I hope that RBG’s death will be a wake-up to the lefties who only focus on the Presidential election and don’t understand or care about the broader implications. I mourn for her, but hope that her passing is a rallying point before the election.

RBG was a lion of the court. She will be deeply missed.

This is more than depressing.
I do believe that it will energize the left more than the right. Republican hypocrisy will be on full display. It sucks that we will have to for things that we fought so hard to earn. It is a step back, but the election will be two steps forward.
The reason we all rely so heavily on SCOTUS is the filibuster. The repugs have been using it for many years to block every change the majority might want. Get rid of that and the Court’s importance isn’t so great.
In other words, nothing has changed. We need to elect Biden, we need to take back the Senate. On a local level, people need to get involved and VOTE so that the nazis and confederates no longer have the voice they have now in state and local policies. Look around and you will see it happening already.
As to expanding the Court, I’d be fine with it, but I don’t think it’s going to happen. But it’s not a fixed entity, and and justices can change (it’s happened before), as can the makeup of the court.
And I’m out for now. I’m already sick of the painting of horrid pictures of the future, without even a decent interval to remember RBG and her accomplishments.

Sean Trende of RCP says - and I agree - that Trump’s best move is NOT to nominate anyone before the election, because then he makes it explicit that this election is about the Court.
If he nominates somebody, then that’s it, done. He loses any leverage to get people to the polls because even though people are pointing out that if Mark Kelly wins, he can be sworn in on November 30th, Mitch McConnell has a calendar, too, so he can hold the vote when he can still win.

Romney’s office refuted the claim he wouldn’t vote for a nominee before January. Not saying he WOULD vote, though.
The thing is, if there’s a nominee, EVERYONE KNOWS they’ll be confirmed, either before or after the election. I don’t see how this is a plus for the Right. In some ways, the status where RBG is still alive but being hospitalized for a day or so every couple weeks is better, because her replacement is still in doubt.

There would have to be just enough that someone could stay behind and force the quorum vote with only 49 or less present rather than let them assume quorum.

Not unreasonable honestly. The Founders I think were definitely wrong on the idea that Senators should be elected by state legislatures. The sooner we get rid of the notion that the Founders were infallible and without error the better. There are mourners at the Supreme Court right now. 10:42 PM EST. I don’t think I’ve ever felt the lost of a SCOTUS justice so much. When I took government in high school, we saw a video about the court and both Scalia and Ginsburg were in it. They were cordial towards each other but what Ginsburg said about the Constitution being a living documented resonated with me then as it still does now.

No, I think life terms make sense, because you don’t want the court to swing with the whims of the day.
The problem is, quite simply, the Senate and the Electoral College. They’re remnants of our past as semi-independent former colonies, and of slavery.
So, we expand the Court, and we grant PR and DC statehood. Also, maybe expand the House. None of these requires more than the House, Senate, and WH. I hope we learned out lesson in 2010? Consolidate power FIRST. The other side will do just that when they have the chance, and the only way to restore American democracy is for them to lose the whip hand.

Legally it’s a small step from ruling that the right to life of a fetus is more important that the mother’s health etc. to ruling that the right to life of a fetus trumps any state interest in legalizing abortion.
In other words, we’re looking at a Dred Scott situation, where a court that overturns Roe v. Wade is as likely to impose a nationwide abortion ban as it is to leave it up to the states.
Then we have to go back to where it should have gone in the first place, which is that a ban on abortion is religiously based and not allowed under the First Amendment.

I’m not the far left, but honestly I think it would have been a good move. She could have enjoyed a few years of well-deserved retirement, and the fate of our republic wouldn’t hang on an 87 year old woman’s pancreas.
We’re going to learn all the details someday about how Kennedy was persuaded to retire, and it won’t be pretty. But it gave us Justice Beer for probably the rest of my life, so from a political sense, it worked.
As in so many things these days, the usual rules of decorum and tradition (in this case, justices don’t time their retirements for political reasons) once again apply only to Democrats.
I loved RBG, but I don’t think waiting out the Obama administration was one of her better moves.

Sorry if I sound angry tonight. I’ll be okay. It’s just goddamn. We knew that 2016 was consequential. We warned them. They didn’t want to listen and here we are and as I said we could well have the most right leaning court in years which is really going to hinder progress because the right wingers on the court are a bunch of partisan hacks who just have this delusional interpretation of the Constituion especially that jackass Thomas and Alito. And then there’s Kavanaugh who is the preppy bastard that you always wanted to punch in the face who only has his job because of his lifetime of service to the Republican PArty.

Ha. Seriously though guys. I would have gone nuts the past four years if not for here. I’m going to be okay and I’m as determined as ever to beat Trump this fall but damn if I don’t feel the same sadness I did four years ago. Plus we really did probably lose arguably the best justice of the court. No disrespect to Sotomayor, Breyer, and Kagan but RBG was amazing.

My assumption was before RBG died that one or both would step down before the 2022 midterm. I don’t know how to feel about age limits 100% but the fact is SCOTUS keeps on growing more politicized and honestly? I blame Reagan for a lot of that shit because he had the bright idea to put Bork on.*

No, I think life terms make sense, because you don’t want the court to swing with the whims of the day.
The problem is, quite simply, the Senate and the Electoral College. They’re remnants of our past as semi-independent former colonies, and of slavery.
So, we expand the Court, and we grant PR and DC statehood. Also, maybe expand the House. None of these requires more than the House, Senate, and WH. I hope we learned out lesson in 2010? Consolidate power FIRST. The other side will do just that when they have the chance, and the only way to restore American democracy is for them to lose the whip hand.
Eliminating the EC would require a constitutional amendment, but there’s nothing there about how it is constituted (pun not intended). I think. IANAL. Removing the “senatorial contingent” and basing each state’s numbers on the number of house members they have would go a long way toward removing the imbalance of the EC.

My problem is that this basically will solidify Republican ownership of the entire judiciary for the next generation and a half, combined with MItch’s single-minded task of filling every single vacancy so there’s virtually no hope of Dems undoing that damage within even two back to back Dem presidencies.

True, but if we doubled the size of the House, we’d significantly reduce the voting power of the states nobody wants to actually live in less populated states.

The House and Senate determine the size of the Federal Bench. All of it. We could pack ALL courts.

Having more House Representatives would help (2x or 3x would not be unreasonable).
