congress likely has the authority, not the president

there’s more than this, but this is enough:

To start, postponing the elections would not actually keep Donald Trump in power, in and of itself. Per the terms of the 20th Amendment, his first term will end on January 20, 2021. If he has not been duly reelected, he would have no further legal claim to power. Nor, for that matter, would Mike Pence or Nancy Pelosi. In the absence of elections, their terms will have concluded as well, and their offices will be vacant. In fact, in the event of elections postponed beyond January 20, 2021, there would be one person, and only one person, in the entire line of succession who would still be legally in office. That would be President pro tempore of the United States Senate Chuck Grassley (R-IA), whose current term expires in January 2023. Going by the letter of the law, then, postponed elections would result in President Grassley.

Of course, this is purely hypothetical, as House Democrats would never agree to give Donald Trump the power to postpone elections. He might try it anyhow, of course, but then we’d be dangerously close to coup d’état territory.

I think other than setting election day by statute, Congress hasn’t used any of its other powers to set election laws. The interesting bit will be if some state legislators start floating the idea of just appointing electors rather than going with a presidential election. Also, there’s the possibility that if senatorial terms end without elections, the governors of those states would be able to appoint replacements. Not sure what it means for the House (the constitution requires elections to fill vacancies in the House) - and the system can’t work if there’s no House of Representatives.

Hopefully, we will avoid those potential clusterfucks. Hell, the elections went forward in 1918 and 1920 during the Spanish Flu epidemic.

Stopped at Walgreens and the local grocery store on my way home from work. Both were crowded but not insane. At both stores it just felt like something had broken. You could see it in everyone’s face that there is no joy in Mudville.

The grocery store I go to is a mom & pop kind of place with union employees. They still have carry-out guys if you need them, and I usually tip a buck. Today I was able to carry everything out myself so I tipped the check-out clerk instead. She was working her butt off getting everyone thru the line quickly and she deserved it. Everyone in the store deserves it.

I’m home now for the night. The bars in St. Paul tend to go nuts on St. Pat’s day and I don’t doubt that will be the case tomorrow. A lot of people come in from the suburbs. Tomorrow I’m going to come home from work (it was decided today that I can’t work from home) and batten down the hatches .

We’re back from Scottsbluff (pop 14,000, largest city in the Nebraska Panhandle). We survived the militarised hospital and the shopocalypse at the Co-op, where the Public Health District is trying to keep Covid-19 out of the Panhandle. Behind the hide bar.

All entrances to Regions West Medical Center in Scottsbluff are guarded. No one except staff, patients, their caregivers, and suppliers are allowed in the hospital (suppliers must use the rear entrance).

Going through the guard post set up in the outpatient clinic area, they ask who you are, check to see if you have an appointment from a printout, and ask if you’ve been out of the Panhandle in the last thirty days. (Answer that one “yes” and they have you fill in a name/address form so the Public Health District can monitor your three-week quarantine.) They also had plenty of masks.

My appointment was uneventful, though I was late because I did not anticipate going through a checkpoint to get in the hospital. You are also required to check out on leaving, so they can keep track of who is in the hospital.

After leaving the hospital, we went out to eat at the finest Mexican restaurant in Scottsbluff, Olé (shameless plug for them, goes to Yelp). The time of day was before the dinner hour, so we were the only patrons in the restaurant. (As is customary in restaurants here where we are regulars, they turn off FOX from televisions in our view when they seat us. Something something we leave very good tips.)

After that it was off to Gering (town attached to Scottsbluff which used to be the county seat). Driving through downtown Scottsbluff, the shops were packed. No parking anywhere. Out on the highway, Hobby Lobby and Staples were packed full.

Downtown Gering was less busy than Scottsbluff. Safeway was a mob scene in the parking lot as we passed it. (That Safeway services the whole Panhandle and SE Wyoming.)

The YMCA’s scrolling sign: Come to the Y and get fit! By order of the health department, the Y is closed until further notice.”

The Co-op was very busy for the time of day. It appeared every farm and ranch wife, and the ranch hands, were in the store today. Our regular shopping trip was cut short by an announcement “The Public Health District has ordered all stores close at six pm and not reopen until 10 am to allow sanitising.”

The toilet paper aisle was wiped out. (I found two six-packs of Charmin on the back of a top shelf, I took one and left the other where it could be seen.) I don’t get it; this is an area where they still put phone books in the outhouses here along the highway rest areas (really). There were signs everywhere “no more than three packs of toilet paper per customer.”

Different things were wiped out here than I’ve read in other places.

Meats and chicken were in good supply, with chicken on sale.

Everything related to baking supplies including sugar, yeast, and baking powder were gone, but commercial bread was in stock. Cake mixes were plentiful though.

Coffee was wiped out, except those damn Kuerig cups. Fortunately I have plenty of coffee at home from my commissary run.

Not an egg in the place. Fortunately we get our eggs from a person here in town who can’t eat all his chickens lay. No potatoes of any type. Almost all rice was wiped out, except for flavoured packages and dinner mixes. All dried beans were sold out.

Young people were stripping the ramen noodles from the shelves as I went to get my usual supply. I watched three cases carried off in baskets. I got six packages.

For dairy, cheese was in good supply, as was butter and 20% cream, but all varieties of milk were gone, except for almond milk. (I quipped to an elderly lady “how do they milk an almond anyway? I’ve milked a cow but my hands aren’t small enough to milk almonds.” That drew a laugh from her.)

In personal care products, all shaving cream was sold out. Razors were plentiful.

Cleaning supplies were in stock. Laundry and dish detergent were plentiful (Palmolive dish soap was on sale, too). Plenty of bleach.

Interestingly, the booze section was fully stocked, as were cigarettes. (Smokeless tobacco was sold out.) Frozen entrees were well-stocked, but frozen vegetables were gone.

Potato chips were annihilated. There were a few packages of Fritos. All cheap bottled juices (the kind blended with grape juice) were sold out. Pure fruit juices (such as orange or cranberry) were in good supply.

In the 1800’s, all nominees were of course white men. But there was geographical prerequisites — A NY seat, southern seats, frontier seats, etc. Ever since Louis Brandeis (appointed 1916) there’s been a recognized need for “a Jewish seat.” Since Thurgood Marshall, there’s been a bi-partisan consensus that there must be a black seat (that’s why Clarence Thomas got picked). Since Sandra Day O’Connor, both parties have had specific search committees deliberately making lists of potential women nominees.

“Order your food online,” they said. LMFAO @ them and myself. Amazon Green/Wholefoods. 22 items from eggs to bread to salsa and cheddar. $112. The cart was fulfillable to my work address. but at home? All 22 items removed from my cart. Downtown? okay. North Hollywood? Zip. I’m fairly pissed. I pay prime for THIS? Tell my boss my weeks’ worth of groceries will be at the building loading dock?
