Supreme Court: Trump Is Not Immune From Subpoenas

Politics • Views: 17,193

YouTube

It’s a mixed bag. This ruling doesn’t mean we’re going to see Trump’s returns right away, but the most important part of the ruling is that the Supreme Court unanimously rejected Trump’s claims that he has absolute immunity.

On the not-so-good side, the court may have managed to kick the can down the road far enough that nothing will come out before the election.

But there’s no doubt about one thing: Trump’s paranoia is now going into overdrive; he’s posted at least 10 unhinged rage-tweets so far this morning.

UPDATE at 7/9/20 9:56:27 am by Charles Johnson

Here’s a more optimistic take from Neil Katyal.

Trump loses on both cases as he’s not above the law, but the way in which he’s being held accountable means that the cases get strung out past November. Justice delayed is justice denied. Instead of indicating that Trump had to immediately turn over the documents in the Vance case, it’s back to the District on remand. That means Trump gets to spend another bunch of money he doesn’t have to fight the release of these tax documents well into 2021.

I’m more focused on the Vance case since it is state crimes-related. The Mazars and Deutsche Bank cases also show the limits of presidential immunity, but again, it’s up to the District to show they took the potential immunities into account.

I would have argued that they already did, and he’s not above the law and moved to get the documents release immediately, but as with Vance, it probably would have split the court’s ruling in such a way that it would have given Trump the outright win. By remanding, Roberts gets to show that there’s no one above the law, but the time delay means that Trump effectively is above the law - and that seems to be Schiff’s take too.

For comparison, Native Americans are entitled to the Black Hills of South Dakota. There’s about $1 billion in escrow waiting for them, but the Native Americans want the land, not the money.

Besides, the land and mineral assets are worth far more than $1 billion with interest.

The gold from the Lead mine district alone was worth about $60 billion. So the US was lowballing them even while admitting they were wrong and expropriated land belonging to Native Americans because gold was found there.

The land, water and animals often have special spiritual meaning in Native cultures so it should come as no surprise they don’t want the money.

Swapping Pence for Haley isn’t going to help Trump since he’s the top of the ticket. He’d lose evangelicals and misogynists by going with Haley. That’s Trump’s base. There’s no benefit to going with Haley other than her being outside Trump’s immediate orbit at the moment and not totally botching the covid19 response, which ultimately goes back to Trump himself.

I believe Epstein’s death to be somewhere between him being murdered outright, or him being allowed to choose the time and place to die, because he’s surrounded by people that ensure that he is dead if he talks anyways.

On the not-so-good side, the court may have managed to kick the can down the road far enough that nothing will come out before the election.

In pretty much every ruling the Court gives, especially when it is a case of first impression (meaning the first time they’ve heard a case with the questions at issue) they tend to kick the can down the road. And on evidentiary questions like subpoenas, the ruling is always sent back to the trial court “for further proceedings not inconsistent with this ruling.”

It’s just part of how the courts work.

But as Alito pointed out in one of his dissents, while Trump can offer arguments, the way the majority opinion is written, those arguments are likely not going to be fruitful.

That said, the bigger decision today is McGirt. At least for federal criminal law, the eastern half of Oklahoma is still technically a reservation. How much further that decision can be applied and expanded is a question for future cases, but it may well have wide ranging implications, not only in Oklahoma but across the west and midwest.

Unless the VP says they want out, or there is a cloud of scandal over the VP (independent from POTUS), it really doesn’t make much sense. But then, the office of the Vice President doesn’t make sense beyond “we always have an even number of Senators and we occasionally need someone to break ties”

I suppose they could pressure him to resign or something along those lines.

I meant dumping him from the 2020 ticket. Jared tells him that all the bad polling is Pence’s fault and XX would improve his numbers. Trump has surrounded himself with people who don’t know what they’re doing with a mission statement of keep Trump happy.

Trump can’t fire him, but he can be off the ticket with probably two or three phone calls.

Nominate someone else at the convention. Pence has to ride out the rest of the year waking up and calling the WH to make sure Trump woke up, and then going back to drawing stenciled portraits of Mother like Seymour Skinner.

Unless the VP says they want out, or there is a cloud of scandal over the VP (independent from POTUS), it really doesn’t make much sense. But then, the office of the Vice President doesn’t make sense beyond “we always have an even number of Senators and we occasionally need someone to break ties”

That’s the VP quitting, not the prez forcing him out.
And we’d all know he was forced out no matter what excuse he gave.

