They’re Republicans first. And you know what? That’s their right but don’t act like you’re doing what you do because of Chrits. Falwell knows damn well that Southern Baptists like his asshole father accepted the Roe decision and then used it because their then issue du jere (busing) wasn’t getting them much traction. I don’t like the RCC church but at least they’ve been consistent in their opposition to Roe. They’re assholes for other reasons of course and I say that as a baptized Catholic but at least they didn’t start opposing choice simply for power reasons like the scumbag right wing evangelical racists.

Evangelical Christians are by their own teaching more conservative than the norm of Christians.

Falwell’s father was a bigoted ass who also worshiped at the Alter of Ayn Rand and Conservatism for decades.

They have spent most of my life seeking to grasp the power of the secular state so they can enact a religious agenda.

Lots of Christians (not just Evangelicals) offer the argument that you can use a flawed vessel (in this case Trump) to obtain a good end (in their case theocratic rule).

And it isn’t just Evangelicals; most Christian groups broke for Trump. Hispanic Catholics were the only Christian group Pew Research polled who broke for Hillary Clinton.

Jews, other religions, and atheists/agnostics voted for Clinton, but we aren’t enough by ourselves.

The chart goes back to 2000. Christians are consistently correlated with “Republican.”

Many are individually or in their church engaging in the same self-serving parsing of Scripture. Others are just habituated to a cycle of minimally-shaming and forgiving powerful men who perform the (perfunctory) rituals of piety. Some just have selfish shit that Falwell advances and makes “holy.” Falwell Jr may upset them occasionally, but his behavior fits into cultural patterns they’re already comfortable with, he’s an insider to their community and they’ll shield him from outsiders.

Falwell Jr, including his venality and sex scandal, fall inside what is normal and excusable for these folks, because religion in general and their religion in specific shelters dudes with in-group power by suggesting that everyone in the outgroup is so depraved that their stealing/fucking/grifting/lying is a necessary evil.

I’m aware of that (1980 was the first election I voted in). The Southern Baptist President Carter was thrown under a bus by Evangelicals for Reagan because they wanted power, not good governance.

I voted for Carter. Funny story about that.

I was at sea and had a federal absentee ballot. (Those do not permit you to vote in local elections where you are registered, only federal offices.) That ballot requires either a notary public (not available on aircraft carriers), or the countersignature of an officer ranked O-5 or above (basically a department head in the Navy).

It was passed down that no one could seal their ballot before it was signed, ostensibly so they could “check to see if it was really you casting the ballot.”

It was so officers could check to see how enlisted members were voting. The officer corps has always leaned heavily conservative, and you would be unsurprised to know that my DH was maintaining a list of who voted for who.

Guess how that shook out later in performance evaluations.

All of that is illegal of course, but there is no specific citation for it in the UCMJ, and who’s going to get a federal complaint in the middle of the Med on an aircraft carrier? And if you protested over your ballot being compromised, that would work out worse than simply voting for Jimmy Carter.

Voter suppression has been going on for a long time, and that was my first introduction to it. Intimidation when casting ballots.

It’s a hole in State law. He was told by a Judge that he couldn’t have weapons in his possession after his vehicular assault on his wife, but there is no requirement that local cops enforce that judgement. (!!!)

When she went to his house, used her key, and collected his guns and took them to the cop shop, they arrested her for breaking and entering and grand larceny. Under the law, she is prima facie guilty of that charge and they had no choice. It’s up to the courts to work it out.

Florida: go figure.

My wife is listening an Aron Ra podcast where he is interviewing a woman who used to belong to Rick Tyler’s cult.

He’s the guy who ran in the election in Tennessee with all the “make America white again” billboards.

She notes his church ran a restaurant with all children as workers, and she was the adult overseer (when locals found out he was a Nazi they boycotted the restaurant, causing it to close).

She also claims he is a polygamist (marriages can only be recognised by God, not by any state power) and has twenty children.

She says it was an Ann Coulter book which turned him to his views. Subsequently, he held rallies with people such as Matthew Heimbach.

He is running for President in 2020 on the American Freedom Party ticket (Third Positionism, otherwise known as fascists).

