Here’s the thing, though… judges, particularly Supreme Court Justices very rarely reverse their own decisions. For that to happen, something major has to have changed between the two cases. It’s highly unlikely that CJ Roberts is going to find anything so different that he’s going to change his mind completely and decide that the law is now unconstitutional when it wasn’t just a couple of years ago.

I haven’t looked at recent voting patterns, but it’s not uncommon to see different configurations of majorities in Supreme Court cases. 538 has this about the Court prior to Kavanaugh’s appointment, there’s a handy chart that shows that Sotomayor and Roberts have agreed on decisions about two-thirds of the time since Gorsuch took the bench (not sure if that includes unanimous or per curium decisions).

Just as an observation in re: Facebook, it really is a haven for boomers now. There are several former high school classmates who have been reminiscing about Senior Cut Day and other such formative events of our misspent youth in a FB group they formed. Me, I had a pretty good time in high school, but a much more interesting life afterward, so reminiscing about The Good Old Days has less appeal.

I figure since I have spent the last 35 years working with people perpetually younger than me (aka teenagers), I’ve developed a better appreciation of the Now than of the Past. Also, I left my hometown in 1978 forever and have never had a yen to return to it.

We now resume our regularly scheduled programming, now in progress.

‘i havent had an accident in 20 years’ is no reason to cancel your car insurance or not wear your seatbelt

For most of U.S. history, presidents managed to pick AGs who were able to be a functional part of the president’s team, but independent enough to put the country ahead of the man in the Oval Office. But that tradition has weakened considerably in the past 50 years or so; JFK’s appointment of his brother probably didn’t help, nor did Richard Nixon’s (temporary) appointment of Robert “Saturday Night Massacre” Bork, nor George W. Bush’s appointment of Alberto “Hatchet Man” Gonzales. Presumably, we will soon know if Bill Barr will be added to the roll of dishonor.

Yup. I advise my students not to pass up golden opportunities when they pass their way, because when you’re older you’re gonna regret not grabbing the ring when you had the chance. I suspect many people who yearn for the Good Old Days of high school are really lamenting the loss of the dreams they had when they were teens, dreams they gave up to do whatever family and society expected of them.

When I was in HS, I dreamed of traveling the world. And going into space. I’m working on the first dream now. The second will probably require a shiteload more cash.

Then, once you had warehouses of merchandise, what’s going to happen if the warehouse catches fire? A wise businessman would want some protection against those potential losses.

My former GP used to run ‘medical network’ programming, which was a thinly-veiled pitch for pharmaceuticals from a certain brand (Astrazeneca). Over time as I’d go for this ailment or that, I’d notice more and more equipment and digital toys like DVD players, all branded with that company’s logo.

The last time I went to his office, I sat in the waiting room with three salespeople - and they all got in to see the doctor before I did. I found another GP in my town and started seeing him instead. His office has local news on, which I’m happy to not have to pay attention to.

There is so much money being spent by corporations for promotional items in medical offices. I told my wife it reminded me of the the music industry in the late 80s, when record companies had so much money they didn’t know what to do with it all, and they ended up spending a lot of it on pretty expensive promo items.

Good morning.

Yesterday was spent carrying out civic responsibilities (jury duty) that many of our elected and appointed officials seem not to take seriously or only serve in a highly partisan manner. Luckily this kept me from reading media stuff for most of the day and I expect that was a good thing for my sanity.

Today will be spent doing tasks related to gathering a few last tax things for the accountant and then chasing down the HR person of my former employer since I think my healthcare coverage terminates in about a week and I’ve received no notification of that happening. (Which makes all the ACA talk a bit more frightening since I will need to get coverage that way and am solidly in the pre-existing condition camp.)

No one has read the entire Mueller report except Mueller and AG Barr. Everyone bulkshitting on TV or online about the contents of the report are doing so without ever seeing a single page of the report.

Russian foreign nationals indicted

Trump NSA Flynn - plea deal
Trump FP adviser Papadopoulos - plea deal and prison.

Trump’s personal lawyer - plea deal and prison

Everyone in Trumpworld remains suspect. There are still unresolved issues out there that can be assessed only after the full report is released, including lying about any number of issues, obstruction, etc. Trump is hardly exonerated here. Context matters.

