Our Horrible President Comes to the Defense of Alex Acosta, Who Oversaw Epstein’s Wrist-Slap Deal

Politics • Views: 21,739

It’s not surprising, but today Donald Trump finally broke his silence on Alex Acosta, who oversaw the outrageously lenient deal that helped Jeffrey Epstein evade justice and harm uncounted children. Trump says he feels “very badly” — not for the children victimized by this predator and his cronies, but for poor Alex Acosta. He says Acosta didn’t make the decision to grant a plea deal to Epstein.

That’s a lie.

Trump also said he “wasn’t a fan” of Jeffrey Epstein, and that he had “a falling out with him.”

This is almost certainly another lie.

It’s very striking that Donald Trump has repeatedly expressed sympathy for powerful men accused of sex crimes — but he never expresses sympathy for victims of sex crimes.

Acosta is being dragged and ratioed for all his tweets today claiming he gave Epstein a cushy deal, and that based on what we now know, he hopes Epstein is punished.

Bulkshit. Revisionist history bulkshit.

At the time of the plea, there was enough evidence to throw Epstein down a dark hole never to reemerge. He should have gotten life then based on molesting all those young girls.

In 2008, federal prosecutors in Miami — led by former U.S. Attorney Alexander Acosta — drafted a 53-page indictment against Epstein, including charges that could have put him in prison for life. But Acosta made a deal with Epstein’s legal team that resulted in 13 months in jail and a non-prosecution agreement for any possible federal charges. According to a copy of the non-prosecution agreement, the likelihood of a federal charge had been high: The FBI and the U.S. Attorney’s office determined that from 2001 to September 2007, Epstein had conspired to persuade minors to engage in prostitution, conspired to transport minors across state lines for the purpose of illicit sexual conduct, and recruited a minor across state lines to engage in a commercial sex act.

Acosta immunized coconspirators too. That’s absolutely crazy given the circumstances. Everyone got off scot-free or with a slap on the wrist. That SDNY is trying to hold Epstein accountable is the exception. Thus far, the rule is if you’re powerful and rich, you can avoid justice for years on end.

Everyone’s thinking about this in terms of Trump being part of the demand side of this shit, but he’s been proximate to people on the supply side. too. Trump also hung around with Nick Casablanca and a bunch of other dudes that ran “modeling agencies” that (1) trafficking teenaged girls under the guise of modeling contracts, (2) were abusers as well as exploiters. Trump Modeling was built on the exact same methodology as Casablanca’s Elite Modeling.

Also, while anyone can end up coping with the experience of discovering an abuser amongst their circle of acquaintances, it is very fucking weird for one guy to have multiple instances of social connection to more than one set of organized traffickers/abusers.

Not that it matters. Trumpism is libertine nihilism with a thin coating of conservative tropes, and the cultural institutions of the right prior to Trump have created elaborate justification systems for why powerful dudes can be forgiven and people who’ve been victimized are actually to blame.

That’s the bottom of this shit: these are people who don’t believe in anything, but cling to the externalities of belief—religious ritual, legal formalities—because it shields them.

Asset forfeiture is a possibility (and it was included in the indictment filings), but I’m not sure if it could go to restitution of victims.

Yes, I know, that’s 10 months away. Yes, Trump can continue to do some damage in 10 months, but if all a Democratic House accomplishes is making Trump a martyr to Trumpers then it will be for nought.

62
lawhawk  Jul 9, 2019 • 11:31:45am

Acosta must resign, but we know he wont. This is how Trumpworld operates.

Impeachment wont solve this any more than it would against Trump as the GOP will close ranks and protect their own despite the craven criminality, misconduct, incompetence, and inability to do basic vetting of officials (which the Senate GOP ignored to rubber stamp another right wing extremist).

Acosta made awful decisions that put children at serious risk of harm. He enabled a sex predator and enabled child sex trafficking among him and his associates. That’s unconscionable. And the GOP is fine with it.

