He just got us a beautiful ad. No ad will be more beautiful than Trump bragging about wanting to cut SS and Medicare because it’s easy. When you’re a moron, they let you sink yourself.// All mocking aside, this needs to be used against him big time.

Lithwick on slate

Schrodinger’s witnesses

there is a laughable argument being advanced in these opening hours that should now be, well, laughed at. In tabling Chuck Schumer’s various motions to call witnesses and subpoena documents and records, Trump’s defenders are somehow claiming both that it’s too late to obtain such evidence, and also, of course, that it’s far too early

.”

I’ve said already and we know the game
But if the Rs frame solely on procedural minutae when the rules are self serving to start, it’s gonna look really bad later

They have total control over witnesses and dox
Eventually it will come out
Being in the side of “the rule said, we weren’t allowed to, etc” will be seen for what it is; petty and unbelieved

And don’t let them say “we all agreed on the rules”. Cause they werent

But how many of those are “real Americans”. You know, the ones they’ll allow to vote, the ones the media slobbers over. Because that’s where it’ll really tell.

There is no such thing within American law that is an absolute privilege. Almost every privilege has a crime/fraud exemption, there is no reason to think that executive privilege is any different

I’m old enough to remember when people thought we’d never take back the House. We’re getting there. More people voted for his impeachment than any President and more people support his removal. The GOP imo is trapped by him in a lot of ways.

They won’t start paying attention until polling numbers around this September or so. And if those polling numbers show conclusively the GOP is fucked six ways from Sunday, then they’ll start paying attention. And their first order of business will be to frantically try to distance themselves from Trump as far as possible.

Nah. The real numbers are the ones relating to whether or not they get unseated by a further right-wing challenger in the primaries.

Their districts are either Gerrymandered to hell & back, or they figure they can ride it out and rely on Fox and Trump to deliver distractions over the summer, and that the American electorate will display the memory capacity of goldfish again…

The problem with a lot of young Dems is they want wholesale sweeping change((s).
And right now!

In this environment that is not a realistic way to think or vote.
It is not tenable let alone probable short of a fundamental wholesale revolution (wholesale change)
And that ain’t gonna happen. For scads of reasons.

Yeah, and I get how giving into despair is an excuse for inaction, and NO WAY am I advocating giving up, lying down and just accepting the shitstorm.

However, the true problem is not the GOP; nor even Trump. It is the sick, deranged right-wing echo chamber that birthed Trump and McConnell, and protects them from any consequences for their crimes.

Fox is the true enemy. Get rid of them, and the GOP can maybe, finally, start coming back to sanity.

Back about 17-18 years ago, I recall reading about how Republican Senator Peter Fitzgerald and Senator Hillary Clinton became friends because they were both from Illinois — and that was enough to derail Fitzgerald’s future in the Republican Party, forcing him not to run for re-election and opening a vacancy for Barack Obama.

Eclectic Cyborg  Jan 22, 2020 • 11:33:50am

Deaths from China’s new virus rose to 17 on Wednesday with more than 540 cases confirmed, increasing fears of contagion from an infection suspected to originate from illegally-traded wildlife.

The previously unknown, flu-like coronavirus strain is believed to have emerged from an animal market in central Wuhan city, with cases now detected as far away as the United States.

Contrasting with its secrecy over the 2002-03 Severe Acute Respiratory Syndrome (SARS) that killed nearly 800 people, China’s communist government has this time given regular updates to try to avoid panic as millions travel for the Lunar New Year.

“The rise in the mobility of the public has objectively increased the risk of the epidemic spreading,” National Health Commission vice-minister Li Bin said.

The World Health Organization (WHO) was meeting to rule if the outbreak was a global health emergency.

17 deaths in 540 cases would be a mortality rate of around 3%. The question is how many of those 540 cases will also become fatalities. At least China seems to realize they screwed the pooch with SARS and is trying stay on top of this new bug.

I dunno: just a quick scan of the Wiki for the Wuhan coronavirus is both frightening and reassuring.

