Can Cruz vote for Cruz?

Because if he can’t, there’s not much margin to get him through without Murkowski (and I’m guessing Collins and maybe Romney.)

When Trump announced Cruz as part of the 20-name list Wednesday, the senator issued a statement suggesting he was satisfied with remaining in Congress. He more explicitly said he wasn’t interested during a Fox News interview Sunday.

“Do you want the job?” host Maria Bartiromo asked.

“I don’t,” Cruz responded. “It is deeply honoring, it’s humbling to be included in the list … but it’s not the desire of my heart. I want to be in the political fight.”

A hollow voice says, Beware the strongman con  Sep 18, 2020 • 5:39:06pm

The reason we all rely so heavily on SCOTUS is the filibuster. The repugs have been using it for many years to block every change the majority might want. Get rid of that and the Court’s importance isn’t so great.

In other words, nothing has changed. We need to elect Biden, we need to take back the Senate. On a local level, people need to get involved and VOTE so that the nazis and confederates no longer have the voice they have now in state and local policies. Look around and you will see it happening already.

As to expanding the Court, I’d be fine with it, but I don’t think it’s going to happen. But it’s not a fixed entity, and and justices can change (it’s happened before), as can the makeup of the court.

And I’m out for now. I’m already sick of the painting of horrid pictures of the future, without even a decent interval to remember RBG and her accomplishments.

Wont open (paywall?) - what’s their basis for this? I though Senate seats only “vacated” at the end of the session

Two Republican and Democratic election attorneys agree that state law and Senate practices would make Kelly eligible to take over the seat once held by Sen. John McCain as soon as Nov. 30, when the state election results are expected to be canvassed…

“Everything in statute suggests it happens very quickly after the election results are finalized,” Mary O’Grady, an attorney specializing in election law and a Democrat, said.

Thomas Basile, a Republican who also specializes in election law, added, “In the ordinary course, in an ordinary Senate election, the winner of the election would begin his or her term until January. But in this context, a special election to fill a vacancy in a pending term … the winner could be sworn in and seated earlier than he or she otherwise would be if this were a regular election.”

The cached version gets around the paywall

Let’s not beat around the bush: The Supreme Court is now going to be stacked in the Republicans’ favor for the next 20 years. Let’s just focus on working around it, to minimize the impact that this has. We have to win in November, both the Senate and the Presidency. It’s the only way we live.

In the long run, the supreme court is more often an impediment to progress than not. For every good decision there are 2+ bad ones.

However, the trend has been for SCOTUS decisions to have ever-increasing impact. So working around a fascist Supreme Court will be more difficult now than when FDR had to do it back in the 1930s.

I left the Dark Side permanently about 1991. I was a Republican for many years until I realized that the right-wingers don’t give a damn about anyone but the people at the top. I became a part of this community early on, lurking in 2002, joining up in 2003. I’m #2138. I’ve been here a while.

But g-d damn it, one thing I’ve noticed is that way too many Democrats have too much “quit” in them. Most of them don’t, but too many do.

You think I don’t understand?

You think I’m not grieving this terrible loss?

Sean Trende of RCP says - and I agree - that Trump’s best move is NOT to nominate anyone before the election, because then he makes it explicit that this election is about the Court.

If he nominates somebody, then that’s it, done. He loses any leverage to get people to the polls because even though people are pointing out that if Mark Kelly wins, he can be sworn in on November 30th, Mitch McConnell has a calendar, too, so he can hold the vote when he can still win.

Romney’s office refuted the claim he wouldn’t vote for a nominee before January. Not saying he WOULD vote, though.

The thing is, if there’s a nominee, EVERYONE KNOWS they’ll be confirmed, either before or after the election. I don’t see how this is a plus for the Right. Yeah federal legalization of abortion in all 50 states.

Legally it’s a small step from ruling that the right to life of a fetus is more important that the mother’s health etc. to ruling that the right to life of a fetus trumps any state interest in legalizing abortion.

In other words, we’re looking at a Dred Scott situation, where a court that overturns Roe v. Wade is as likely to impose a nationwide abortion ban as it is to leave it up to the states.

United States Senate
quorum - The number of senators that must be present for the Senate to do business. The Constitution requires a majority of senators (51) for a quorum. Often, fewer senators are actually present on the floor, but the Senate presumes that a quorum is present unless the contrary is shown by a roll call vote or quorum call.

