Friday, Mar 22, 2019: The Mueller Report Drops

Politics • Views: 39,140

News is breaking all over the place… because the Mueller report has been delivered to the Attorney General and nobody knows what it says yet except the people who worked on it.

But we do know we can expect some massively weird tweets from President Cuckoo Clock in short order.

I’m not sure if I should be excited or terrified that it’s actually been delivered now, because I’m not sure what it exactly portends now.

Just posted this in previous thread and saw this new thread opened.

- - -

The MSNBC panel discussed that Mueller had a narrow area to report on. That goes to Chuck Todd asking if the fact Mueller never really mentioned the Trump kids means they are in the clear.

The thinking is SDNY courts have way more power and cover of the Trump’s and Trump companies. They benefit from Mueller’s discovery and evidence collection and testimony. And much of that is not in the narrow definition of Mueller’s investigation and leaving that to SDNY keeps the “politics” out of it making less a witch hunt and more an investigation that was legally defined.

I mean, the problem isn’t really whether it looks good for Trump.

The problem is whether or not this finally pierces the veil of normalizing that the media seems dead set to operate behind. We know more than likely that the GOP will shrug and act like this not only exonerates Trump but damns the Dems. But it’s going to be important whether this moves the needle far as how the media treats Trump and the GOP now.

Yeah I haven’t heard anything reported from the GOP side yet. Messaging is going to be key in this. I have no idea what Mueller’s report will actually find but I’m thinking it will find that he obstructed the investigation and if you know your Watergate history, that is what did Nixon in, there’s little evidence that Nixon actively ordered the Watergate break in.

So apparently there are no additional indictments. This doesn’t seem like particularly good news. After all, it means the Trump children have escaped any charges.

well, they imagine the GOP are “supposed” to be in power, so when its otherwise, it feels like an anomaly. Same for the media, take for example the way that the media PURSUED Congresswoman Omar for their own characterization of her words (which they twisted out of context) and the fact that as a country, we’re separating families and imprisoning children and people aren’t camped out in front of ICE and HHS offices demanding answers…

Like most things in life, I think the report will be not as good as we hoped, nor as bad as we feared. I don’t think it will exonerate Trump et al. (not that that will stop the mob from claiming it does) but it won’t implicate him directly in crimes.

By all reports, Mueller’s been a straight shooter and faithful public servant throughout his career and he’s not likely to buck the standing DOJ thinking that a sitting president is non indictable, just like I think he’s going to follow proper prosecutorial guidelines in not throwing accusations at people who haven’t been charged.

But I do think he’s going to put enough out there that, for anyone reading between the lines (like say, several interested congressional committees), there will be plenty of threads left to pull on and unravel the whole damn Trump empire.

I think it is yet to be determined that Jared Kushner is getting off. As some were talking today, Mueller is held to investigating Donald Trump.

So, Mueller can be interview by the House Judiciary Committee and they can look into charges against him.

It keeps Mueller tight to his job description. But can;t he talk about more to congress and it has been said he has turned a lot of evidence over to the other US Prosecutors.

Mueller may have learned a lot in his investigation that may not be in his report due to that narrow window he is staying in.

And I think that is done because it cuts down on people saying Mueller was out of control and on a fishing expedition.

And there is talk that Mueller may have been pushed to wrap it up now.

It’s going to take a week or two before we start hearing the real news.

My expectation is that the report will say that Russia interfered in the election (it did) and that Trump family members/employees assisted with that interference (they did), but that there isn’t enough concrete evidence to indict. And with that, Trump will go off on a screaming rant about NO COLLUSION WITCH HUNT and we’ll all just be like, did you not read the report?

Russia is the most alcoholic country on the planet. I’m sure part of that is Siberia, but a large part of the rest is probably just all the mentally broken people coping with the things they have to do to get by.

The good news is that many young men have sworn off alcohol and turned to straight-edge hooliganism.

Yes, but Mueller had grand jury, which has previously indicted.

If said grand jury didn’t make any more indictments, that seems to put an end to alleged criminality, save perhaps for Trump himself, if Mueller believes that a sitting President can’t be indicted.

224
ckkatz  Mar 22, 2019 • 5:05:19pm

At first look, it sounds to me like Mueller mostly indicted and prosecuted people who impeded his investigation.

The facts that he was charged to find in his investigation appear to have largely been forwarded to other teams to pursue.

Even if it is not, the ability of Trump to have programmed his MAGAdolts into believing that if Mueller doesn’t put COLLUSION in 72 point type on the cover then Trump is innocent, will stick with said dolts.

No matter how much other evidence of various wrongdoings have surfaced and will surface about Trump, Trump has succeeded in pushing the public narrative about COLLUSION!!

Mueller had the power to indict, that’s why you convene a grand jury - and he convened two. But it was limited to the scope of the memo creating his office. So if he came across things that weren’t within that scope, he’d have to let the AG (or DAG) know about it and/or refer it to the appropriate US Attorney’s office. Mueller had grand juries in Virginia and DC, I believe. When they found stuff in other jurisdictions, they referred it out accordingly, so the SDNY had some fun.