It speaks of awful judgment but I don’t see how that rises to an impeachable offense. There’s far more to go after with Trump on impeachment - as in actual federal felonies in which Trump specifically engaged in, knowing full well that the GOP will not convict in the Senate. Why would anyone think that they’d be any less forgiving of Acosta who didn’t personally break the law? They’ll protect their own.

I see this more as judgment calls on the plea deal, and I think the GOP would find that sufficiently plausible. She may think that this wouldn’t get us closer to ending Trumpworld, and would deflect from going after Trump directly (such as it is, where they’re still ignoring subpoenas without consequence).

I get how if you actually threaten and move forward with impeachment, you force the GOP to defend the guy who cut a sweetheart deal with a child sex molester and immunized his fellow sex predators who raped children. I just think that the GOP are willing to defend the indefensible, because they think they fucking can - with no consequences. They have gamed the system to their benefit.

im actually seeing two sides to this - the side you describe - sort of from the base

and trumpism from he himself. as krugman said last year, he is no populist

Watching Trump in action, it’s hard to escape the impression that he knows very well that he’s inflicting punishment on his own base. But he’s a man who likes to humiliate others, in ways great and small. And my guess is that he actually takes pleasure in watching his supporters follow him even as be betrays them.

Anyway, whatever his motivations, Trump in action is the opposite of populist. And no, his trade war doesn’t change that judgment….Furthermore, the Trumpian trade war is being carried out in a way that produces maximum harm to U.S. workers in return for minimum benefits.

While he isn’t a populist, however, Trump is a pathological liar, the most dishonest man ever to hold high office in America. And his claim to stand with working Americans is one of his biggest lies.

Which brings me back to media use of the term “populist.” When you describe Trump using that word, you are in effect complicit in his lie — especially when you do it in the context of supposedly objective reporting.

And you don’t have to do this. You can describe what Trump is doing without using words that give him credit where it isn’t due. He’s scamming his supporters; you don’t have to help him do it.

Ben Sasse was one of the people to actually raise an alarm about Acosta recently.

I can’t see any senator wanting to go into 2020 defending a guy who made a deeply suspicious sweetheart deal with a “billionaire” pervert.

re: #73 A Mom Anon

That’s correct. Impeachment is a political process. It doesn’t require a criminal conviction, but in practice, having a criminal record and indictments would bolster the case. Otherwise, it would seem as though you’re trying to remove for a policy difference, and not because of “high crimes and misdemeanors”.

You can argue that Acosta imperiled 100s of children, and let sex predators loose, but we all know that prosecutors have done plea deals that let rich and powerful skirt justice since forever. It’s a judgment call - an almost uniformly awful one where rich and powerful are immunized against their criminal conduct, while their victims never see justice. We see this with rapists who are rich/powerful, but women who allege rape/sex abuse infrequently see justice because prosecutors don’t take the cases seriously, investigators don’t process rape kits, etc., and the system is stacked against the victims.

I’m willing to be wrong and watch Acosta get impeached, but I don’t think the Senate will remove, and the effort to impeach means time Democrats can’t go after Trump.

There’s only so much time in the calendar to do that - and even that time is running out. It’s getting late early.

Some of the biggest Trumpers I know are fathers of girls. How given the way Trump treats women and responds to women being abused astounds me. I’m just glad the fathers and grandfather’s I look up to are repulsed by Trump.

Living in a social conservative area (that’s rife with sexual hypocrisy), I’ve grown up around men who view their daughters as one kind of object—to be kept pure and passed to an “acceptable” male—and women they want to be sexually available as a different kind of object. And that happens within a larger cultural context where there’s a madonna/whore complex built into religion and gender norms, but then is refined when assholes come together and give each other permission to be predatory. Sometimes that’s just the local bros who hang out together, but it’s also how The Catholic Church’s predation problem just keeps chugging along.

A subset of victim-blaming is demarcating the “wrong” types of people who a priori cannot be sexually victimized. That conservative sexual mores create a permanent demimonde of individuals who’ve lost their social value is a feature not a bug, because it creates acceptable targets for exploitation and outright predation.

Bulkshit. Revisionist history bulkshit.

