Supreme Court: Trump Is Not Immune From Subpoenas

It’s a mixed bag. This ruling doesn’t mean we’re going to see Trump’s returns right away, but the most important part of the ruling is that the Supreme Court unanimously rejected Trump’s claims that he has absolute immunity.

On the not-so-good side, the court may have managed to kick the can down the road far enough that nothing will come out before the election.

But there’s no doubt about one thing: Trump’s paranoia is now going into overdrive; he’s posted at least 10 unhinged rage-tweets so far this morning.

Trump loses on both cases as he’s not above the law, but the way in which he’s being held accountable means that the cases get strung out past November. Justice delayed is justice denied. Instead of indicating that Trump had to immediately turn over the documents in the Vance case, it’s back to the District on remand. That means Trump gets to spend another bunch of money he doesn’t have to fight the release of these tax documents well into 2021.

I’m more focused on the Vance case since it is state crimes-related. The Mazars and Deutsche Bank cases also show the limits of presidential immunity, but again, it’s up to the District to show they took the potential immunities into account.

I would have argued that they already did, and he’s not above the law and moved to get the documents release immediately, but as with Vance, it probably would have split the court’s ruling in such a way that it would have given Trump the outright win. By remanding, Roberts gets to show that there’s no one above the law, but the time delay means that Trump effectively is above the law - and that seems to be Schiff’s take too.

For comparison, Native Americans are entitled to the Black Hills of South Dakota. There’s about $1 billion in escrow waiting for them, but the Native Americans want the land, not the money.

Besides, the land and mineral assets are worth far more than $1 billion with interest.

The gold from the Lead mine district alone was worth about $60 billion. So the US was lowballing them even while admitting they were wrong and expropriated land belonging to Native Americans because gold was found there.

Yes. There’ll be so much scrutiny on making sure that this case goes forward, from NY AG James to local prosecutors outside the Manhattan DA’s office, to prosecutors within the office, that it’ll be hard to make this go away.

Swapping Pence for Haley isn’t going to help Trump since he’s the top of the ticket. He’d lose evangelicals and misogynists by going with Haley. That’s Trump’s base. There’s no benefit to going with Haley other than her being outside Trump’s immediate orbit at the moment and not totally botching the covid19 response, which ultimately goes back to Trump himself.

On the not-so-good side, the court may have managed to kick the can down the road far enough that nothing will come out before the election.

In pretty much every ruling the Court gives, especially when it is a case of first impression (meaning the first time they’ve heard a case with the questions at issue) they tend to kick the can down the road. And on evidentiary questions like subpoenas, the ruling is always sent back to the trial court “for further proceedings not inconsistent with this ruling.”

It’s just part of how the courts work.

But as Alito pointed out in one of his dissents, while Trump can offer arguments, the way the majority opinion is written, those arguments are likely not going to be fruitful.

That said, the bigger decision today is McGirt. At least for federal criminal law, the eastern half of Oklahoma is still technically a reservation. How much further that decision can be applied and expanded is a question for future cases, but it may well have wide ranging implications, not only in Oklahoma but across the west and midwest.

“I believe she is the most corrupt person to occupy the governor’s mansion since Reconstruction,” declared John Rainey, a longtime Republican fundraiser and power broker who chaired the state’s Board of Economic Advisers for eight years.

In cheerier news, apropos of nothing but, one of the people I follow on Instagram is Kelly Harp. She’s the wife of Clint Harp, who’s one of the carpenters for the Fixer Upper show on HGTV, which is based in Waco, TX. Clint Harp has his own wood shop and I think he has his own show on another network.

Anyway, hadn’t much thought of her politics, if she had any. She seems sweet. But I assumed if anything that she probably tended conservative. I certainly hadn’t imagined her as a BLM supporter.

However, surprisingly, in the past month, she has been posting a lot on racial justice issues, talking about what she’s learning, recommending many of the books that have received attention, and so forth.

Not surprisingly, many of her mostly white followers are not exactly pleased by this turn of events.

But she. isn’t. having. any. of. it. She’s been laying the smacketh down, in fact, to the various denialists and Trump apologists trying to refute her.

So, while things are bad in many places, there are some bright lights.

It all comes back to this: if they aren’t paying parents enough where they can take leave from their job; pay their bills/buy groceries; and watch the kids, then the schools have to open up.

If teachers strike due to unsafe conditions, that’s a different issue. But the school districts can’t keep things closed down overall as long as teachers are willing to be there; UE benefits are going away; parents can’t telecommute; and kids rely on subsidized meals from schools.
