The second impeachment. Hopefully he’ll be the only one to unlock this grotesque achievement.

And only 10 of the Republicans voted for it, which is disgraceful but who expects any better from the GOP in the Trump era?

Conviction won’t happen again until after the inauguration. At that point, it’s not really the conviction that’s important, but the vote on keeping him from running for office again.

As I’ve said, my biggest fear is that he starts a war/launches a nuke. The “normal” process for such a thing is geared toward speed above all else, so there are no checks and balances - once a president gives the order, nukes are launched within minutes.

Nancy Pelosi had discussions with Pentagon top brass about this, but who knows what their response was. Hopefully more than a shrug emoji and “whatchagonnado?”

I suspect that we’re going to see some fears realized, some false assumptions and still some very dark shit as people follow the money, track the cell-phone pings and connect the social media dots.

One of my friends (former) is and Indian American who came to America as a small child. Raging Trumper.

He joined the police force and made national news recently when he pulled his gun and threatened a prone and handcuffed suspect. He held the gun to the back of the guys head and said he would splatter his brains all over the sidewalk if he didn’t identify himself.

He was fired and now faces felony assault charges.

Same here, but the fact that Pelosi and the Pentagon discussed ways to avoid it made me feel a little better.

Presidents should not have the power to destroy the world on a whim. I understand the rationale for doing it this way in the Cold War, but that was before we had a president who might very well use it because someone insulted him in a tweet.

Though Pence is still technically President of the Senate until noon on the 20th.

Also, just as an aside, I wonder when Kamala Harris is actually going to resign and hand the seat (unfortunately now the least-senior) to Alex Padilla?

Certification is to be performed “no later than Friday of the second week following the election”, which would be Friday, January 22. They may certify before then, but that’s the official deadline.

The power of the President to issue pardons is absolute. As far as I understand it, there is no power in heaven or on earth that can now prevent Trump from issuing whatever pardons he wants for the next seven days. The legality of those pardons can only be tested in federal court, and will likely have nothing to do with impeachment.

Actually, I think I prefer the impeachment trial to take place after Biden is sworn in. There’s some MAJOR advantages to this.

First and foremost, Mitch McConnell will NOT be setting the rules on the trial - that would instead be in all likelihood be the job of Chuck Schumer.

What this means is that, unlike the first trial, instead of debate being shut down, key witnesses being suppressed, and incriminating evidence not allowed to be submitted, there will be a full accounting.

This would include calling Donald Trump to the witness stand, and he would be compelled to testify, as claims of executive privilege for ex-presidents is significantly limited.
The Republicans are going to regret not taking the 25th Amendment option, which gave them a fairly painless out - as it is pretty much guaranteed that there is going to be plenty of daylight shone on Trump’s criminal deeds directly related to his insurrection against the United States.

I can’t explain in words alone how horrified and distraught I was over it. Those chants of “HANG MIKE PENCE” will forever instill terror in me.

No, not for his safety. In this country it seems to be a defining trait that the ability to feel empathy for others is a liberal/Democratic trait, whilst the ability to feel empathy only when it affect you personally is a conservative/libertarian/Republican trait.

It seems to be a large grey area amongst Constitutional scholars; the plain text does not speak to it one way or the other, so it’s up to interpretation of “they’re out of office, so the trial is moot” vs. “if an official could just resign before their impeachment trial and thus avoid being barred from holding office, why even have the power in the first place”.

Trump is a clear and present danger and that should suffice to distinguish from impeachment of a judge becoming moot if the judge resigns. William W. Belknap, Secretary of War, resigned after impeachment but before trial and was acquitted. That was in 1876.

Samuel B Kent, District Court Judge, impeached June 19, 2009, resigned June 30, 2009, trial dismissed July 22, 2009.

George W English, Distric Court Judge, impeached April 1, 1926, resigned November 4, 1926, trial dismissed December 13, 1926

Mark W Delahay, District Court Judge, was impeached by the House for drunkenness, but he resigned before any formal articles of impeachment were drawn up, so no Senate trial at all.