At the time of the plea, there was enough evidence to throw Epstein down a dark hole never to reemerge. He should have gotten life then based on molesting all those young girls.

Acosta immunized coconspirators too. That’s absolutely crazy given the circumstances. Everyone got off scot-free or with a slap on the wrist. That SDNY is trying to hold Epstein accountable is the exception. Thus far, the rule is if you’re powerful and rich, you can avoid justice for years on end.

if any of epstein’s crimes occurred after his skate, Acosta will be absolutely wrecked from this point on. No one’s inviting him to any dinners with the kind of stink he would bring with him.

Just paged this today - it turns out that the whole Seth Rich conspiracy theory was pushed by the Kremlin

In her efforts to better understand where the conspiracy theories were coming from, Sines used her security clearance to access copies of two SVR intelligence reports about Seth Rich that had been intercepted by U.S. intelligence officials. She later wrote a memo documenting the Russian role in fomenting the conspiracy theories that she sent to the Justice Department’s national security division, and personally briefed special counsel Robert Mueller’s prosecutors on her findings.

“It appeared to me that it was a very clear campaign to deflect an ongoing federal criminal investigation,” Sines said. “So then you have to look at why is Russia doing this? … It’s not rocket science before you add it up and you go, ‘Oh, if Seth is the leaker to WikiLeaks — it doesn’t have anything to do with the Russians. So of course Russia’s interest in doing this is incredibly transparent.” The Russian strategy, Sines said, was diabolically simple: “Let’s blame it on Seth Rich. He’s a very convenient target.”

What I saw is that the photos etc were previously unknown. Also, the deal (according to the NYT and of course IANAL) does not preclude any other federal district from charging….and some of the crimes happened in NYC which means that SDNY gets a bite at the apple. Moreover, since he wasn’t charged with anything except pandering, there is no double jeopardy issue and there is no statute of limitations on this either.

re: #120 lawhawk

And yet there’s some discussion today that suggests that the prosecution deal prohibited further prosecutions for the same crimes (and that Epstein will assert double jeopardy).

nytimes.com

Mr. Epstein can be prosecuted by the Southern District of New York because his agreement was with the United States attorney’s office for the Southern District of Florida. As New York federal prosecutors noted, the agreement does not bind other offices. In fact, Justice Department policy prevents United States attorney’s offices from making agreements that limit other offices.

Mr. Epstein will not be able to stop the new charges from going forward. There is no statute of limitation in cases like this, and because he was never charged with a federal offense, there is no double jeopardy issue. New York prosecutors can charge him with the entire scheme, including his activity in South Florida, because his alleged crimes occurred in part in New York.

So Mr. Epstein, 66, will have to go to court and fight the charges or accept a lengthy prison term, which could effectively be a life sentence. At trial, he will face testimony from three former employees who aided his sexual abuse of children, all of whom are described in the indictment. They most likely received deals from prosecutors because they have serious liability for Mr. Epstein’s abuse.

Federal prosecutors told the court that they have extensive documentary evidence, including contemporaneous notes and call records confirming that Mr. Epstein and his accomplices communicated with victims. In a search of his home over the weekend, law enforcement recovered what prosecutors described as “an extraordinary volume of photographs of nude and partially nude young women or girls.” A jury will find those
photographs, and the alleged sexual trafficking of minors, highly disturbing.

The best evidence in the case, in fact, may result from the non-prosecution agreement itself, which required Epstein to plead guilty to a state charge of solicitation of minors to engage in prostitution. Under an obscure provision of the Federal Rules of Evidence, that conviction may be admissible at trial against Mr. Epstein.

As a general rule, juries are not permitted to learn about a defendant’s prior convictions. Juries are supposed to convict based on the evidence of the particular crime before them, not infer that the defendant committed this crime because he committed a similar crime in the past. But criminal cases involving “child molestation” are an exception.

As long as the government can prove that Mr. Epstein’s state conviction resulted from “molestation” — which is broadly defined — of a minor under the age of 14, the conviction can be used against him in this new case if part of the conspiracy case involves allegations that he abused a minor under 14. If prosecutors successfully get Mr. Epstein’s prior conviction in front of the jury, it will be hard for jurors to vote to acquit.

