Michael Cohen’s Plea Deal Shows Trump Lied About Not Having Business Interests in Russia

The big news today is that Donald Trump lied repeatedly about not having any business interests in Russia. In fact, he was negotiating with Kremlin officials for a Moscow Trump Tower through his fixer Michael Cohen during the campaign, as he was lying about it, and Cohen then proceeded to lie to Congress about it as well.

This may seem like just one more case of Trump lying through his teeth, but this time it has very serious implications for Robert Mueller’s investigation.

Trump just submitted written responses to Mueller. You can take it to the bank that Mueller knew exactly what to ask Trump, and that he had Cohen’s lies and updated plea already figured out before asking the questions of Trump.

A good prosecutor knows the answers before asking questions of the people he’s deposing or seeking sworn statements from. Mueller’s had the receipts for all of this for a while, and Cohen’s affirmation in court that he lied specifically about the Russia-Trump business while the campaign was ongoing adds to the pile of evidence Mueller has against not only Trump but Ivanka, Junior, and everyone else in Trumpworld.

It’s why Trump’s been slagging Mueller every chance he gets because at a subconscious level Trump knows he’s being boxed in and there’s not a goddamned thing he can do about it because all Trump knows how to do is lie, bully, bloviate, and project.

Except you can’t do any of that with Mueller. All Mueller does is get guilty pleas, convictions, and the evidence to put down Trump’s criminal syndicate.

Now, let’s take the devil’s advocate position. You would need such a series of highly improbable events for anything Trump says about Mueller and this investigation to be accurate. Trump would need people to think that Mueller, who his own people picked, is somehow deep state out to get him. Rosenstein and other GOPers are also deep state out to get him. Whitaker as acting AG also nodded in assent to go ahead with this deal.

Oh yeah, that’s right - Whitaker knows damned well that he can’t and shouldn’t interfere here either, because that too will come to light, and he’s got the same issues Sessions had (probably someone else in his office reminding him that the DOJ serves the US, not Trump).

The Mueller Team criminal indictments and convictions are certainly signs of technical excellence.

But what impresses me more is the story Mueller and his team are telling with them. His story this week was the case of the bad-faith cooperator versus the good-faith cooperator.

Clearly that team knows that this investigation sits right on the boundary between the legal and political. In order to affect the political he needs to make a convincing case to the public by telling it as a story.

Why would he want to do this?

Because, I think, he wants to counter the bigger point that Trump and his supporters are making. That they own the legal system, that they control it, and that the legal system is compromised. This point is continually underscored by McConnell, who admits that he will do whatever is necessary, including acting without any integrity or sense of fair play, to get _his_ lackeys into lifetime appointments in the judiciary.

If the proper secure precautions are taken with counting, why should it matter if properly-submitted ballots (late, mail, provisional or whatever) are counted immediately on Election Night, or later (within a reasonable time)?

That said, Ryan (and some other GOPers) do have a vague fraction of a point re the 2018 midterms: AFAICR, a large percentage of Democratic wins/flips have been by relatively thin margins - especially in those reddish/purple/marginal districts: and, this time round, often by recount/late-ballot/mail-ballot re-totalling, and later-than-usual. It won’t matter for the next Congress, but I just get a feeling that the “blue wave”, while quite broad, is not quite deep enough to portend a fundamental shift in public sentiments (though, of course, it is a fine start). I hope Dems can properly build on their 2018 successes to do as well, or better, in 2020. Especially as regards the Senate: IMO the more-important Chamber to try to control.

Ryan just can’t admit that he was a failure as Speaker and indeed a legislator. The only thing he’s actually famous for in legislation never was going to pass Congress and indeed he had to run away with it once people saw what a pos budget it was and when Romney made him his running mate.

Who to look at: Kushner and Junior. They’ve been trying to cut deals with the Gulf States and KSA. Trump knew or had reason to know this too.

No one in Trumpworld’s upper echelons bothered to divest their holdings or set up chinese walls to segregate their political actions from their personal business. Trump doesn’t hide fact that he considers every visit to his properties to be something that helps his bottom line.

NY has Otisville. The Metropolitan Detention Facilities in NYC are essentially for pre-trial dispositions. Once convicted, they go elsewhere. Otisville is probably the closest, or Fort Dix in NJ.

I’ve started watching Escape at Danemora. Fascinating TV(don’t tell me what happened yet!) but yeah that’s perfect. It’s near the Canadian border and probably one of the more brutally cold parts of an a state that already has brutal winters.

Yeah it is pretty good so far. Benicio del Toro is of course fantastic as always. Patricia Arquette’s character is quite something, too. Paul Dano manages to play some gritty roles. It’s directed by Ben Stiller of all people.

The only other amici in support of the US is by the National Indigenous Women’s Resource Center and by the National Association of Counties. The NIWRC brief raises the issue of dual sovereignty with respect to tribal lands. The states and counties are basically trying to hold onto existing power.

Very interested to see how that case plays out.

Right, the question is how SCOTUS rules on a blanket Ford to Nixon style pardon for “all crimes” committed in a given time frame. If they do strike down separate sovereigns they’re going to have to explicitly say what happens when there’s some degree of statutory overlap. Like, is State tax evasion substantially different enough from Federal tax evasion that double jeopardy can never possibly attach? I’d say yes because false certification of State taxes is a separate criminal act and while the statues may use similar terms but describe distinct offenses. My point is just that the court is going to have to get pretty explicit in its ruling.

That’s probably the right thing for them to do though. Wait for a case to come up where someone was pardoned under state or federal law and prosecuted under the other. That gives the system a chance for attorneys and judges to work out answer at the trial and appellate levels before the Supreme Court has to weigh in.

And more likely there will be a concurring and/or dissenting opinion that will provide some guidance on the issue for future litigation.

— Keep a camera on her. To prove that no one is physically or verbally harassing her. Make sure she knows it.

I remember watching a video made several years ago, of an elderly woman making her first tandem parachute jump. Her chute failed and she was hanging on to the instructor half upside down. Her clothes blew off. It was horrible.

Recently up here a parachute instructor on a tandem jump apparently loosened the harness leaving the parachute with the student and then falling to his death. Experts all said it couldn’t have been an accident and so it was officially declared a suicide.

Trespassing is a tricky thing. If a building is generally open to the public, it’s hard to claim trespassing (like it’s not actually unlawful to cut through someone’s parking lot, even though it’s a technical trespass). Yes: reportedly, the police had to cut her cuffs off to allow her to leave. They probably (rightly IMO) figured it was a cheap price to pay to get rid of a public nuisance….
