bypass the lower court. They weighed in on an appeal from the Sixth Circuit. That is allowed.

Rowan County Clerk Kim Davis, who got national attention in 2015 for refusing to issue marriage licenses after the Obergefell Supreme Court decision, is up for reelection, and she is defending her homophobia on the campaign trail.

Shortly after the Supreme Court ruled bans on same-sex marriage unconstitutional in 2015, Davis was caught on video denying a marriage license to David Ermold and David Moore.

She announced that her policy was to stop issuing marriage licenses altogether because she was “asked to violate a central teaching of Scripture and of Jesus Himself regarding marriage.”

A judge ordered her to issue marriage licenses and sent her to jail for five days for contempt of court when she refused.

Speaking at the Dewan Rakyat today during Question Time, Ahmad Zahid said he was worried that Malaysia might similarly incur the wrath of Allah due the LGBT community’s activities here.

“We look at the situation in Malaysia, we are worried because we know what happened in Palu recently where there was an earthquake and tsunami. It was reported that there were more than 1,000 members of their community who were involved in such (LGBT) activities.

“As a result the entire area was destroyed. This is the punishment of Allah. My question is whether Jakim’s programmes (to rehabilitate the LGBT) is successful because data shows that in the middle of the year more than 1,000 (LGBT) joined these programmes.

“We need to ensure that Malaysia and those who are against LGBT are spared Allah’s punishment,” said Ahmad Zahid.

I’ve made some contributions to candidates via Act Blue and I am now getting about 100 email messages a day telling me how every candidate is in absolute dire straights with their blue wave advantages crumbling before our eyes. I’m afraid that my budget is maxed out for donations and this constant bombardment of horrible news is making me feel like crap. I’ve got my sample ballot researched and filled out, but in-person early voting here doesn’t start until a week before the election. Despite all the news about early voting crowds, I’m horribly anxious about how this is going to end.

After he was gone, the Judiciary Act of 1869 added one justice to end deadlocks of 4-4 on the court. All attempts at court-packing have since been stopped before they could occur (the last attempt was FDR).

I just don’t have any faith in SCOTUS at this point. Roberts may temper some of the more extreme stuff that Kavanaugh, Gorsuch, and Thomas would want to become the new precedent but Roberts handling on voting rights act shows me the man doesn’t have a damn clue or care about why that legislation was necessary in the first place.

It would be comforting to conclude that the menace of violence surrounding the 2016 presidential election is unique. But my research on the history of voting rights in the United States suggests that this is far from the case. The eldest of three children, he attended Austin Community College from 2010 to 2012, leaving without graduating but in good academic standing.[35] He was home-schooled by his mother, who in February 2013 “officially graduated” him from high school. He wrote blog posts in 2012, where he identified as a conservative who was “not that politically inclined”; he argued for the death penalty, and argued against same-sex marriages and sex offender registries. He reportedly was part of a club called Righteous Invasion of Truth (R.I.O.T.), apparently named after a Carman song. The club’s members, home-schooled kids, practiced survivalism and held Bible studies.

I honestly believe that until they face and reconcile their own racism and misogyny, they’ll never be able to function as a political party ever again, instead they’ll simply devolve into nothing like the Whigs as more and more people come to their senses… I almost wish that they would have their fucking Lee J Cobb moment in 12 Angry Men but it seems like they want to come back to the judge with a hung jury instead…..

Citing law enforcement sources, NBC said a device arrived at the Tribeca Grill early on Thursday local time.

De Niro is a vocal Trump opponent, and once called him “a national disaster”.

I don’t have the time to think through all of the possibilities, (or enough information to make it worth even attempting to do that), but I have a suspicion that Turkey might not be interested in a deal with MBS.

Normally, we don’t see how intelligence agencies gather information, as exposing that information makes it much easier for foreign nations to counter those information gathering procedures.

Right from the start Turkey has been revealing much more about their information gather abilities than you would expect including:

* They have audio recording capabilities inside the consulate’s most protected office.

* The ability to track individuals throughout Istanbul via CCTV.

* Given how quickly the Turkish authorities responded to the event, a very high chance that they had an information source that the murder was going to take place before it was going to take place.

If they were looking to do a deal with MBS, I’m pretty sure they could have done it via private channels that didn’t broadcast all of that information to every intelligence agency in the world.

I think there is a much higher chance that Turkey thinks that the current Saudi Regime is far too unstable, and is gambling that putting this information public is going to either put enough pressure on the Saudi regime to remove MBS, or would at least make his position be more tenuous, so that he’s not as likely to start any more wars.

Of course, if the Turkish intelligence services _do_ have audio of MBS overseeing the murder in realtime via skype (which is not impossible) then what I said might be completely moot, as that would still be a thing worth bargaining for, even after the cost of what info they have given away already.

The politicians who received them all have mail screening and/or Secret Service protection. They were intercepted by authorities.

My concern is if the agitprop from Trump and FOX and other GOP politicians, coupled with the visibility of this campaign, causes other wingnuts to go into “copycat” mode against local people in their areas.

In his talk, Gingrich said that the polarization is “everyone’s fault,” which, okay, but the term “enemy of the people” is utterly unworthy of an American, especially a conservative American who is old enough to remember the Cold War, and what communism was, and is. Annoying start to the day — now that I’m retired, I try to sleep in (really late!) but got an 8AM call on my cell from a 619 number. The person at the other end identified themselves as being from Medicare, told me that I was going to receive an updated card, and then started asking me to confirm information to ensure card was correct; they had correct name, address — all publicly available. I realized this was too suspicious and finally said my information has not changed from the last card they sent and hung up. Even that was probably too much to provide them, but at least I did not reveal anything other than what was already public knowledge — in any case I went online and discovered that these were telemarketers.

I should have known better.

That is both a huge phone and email scam going on. I get both, though I am not on Medicare yet. I just turned 64 in August.

The individual needs to initiate all contact with insurance and banks and the like, or if someone is unable, have their caretaker do the contacts.

Even if it is a legit call, say you will call or visit their office. You make the contacts. It is best just to never trust anything like a phone call or email coming to you.

Or, they aren’t thinking that their bombs wont detonate into a million pieces. Or that the FBI can’t reconstruct bombs from their component parts.

Let’s remind folks that the 1993 WTC bombing was cracked because of a VIN on an engine component and the bomber went to the rental truck company seeking a refund. FBI matched those things up and broke up that terror group.

I don’t think that is clear yet. There have been an awful lot of ex FBI/ATF types saying the bombs for some reason did not go off.

Look at the bomb images. Do you see anything that would trigger them to go off when the envelope was opened?

Most exploding mail bombs are in some kind of a box or container that allows for the container to be the trigger, like a lid or flap.

The images show a funky cheap digital clock that looks to be the trigger.

Until we know for sure, I am going to not believe anything other than it was a pure terrorist result they wanted and got. I keep open the idea they were not meant to work.

I think whoever is behind it is in messing with heads at this point. Sending a message seems to be the goal.

Are you saying I am downplaying all this? I don’t think I said that…so who is saying “but they didn’t work?”

I think it is pure terrorism. I just have a feeling they were sent as a message that had they been set to do their thing look at who all would have been involved.

In some ways I hope this costs Andy Lack his job, He just blew a big hole in the NBC News budget with this booting of Megyn Kelly.

He was foolish for thinking she would ever work out at NBC.

They were eyeing those Fox News ratings with $$ in their eyes. Obviously no-one thought about the fact that obviously racist punditry which doesn’t cause a ripple at Fox News would be problematic on an NBC news show.