They may have decided against indictments because of venue - for example Trump Jr’s criminality all seemed to have happened in New York and neither Virginia nor DC may have jurisdiction - or because they didn’t believe they had enough evidence to get a conviction (the old saying is that a prosecutor could indict a ham sandwich, but in practice good prosecutors don’t like to indict if they don’t have evidence for a conviction). That doesn’t mean that the DOJ can’t still pursue the evidence that Mueller uncovered thus far and eventually seek indictments. And in fairness, I’m not a criminal law attorney so I don’t know enough about the procedural aspects to say much beyond that.

I’ve felt that way for months. No point in agonizing over it. I think Mueller would be unlikely to ignore serious leads; he’s the kind of guy who turns over stones when he finds them. If everyone just shut the heck up and made like clams then the path might lead nowhere, but I’ve always said that two people can keep a secret if one of them is dead. It’s not entirely clear that Donald Trump can keep a secret dead or live, but having a team of lawyers pulling his strings for his deposition probably helped.

It may be that Mr. Jones’s speech discomfits folks in Southern New England. Our family and friends lost loved ones at Sandy Hook. But free speech is always tested in the crucible of unpopular, even sometimes irresponsible speech. Mr. Jones has millions of listeners who look to him to understand a bewildering world. He operates a newsgathering organization that may be unorthodox, but is no less real. He seeks the ability to protect the identity of those who contribute tips to his enterprise by claiming the journalistic privilege. A sanction involving the loss of the right to assert privilege on grounds that it has been waived is also unduly harsh. The anti-SLAPP statute and the state’s journalistic shield statute express a strong public policy preference for safeguarding core first amendment values. These values ought not to be sacrificed for the sake of the tender sensibilities of the politically correct. [Fuck You Norm]

If sanctions are appropriate, the defendants request that they be as follows: a waiver of the right to seek compensation for the cost of compliance with the plaintiffs’ burdensome requests, and a date certain by which the defendants must submit discovery compliance or suffer potential loss of the right to make claims of journalistic privilege.

CONCLUSION
The focus of this litigation should not be on what Mr. Jones said and why he said it. The focus should be on what conditions in American life make the sorts of conspiracy theories he is alleged to have advanced so popular to millions of listeners. The answer is simple: there is a broad crisis of legitimacy afoot in the United States. Legitimacy won’t be restored by silencing the unorthodox. The marketplace of ideas is where speech is tested. It has long since been that way in the United States. Do we now enact special rules now because fear is in the air? There is no mob quite so ferocious as a mob of self-righteous folk. Let this case be tested on its merits, not on adventitious posturing and pleading wars.

There’s a fair argument to make that people got their expectations raised too high and that the report will be a disappointment because of that. That people expected too much of Mueller without taking into account the narrowness of the authority he was granted and the corresponding need to limit what he could look into himself versus what he would have to hand off to those with proper jurisdiction. And that too many folks have spent a long time now predicting aloud things that either couldn’t happen or would be very difficult due to such circumstances.

The flip side to that is those with the proper jurisdiction are still investigating and still have the power to royally fuck up Trump’s life. House Democrats can and should continue to investigate everything that is within their authority to investigate, if only because it is their job to provide a check on the actions of the executive branch.

At this point, if the Mueller Report was a single sheet of paper that said “No collusion,” I would actually feel better because at least there would be no uncertainty. But this thing is going to drag on and on and on and during all that time, Trump will still be President, and I’m not excited about any of the 2020 Dem candidates.

So I’ve got some Lagunitas Sumpin Easy, and Mrs. Commodore is cooking mushroom stroganoff.

Fish and chips, that’s what I need. The real thing. Chips with vinegar and salt, hot beer-battered cod or other mild white fish, not too crispy, just right. Lemon wedges optional. I need this.

That’s exactly what I’m eating right now, except I’m in MN so the fish is Walleye. I’m eating the fish with a fork so my fingers don’t make my keyboard all greasy. Food is from Mac’s Fish and Chips on Snelling Ave.

Mushy peas are the modern equivalent of the centuries-old pease porridge, and is traditionally made with dried peas and dyed green.

If I had a week in Paris, I might see everything I’d want in the Louvre… Lyon just means food to me - good food, sausage, pate, coq au vin & local Beaujolais red wine… Avignon is more of the same (burp!) though John Stuart Mill, the great philosopher, died at Avignon in 1873 and is buried in there.

I’ve not heard of the cemetery before. I’ll put that on the list. What Holocaust memorials are there? I went to the one in DC (Twice, once for a college field trip from Chicago), it’s overwhelming to say the least. I got down to the 2nd floor and had to back up against a wall, close my eyes and do deep breathing, before I went into complete hysterics. I was that close to losing it.

I was with three people… Who were waiting for me on the ground floor for more than two hours after they were through with their walkthrough (we wandered on our own). There was so much sadness to take in.

Overwhelming. No other word for it. I’ve heard Yad Veshim in Israel is even more so. I’m not sure I can emotionally cope.

Dachau was hard to deal with but strangely not as bad as a small camp (previously a Belgium fort the Nazis till over) I visited. I was sick after I went there.

The Resistance in the war years would use them for hiding. Really cool. I’d definitely would make my must see that, what’s already been mentioned, & that one famous cemetery. I myself have a New Orleans trip in late May due.

re: #358 MsJ

Has anyone been to/have recommendations for Must See places in Paris, Lyon and Avignon, France?

I saw the Popes’ palace in Avignon and liked it. Paris — Notre Dame and the Eiffel Tower (there’s a Seine river cruise).
