It’s not surprising, but today Donald Trump finally broke his silence on Alex Acosta, who oversaw the outrageously lenient deal that helped Jeffrey Epstein evade justice and harm uncounted children. Trump says he feels “very badly” — not for the children victimized by this predator and his cronies, but for poor Alex Acosta. He says Acosta didn’t make the decision to grant a plea deal to Epstein.

That’s a lie.

At the time of the plea, there was enough evidence to throw Epstein down a dark hole never to reemerge. He should have gotten life then based on molesting all those young girls.

In 2008, federal prosecutors in Miami — led by former U.S. Attorney Alexander Acosta — drafted a 53-page indictment against Epstein, including charges that could have put him in prison for life. But Acosta made a deal with Epstein’s legal team that resulted in 13 months in jail and a non-prosecution agreement for any possible federal charges. According to a copy of the non-prosecution agreement, the likelihood of a federal charge had been high: The FBI and the U.S. Attorney’s office determined that from 2001 to September 2007, Epstein had conspired to persuade minors to engage in prostitution, conspired to transport minors across state lines for the purpose of illicit sexual conduct, and recruited a minor across state lines to engage in a commercial sex act.

Acosta immunized coconspirators too. That’s absolutely crazy given the circumstances. Everyone got off scot-free or with a slap on the wrist. That SDNY is trying to hold Epstein accountable is the exception. Thus far, the rule is if you’re powerful and rich, you can avoid justice for years on end.

Asset forfeiture is a possibility (and it was included in the indictment filings), but I’m not sure if it could go to restitution of victims.

Impeachment wont solve this any more than it would against Trump as the GOP will close ranks and protect their own despite the craven criminality, misconduct, incompetence, and inability to do basic vetting of officials (which the Senate GOP ignored to rubber stamp another right wing extremist).

Acosta made awful decisions that put children at serious risk of harm. He enabled a sex predator and enabled child sex trafficking among him and his associates. That’s unconscionable. And the GOP is fine with it.

It speaks of awful judgment but I don’t see how that rises to an impeachable offense. There’s far more to go after with Trump on impeachment - as in actual federal felonies in which Trump specifically engaged in, knowing full well that the GOP will not convict in the Senate. Why would anyone think that they’d be any less forgiving of Acosta who didn’t personally break the law? They’ll protect their own.

That’s correct. Impeachment is a political process. It doesn’t require a criminal conviction, but in practice, having a criminal record and indictments would bolster the case. Otherwise, it would seem as though you’re trying to remove for a policy difference, and not because of “high crimes and misdemeanors”.

You can argue that Acosta imperiled 100s of children, and let sex predators loose, but we all know that prosecutors have done plea deals that let rich and powerful skirt justice since forever. It’s a judgment call - an almost uniformly awful one where rich and powerful are immunized against their criminal conduct, while their victims never see justice. We see this with rapists who are rich/powerful, but women who allege rape/sex abuse infrequently see justice because prosecutors don’t take the cases seriously, investigators don’t process rape kits, etc., and the system is stacked against the victims.

I’m willing to be wrong and watch Acosta get impeached, but I don’t think the Senate will remove, and the effort to impeach means time Democrats can’t go after Trump.

There’s only so much time in the calendar to do that - and even that time is running out. It’s getting late early.

What I saw is that the photos etc were previously unknown. Also, the deal (according to the NYT and of course IANAL) does not preclude any other federal district from charging….and some of the crimes happened in NYC which means that SDNY gets a bite at the apple. Moreover, since he wasn’t charged with anything except pandering, there is no double jeopardy issue and there is no statute of limitations on this either.

Mr. Epstein can be prosecuted by the Southern District of New York because his agreement was with the United States attorney’s office for the Southern District of Florida. As New York federal prosecutors noted, the agreement does not bind other offices. In fact, Justice Department policy prevents United States attorney’s offices from making agreements that limit other offices.

Mr. Epstein will not be able to stop the new charges from going forward. There is no statute of limitation in cases like this, and because he was never charged with a federal offense, there is no double jeopardy issue. New York prosecutors can charge him with the entire scheme, including his activity in South Florida, because his alleged crimes occurred in part in New York.

So Mr. Epstein, 66, will have to go to court and fight the charges or accept a lengthy prison term, which could effectively be a life sentence. At trial, he will face testimony from three former employees who aided his sexual abuse of children, all of whom are described in the indictment. They most likely received deals from prosecutors because they have serious liability for Mr. Epstein’s abuse.

Federal prosecutors told the court that they have extensive documentary evidence, including contemporaneous notes and call records confirming that Mr. Epstein and his accomplices communicated with victims. In a search of his home over the weekend, law enforcement recovered what prosecutors described as “an extraordinary volume of photographs of nude and partially nude young women or girls.” A jury will find those
photographs, and the alleged sexual trafficking of minors, highly disturbing.

