My only real problem with this is that Warren should know - as an attorney - that Bloomberg’s point about the non-disclosure/non-disparagement agreements being to be benefit of all parties. Yes, it does stop plaintiffs/employees from talking about the case/claim later. But it also does stop employers and defendants from talking shit about the plaintiff later, and/or mocking their claims.

I say this as a lawyer who has litigated and settled a whole lot of cases - it’s usually a provision put in by attorneys in part because they don’t want to be back dealing with the same case two years later because someone is running their mouth and the other side thinks its defamation or whatever. It, in a very clunky way, allows the parties to put the case behind them and move on - and trust me, after a year of litigation where you’ve been responding to discovery and going through mediation and all the other bullshit before your proverbial day in court, you’ll want to move on.

It feels like a populist stunt to me. And I don’t like populism, it’s playing with fire.

Bloomberg fucked up his answer, which isn’t a surprise, he basically was subject to a surprise cross-examination with apparently no prep.

One more thought about Warren’s debate performance… I think her best bit was when she went full Law Professor on Buttigeg and Klobachar. Saying his health care plan wasn’t a plan, it was a power point presentation. And that her’s wasn’t even a plan, it was a post it note with “insert plan here.” That or the bit at the end where she made the case for her electability and the flaws with everyone else at the end.

I said earlier, I’ve mostly made up my mind, barring some weird turn of events between now and Super Tuesday, and my vote is going to be for Warren - populist reservations and all.

IMO the US presidential pardon power should be removed via constitutional amendment.

Trump’s abuses have made this crystal clear.

Furthermore, while there is absolutely no question of any equivalence with Trump’s abuses, I do remember not being amused by Bill Clinton’s pardon of Marc Rich.

Well I think one thing Trump’s “presidency” has done is blown mile-long holes in the argument that the Constitution is a “divinely inspired” document that needn’t have any correction, amendments, or evolution. The Electoral College, Pardon power, and the creeping power of an Executive Police Force beholden only to Trump are just some of the things the Founding Fathers were just either too lazy to contemplate or too naïve to consider actually happening. An abjectly divided Congress with a Republican Party firmly hostile towards the Age of Enlightenment is something that they probably thought could never come to pass.
