I have a limited amount of time and energy left to me in this life (hey, we all do!) but it is my intent to make sure I am around long enough to be able to scream at the top of my lungs if Nikki Haley should try to position herself as some kind of clean hands leader in the post-Trump era. She is not in any sense better than anyone else in the rogues’ gallery of this administration. I keep reading that her book is largely an effort to project the image of a GOP grownup. It is FUCKING BULLSHIT and she should not be allowed to get away with it.

Thank you Flying Spaghetti Monster for finally hearing my pleas and knocking Sean Spicer off of Dancing With The Stars!

Spicer’s increasingly long tenure on the show has been controversial since the beginning. But it hit a boiling point last week, when the judges were visibly frustrated that much more talented celebrity dancers were being sent home because Spicer, who received consistently low scores, was never in the bottom two. In addition to tweets from President Trump, many on social media — including Donald Trump Jr. — urged fans to vote for Spicer to anger “Hollywood” and “liberals” and “leftist elites.” (Even though some of the biggest “DWTS” viewership comes from states that voted for Trump.)

So much for Veterans Day being a holiday. I am on call, and I was called to a bridge line n one call this morning and one call this afternoon. I wandered in after a run to the drug store to see if they had a properly fitting knee wrap (answer would be no) so I picked up some junk food. I came back home to find my work computer going berserk and a vendor seems to have Issues. I think I’m going to be up for a while…blergh.

Eh, if it’s clear that listeners knew who Clinton was talking about, then she needn’t say her name for it to be defamation. And Clinton did say that Stein “is also a Russian asset” so that sort of implies that Gabbard is a Russian asset.

The problem Gabbard has is that she is a public figure and thus must meet the standard of actual malice. In this case, Clinton can argue that she was merely stating a political opinion about a politician. And that’s likely protected speech under the first amendment. She can also raise truth as a defense, and Gabbard does have a history of saying shit that sounds a lot like the Russian or Syrian talking points.

As the old legal adage goes, “discovery’s a bitch” and that’s most certainly true in defamation cases.

Clinton’s exact quote was, “I’m not making any predictions, but I think they’ve got their eye on somebody who is currently in the Democratic primary and are grooming her to be the third-party candidate.” She was responding to a question about Republicans, so the “they’ve” in that context refers to the GOP.

She was speaking about Stein when she said, “She’s the favorite of the Russians.”

Both are clear opinions about who she thinks these third party groups are grooming / like and aren’t actionable in the slightest.

Interesting read; if Sheffield is correct in his analysis that Christian Nationalists/alt-right types are beginning to realize that the GOP doesn’t particularly give much of a shit about their agenda, then they may begin turning against the GOP and while their numbers might be small, they certainly do have an impact. In tight races, if such folks stayed home or voted third-party, it could make quite a difference.

Think we might be going about the whole Gabbard bit the wrong way, focusing too much on the word “she” when there are two words that more readily kill the threat of a defamation suit: “I think.” IOW, Clinton is expressing an opinion that an unnamed woman in the Dem primary field was being groomed for a third-party run by the Russians who see her as an asset. As the Gabbard campaign’s letter notes, what matters is how the statement is “read and understood by the public.” That raises the question of why the public read Hillary’s opinion and immediately assumed she was talking about Tulsi Gabbard. And they insist that the “confirmation” came from Clinton’s spokesman, but he was asked specifically if Gabbard was the woman being referred to.

Or, shorter and pithier, you cannot tarnish an already rusted blade. To prove defamation you have to prove injury to one’s reputation. But if Tulsi’s reputation is such that everybody automatically assumed she was the target of Hillary’s statement without being explicitly named, then there’s no way that her lawyers could prove “injury.”

Here in the Atlanta metro it’s very rainy, cold and dreary. I seriously hope all this rain has a chance to dry out before the temps drop or we’re looking at an epic clusterfuck. We’re about to see our weather go from the 60s yesterday to the 20s by tonight. *winter is coming* is all too appropriate, especially in Northern NY, as downwind of Lake Ontario could see a foot or more of snow. We wont see anything like that today, but could get a dusting that gives grassy spots a bit of white, and makes driving nasty with slippery spots.

