a rando’s thoughts on flynn

But did Trump succeed in protecting himself?

1) To accept the pardon, Flynn has to admit guilt. Which means any accessory crimes not covered have a guilty admission tied to them.

2) Flynn isn’t covered by 5th amendment protection (he can’t legally incriminate himself for crimes he is pardoned from). As such, any court, grand jury and congressional panel can require testimony and Flynn has to testify or face contempt charges.

3) Flynn’s trial is in court. A smart defense lawyer will argue for closing the case, a smart prosecutor will ask for Flynn to elocute first. That elocution has no 5th amendment protection anymore, and if elocution contains another set of lies (remember - Flynn lying got him into this mess), opens another set of crimes and might invalidate the pardon.

So, it looks like saving Flynn only opens light into the process. Trump may think it saves himself, but Trump has a limited understanding of legal process.

A pardon comes with no legal requirement to admit guilt. Also, I am not a lawyer, but assume you can still plead the 5th if there is a chance your testimony could be used against you in a a different jurisdiction, like a state court.

Burdick does require allocution to the crimes being pardoned for.

If you’re pardoned on the federal crimes, you lose the 5A protection on those crimes. If there are state charges, then the 5A would apply as to those charges. It would depend on the facts and circumstances as to what overlap is present, if any.

Cranberry-orange sauce is yummy. It doesn’t take forever to make and freezes well, so you can have it with your turkey at Second Thanksgiving. And if you don’t like, that means there’s more for me.

What? You don’t do Second Thanksgiving? That’s when your friend-and-neighbor has bought an extra turkey which her husband cooks on the BBQ and you and your kids and their spouses and her kid and spouse all get together for a giant potluck in January.
Which won’t happen any more than First Thanksgiving will this year. Sigh.

I’ve done turkey before for other holidays, but since it’s just the mrs and I, we’ll be doing just a turkey breast. I figure I’ll do a balsamic sauce with tarragon, sage, and rosemary. I’ll roast up a bunch of vegies as a side - parsnips, carrots, sweet potatoes, zucchini. I have chicken soup and matzah balls made previously, and just made cranberry sauce for first time - bag of cranberries, honey, water, orange juice, orange zest, and let it do its thing.

No stuffing though. Don’t need the carbs. Figure that the pan sauces should be good for any/all of that.

We’re doing a small-ish turkey because we have plenty of room in the freezer for leftovers. We’ve been getting “heritage” birds for several years because they are just tastier. And we feel better about the way they are raised. (As God is my witness, these turkeys can fly! At least enough to get up on a shed roof, as shown in photos of the farm where they’re raised.)
Said bird is currently residing in brine in the refrigerator. The cranberry sauce is done. Tomorrow I’ll make a small batch of stuffing (yes, to go in the bird) and a couple other sides. We really don’t have anything for dessert because a whole pumpkin pie for 2 people is just too much, but that’s OK.
We’ll Zoom with the kids and then Mr. C. and I will dine with each other.

Repeating my comments from 11/8, when Kasich’s name first reared its ugly head:

Before Kasich urges Biden to meet Congressional Republicans halfway, he should STFD and STFU. Kasich is, and always has been, a gigantic asshole and I don’t get the Dem acceptance of his bullshit. Him speaking at the convention nauseated me.

Oh, and he was quite the successful Biden surrogate—Trump won Ohio in 2016 with 51.69% of the vote; 2020, it jumped to 53.40%.

Everyone has a line that shouldn’t be crossed. Mine is Kasich (and a few others.) Putting a pig like him in the cabinet, with his anti-woman and other assorted nasty, ugly positions, is a slap in the face to many, many people. As Molly Ivins said, You Got to Dance with Them What Brung You. And Kasich didn’t “brung” us any damn thing.

I’m not saying it would ever make me vote for a Republican (it wouldn’t) or turn me against Biden, but it could certainly put a damper on my actions and donations going forward.

Inexpensive rapid in-home Covid-19 testing is a technology that much of the world is embracing, while the US continues to resist and ignore. Sure it’s way less sensitive than pcr tests, but that is an advantage if you want the result, pos or neg, to indicate whether or not you are likely to be infectious right NOW.

I’m actually surprised that QAnon doesn’t seem to have found fertile soil in Belgium; after all, they had the notorious Marc Dutroux case, what with Dutroux’s allegations that he was simply a procurer for high-ranking kiddie rapists (those allegations were never proven and were almost certainly Dutroux trying to save his worthless hide). That being said, the Belgian authorities royally fucked up during the investigation, leading to a good deal of justifiable public outrage.

A report released Wednesday by the Washington-based Institute for Policy Studies tracked the net worth of the over 650 of the wealthiest Americans from March 18 to Nov. 24, and found that dozens joined the ranks of billionaires during this period and that 29 saw their wealth double amid the pandemic.

