Good Afternoon Lizards. I hope all of you are doing and feeling well. I’ve been a bit sidelined from hurting my stupid knees working outside for hours standing on bricks and concrete. We’re all starting to feel the mental health strains of being on lockdown since March. Hanging in there, but the isolation is a bit much. My son had a couple of(socially distanced and outside only) friends over to swim yesterday and Cleo had a blast playing in the pool with everyone. It was the first time I have seen my kid smile in awhile. We’ve also been working on album cover jigsaw puzzles. So far we have Metallica’s Master of Puppets, Iron Maiden’s Iron Maiden, Iron Maiden’s Seventh Son of a Seventh Son, and right now we’re doing Slayer’s Reign in Blood. My husband also bought me 4 versions of Funko Pop Eddies and a Kerry King Funko. My belated anniversary gift, lol. I’m ordering some different puzzles too, puppies and other stuff. It’s been therapeutic, if anyone needs an outlet.
My son got notice that Stein Mart is going out of business so he has no job to return to. So now we have to find him some health insurance. Sigh. He wants to get back to work, we just don’t know where or when. I am looking at job training in skilled trades, maybe to see if we can find money for schooling or something. Warehouse work doesn’t pay enough for him to ever be on his own financially. I’m sad for him, and it’s also made his anxiety worse. I’m hoping that creating a plan to follow will help him.
I hope you all are finding a way through this madness. I’m fighting wicked anxiety and depression, I hate all the uncertainty of the future and not being able to survive financially, let alone physically. According to the NBC News/WSJ poll, 61 percent of all voters think America’s response to the coronavirus has been unsuccessful. That includes 84 percent of Dem respondents, 58 percent of independents, but just 37 percent of Republicans.

I haven’t watched Last Week Tonight, but there’s a hundred reasons why our jury system sucks… most people can’t afford to take multiple days off work (most employers don’t pay for days off on jury duty; and what the court provides is shit). there’s a culture of “how can I get out of jury duty” that pervades our society; in other words: it’s not seen as a civic duty and a matter of patriotism, it’s a chore that nobody wants to bother with. then there’s how jury duty actually plays out for a lot of people - ie, they go to the courthouse, sit in the jury room all day and don’t even get called to go to the courtroom (usually because there is a last minute settlement). and if you do get into the courtroom, the actual voir dire process is (speaking as a former litigator) litigators at their worst.
My general comments re polling for years: polls have become increasingly unreliable. You cannot reach most people: they don’t have landlines or they don’t answer calls from unfamiliar numbers, they don’t answer their door, they throw out mail. Take every poll with a grain of salt; wait, no, take every poll with a pound of salt.
In this year, especially, it’s also unclear who can or will be voting; millions may be evicted, and in some states, that can happen sooner than later. Homeless people generally don’t have valid voting registration. Under DeJoy, the USPS will be deliberately sabotaging voting, possibly targeting mail from area codes that are more Democratic. There is no villainy that this administration and the GOP are incapable of committing.

The polling was actually very accurate nationally in 2016 and overall in 2018. State polls were off because what noone saw coming was the appeal Trump had to whites without a college degree; a lot of polls are weighting for education now. The votes cast are likely to be within a couple of points of the polls. However, mail in ballots get rejected at a higher rate than in person ballots, and of course the sabotage of the USPS could cause a lot of mail in ballots to not be delivered to voters and to not be returned in time to be counted.

It’s difficult when speakers have no audience to roar their approval. That’s one interesting feature of the pandemic Bill Maher show: he has a “canned audience” to laugh during his monologue — he shows clips of audiences from other venues, from decades in the past, as “fake” reactions to his jokes.
One point I certainly made to my sister last night: at least Bernie Stans have no way to interfere with the presentations. Of course, that does mean everything may appear stilted with no hint of spontaneity.

I’ve served on a couple of juries. On the one hand, I’m an ex-lawyer. On the other hand, my evil too big to fail employer is extremely reliable in letting people off from work and paying us. So it’s a sure bet that if I’m called for jury duty, short of the case involving a relative or my employer. I’m ending up on that jury.
The case in federal court was SO DULL. All of the jurors knew how many lights were on the courtroom ceiling (that’d be 47).

There’s a whole science to polling that is so far beyond what most people realize. We are a long way from “let’s call 700 random phone numbers and see what people say.” As a result, polls are actually pretty damn reliable.

I’ll look at that thanks. We tried with a welding school just after high school and it was expensive plus they had no grants or loans except some private deal they had with a bank. He was totally intimidated too. But calling the unions and asking what they do to get young people into the trades is a good idea. I keep trying to explain to him that if he could learn welding, electrical or plumbing, he could make as much money as some doctors do, without the years of school or debt. Wish me luck, lol. This last job was a big deal for him because he got it all by himself, no community or government program or family helping. He was doing ok too, comfortable with the place and people. Which is huge for someone with Asperger’s.

There’s already speculation about who Newsom would appoint if Harris becomes VP. Some talk of an old guard caretaker (like Jerry Brown) to serve out the last two years and then have an open seat in 2022 (when Harris’ term was set to expire anyway). Lot of talk about a Latino/a appointee as well.
I’m not too big a fan of the Jerry Brown idea, only because DiFi is still in office for another 4 years. Someone younger would be a better choice just by default.

Becerra also has the benefit of being from Southern California. We have some weird north/south and coastal/inland splits in our politics. The coastal/inland tends to be the traditional R/D divide with Democrats mostly winning in coastal counties/cities and Republicans in inland areas. The north/south divide tends to be a Bay Area vs LA thing and how differently the major population centers developed in those areas.