That these new epidemics can pop up at any time is scary: though if one reads the posited origin theory, it’s not surprising:

As the cluster of cases with “pneumonia of unknown cause” had centered around a wholesale animal and fish market, which had a thousand stalls selling chickens, pheasants, bats, marmots, venomous snakes, spotted deer and the organs of rabbits and other wild animals, it led to the suspicion that the cause may be a novel coronavirus from an animal source

OTOH, the Chinese authorities (and the WHO, and health authorities worldwide) seem to have jumped onto this outbreak pretty quickly: it sounds like a bad thing to get (and even at 3% mortality, pretty deadly), but if proper precautions and rigorous testing can contain the outbreak (and it looks like they are cracking down pretty hard) another Black Death seems unlikely. So far.

But don’t forget that in a parliamentary system, 40% of the vote is a crushing majority. As to Hitler himself, he only became Reichskanzler thanks to a shabby, backroom political deal put together by two former Chancellors (Kurt von Schleicher and Franz von Papen) and he was sworn into office by a senile President Hindenburg.

“Presumption of innocence” simply means that the defendant does not have to prove he’s innocent, but rather than the prosecutor has to prove their guilt by either preponderance of evidence (civil court) or beyond reasonable doubt (criminal court). Marital privilege is absolute.

It is and it isn’t. The testimonial spousal privilege is held by the testifying spouse, so if your spouse chooses to testify, you can’t stop them from doing so. And the communications privilege has some exceptions (from wikipedia because I’m too lazy to look up the cites):

The spousal communications privilege may not be invoked if the spouses are suing each other or each other’s estates in a civil case; nor if one of the spouses has initiated a criminal proceeding against the other; nor in a competency proceeding regarding one of the spouses. These three scenarios are identical to the limitations which also apply to limit the spousal testimonial privilege. Two further scenarios defeat the spousal communications privilege: if the confidential communication was made in order to plan or commit a crime or fraud, or if a defendant-spouse wishes, in a criminal trial, to testify in their own defense, about a confidential marital communication. In these five situations, a court will not allow either spouse to assert the privilege to block the testimony.

Klobuchar: You can’t have a trial without witnesses. Bingo.

Yeah, but you can have a trial without testimony. That’s basically what a motion for summary judgment is. You have declarations/depositions and hard evidence and you make the determination based on that.

In this case, since the hard evidence has been entered into the record and doesn’t require authentication/foundation that you would need in a normal trial, there’s an argument to be made (not a good one, but one) that witnesses are not necessary. The record is complete and it shows that Trump is guilty as fucking sin.

It’s no longer a question of the UK’s remaining in the EU. Now it’s a question of the UK’s rejoining the EU at some point in the future.

Not an easy sell, to say the least, but then again, if Britain has a lost decade or so as a result of Brexit, it might make it more palatable, let’s say, about 20 years from now or so.

I don’t think that anyone other than Momentum’s members—even among younger English folks (since Scotland will leave by 2034 even if it requires a Troubles—Scots Edition to get there)—would ever accept retiring the Pound and joining Schengen.

At this hope, England’s hopes for being permitted to join a superstate made up of EU members basically boil down to the entire EU constitution being tossed, which I can only see happening if Germans and French folks see that they will be forced to serve as Latin America to Putin’s Washington without England and somehow England is the deciding factor in keeping them truly free.

I dunno: the whole Brexit deal was formulated (besides the “Chuck The Bloody Foreigners Out” part, which was always one of the main sells) on the premise that the UK was such an economic powerhouse, that once “free” of onerous European “overregulation” and “interference”, 1) Europe would be forced to deal with Britain on British terms, and 2) said “powerhouse” status would allow them to deal with the rest of the world as they liked.
Well, 1) has been busted as a fantasy already: though there is a lot to be worked out, the EU, so far, hasn’t been inclined to cut the UK much slack regarding trade regs, tariffs, etc: and there is really little impetus for them to do so. And 2) is still (as it has been from the beginning) a “remains to be seen” scenario. Though it’s a certainty that the Tory Government is going to try to spin out any bad economic repercussions from Brexit for as long as possible, mask which ones they can, and likely spend most of the time trying to craft a message blaming Someone Else for the problems.