The net worth of this minuscule group is twice the amount of wealth of the bottom 50% of U.S. households — about 160 million people, per the report.

They then go home feeling virtuous and looking down on other people they see in the street not wearing a mask AT ALL! How dare they, don’t they know how serious this disease is?

Wear a mask if you absolutely must go out and interact with other people. Don’t use it as an EXCUSE to go out and interact with people. Stay home, stay isolated as much as possible.

There are still Trump flags here and there but probably not nearly as much now as during the formal campaign. The despair is palpable. So is the sense of entitlement where you can live your entire life without meeting anyone who is not your own “white” identity or else a poor black person or in any regard anyone who is not fundamentalist Christian.

The small towns were built during the age of trade unions, family farms, and domestic manufacturing. Those days are gone and thanks to Republican control now will not return. But the voters here don’t care. They just fear change and fear falling even further down the well of despair. And with despair comes the inclination to favor dictators or their wanna-bes. Republicans happily assume this role and the mantle of dictator quickly and naturally so here we are. Trump and his more capable, less vulgar followup candidates are not going away either. The masks are off, the way forward revealed, and it is by naked authoritarianism and hatred for all “others.” We are in for a rough ride for at least another 20 years.

The best part of thanksgiving is leftovers.
Especially -
Turkey dip!!!

My mother would take the usually huge amount of leftover breast meat and shred and dice it into several cups of turkey were available. Dump that into a large bowl, mix with a cup of mayo, a cup of plain yogurt and a cup of shredded sweet coconut. Season with a dash of allspice to taste. Chill and serve on Ritz style crackers.

(originally my mother would have used all miracle whip for the dressing but my ex hates it so came up with the mayo/yogurt combo that I must admit tastes better.)

Memories of the last recipe I sent to Dad for cranberry upside down cake. Dad loved making pineapple upside down cake and I thought he’d get a kick out of the recipe.

Dad made it, said it was so wonderful he ate the whole cake.

I just watched that. I was kind of dumbfounded when Joe said that he and his buddies had been fighting against Newt Gingrich because he wasn’t conservative enough. Joe still thinks this is a great thing to say out loud.

Nuclear power plants are nothing to do with nuclear weapons development and proliferation. Atomstroyexport sells reactors to all sorts of countries just like Westinghouse does in the States. The only done deal for nuclear power plants in the Middle East are the four Korean-built KPR1400 reactors in the UAE which are nearing completion and the Bushehr reactor in Iran which was finished by, surprise, Atomstroyexport. There’s a second reactor being built by Atomstroyexport at Bushehr, a more modern VVER-1000 (but not the top-of-the-line TOI model, pity) and plans for a third but no hole-in-the-ground, bent metal and poured concrete quite yet.

Yeah, and seeming to ignore the fact that all those business he cites as being allowed to open are doing so with notable (and clearly-demarcated) restrictions on masking and capacity. Of course, the enforcement of said rules is pretty loose - it’s usually up to the store owner/manager - but in theory, or at least on the face of the laws, some restrictions in the name of public health are (at least so far) considered permissable.
But of course, once you get into the realm of “religious freedom”….

The St. Paul Chamber Orchestra has halted all livestream performances, citing COVID-19 “rampaging in our community.”

The decision comes two weeks after the nonprofit canceled a performance after someone directly involved with the livestream tested positive for the virus. A spokesperson declined to say whether it was a musician or a staff person, citing health privacy concerns.

In August, the orchestra had canceled its fall schedule of in-person concerts, but continued making music at Ordway Concert Hall, livestreaming shows on its website.

But on Wednesday, the nonprofit’s leaders announced the suspension of those concerts “to protect the health of our musicians, staff and crew.”

My brother worked under him (technically: he worked for a company that Perot bought out) and he said he was self-destructive crazy. His company was purchased, shelved, and then re-sold for a fraction. For no good reason. The buyers (the original owners) took it back but they had lost precious time and resources. Ended up being bought out by Siemen’s, which absorbed them into its gigantic maw.

No Friendsgiving this year. Just here in my apartment doing what I do every Friendsgiving morning. Taking out the fan from my kitchen window and sealing up all the apartment windows in anticipation of the winter cold rains which used to start around Indigenous People’s Day in October…and there is still no rain in the long range forecast…

And to which our Federal system allows an outsize influence.

* IMO, basically a conservative, conformist, authoritarian “ultranationalism”; founded on codified prejudices and propped up by ostentatious religiosity. Not universal, of course, but prevalent and unavoidable. YMMV…

There’s a big difference between suppressing someone’s ability to vote before an election, and tossing their vote out after an election. (In the sense of how obviously corrupt it looks/why I don’t think Trump is going to get this election overturned at the Supreme Court, there are too many states needing to be overturned, and Biden won them by too large a margin.)