I have never gotten why conservatives could gush at Reagan telling Gorbachev to tear down the wall and then suggest it would be a good idea for our own country. But so much of what conservatives think about immigration frankly comes from a place of great ignorance and I do blame them for that because they choose to only get right wing propaganda that tells them about immigrants raping and murdering. They don’t tell them about 99.9% of immigrants who are here to make a better life for themselves and or tehir families and many of whom just may be making their lives easier whether it’s a service industry job or something else. They choose to be nativist assholes. That’s why I don’t have a lot of sympathy for them. I don’t want them to get hurt by Trump’s policies but I do want them to know damn well that their bigotry is going to fuck them i nthe long run.

When some of my friends post about immigration, some of their ignorant friends show their true colors. They don’t know for instance the conditions that are making people flee Central America. They sure as shit don’t know you need to be in our country to apply for asylum. They definitely don’t know that being undocumented is a misdemeanor and a civil offense and that Trump is separating families over what is in effect equivalent to a parking ticket. They don’t know that it costs in fact more money to treat immigrants like crap tahn humanely. And they’ll never fucking even attempt to empathize? Why because so many of them think their shit doesn’t stink because they were lucky enough to be a cell fertilized in America or later for their mother to give birth to them in America.

I will always blame Trump for awakening ugly xenophobia in this country that went against everything that I grew up with. Immigrants were and always will be a part of my life. They’ve been friends, teammates, roommates, co-workers, teachers, supervisors, and family. That is the argument we need to hit home against Trump’s immigration policy. That it is at its very base nature is anti family.

Yes we do have laws but maybe we need to look at why people come illegally. It’s not because they’re flaunting it. It’s because immigration as opposed to when most white people’s ancestors got here has become consuming both in time and money. If there was violence in my backyard, you sure as hell bet I would want to go to a more safer place where millions have thrived. And you know what? We used to have Presidents that got that yearning. And instead now we have a bully who uses fear of the other to keep his political power. A childish bully who has no idea what made this country the beacon ti was for millions.

Yes, I missed that part. But she had the keys from the police, who could (should?) have withheld them. Once in her custody, given to her by the police, didn’t she have legal access to remove his guns, as required by the Judge and deliver them to the police?

It’s just a legal goat fuck, and a woman in fear for her life is arrested for removing the instruments of her death from a killer who has already made an attempt on her life.

But it wuz hiz gunz she stole.

Turns out they aren’t fans of it. They have similar objections to me about it, along with others.

(via CNN) Households making less than $30,000 per year would pay $25; those making less than $40,000 would pay $57; those making less than $50,000 would pay $98; those making less than $75,000 would pay $164; those making less than $100,000 would pay $270; those making less than $200,000 would pay $485; and those making more than $200,000 would pay $1,000.

We get what O’Rourke wants to do here; it’s a variation on the idea that bringing back the draft might make Americans less likely to rush into foreign adventures, because that could be their son or daughter being sent off to die for oil (or rare earth minerals, for future wars). Only instead of our beloved children at stake, it would be our beloved … money? On the up side, when we say we value our brave men and women in the armed forces, we’d be able to put an exact price on how much.

I was at sea and had a federal absentee ballot. (Those do not permit you to vote in local elections where you are registered, only federal offices.) That ballot requires either a notary public (not available on aircraft carriers), or the countersignature of an officer ranked O-5 or above (basically a department head in the Navy).

It was passed down that no one could seal their ballot before it was signed, ostensibly so they could “check to see if it was really you casting the ballot.”

It was so officers could check to see how enlisted members were voting. The officer corps has always leaned heavily conservative, and you would be unsurprised to know that my DH was maintaining a list of who voted for who.

Guess how that shook out later in performance evaluations.

For an extra layer of WTF-ery on that election… does anybody remember that Carter was a Navy vet (submarines), and Reagan’s only military service was making propaganda films in WWII?

Any lawyer lizards around right now? I’m getting ready for trial in a custody case. Discovery was due on Friday (and that was after my attorney gave them an extension). It’s now Tuesday night and no Discovery. We go to trial on July 18. We are also trying to work out a settlement since he originally offered to give me custody of the eldest and keep it status quo with the younger because that’s what she wants right now…knowing that within a few months of her actually having to live with the girlfriend who is moving in soon, her opinion will likely change and then we have her testimony that she doesn’t want to live with dad, either.

