Last I checked, you can’t bring in new evidence during appeals. And certainly not evidence that is irrelevant to the appeal being heard. IOW, you can’t use an appeal on a minor matter as a trojan horse for a case that the courts already put the kibosh on.

Most appeals are about the trial either being conducted incorrectly or the judge misinterpreting the law. Since the appeal being sought in PA is that the court failed to allow Rudy’s “crack lawyers” file an amended version of the original complaint, the USSC is not going to allow the “big evidence” to be presented. The most they can do is declare that it was wrong for the lower court to refuse the filing of the amended complaint. At which point the case gets squashed for everything from lack of standing to piss-poor “evidence.”

I want to say that this election has been a triumph of our federal system. In the midst of a pandemic, we had a rousingly successful election in which vastly more people than ever voted. While federal government Republicans pretended to believe there were significant issues, local election officials, including many Republicans, who worked countless hours and were proud of what they achieved, vigorously defended their hard work. I tip my hat to all of them who made what could’ve been a massive shit show such a rousing success for democracy, which Trump could not break.

I stopped by my mother’s after seeing the doctor and chatted with my brother. We talked briefly about Sidney Powell. Remember. he’s a conservative guy, he may have voted for Trump (but I didn’t ask). But when Sidney Powell’s ouster was mentioned on TV, he started pointing and laughing because he’d heard Powell’s crazy about the governor of Georgia, communists and Venezuela. When it’s too incredible for my brother, you’ve lost.

As for the doctor, I’m fine. My blood sugar is decent, my blood pressure is low, and I am now at the lowest weight ever for my adult life. But that last is because I’m having difficulty eating. I’m hoping now that GSAEmily has signed off on the transition, I’ll feel better. I’m pretty sure it’s just nerves.

As with everything else in the law, there are some exceptions but most exceptions for bringing new evidence on appeal are along the lines of “the other side hid stuff from the trial court” or “facts on the ground changed in a way that effect the case”

I should add, even in the cases where there is an exception to “no new evidence on appeal” the appellate courts won’t weigh the veracity of the new evidence. At most they will decide whether the new evidence (if true) warrant additional review by the trial court

The only sort-of famous person I’m friends with that anyone here at LGF would know is Brooke Binkowski. The rest of them are in alternative/underground music and/or comics industry.