controlling the Senate process is a problem and the major flaw is obvious:
- demonstrated here when a president’s party controls the process
- it’s also a major flaw when the opposition controls the process (clinton)

the house process is less problematic (for me)

speaking strictly to the rules

impeachment as a whole is rarely used
and it’s not spelled out too well
and has little ‘precedent’ - because precedent doesnt apply they way it does in courts

it doesnt use state or federal rules and really should only be carefully compared to them

it’s not only a hybrid - it’s separate from civil or criminal trials

it’s way more serious and the aspirations toward truth and accuracy should be way higher, and desireable by all parties

alas, they are way lower and being ground under the boot heel into meaninglessness

I’ll stand by my assessment - a Party faithful burning down the legislative body and blaming it on “socialists” so that the ruler can assume absolute power with no checks (Trump and Republicans would pass Enabling Acts in a heartbeat if allowed), and marginalization/persecution of “others” becoming the norm of the day? Pretty much nails this group.

Meanwhile, I spent a fruitless morning at the DMV trying to get a Real ID. It seems my marriage certificate from 1977 that shows my maiden name and me marrying Mr. C. (complete with the fact that the info was recorded by Jefferson Co. CO, and where that record is) isn’t certified (like they gave out certified copies 42 years ago.) So, I get to send off for a certified copy. Yay. Then I can go back and spend another hour and a half in line to find out if it is good enough.
If I thought this was doing anyone any good safety-wise, I’d be fine with that. But if I were trying to produce fake documents, I feel confident I could have faked the embossing, so this is just something to annoy women who have ever been married to provide more Security Theater.

At this hour, in an election “today,” with tensions high and vitriol flying, the contest stands:
* Bernie Sanders 52%, Trump 43%, Democrat wins by 9.
* Joe Biden 50%, Trump 43%, Democrat wins by 7.
* Mike Bloomberg 49%, Trump 42%, Republican-turned Democrat New Yorker defeats Democrat-turned Republican New Yorker by 7.
* Elizabeth Warren 48%, Trump 45%, Democrat wins by 3.
* Pete Buttigieg 47%, Trump 44%, Democrat wins by 3.
* Andrew Yang 46%, Trump 44%, Democrat leads by 2, within the theoretical sampling error.

re: #259 Belafon

That’s not really a surprise. Trump’s ceiling has always been right around 45% (he got 46% in 2016, meaning 54% of voters voted for someone else).

What likely hurt Clinton in 2016 was weaker turn out (she got about 60k fewer votes than Obama did in 2012) and/or third party voting which was very strong in 2016 compared to most “two person” races historically.

Trump doesn’t have the luxury of the Greens or Libertarians running anyone that will actually get a real look from more than 1-3% of voters. Nor does he have the luxury of being an unknown agent of change. He now has a record and as a result the worst fucking approval ratings since… ever? He is probably in the weakest position that any incumbent president has been in, in my life time at least.

Ted, there were legal and legitimate methods of asking the Ukrainian gov’t to investigate the Bidens for potential charges of corruption. Why did Trump use none of those? Because he didn’t want an investigation, he wanted the announcement of one because he felt that having his opponent under the shadow of such helped him last go around. If he actually got an investigation going, there was the worry that one or both men would be cleared before the election, which would help them and hurt him.

And there was serious evidence of real corruption concerning Hunter Biden on the board of Burisma.

no one disputes the first thing. no one.
the question is how, and where’s the paper trail and why wont anyone in the admin explain how this was done and why

as to the second - are you suggesting that the ‘serious evidence of real corruption concerning hunter biden” was cleared up in those 50-odd days the money was held to trumps satisfaction and so he released the money? If so, THEN WHAT THE HELL IS THE PROBLEM?