How do I go forward without the Discovery from him? Is this usually a big deal with the courts when the other side doesn’t deliver on time? I’ve got no clue.

Yeah. He shat on Attlee a lot but Attlee did more to make the life of the average British subject better. I think he was well spoken with many good one liners but imo like Thatcher later his faults were many especially in the post WWII world. They just see Winston as the chubby guy with one liners who worked with FDR to defeat the Nazis. They don’t see the unrepentant imperialist who was definitely bigoted and whose imperialist instincts led to trouble in Ireland, India, & others. Thatcher likewise is seen as Reagan’s BFF in fighting the USSR and her staunch support for right wing tyrants like Pinochet and retrograde policies like poll taxes is forgotten which was of course why many Brits weren’t exactly mourning her. I get what she did for women leaders but I’m not an admirer. Both are better than the UKIP and Boris Johnson/Teresa May but both are overhyped for the reasons stated.

It’s now Tuesday night and no Discovery. We go to trial on July 18. We are also trying to work out a settlement since he originally offered to give me custody of the eldest and keep it status quo with the younger because that’s what she wants right now…knowing that within a few months of her actually having to live with the girlfriend who is moving in soon, her opinion will likely change and then we have her testimony that she doesn’t want to live with dad, either.

How do I go forward without the Discovery from him? Is this usually a big deal with the courts when the other side doesn’t deliver on time? I’ve got no clue.

You need to talk to your attorney about that.

Gabriela Cattuzzo, a streamer who primarily broadcasts on Facebook from Brazil, has been dropped from gaming peripheral maker Razer’s influencer program after she tweeted that “men are trash,” which Razer Brazil said counted as “Extremism.”

Last week, Cattuzzo tweeted a photo of herself riding a mechanical bull, to which a user on Twitter replied saying “you can ride me as much as you want.” Cattuzzo responded to the user, saying “There’s always an asshole to say shit and sexualize women, even when the woman is making a joke, right? That’s why men are trash.”

Gamergate was (and in many ways still is) a thing after all. Misogyny is an issue that’s plagued gamer culture for decades and has become only more visible with time. And while I believe there have been cases of sponsored streamers dropped for various reasons, I rarely have seen one with this kind of statement claiming outright victimhood the way Razer Brazil’s did.

When she went to his house, used her key, and collected his guns and took them to the cop shop, they arrested her for breaking and entering and grand larceny. Under the law, she is prima facie guilty of that charge and they had no choice. It’s up to the courts to work it out.

1) I’m still not sure Cattuzzo’s statement calling men ‘trash’ approaches ‘venomous’ in the way it happened.

2) That’s just the thing, this stuff isn’t happening in a vacuum. If this was a man doing this, the misogynistic behavior it would encourage would be far larger in scale than any supposed ‘misandrist’ behavior Cattuzzo’s statement did (hell, it seemed to stir up the misogynistic crowd anyhow).

3) Female gamer crowds already face a lot of shit, from dumb gendered appeals by companies to the harassment and venom in gaming communities. A male spokesperson or sponsored influencer going out with dumb statement like that, even without much prior history, can easily threaten a company’s outreach toward female customers if it’s seen as encouraging that kind of behavior. There’s no equivalent threat of turning off male customers wholesale from a sponsored female influencer making this kind of statement.

There’s no real point in trying to come out with hypothetical equivalent scenarios, because the playing fields aren’t anywhere equal at all. It’s the same kind of shit like with people online casting doubt on sexual harassment victims, up to and including insults like ‘bitch’ and ‘slut’, only to cry out about man-hating when women call out men in general for this kind of encouraged behavior. If the playing fields were equal, there might be a point, but they are so absolutely not level.

There’s no real point in trying to come out with hypothetical equivalent scenarios, because the playing fields aren’t anywhere equal at all. It’s the same kind of shit like with people online casting doubt on sexual harassment victims, up to and including insults like ‘bitch’ and ‘slut’, only to cry out about man-hating when women call out men in general for this kind of encouraged behavior. If the playing fields were equal, there might be a point, but they are so absolutely not level.

You’ve a company that, by the logic I’m seeing expressed, is aimed at a largely male demographic. And a spokesperson for that company comes out and screams that the customer base for that product are “trash.” A customer base that did not respond by having a public discussion about why she made such a statement, but instead ramped up the abuse and attacked her in various ways. What do you believe the company should have done?