Ouch.

So this wasn’t a judgement thing in his own excuse. He says he was told to not pursue the case because of national security concerns.

This needs to be investigated.

I saw another motivation for the plea deal talked about in an Atlantic article by a former Federal prosecutor:

But Epstein could afford the lavish attention of a defense team staffed by legal luminaries such as Alan Dershowitz and Kenneth Starr. Most of us hope an attorney will defend us competently at trial, but the superrich can afford to go on the offense. Epstein’s lawyers hounded the U.S. Attorney’s Office for the Southern District of Florida, which was considering federal charges, based on reports that Epstein had procured underage girls across state lines. Former U.S. Attorney Alex Acosta—now President Donald Trump’s secretary of labor—characterized the tactic as a “year-long assault on the prosecution and prosecutors,” and complained that Epstein’s team investigated prosecutors and their families, “looking for personal peccadilloes that may provide a basis for disqualification.”

more

It is more plausible that Epstein successfully wielded his nearly incomprehensible money and power to influence the decision at the highest levels. The personal attacks on the prosecution likely helped too: Federal prosecutors aren’t used to being on the defensive. I once prosecuted a defendant with the resources to hire a famed Kennedy-assassination conspiracy theorist to spin elaborate tales about me; it was unsettling and made the case extremely difficult.

The part about trashing the prosecutors, by attorneys including Trump defenders Dershowitz and Starr, is particularly interesting, and obviously relates to the treatment of Mueller.

The use of a child molester playbook on the Mueller investigation should definitely be part of the Mueller hearings.

Trump’s Twitter blocks violate First Amendment rights, appeals court affirms
Kate Cox - Jul 9, 2019 4:28 pm UTC

Excerpt:

The US Court of Appeals for the Second Circuit on Tuesday issued an opinion supporting an earlier federal court ruling that as long as Donald Trump is a public official, he cannot block people (which prevents them from reading his feed or responding to his comments) he disagrees with on Twitter.

The opinion (PDF) is narrow, specific, and unanimous, with all three judges concurring. “We do not consider or decide whether an elected official violates the Constitution by excluding persons from a wholly private social media account,” the judges write, “Nor do we consider whether private social media companies are bound by the First Amendment when policing their platforms.”

But, they continue, “The First Amendment does not permit a public official who utilizes a social media account for all manner of official purposes to exclude persons from an otherwise-open online dialogue because they expressed views with which the official disagrees….

And if you point out smart, capable woman to them, she’s a fake who fucked her way into success or she took credit for something a man did. And they wonder why they have shitty relationships with women or none at all? ‘‘Tis a mystery for the ages…..

How does an adult male become liberal/leftist? They fucking grow up.

An oldie but a goodie:

“There are two novels that can change a bookish fourteen-year old’s life: The Lord of the Rings and Atlas Shrugged. One is a childish fantasy that often engenders a lifelong obsession with its unbelievable heroes, leading to an emotionally stunted, socially crippled adulthood, unable to deal with the real world. The other, of course, involves orcs.” [Kung Fu Monkey — Ephemera, blog post, March 19, 2009]

re: #67 marcusgorillius

I agree, I’ve given Pelosi the benefit of doubt but Ihave had enough. Christ, stand for something, do something more than lip service. Maybe A.O.C. Should be speaker. That would get someone’s attention. Trump and his gang have brought out the absolute worst of America. My God, what are you waiting for!!

I’m willing to give Pelosi a lot of slack; I don’t know whether she’s doing the right thing. However, I’ve worked in high profile governmental organizations, and read the media think pieces about what the leaders of the organizations should or shouldn’t be doing. Generally, they are useless unless they are or were insiders or real subject experts (and are being completely honest with you as well).

First, the media will tell the organization to do something that is flatly against policy and law and not realize it. Second, and more subtly, most of the time the media completely misses what the decision confronting the organization actually is, because they are relying solely on the news. The news tells you what is new, what has changed, but rarely tells you important things that have been the same for decades. These constants shape what the organization does on an ongoing basis but unless you’re living it you never will have run across them, because, they’re just not news.