Broken record here!! broken record!! These polls aren’t worth the pixels that display them. First, it’s probably near impossible to get an unbiased random sample in these days of call id; most people don’t respond to calls, emails, and actual mailings — so the sample is not reflective of the voting population from the start. Second, these samples don’t reflect the effect of voter suppression or a change in voter demographics. Third, they don’t show what happens when a campaign starts in earnest — it’s easy to shine before the mud gets thrown at you. Let’s not forget the damage to Warren, Kamala forced out the of race — much of that was due to the blind hot focus of Bernie Bros. Bernie has been spared the Trump hatred because Trump knows that he will be easy pickings. And he will be.

Can I just say that the impeachment managers are all doing a great job representing the country and the Democratic Party to the American people. There is no Jim Jordan, Mark Meadows, or Devin Nunes but a collection of statesmen and women from all around the country.

Another person doing is a good job is Manchin. He’s been faithful on all the party-line vote so far, which is crucial.

Because of the both-siderist media, all it would take is one Senate Democrat voting with Senate Republicans to instantly create the “Bipartisan Senate rejects partisan House impeachment” shit-narrative.

Yum! I’m jelly. I eat eggs daily - cheap good food but lets face it, even the best mass market eggs are nothing like those from a small near by farm. I’m always in heaven when I get a dozen or two from my fathers birds. If I lived where I could set up a little coop, I’d get 4 hens in a heartbeat.

The U.S. Department of the Interior reportedly plans to permanently ground a civilian drone fleet, because the approximately 1,000 drones are partly sourced from China. The department concluded that the risk is too great that the devices could be used by China’s government for spying. The drones were used to help manage wildfires, map terrain, and monitor natural resources. The Interior Department said it would provisionally ground 810 camera drones while Interior Secretary David Bernhardt reviews their security risks. A department spokesperson said drones made in China or featuring Chinese components will stay grounded except for emergency use. Staff at several federal agencies have balked at the plan to permanently ground the drone fleet

On June 27 and 28, 2017, The Guardian reported that documents obtained by them confirmed later that “millions in donations” were steered to his family members, that Sekulow “approved plans to push poor and jobless people to donate money to his Christian nonprofit, which since 2000 has steered more than $60m to Sekulow, his family and their businesses”, and that attorneys general in New York and North Carolina opened investigations of Sekulow’s CASE for possibly using pressure tactics in telemarketer calls to raise money which was allegedly misdirected to Sekulow and his family.

Looks like this has been going on for years — way before Trump became president. There is something terribly wrong with a tax system that allows so many to set up charities that benefit them personally. Trump was forced to give up his charity — let’s hope that someone will do the same to Sekulow’s and force him to pay millions in taxes.

I’d say you’re both right: the key is that the CBS News folks are more old school conservative (actually rather Burke-sian in it’s approach - not that things can’t or shouldn’t change, just that one should carefully think about the changes). Hence no love for the fuckery that is Trump (whom NBC sold their soul to ages ago) .

Definition: Deliberation is a process of thoughtfully weighing options, usually prior to voting. Deliberation emphasizes the use of logic and reason as opposed to power-struggle, creativity, or dialog.

When was the last time that happened?

This is a trial like Socrates’. One side is offering compelling logic, soaked in the arrogance of the academic grove, and the other side is a bunch of carpet-bagging death heads.

I suppose they have to try a quarantine, but if this new virus spreads comparably to common colds, it will be futile.

If it spread like the common cold, wouldn’t there be far more than 540 cases in China at this time?

Interesting metaphor. It’s a pity that the mango moron will not be the one taking the cup of hemlock rather than feeding it to the constitution instead.

Every GOP Senator has already made it clear that Republicans can ignore the law. It does not apply to them because they are only answerable to God.

They have elevated Trump to be Dictator for Life to be succeeded by Princess Ivanka.

An air tanker has crashed while fighting the fires in New South Wales

The NSW Rural Fire Service (RFS) is investigating reports of a large air tanker which crashed in the state’s south.

In a statement, it said “contact had been lost with a Large Air Tanker which was working in the Snowy Monaro area”.

“Local ground crews indicate the aircraft may have crashed,” the RFS said in a statement.

“A number of helicopters are in the area carrying out a search.”