Court papers: Man accused of building bomb in Lebanon County wanted to warn police of alien threat

The affidavit stated Oxenreider told police he wasn’t trying to hurt anyone but wanted to talk to them about things he has been experiencing. He told investigators he had gone to several agencies but no one would listen, the complaint said.

The complaint stated:

“The defendant related back in 2014 he had an encounter with a UFO ship and aliens. These were recent enough that there’s a great many living witnesses, living perpetrators, living victims, and substantial documentation proving that it was a deliberate federal and/or state policy.

1. They really shouldn’t have to make decisions about how to pay for college.
2. (And this is the big one) You are paying for both of those every day of your life, with interest, until we solve it.

Think of it this way: Which is cheaper, paying for your house up front, or with a loan? Up front right? And you would actually be cheaper to your employers if you didn’t have to pay the interest on your house loan. The same thing happens with college loans. Not only are you going to pay for the services of a doctor, you’re also paying for the interest on the loans to get through school.

Reparations are not just about slavery as mentioned above.

As for those student loan decisions, I was lucky to graduate without debt with the aid of Social Security, BEOG funding and cheap in-state tuition. Part-time student jobs dishwashing or working in the library helped cover the rest.

University tuition has increased at a rate of something like 300% over inflation, there is something wrong with that. I would support a plan to forgive some or all outstanding debt.

Japanese Americans interred during WWII.
Native Americans for centuries of mistreatment (some of which is still ongoing).
Pigford litigation.

They can do so again. It would take a bunch of genealogical work, but you could figure out a fund and compensation amount to those whose ancestors were enslaved.

It isn’t controversial to do reparations. What apparently is controversial is that some people think that making African Americans whole for the damage and treatment done for centuries of brutality, racism, violence, and enslavement is somehow not warranted or too costly.

Think of it this way: Which is cheaper, paying for your house up front, or with a loan? Up front right? Not only are you going to pay for the services of a doctor, you’re also paying for the interest on the loans to get through school.

My parents’ undergrad degrees were free; summer jobs and GI Bill and mom working paid for dad’s med school.

Which meant that when he got his MD they had zero debt, plus enough cash on hand to buy a car and drive cross-country to where his internship was, rent a decent house, and mom could stay home with newborn twins while he was doing his internship. I was born the year he finished his residency.

So the day he passed his Boards and could go into private practice, they could start right away saving for a down payment on a house, which they then of course furnished. None of that economic activity (times however many of their generation had the same circumstances) would have occurred if they’d had to spend the next 20 years paying off loans.

(and the govt did ultimately get their money back, in the form of 40 years highest-bracket income tax. Plus of course it was a useful thing for society at large to have another doctor existing and doing his job).

It was the dotcom boom and the state was flush with cash. Rather than use the extra money to strengthen and expand the system (knowing full well it was already straining then), they kept cutting tuition rates. I mean, I appreciated it at the time because it meant I was student loan debt free when I graduated, but it wasn’t the most foresight by the state.

Proxy election yesterday in Queens, NY.

The race was for the Queens DA, to fill a seat vacated by the passing of Richard Brown.

It’s too close to call with 99% votes in and will go to a recount, but Melinda Katz appears to have lost to Tiffany Cabán. Cabán had backing of the likes of the progressives who launched AOC, AOC herself, Warren, Sanders, and the NYT. Katz has been a fixture in NY politics for years (she had been in the Assembly and then the Borough President) and had backing of several prominent African American leaders, including Rep. Meeks (who became the county leader after AOC beat Crowley).

Katz hasn’t conceded. Cabán is acting as the winner, and expect a recount, and absentee ballots to be counted, which could sway the total.

The race was for the Queens DA, to fill a seat vacated by the passing of Richard Brown.

It’s too close to call with 99% votes in and will go to a recount, but Melinda Katz appears to have lost to Tiffany Cabán. Cabán had backing of the likes of the progressives who launched AOC, AOC herself, Warren, Sanders, and the NYT. Katz has been a fixture in NY politics for years (she had been in the Assembly and then the Borough President) and had backing of several prominent African American leaders, including Rep. Meeks (who became the county leader after AOC beat Crowley).