So there’s precedent for continuing with trial after someone has left office.

My gut sense is that the Framers wouldn’t have considered someone who had been impeached (regardless of conviction) capable of becoming president, at least the way they thought the system would work - with electors exercising independent judgment on the election. Obviously, with any position requiring Senate confirmation, it is highly unlikely that someone who was impeached and resigned would get confirmed.

I think the idea is that once out of office they would be subject to criminal liability, and again, the idea that a convicted felon could win elected office is something that wouldn’t have crossed the Framers’ minds.

Of course, part of our problem is that while we have the trappings of the Framers’ system in the electoral college, electors don’t exercise independent judgment and there’s - at least in theory - nothing to prevent Trump from running again if they dismiss the trial as moot.

We’ve once again run into the problem that while we operate broadly under the Framers’ system, we have modified how it works and created some blind spots.

I don’t feel a lot of empathy for him. He’s neck deep in a lot of corruption, poor leadership, and criminality - and he walked into it with open eyes.

Problem with that is that George III when not in the grips of whatever his affliction was (and that’s still heatedly argued about) he was actually a very good monarch. That he had troubles with the wealthy colonists who wanted more say in their situation (the poor ones neither side gave a f*** about) was just something that could have probably been dealt with if they’d paid more attention to what the real issues were. I think there is a standing need for many to “Nuke it from orbit. Gay panic. Defendants would not be able to use a “gay panic” defense under LB 321, introduced by Sen. John Cavanaugh of Omaha. The bill would bar courts from considering evidence that a defendant’s actions resulted from finding out or knowing a crime victim’s gender identity or sexual orientation.

Malcolm X Day. The birthday of El-Hajj Malik El-Shabazz, also known as Malcolm X, would become a state holiday under LB 349, introduced by Sen. Terrell McKinney of Omaha. El-Shabazz was born Malcolm Little on May 19, 1925, in Omaha. He grew up to become an influential Black leader, who was assassinated on Feb. 21, 1965.

A resolution was also introduced as a proposal to reduce Nebraska’s famously high property taxes and underfunding of rural school districts in what might be a compromise for those seeking to lower property taxes and those improving schools.

The proposal by state senator Tom Briese would transfer the cost of funding everything but buildings to the state general fund. Teachers, aides, schoolbooks, &c would all be paid for by the state (about 60% of the costs of running schools here). The bulk of state aid currently goes to a few large school districts, and very little goes to over two hundred rural school districts.

Those who seek to reduce or eliminate the state income tax would probably be opposed to this measure.

IANAL, but my reading of the text says elected or appointed. Police officers do not appear to be included.

Section 3. Just had a thought about the impeachment trial… under Rule XI of the Senate impeachment rules, they could kick the trial to a committee who after trial gives a recommendation to the full body. This is actually how most judicial impeachment goes where it is referred to the judiciary committee

That would allow the full senate to carry on with regular business. And has the added bonus of further sidelining Trump.

OTOH, those guard troops have training I wouldn’t have had: In the current Manual of Common Tasks that every soldier must know and is tested on at least once a year, there are three tasks dealing with detecting and safely dealing with IED’s and on on unexploded ordinance. Because of this they have a much better chance of finding the bombs first.

The election wasn’t stolen, but the GOP has been radicalized by Fox (from Carlson, Hannity and the rest on down) and primed by Trump to believe the lie. They repeated the lie enough that Fox viewers and the GOP base (interchangeable) wouldn’t believe that Trump admits it was a hoax. They’d sooner believe that it too was part of the conspiracy, or that the conspirators got to Trump.

The GOP base are a right wing domestic terror group, and they’ve already shown their violent inclinations and intentions.

In my opinion, in America Christianity became entwined with white supremacy in the years before the Civil War. Especially in The South.

Slavery was the source of The South’s wealth and as is usually the case, religion supported that. Any pastor, reverend, or preacher who said otherwise was punished and/or exiled.

So Christianity became the American Faith, where America is the deity and the deity has said that white people are better.