He picked all these people who turned out to be liars and implicted in multiple federal felonies. He picks all the best people? Best at criming.

I think the DOJ new position is red meat for the base. They have to know how ridiculous this legal theory is, and are probably confident that at least Roberts won’t vote to overturn the ACA based on it.

This is one of the problems with the executive branch being able to decide which laws it can and/or should defend. I’ve always been skeptical of the idea that the executive can do this. Seems to run afoul of the requirement to “see the law is faithfully executed”.

I went out with friends last night in Pittsburgh. Scoured Google for the right place after way too much catered conference food. Found a place up on Mt Washington with an epic view. Altius is the name of the place. After clouds all day the city gave us a few beautiful sunset minutes. Caught this at the end, liking the lights.

Attorney General William Barr’s summary of special counsel Robert Mueller’s conclusions, in the fancy language of lawyers, impeaches itself. That means that its own words and reasoning call some of Barr’s conclusions into doubt, particularly Barr’s eagerness to say that Donald Trump can’t be proven to have obstructed justice.

It is hard for any of us to know how much credence to give Barr’s précis of the Mueller investigation without knowing more about the evidence. Barr’s letter, however, acknowledges that much and pledges to work to disclose as much as he can without violating Federal Rule of Criminal Procedure 6(e), which bars making public grand jury proceedings. But the attorney general’s eagerness to clear Trump of possible obstruction of justice, after having the report in hand for less than 48 hours, is unbecoming of his office and Mueller’s two-year investigation. Furthermore, some of the reasoning in his letter is clearly deeply flawed….

Throughout his election campaign and long after, Trump denied that Russia was responsible for the massive interference in our election that Mueller has now concluded occurred. Trump made these denials “despite,” to quote Barr, “multiple offers from Russian-affiliated individuals to assist the Trump campaign.” Aside from any crimes Trump or his campaign committed by being in cahoots with the Russians, there are other clear gains to Trump in hindering the investigation. The most obvious is that the Russian interference, which both Barr and Mueller say the Trump campaign knew about, calls the legitimacy of the 2016 election into question.

…To argue that no underlying crime means no obstruction is therefore nonsense. That is fallacious reasoning and it impugns Barr’s integrity and his reputation as a lawyer. Worse, it represents a troubling effort to paper over the acknowledged evidence that Mr. Trump committed a crime in public view.”

I am confused about the Senate Green New Deal bill. Is there actual legitimate proposed legislation in the House, rather than just a wish list of possible programs? I realize until legislation passes the House there is no legitimate bill for the Senate to vote on but still what is in the document they are bringing up for a vote?

Russians took potshots at U2 flights regularly, which is why the US developed the SR-71/A-12.

The full concept of states’ rights were developed in a very different world — our attachments then were, by necessity, to people and places physically near to us. There’s been an outbreak there for the past several weeks, and it’s gotten steadily worse. There are additional outbreaks in Brooklyn too.

This is not the first time in the past several years we’ve seen outbreaks here either.

NYS has to eliminate all the exemptions except for medical necessity. Not just NYS - all the states that allow ideological/religious exemptions.

It’s a public health thing. But we have an antivaxxer in the WH and far too many people think that there’s more harm done by vaccination than not.

Except… polio and smallpox aren’t a thing (they used to kill/maim millions over the existence of those diseases). People died (and still die) from measles every year.

We can prevent some cancers with the HPV vaccine.

But people still buy into the MMR autism bulkshit. Or the latest nonsense du jour about vaccinations somehow overwhelming the immune systems of children/infants (when every breath exposes them to more than any one vaccine could).

I was skeptical of it then as well. I think DOMA was a terrible, stupid, and facially unconstitutional when it passed. But I also believe that the Obama Administration has a duty to defend it in court.

Plus there are ways to defend a law with really defending it. You can cede certain arguments or lead the court to certain arguments where your rational falls apart

But this opens the door to all kinds of trouble. Let’s say the Dems win in 2020 and manage to pass a gun control/background check law and then a Tepublican wins in 2024 and decides he’s not only not going to defend the law, he’s going to proactively decide not to enforce it because he thinks it’s unconstitutional?

I had a friend I worked with that lived just up the road from there on Sycamore St. Don’t know if it is still there but we would always end the night at a bar called Red Beards, a fun little tavern.