Katz hasn’t conceded. Cabán is acting as the winner, and expect a recount, and absentee ballots to be counted, which could sway the total.

So, I was just doing some research. The distance from the capital city of Guatemala to Laredo TX is roughly 1500 miles.

That would be about the same as WALKING the entire U.S eastern seaboard from Portland, Maine to Miami. The average human walking speed is 3 MPH (meaning if you walked 12 full hours in a day you could cover 36 miles), and that’s when walking on generally flat, smooth terrain which most of the area between the U.S. and Central America is NOT.

Not to mention when journeying from Guatemala to the U.S. you have to contend with paramilitary groups, drug cartels, various types of dangerous animals, the aforementioned unforgiving terrain, not to mention the strain and fatigue that comes with being exposed to the elements (especially when it is hot) for days on end.

People do NOT come to the decision to make this journey lightly and that goes whether they are planning to enter via legal means or not. In fact they frequently pay human smugglers known as coyotes thousands of dollars for assistance on their journey.

I don’t know about you, but I think long and hard before dropping a few thousand bucks on anything.

Consider how bad it is in these countries for people to look at all the obstacles involved in coming to the United States and think: “I still want to do this.”

My niece isn’t much older than my father’s grandfather was when he got here from Germany. I don’t know what specifically made his father decide to leave Germany but I do know that the people who bash Hispanics or MEers for bringing their children on difficult journeys don’t have a problem with what his parents did. Ditto Dad’s great grandfather who fled the Potato Famine as a child. Desperate times. It makes me angry to see people with Irish, German, & Slavic surnames especially engaging in Know-Nothingism.

The company that owns the Philly oil refinery that saw those huge explosions and fire last week is filing its intent to shutter the facility and lay off its staff. The facility is the largest oil refinery on the East Coast, and the shutdown is likely to cause gas prices to spike across the region.

Perhaps nobody’s explained to him that it’s not “the Democrats’ asylum policy” — it’s international law, we’re the ones who came up with the idea and pushed the rest of the world to get onboard and we signed and ratified treaties about it in 1946, expressly because Nazis.

(in 1936, European Jews applying for US visas faced an 11-year waiting list. By 1939, the waiting list was closer to 25 years. They obviously didn’t have that long.

The UK was almost as stuffy as us about grown-ups trying to escape Europe, but at least they accepted the Kindertransport.)

In Supreme Court news today… it looks like the law regarding interpreting regulations is going to get more complex:

This Court’s deference doctrine is rooted in a presumption that Congress intended for courts to defer to agencies when they interpret their own ambiguous rules. The Court adopts that presumption for a set of reasons related to the comparative attributes of courts and agencies in answering interpretive questions. But when the reasons for the presumption do not hold up, or when countervailing reasons
outweigh them, courts should not give deference to an agency’s reading. The Court as thus cabined Auer’s scope in varied and critical ways.

First and foremost, a court should not afford Auer deference unless, after exhausting all the “traditional tools” of construction, Chevron U. S. A. Inc. v. Natural Resources Defense Council, Inc., 467 U. S. 837, 843, n. 9, the regulation is genuinely ambiguous. A court must carefully consider the text, structure, history, and purpose of a regulation before resorting to deference. If genuine ambiguity remains, the agency’s reading must still fall “within the bounds of reasonable interpretation.” Arlington v. FCC, 569 U. S. 290, 296. And even then, not every reasonable agency reading of a genuinely ambiguous rule should receive Auer deference. Rather, a court must also make an independent inquiry into whether the character and context of the agency interpretation entitles it to controlling weight. See, e.g., Christopher v. SmithKline Beecham Corp., 567 U. S. 142, 155. The inquiry along this dimension does not reduce to an exhaustive test, but the Court has laid out some especially important markers for identifying when Auer deference is and is not appropriate. To begin with, the regulatory interpretation must be the agency’s authoritative or official position, rather than any more ad hoc statement not reflecting the agency’s views. Next, the agency’s interpretation must in some way implicate its substantive expertise, as the basis for deference ebbs when the subject matter of a dispute is distant from the agency’s ordinary duties. Finally, an agency’s reading of a rule must reflect its ” fair and considered judgment.” Auer, 519 U. S., at 462. A court should decline to defer, for example, to a merely ” ‘convenient litigating position,’ ” Christopher, 567 U. S., at 155., or to a new interpretation that creates “unfair surprise” to regulated parties, Long Island Care at Home, Ltd. v. Coke, 551 U. S. 158, 170. Pp. 11-19

