If they really want to, they could. There would be backlash but if they decide backlash-be-damned, there is little to stop them.

re: #41 Wendell Zurkowitz ((slave to the waffle light))

It is obviously being actively promoted by Trump, if he can get enough people to sign on, it will become an ugly reality.

The short answer is this is not really a possibility in any practical sense. Technically, a state legislature could issue a slate of Trump electors (although remember, this would have to be passed by the legislature and signed by the governor, which is a bit of a lift). Of course, the Sec State and/or Governor would probably issue another slate of Biden electors in accordance with applicable State law, therefore meeting “safe harbor” deadlines. This goes to the incoming Congress joint session, with the Democrats in charge of the House. If there is a dispute between slates of electors, and even if a Republican Senate goes all in for Trump, the worst situation you will get is a deadlock between them over which slate to accept, which defaults by Federal law to the safe harbor slate of electors (the Biden one). So no, the system is creaky and stupid but not that stupid.

If you ignore the mountain of stupid bullshit designed to confuse and scare people, so far the election machinery has done exactly what it was supposed to do when it was supposed to do it. All the stupid court cases were thrown out, counties have certified their votes on schedule, and now states are certifying their votes on schedule. Trump is trying to panic and scare everybody because THATS WHAT HE DOES.

i would make one correction, as i understand things

if a state legislature issued it’s own slate of electors, Congress would *not* have a dilemma, or difference or dispute of any sort.

it would have a legitimate slate of electors certified by the governor or SOS or whoever, based on the election.
and
it would have ‘something’ from the legislature. that ‘something’ would have no weight, validity or legality. the legislature (depending on the state) has no such power to select the electors after an election by vote of the people.

*I* could send a slate of electors and it would have exactly the same validity as the legislature’s in this circumstance

The Trump argument that the state legislators can pick their own electors is a farce.

It’s like arguing that majority members of a state legislature can commit murder with impunity because they could (theoretically) pass a law to make murder done in their state by majority members of the legislature legal.

Anything the state legislatures do with electors without first taking that power back into their own hands legally is null and void.

That is what I have been saying. The law in all 50 states says that the electors are chosen according to the winner of the popular vote in that state. There is no “takesies-backsies” on that. You can’t retroactively pass a law to allow the legislators to overrule that decision. For all their bluster, there is no path to victory by legal means, and I suspect that most people involved except Trump know it.

Theoretically a state legislature that didn’t like how a particular election came out could immediately pass a law to change that result. But IIRC PA republicans don’t have a veto proof majority, so doing this legally would fail because of a veto from Wolf.

Another reminder of why these state level races are so important. IIRC the governors of MI, WI and PA all recently switched from R to D. Had that not happened, these state legislatures stealing the election for Trump would have been a much greater threat.

I remember a couple years ago (?) they kept putting happy animal rescue stories on FB, and I was wondering who the fuck are these people that are plastering their happy shit all over? I follow several animal rescue groups and I had never seen or heard of them before. Didn’t sit right with me - too targeted. Most rescue groups work hard to build trust and are always scrambling for funds. Not these assholes.

Then I did some checking and saw they were a cult group of foreign alt-right weirdos, that had nothing to do with animal rescues or rights, it was just clickbait. For no particular reason I’ve received a couple of their newspapers in my mailbox, which I have used to start fires.

They’re completely fucking crazy, like Fox News TV but in print.

Falun Gong is legit persecuted by the Chinese government. But my sympathy for that is mostly gone because they have so thoroughly aligned with US right wing nut jobs.

E.g., the most disgusting piece of propaganda I saw at the time of the Kavanaugh nomination was in the Epoch Times (their rag of a newspaper), where some smarmy little prick pointed out that “the longest interval between a SCOTUS nomination and a confirmation vote was for Bork.”

We require people to register if they are acting as the agent of a foreign government. In this case we are dealing with a foreign anti-government millenarian cult. That’s perhaps more dangerous.

re: #83 EPR-radar

The Trump argument that the state legislators can pick their own electors is a farce.

It’s like arguing that majority members of a state legislature can commit murder with impunity because they could (theoretically) pass a law to make murder done in their state by majority members of the legislature legal.

Anything the state legislatures do with electors without first taking that power back into their own hands legally is null and void.

From Article 2 of the Constitution:

“Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.”

There is nothing in there about a Governor having to approve this. Yes, each state has a law specifying that the electors are chosen by popular vote. But SCOTUS is stacked with originalists who may very well revert to the explicit text of the Constitution. The Republican Party has repeatedly shown that all it cares about is power and wealth. We are in uncharted waters here and may be witnessing the death of our republic, with the full approval of 73 million of our fellow Americans.

Either the Republican Party stops this now or we will not recover.

When federal law is silent on a subject, the usual rule in Federal court is to defer to state-level law. In all applicable cases, that state level law makes state legislators stepping in (without making new law) to override an election illegal. The US constitution is simply irrelevant on this point.

Sure, SCOTUS could do the maximum GOP hackitude thing, but IMO that’s unlikely, even for this SCOTUS. Roberts and Gorsuch seem to be the likeliest to hold the line here.