And the the Democratic House needs to vote for a new VP to be in place until January 20th, 2021.

Or they leave it vacant with trump to look in his rearview every day and see nancy

I was thinking more along the lines of nominating a new VP at the convention. There is no mechanism for POTUS to remove the VP. The only mechanism to remove a sitting VP before their term expires is impeachment, resignation, or elevation to the main job.

But from the perspective of nominating a new VP, as I said, unless the VP wants out or there is some scandal involved, it is really hard to justify changing VP’s at re-election.

I think Harris the VP selection. Sort of a play on the old Young Pope/Old Pope rule.* You have an older presidential nominee, you go with a younger VP; you have a younger presidential nominee, you go with an older VP.

*the old line within the Catholic Church was that after electing a young pope (like JPII when he was picked) with a long reign, you elect an old pope more likely to have a shorter reign.

And I realize that even with a “process” the snowflake wingnuts will still whine and cry that it’s all still so unfair and rigged bias and nobody cares about them and they’re oppressed by PC blah blah blah. A more formal process nonetheless gives them a little less room for complaint.

My Texas brother and I were chatting today about non-political topics, when I started to bring up the Gorsuch Oklahoma decision — but my approach was so indirect that he thought I was referring to the tax decisions. His reaction was that Vance could see only a limited slice of the tax records and that this really was not very important. The cult remains in thrall to Trump.

He had not previously heard of the Oklahoma decision, but it did not trouble him at all — he and his wife visit the tribal casinos there and he has nothing but praise for their management. And he had no concern about the effects of this decision — but that’s probably because Fox and the other RW media hadn’t yet started providing him with the “correct” opinion.

Yeah I don’t know how that fits the Faux narrative since it’s more brown people than black people, and it’s Oklahoma, which while being celebrated as one of the real America states, is not of any real concern to the Faux propagandists.

In cheerier news, apropos of nothing but, one of the people I follow on Instagram is Kelly Harp. She’s the wife of Clint Harp, who’s one of the carpenters for the Fixer Upper show on HGTV, which is based in Waco, TX. Clint Harp has his own wood shop and I think he has his own show on another network.

Anyway, hadn’t much thought of her politics, if she had any. She seems sweet. But I assumed if anything that she probably tended conservative. I certainly hadn’t imagined her as a BLM supporter.

However, surprisingly, in the past month, she has been posting a lot on racial justice issues, talking about what she’s learning, recommending many of the books that have received attention, and so forth.

Not surprisingly, many of her mostly white followers are not exactly pleased by this turn of events.

But she. isn’t. having. any. of. it. She’s been laying the smacketh down, in fact, to the various denialists and Trump apologists trying to refute her.

So, while things are bad in many places, there are some bright lights.

Give her a follow if you’re on the Instagram thing.

Teachers range from 20s to 60s.
Staff likewise can be 20s to 60s.
Parents can similarly range from 20s to 60s.
Caregivers can extend beyond the 60s.

Even if Trump’s nonsensical rambling about kids being superhuman and don’t get sick (that’s a lie, and there are reports of people under 18 dying from covid19), they’d still have potential to infect everyone else.

Kids would be the spreaders that get everyone else infected.

It all comes back to this: if they aren’t paying parents enough where they can take leave from their job; pay their bills/buy groceries; and watch the kids, then the schools have to open up.

If teachers strike due to unsafe conditions, that’s a different issue. But the school districts can’t keep things closed down overall as long as teachers are willing to be there; UE benefits are going away; parents can’t telecommute; and kids rely on subsidized meals from schools.

The situation is a fuckshow and I’d give a lot to be a permanent resident of Germany, Scandinavia, etc., but that’s the hand that a select few idiots dealt us in November, 2016.

This is an odd new wingnut line.

I’ve been hearing conservatives say for decades that the mass public schooling system is all kinds of fraud, indoctrinates our kids, we need to homeschool, etc

You’d think conservatives would love this, gives them a chance to put momma back in the house.

Governor Beshear announced a mask mandate because Kentucky’s cases have been going up, but a judge issued a TRO barring him from enforcing covid-19 emergency orders, so that will be going up on appeal.

Trivia note: Like many of the “Lost Cause” statues, the Forrest bust was made in the north, Cincinnatti in this case. it was very late for such an idol (1973) but still very much an object of Lost Cause propaganda.

The bass player looked like he was having a lot of fun.

I haven’t done anything that has made me grin like that for a long time. Singer was smiley, too - didn’t get too many glances at the drummer’s face