This is how the voting broke down:

KAGAN, J., announced the judgment of the Court and delivered the opinion of the Court with respect to Parts I, II-B, III-B, and IV, in which ROBERTS, C. J., and GINSBURG, BREYER, and SOTOMAYOR, JJ., joined, and an opinion with respect to Parts II-A and III-A, in which GINSBURG, BREYER, and SOTOMAYOR, JJ., joined. ROBERTS, C. J., filed an opinion concurring in part. GORSUCH, J., filed an opinion concurring in the judgment, in which THOMAS, J., joined, in which KAVANAUGH, J., joined as to Parts I, II, III, IV, and V, and in which ALITO, J., joined as to Parts I, II, and III. KAVANAUGH, J., filed an opinion concurring in the judgment, in which ALITO, J., joined.

So, technically it’s a unanimous decision, but with so many different opinions it’s probably going to mean this issue will be back before the Court in a decade’s time, I’d guess.

Personally, I’m skeptical of any deference being given to the agencies on regulations. I think they should have the same standard of review as the laws on which they are based.

That place probably becomes an immediate Superfund site once it closes.

I used to work for Sunoco - but in an area (plastics) they sold off at the time they were selling off all their other refinery assets in order to simply concentrate on logistics (moving and mixing oil products) and marketing. Refinery profits run on cycles and it’s easy to get into a cash squeeze since the refineries have considerable fixed costs and if the marginal profits on the various splits* are not enough you will bleed money.

And the machinery in that refinery is made to use “sweet” crude. So limited locations they can get their feedstock crude from.

* - There is a constant calculation of what is the most profitable way to refine a barrel of oil. If you make aviation fuel, for instance, you are limited to what other products that barrel creates. So you have to look at what the demands are for the different products are at the time and pick the best combination. So often making unleaded gasoline for cars is not necessarily the best thing to be doing solely on that basis.

Asylum is legal immigration. You can claim it affirmatively upon entry and presenting yourself to an official to seek asylum or defensively as a means to prevent deportation. From the USCIS site:

Every year people come to the United States seeking protection because they have suffered persecution or fear that they will suffer persecution due to:

Race
Religion
Nationality
Membership in a particular social group
Political opinion
If you are eligible for asylum you may be permitted to remain in the United States. To apply for Asylum, file a Form I-589, Application for Asylum and for Withholding of Removal, within one year of your arrival to the United States. There is no fee to apply for asylum.

You may include your spouse and children who are in the United States on your application at the time you file or at any time until a final decision is made on your case. To include your child on your application, the child must be under 21 and unmarried. For more information see our Form I-589, Application for Asylum and for Withholding of Removal page.

The people seeking asylum are doing so because they’re being persecuted, trying to escape violence/war/civil strife, economic collapse of their home countries, etc., and are risking it all to make the journey to the US to seek a better life.

Trump’s turned all this on its head and trying to deter all nonwhites from entering the US, particularly via asylum, because his entire worldview is racist and misogynistic to the core.

Trump doesn’t care about the law - he only cares about removing the nonwhites from our midst (except when they work for his golf resorts and he can profit from it).

So, I started reading The Plaza: The Secret Life of America’s Most Famous Hotel last night. It’s the story of the famed Plaza Hotel in NYC, and I had forgotten that Trump had owned it at one point. What the intro reminds me of not only how much Trump paid for it, but that he put Ivana in charge, paid her $1 a year plus all the clothes she wanted, and that Trump ultimately got so bogged down on the debt with the purchase that he had to sell to get out of hock. In fact, Trump got rid of it as a prepackaged bankruptcy. The purchaser? Saudi prince Al-Waleed bin Talal. It’s changed hands a couple times since, and now a Qatari group owns it. The hotel is a shadow of its former self, as the building is subdivided into a hotel and condominium, and the public spaces are a fraction of the size. The condos are now where anonymous foreigners are parking their ill gotten gains as real estate holdings.