Third, things take time. I’ve been involved in solving problems that were in the news literally years before, but still needed to be worked. The media had moved on a long time ago and had latched on to dozens of shiny objects since then. Problems were solved, but nobody really noticed outside the people directly involved, since it didn’t relate to anything that was then currently news.

So it’s quite possible Pelosi may be fucking this up, but I’m almost certain it’s not for any reason that a casual or even obsessive news follower will grasp.

It’s a strange argument that the Trump Administration is making - that the mandate is now unconstitutional because the tax penalty has been set at zero. Could the next Congress and administration simply raises the tax penalty to some greater than zero? Does that make the mandate once again constitutional? Or what if, hypothetically, the next Congress and administration was to create a tax credit (in effect a negative penalty) for people buying insurance? If so, it seems rather foolish to say that the mandate is unconstitutional simply because a political decision to set a tax penalty/rate at a low level.

Like that’s stopped the GOP before? The GOP has spewed all these nonsensical legal theories, and just enough right wing judges in the circuits have enabled them to get all the way to the Supreme Court, where Roberts crafted his ruling that allowed states to weasel out of expanding Medicare, but stopped short of calling the ACA unconstitutional.

Now the entire system rises and falls with their reliance on the individual mandate.

The GOP are cheering this on, with no plan for what happens next - because they don’t care.

I’m beginning to wonder if a two party system can continue to work in this country. I know there are plenty of reasons why it exists, but it seems like it has outlived its usefulness.

I could see the GOP split into a small-l libertarian sort of party and a Christian Democrat type party. I could see the Dems split between a progressive party and a more center-left party.

The system is not really built for that in most states, but perhaps some sort of arrangement where the parties needed to create coalitions would serve us better than parties that serve as weird coalitions.

No. Because since the GOP tax bill passed, we’ve effectively been working without the mandate - that’s what setting the tax penalty to zero did - it created an unenforceable mandate. But the ACA still exists and still works, more or less. The exchanges still exist, the basic insurance requirements still exist.

Re Flynn I gotta say that drumpf has sure taken the burnish off the military being all upright and honorable. Flynn, Kelly, McMaster, then I thought the new admiral was showing integrity by refusing drumpf but nope he was performing navel operations with a subordinate. Forgive me if I refuse to salute. I went through a long conservative bender for a good part of the 80’s and 90’s.

I know the moment it changed for good as I layed in bed with wife watching the tanks go over the berm into Iraq. I looked at her and said “I got a bad feeling here. This won’t bode well for anyone.” I knew it was a huge lie. And I never looked back and never watched Fox news again.

Their ideal arrangement at any given moment is a ratio of barefoot pregnant sandwich artisans to hot young things that fawn over them.

The exact proportion varies by the shithead and over the lifetime of the shithead, but it’s always there because ultimately it’s just human being as use-value-objects all the down.

In the end, Russia might or might not be the initiator of this conspiracy theory. But even if they weren’t, they obviously did everything they could to promote it. The lesson we can take from all of this is that it is very likely that Vladimir Putin and his cohort are behind a lot of the garbage that floats around in the sewers of social media, working its way up through right-wing news outlets, and eventually being parroted by the White House.

If you judge their deeds rather than their words, then the rule isn’t chastity for all, but rather a X/Y plot of “what sex stuff a dude can get away” versus “clout obtaining through money, influence, and piety.”

Ultimately they’re authoritarians first and…moral, bound by scripture…distant second if at all. The ur-assumption is that they, The Elect, get to determine all aspects of fucking. The rule that overarches both “purity culture” and “boys will be boys” is: there’s a hierarchy, and those higher on the hierarchy dictate the terms of good versus bad fucking.

Make no mistake, these are people who like there to be a stigmatized, degrading demimonde. They specifically want a sexual culture in which there are vulnerable people for them to exploit and discard, where the power gradient is in their favor. They always want to be the fuckers, never the fuckees.