And why wouldn’t they hold the line? Judges only have power if laws mean something, and to illegally put Trump in office like this would be the end of rule of law in the US.

Laws mean whatever the judges decide they mean. Maybe Roberts would care but I wouldn’t count on it; after all he destroyed the VRA. Hitler’s Germany had plenty of laws that were used to enforce his dictatorship. Why do you think that Moscow Mitch stocked the courts with Federalist Society Hacks? Maybe it’s actually Mitch who is responsible for this bloodless (so far) coup?

He’s still rehabbing and improving daily. For the past week, he’s been going up and down the steps (from the 3rd floor). My back is very grateful not to be carrying him up and down anymore. He’s using the FHO leg more and more.

He’s got a new habit that’s frustrating. He never seems to want to go out. When I get the leash, he runs away. So, I had to come up with a strategy. Before I get the leash now, I carry him to the door, put on the leash and head out. Once we’re in the hall, he’s done a 180 and is so excited to go out. What a weirdo.

re: #199 jaunte

Yes, this is the problem.

All too many Americans are so wanting life to be different than it is that when a salesman like Trump comes along and gets them to buy in, they are deeply bought in.

And it is very difficult to change people once they are deeply invested in something.

This is the heart of all things like this with humans: cults, destructive relationships, etc.

Whoever is the dominant party ends up shaping the very mind of those who are consuming.

And this is the kicker - even if the influenced know something is wrong, they have lost the ability to change.

Deprogramming cults is one of the specialties of a sub-division of therapists. It’s a tough business.

Now I still believe that there are Americans out there who identify as Republicans who are very put off by Trump. Yet somehow, other than some high profile types (e.g. Lincoln Project), they feel trapped.

And this gets me back to my lament - the worldview collapse keeps many voters frozen. They can’t internally accept a world that is different than what they were taught as a child, yet they also know that what is going on is in some fundamental way wrong.

The success of fundamentalist Catholics in the 20th century in convincing fundamentalist Evangelical Americans that abortion is the most important national sin of the US ought not be overlooked.

re: #207 Love-Child of Cassandra and Sisyphus

There are people in my Facebook timeline who are very thoughtful, considerate… but can never vote for a Democrat because they think abortion is the unforgivable sin and Democrats are under the power of Satan.

These same folk may find Trump abhorrent… but that is not enough to get them to support the abortion-loving Democrats.

That’s a lust for temporal power. That’s a sin for Christians.

Because I was raised in a Southern Baptist church….and abortion was allowed until quickening.

The change was not from a spiritual basis…it was for power in this world.

Stuff like this is why I wouldn’t be surprised if even though they now have a rock solid 6-3 majority on the supreme court, they still don’t overturn Roe V Wade. Because the moment they overturn it, how do they keep their base energized, and how do they prevent an inevitable culture war backlash? The GOP managed to get gay marriage banned in California, and the response effectively consigned them to a permanent minority not just in the popular vote but more importantly in seats held in government thus making it next to impossible for them to gerrymander their way back into power…

re: #128 Hecuba’s daughter

Laws mean whatever the judges decide they mean. Maybe Roberts would care but I wouldn’t count on it; after all he destroyed the VRA. Hitler’s Germany had plenty of laws that were used to enforce his dictatorship. Why do you think that Moscow Mitch stocked the courts with Federalist Society Hacks? Maybe it’s actually Mitch who is responsible for this bloodless (so far) coup?

Yes, well, so far Trump-appointed Federalist Society hacks have been tossing out Trump lawsuits because they don’t want to touch this shit. I suppose theoretically the Supreme Court could sua sponte declare Trump King of the United States tomorrow: where does this speculation stop?

Again, if you don’t get distracted by the insane sideshow, everything in the election has been proceeding according to process and law. The votes were counted; the mail-in votes were counted; the lawsuits were filed and almost all dismissed; the counties have certified their counts on schedule; and states are certifying their counts on schedule. We’re well out of the zone where you can manufacture a dispute over the vote totals and now it would be a blatant coup, so we’ve passed the most vulnerable part and it gets harder by the day. You can worry and panic all you want, but that’s what Trump wants.

Also I would guess half of those dipshits are from out of state. Not that GA doesn’t have enough assholes and then some, but I would bet half aren’t from this area at all.

The House needs to impeach him again, at once, and then hand that hot potato to the Senate. If things get worse at this rate they may be ready to do something to avoid the next couple of months. I don’t mind if Pence gets to be 46.

re: #217 Dread Pirate Ron

Trump considers any election he didn’t win to be rigged and illegitimate because only legit votes are the ones cast for him and his fellow GOPers.

They are fuckin’ fascists.

The last impeachment taught me that Nancy and company had to get their ducks marshalled and lined up well in advance. If they haven’t done this now (for round two), it won’t happen.

It’ll be hard for Pelosi to fit this in with everything else that Twitter is screaming at her and Schumer to do. (Restocking her freezer with ice cream should be her priority, but… ///)

I am also feeling that another impeachment is in order. Trump’s election fraud antics are a dangerous affront to rule of law. The sentiment is getting more voices.
Why not impeach? The House can make quick work of it and not spend the time and effort that was taken to document and argue the case of Trump’s crimes in the Ukraine case.