I’ve served on a couple of juries.
I was on a jury a couple of years ago at the Edinburgh High Court which deals with serious cases, not something the magistrate’s court would normally dispense with.
The pool of jurors had to turn up to the courthouse on the Monday, absent a really good excuse in writing. They got a second chance to try and talk their way out of it at the courthouse (I didn’t try for various reasons). The survivors got corralled then taken out in groups of about thirty or so to a courtroom where our names were drawn out of an honest-to-goodness goldfish bowl. I was number 11 of a jury of fifteen, the other pool members who weren’t selected were discharged. We were seated in the jury box, the judge went through some rules, we got to see the writ of libels (the charges) against the defendant and the prosecution started laying out its case by 11 o’clock that day. I won’t go into details about the case but just sum it up with one word — “families”. We did get to pass down the classic Scottish legal verdict of Not Proven on a few of the libels which was a win. The accused, an absolute bastard and despicable excuse for a human being (IMO) walked out of the courtroom a free man.
What you Yanks put yourself through in the name of justice is a wonder and an amusement to me.

I still have questions about this: what about Congress’s power of holding someone in ‘inherent contempt’ still doesn’t require some kind of good faith cooperation of some manner? I mean…I keep hearing about them sending the Sergeant-At-Arms to arrest the person being held in contempt….but who else actually helps execute that order? What if the Executive continues to stonewall, obstruct, and otherwise protect whoever is being held in contempt? Where does the court come in, and what if the court ends up dragging things out and/or obstructing themselves?

At 3am this morning, two trucks tried to avoid a wreck on Interstate 30, and ended up on their sides, one of them crossed into the other lanes of traffic, as you can see in the first picture in this story: wfaa.com. If you go look on google maps of the area - Look for Lake Ray Hubbard on the map and then choose the traffic overlay - they are still shut down east bound, and are letting people off slowly west bound.

a) Concerning the car key I lost in the Fort Niobrara National Wildlife Refuge. I called the Mercedes-Benz dealer in Westminster (Denver suburb), Colorado to ask how to get it replaced, and can I please avoid a four-hundred mile round trip for a key?
No dice. Making a factory key requires filling out two forms (one for Mercedes, one for Colorado) stating I am the owner of my car and presenting both my driver’s license and registration in person as proof. Additionally, the key has to be programmed to the car’s computer, so the car has to be at the dealership to do that.
They said I could scan the forms after being filled in (LOL no scanners in any direction for scores of miles here). Instead I had to print out the forms and put them in the mail to the Mercedes dealer.
It takes three days to make a Smart key, according to the dealership. They will call me when they get my forms (and ask for payment then), and again when they are ready for us to make an appointment with the dealership to program the replacement. (As such I ordered two replacements, so we will have three keys.) We’ll probably have to stay overnight in Denver for this.
b) I ordered a replacement telephone directory (mine is from 2013). The telephone company was apologetic about not sending me a directory for seven years, so they will get a new one to me in the mail right away. Bonus, it’s the brand-new 2020 directory which just came out a couple weeks ago for the Nebraska Panhandle and southeast Wyoming.

An interesting sight on our drive back from Valentine was the “yard sign war.” In Valentine, there were bunches of people with Trump flags run up the same pole as an American flag (more of that flag code violating patriotism that seems to define conservative voters).
In the rural area from Valentine to my home was a sea of yard signs or large banner signs with “Rural Nebraskans for Biden/Harris 2020.”

My brother the professor gives the NY SUNY system three weeks of in-person classes before they close back up and go remote due to outbreak(s).
They issued a bunch of rules regarding how students quarantine coming onto campus and thus will be sort of isolated. I would say that my allergies have eased off a bit as I got older. Living *in* a city helped a bit since I think I got less exposure to some things like ragweed. And I was careful when renting to find places that were drier or had good ventilation due to mold allergies.

Mrs. TarH and I have been cleaning out the garage and making trips to our county convenience center. So depressing to see the Trump signs in front of small houses and mobile homes along the road there. The one solace I take is that in fewer than 60 days we will be able to do One-Stop Early Voting. Trump will set up a campaign for 2024 so he can get tax free money to pay his legal expenses, BUT…

Yoo was asked by Koppel, “Just to reassure our viewers a little bit, John, you’ve seen these PEADs?”
“I am not allowed to say whether I have or not,” he laughed.
“Let me put it this way: You were at the Justice Department. Presumably the Justice Department would’ve had to deal with these PEADs if a president wanted to implement one?”
“Yes, that’s fair to say,” Yoo replied. “The Justice Department and the office I worked in would review the legality of the PEADs because they would draw on presidential powers and Congressional powers delegated to them.”
Just a couple of weeks ago, Yoo was at the White House discussing executive power with President Trump.
“‘Cause you never know what the emergency is gonna be,” said Yoo. “So, these PEADs and similar contingency planning documents, when we look back historically at them, sometimes they seem comic.”

With a majority of rabid GOP voters who will only vote for someone with an R next to their name, a moderate Republican who would be willing to compromise, might be nominateable if enough Democrats vote in the Republican primary. The Republicans started playing hardball, _after_ Newt Gingrich, and went into overdrive after the Tea Party’ing wing came into picture. (And in fact, didn’t Thaddeus Cochran win the MS Senate race a few years back after many Democrats voted in the primary for him, instead of an crazier nutjob.)

Where I live, I essentially have no Democratic choices for most offices. The one guy who ran in NE-3 this time around switched to the Nebraska Marijuana Party after winning the Democratic Primary. (That said, I’d rather have him than Adrian Smith, but what was a tough campaign is now a doomed one.)
I’ve read on several sites where people suggest that strategy. Personally, I’d rather not give up my right to select national politicians in the Democratic Primary.

That’s my point. I like being able to choose my Democrats. I get it as a strategy where the GOP dominates and the Dems have little impact but here that’s not the case.