Nope.

Article I, section 5 of the Constitution requires that a quorum (51 senators) be present for the Senate to conduct business. Often, fewer than 51 senators are present on the floor, but the Senate presumes a quorum unless a roll call vote or quorum call suggests otherwise.

Yep. Unless they get some defectors, MItch can still call quorum, and very possibly could even if there were defectors who refused to be present. There would have to be just enough that someone could stay behind and force the quorum vote with only 49 or less present rather than let them assume quorum.

And at that point, you’re better off getting those defectors on paper for a No vote anyhow.

Okay, not to piss on anyone’s dreams at this point, but the most likely outcome is that Trump nominates and the Senate confirms. Doesn’t matter, for the sake of the seat, whether the confirmation or indeed the nomination happen now or after the election.

That doesn’t mean the Dems don’t fight, but our ability to stop this is severely limited. I’m not sure at this point that we should threaten to expand the Court if we win, because we can always do it anyway, and in the unlikely event that it got McConnell to relent, we’d be stuck keeping our promise.

No, I think we should grieve and move on.

Trumps best argument for reelection with a lot of Republicans will be gone, though. They aren’t given to gratitude, so the fact that he filled the seat won’t matter as much as making sure he would fill the seat did. So, there’s that.

I think the GOP underestimated the FURY that the Kavanaugh confirmation triggered. They thought it was a positive for them, and would energize their base, but what it REALLY did was energize ours. Similarly, another naked display of power will pile more fuel on the fire of our fury. I remember Roosevelt’s phrase - “The American People in their righteous might…”

Not unreasonable honestly. The Founders I think were definitely wrong on the idea that Senators should be elected by state legislatures. The sooner we get rid of the notion that the Founders were infallible and without error the better. And I say this as someone who has a lot of admiration for what was accomplished 233 years ago and one day ago in Philly.

Blind Frog Belly White  Sep 18, 2020 • 7:40:30pm

I posted this to Facebook just now:

Ruth Bader Ginsburg looked frail, but that woman was Atlas. She carried all of our hopes for so long, even after she was diagnosed with metastatic pancreatic cancer. She held us all on her narrow shoulders as long as she could. And now it’s time for us to carry her hopes and dreams on ours. We cannot let the authoritarianism of Trump and the cynicism of McConnell extinguish our hope that America will become what America says it is.

“Out of the rack and ruin of our gangster death,
The rape and rot of graft, and stealth, and lies,
We, the people, must redeem
The land, the mines, the plants, the rivers.
The mountains and the endless plain—
All, all the stretch of these great green states—
And make America again!” - Langston Hughes

I quoted Hughes “Let America Be America Again”, because that’s what this election, this fight is about. We on the Left are struggling to hold America to its promise, to make it into the beacon of freedom it claims to be, but has always fallen short of. The Right not only thinks America is fine as it is, they think America was BETTER when we fell EVEN FARTHER short of our aspiration.

The problem is then that RBG would have been off the Court sooner.

No, I think life terms make sense, because you don’t want the court to swing with the whims of the day.

The problem is, quite simply, the Senate and the Electoral College. They’re remnants of our past as semi-independent former colonies, and of slavery.

So, we expand the Court, and we grant PR and DC statehood. Also, maybe expand the House. None of these requires more than the House, Senate, and WH. I hope we learned out lesson in 2010? Consolidate power FIRST. The other side will do just that when they have the chance, and the only way to restore American democracy is for them to lose the whip hand.

I’m not the far left, but honestly I think it would have been a good move. She could have enjoyed a few years of well-deserved retirement, and the fate of our republic wouldn’t hang on an 87 year old woman’s pancreas.

We’re going to learn all the details someday about how Kennedy was persuaded to retire, and it won’t be pretty. But it gave us Justice Beer for probably the rest of my life, so from a political sense, it worked.

As in so many things these days, the usual rules of decorum and tradition (in this case, justices don’t time their retirements for political reasons) once again apply only to Democrats.

I loved RBG, but I don’t think waiting out the Obama administration was one of her better moves.

re: #345 makeitstop

Just a thought - how many more votes will seating another SC justice net Trump? I’m thinking not many - the hard core is already voting for him.