The best evidence in the case, in fact, may result from the non-prosecution agreement itself, which required Epstein to plead guilty to a state charge of solicitation of minors to engage in prostitution. Under an obscure provision of the Federal Rules of Evidence, that conviction may be admissible at trial against Mr. Epstein.
As a general rule, juries are not permitted to learn about a defendant’s prior convictions. Juries are supposed to convict based on the evidence of the particular crime before them, not infer that the defendant committed this crime because he committed a similar crime in the past. But criminal cases involving “child molestation” are an exception.

As long as the government can prove that Mr. Epstein’s state conviction resulted from “molestation” — which is broadly defined — of a minor under the age of 14, the conviction can be used against him in this new case if part of the conspiracy case involves allegations that he abused a minor under 14. If prosecutors successfully get Mr. Epstein’s prior conviction in front of the jury, it will be hard for jurors to vote to acquit.

So this wasn’t a judgement thing in his own excuse. He says he was told to not pursue the case because of national security concerns.

This needs to be investigated.

I saw another motivation for the plea deal talked about in an Atlantic article by a former Federal prosecutor:

It is more plausible that Epstein successfully wielded his nearly incomprehensible money and power to influence the decision at the highest levels. The personal attacks on the prosecution likely helped too: Federal prosecutors aren’t used to being on the defensive. I once prosecuted a defendant with the resources to hire a famed Kennedy-assassination conspiracy theorist to spin elaborate tales about me; it was unsettling and made the case extremely difficult.

The part about trashing the prosecutors, by attorneys including Trump defenders Dershowitz and Starr, is particularly interesting, and obviously relates to the treatment of Mueller.

The use of a child molester playbook on the Mueller investigation should definitely be part of the Mueller hearings.

I’m willing to give Pelosi a lot of slack; I don’t know whether she’s doing the right thing. However, I’ve worked in high profile governmental organizations, and read the media think pieces about what the leaders of the organizations should or shouldn’t be doing. Generally, they are useless unless they are or were insiders or real subject experts (and are being completely honest with you as well).

First, the media will tell the organization to do something that is flatly against policy and law and not realize it. Second, and more subtly, most of the time the media completely misses what the decision confronting the organization actually is, because they are relying solely on the news. The news tells you what is new, what has changed, but rarely tells you important things that have been the same for decades. These constants shape what the organization does on an ongoing basis but unless you’re living it you never will have run across them, because, they’re just not news.

Third, things take time. I’ve been involved in solving problems that were in the news literally years before, but still needed to be worked. The media had moved on a long time ago and had latched on to dozens of shiny objects since then. Problems were solved, but nobody really noticed outside the people directly involved, since it didn’t relate to anything that was then currently news.

So it’s quite possible Pelosi may be fucking this up, but I’m almost certain it’s not for any reason that a casual or even obsessive news follower will grasp.

It’s a strange argument that the Trump Administration is making - that the mandate is now unconstitutional because the tax penalty has been set at zero. Could the next Congress and administration simply raises the tax penalty to some greater than zero? Does that make the mandate once again constitutional? Or what if, hypothetically, the next Congress and administration was to create a tax credit (in effect a negative penalty) for people buying insurance? If so, it seems rather foolish to say that the mandate is unconstitutional simply because a political decision to set a tax penalty/rate at a low level.

I’m beginning to wonder if a two party system can continue to work in this country. I know there are plenty of reasons why it exists, but it seems like it has outlived its usefulness.

I could see the GOP split into a small-l libertarian sort of party and a Christian Democrat type party. I could see the Dems split between a progressive party and a more center-left party.

The system is not really built for that in most states, but perhaps some sort of arrangement where the parties needed to create coalitions would serve us better than parties that serve as weird coalitions.

Could the next Congress and administration simply raises the tax penalty to some greater than zero? Does that make the mandate once again constitutional? Or what if, hypothetically, the next Congress and administration was to create a tax credit (in effect a negative penalty) for people buying insurance? If so, it seems rather foolish to say that the mandate is unconstitutional simply because a political decision to set a tax penalty/rate at a low level.

I worked at Perot Systems on a partnership with my software company a few years ago. The entire headquarters was like a Perot museum. He ate in the cafeteria with us and had security with him at all times. Weird duck, paranoid, egocentric, and down to earth at the same time.

Had a couple friends who I went to tech school with in Houston get jobs with EDS up in Dallas after we graduated. They said it was kind of a stuffy atmosphere, but not a bad place to work.

Sounds good and all, but it’s not like there’s a lot of spending that the government has to do between now and then. All the stadiums that will be used are already built and in use.