But that’s not what has my attention. It’s that Fox is going all in on white nationalism. Between Carlson and Ingraham, the network is pushing overt white nationalist policies, and they aren’t even bothering to hide it anymore. This is a direct result of Trumpism and the GOP abandoning any pretense of what they truly stand for. The GOP is by and for white guys, and everyone else needs to watch as their rights are curtailed.

All the while, Trump lurks in the background spewing his usual bulkshit about impeachment and how Democrats are the real criminals - deflecting and projecting like IMAX as usual. It’s Trump’s tell actually - when he claims someone else is doing something criminal, it’s a sign that Trump himself has done that very act. We see this with the Ukraine scandal and Corruptalago generally.

He wants to deflect from his crimes by having the GOP haul in the Bidens to testify, which will muddy the waters and deflect attention from the fact that Trump has already admitted to extorting and bribing Ukraine to investigate the Bidens by withholding military aid that Congress duly appropriated to hold off the Russians. Once again, we see how Trump’s actions directly benefit Russia, while undermining our allies and partners. This pattern goes back to before the election, and no one has every adequately explained why the GOP suddenly shifted their platform on Russia vis a vis Ukraine. The only explanation I can come up with is that Trump promised Russia to let Ukraine hang out to dry.

What it sounds like is more that the GOP is trying less to set up a *legal* argument than a list of PR talking points (as usual): I’m guessing the “strategy” is to try to “decriminalize” the President’s (and his WH creatures’) actions re Ukraine so that everything else following can be handwaved away as “mere politics”. Or PRESIDENTIAL HARASSMENT….

I get the feeling that if Stephen Miller wants to profane the idea of attending a Jewish service, he has to do so way under-the-radar: like some latter-day marrano. Only instead of fleeing the Inquisition, he has to try to avoid the opprobium of his fellow Jews disgusted by his bigoted xenophobia, and advocacy of inhumane policies.

Clinton’s exact quote was, “I’m not making any predictions, but I think they’ve got their eye on somebody who is currently in the Democratic primary and are grooming her to be the third-party candidate.” She was responding to a question about Republicans, so the “they’ve” in that context refers to the GOP.

She was speaking about Stein when she said, “She’s the favorite of the Russians.”

Both are clear opinions about who she thinks these third party groups are grooming / like and aren’t actionable in the slightest.

I think most of this is stupid, as Happy said, there’s not going to be a law suit. But for what it’s worth, here’s the “full” quote:

“Well, I think there’s going to be two parts and I think it’s going to be the same as 2016: ‘Don’t vote for the other guy. You don’t like me? Don’t vote for the other guy because the other guy is going to do X, Y and Z or the other guy did such terrible things and I’m going to show you in these, you know, flashing videos that appear and then disappear and they’re on the dark web, and nobody can find them, but you’re going to see them and you’re going to see that person doing these horrible things.’”

“They’re also going to do third party again. And I’m not making any predictions but I think they’ve got their eye on somebody who is currently in the Democratic primary and are grooming her to be the third party candidate. She’s the favorite of the Russians. They have a bunch of sites and bots and other ways of supporting her so far, and that’s assuming Jill Stein will give it up. Which she might not, ‘cause she’s also a Russian asset.”

The fairest reading, I think is that Clinton was talking about the GOP and the Russians. And with Trump as a nexus between those two entities, that seems pretty much spot on. Gabbard has been getting support from the troll farms, she seems sympathetic to Putin’s world view, and the GOP would love to have someone like her on the general election ballot in close states to garner some DudeBro/PUMA/moonbat votes that might otherwise go toward the Dem nominee.

As things stand now, Gabbard is an also-ran who is in the gimmick stage of the also-ran campaign cycle — she’s trying to stay relevant by any means necessary. But she’s turning herself into a national joke, which is probably why she’s not seeking re-election in the House.

They looked at his skin color. Seriously Obama is as I’ve seen you point out before the personalification of the American dream and he’s never given that. Meanwhile he had to hear sneers from McCain and especially Romney about socialism. Two guys who had tons of help getting to where they did due to who their daddies were. Same thing with Trump. That’s the thing. Both Obama and the Clintons defined themselves on their own merits. Mitt, McCain, and Trump all to some extent on their Daddy’s.