But looking at ActBlue’s fundraising numbers since the news about Justice Ginsburg broke, it sure look like a lot of people on our side have kicked it up a couple of notches.

As with all of Trump’s ‘wins’, this may not be as big a win as it first appears.

Trump holding that seat hostage is his best bet to get conservatives to vote for him, if he fills it then they really don’t need him anymore.

Watch out, or Thomas will retire, too, if he thinks Trump is going to lose.

This election will determine votes on redistricting in the states. Anything that drives up Democratic votes will help with that.

Sorry if I sound angry tonight. I’ll be okay. It’s just goddamn. We knew that 2016 was consequential. We warned them. They didn’t want to listen and here we are and as I said we could well have the most right leaning court in years which is really going to hinder progress because the right wingers on the court are a bunch of partisan hacks who just have this delusional interpretation of the Constituion especially that jackass Thomas and Alito. And then there’s Kavanaugh who is the preppy bastard that you always wanted to punch in the face who only has his job because of his lifetime of service to the Republican PArty.

Ha. Seriously though guys. I would have gone nuts the past four years if not for here. I’m going to be okay and I’m as determined as ever to beat Trump this fall but damn if I don’t feel the same sadness I did four years ago. Plus we really did probably lose arguably the best justice of the court. No disrespect to Sotomayor, Breyer, and Kagan but RBG was amazing.

Jeez—I’m having deja vu (all over again) to 2004, and getting in heated discussions with idiots who just weren’t “excited” about John Kerry, and I kept on saying SUPREME COURT, SUPREME COURT, SUPREME COURT. And then we got W…and then we got John Roberts …and then we almost got fucking Harriet Miers…and then we go Samuel Alito.

But people just weren’t “excited” about John Kerry.

(And yes, I’m strongly in favor of some sort of age limit for SCOTUS.)

That was my first election. I was more further left then but even I knew how important SCOTUS was. And I’ll tell you this much. I trust Kerry, HRC, and Biden with SCOTUS far more than any leftist purer than thou.

We on the Left, on average, are really pretty goddam dumb. The Right has been all about the courts since at least the 1980s, so they always vote, and they always vote for the Republican candidate.

And us? We say stupid shit like “MY vote has to be WON!”, as if we’re so goddam special that we can just sit out an election if we’re not excited about the candidate and not have the whole country slide into the shitter.

My assumption was before RBG died that one or both would step down before the 2022 midterm. I don’t know how to feel about age limits 100% but the fact is SCOTUS keeps on growing more politicized and honestly? I blame Reagan for a lot of that shit because he had the bright idea to put Bork on.*
* Which is part of why I genuinely do like Biden since him and Teddy K are why Bork is a footnote.

You know what? Fuck Bernie Sanders. I despise what the man has done to mislead so many well meaning albeit naive people about politics and the political process.

Had Bernie Sanders been a tool for the plutocracy with a mission to keep the plutocracy in power forever, it would be difficult to see how that would have changed his campaign in 2016. 2020 was better, but not by much.

re: #333 Blind Frog Belly White

Eliminating the EC would require a constitutional amendment, but there’s nothing there about how it is constituted (pun not intended). I think. IANAL. Removing the “senatorial contingent” and basing each state’s numbers on the number of house members they have would go a long way toward removing the imbalance of the EC.

I mean….it’s not even the election that I’m despondent about. I honestly think the electoral effect will probably push things even more in favor of the Dems.

My problem is that this basically will solidify Republican ownership of the entire judiciary for the next generation and a half, combined with MItch’s single-minded task of filling every single vacancy so there’s virtually no hope of Dems undoing that damage within even two back to back Dem presidencies.

Yeah a lot of our damage is self inflicted. I’m proud to be on the left because of what the left has accomplished over the years but there’s a loud segment on the left that puts their ideological dogmatism above progress and they have allowed the likes of W Bush and Trump to take office because of that.

True, but if we doubled the size of the House, we’d significantly reduce the voting power of the states nobody wants to actually live in less populated states.

The House and Senate determine the size of the Federal Bench. All of it. We could pack ALL courts.

Or eliminate seats, on a “Last In, First Out” basis.

Then reinstate the seats later…..

# of Electors = House delegation + senators is explicitly in the constitution IIRC.

Having more House Representatives would help (2x or 3x would not be unreasonable).
