Extra juror briefly deliberated trucker’s fate; now he could get new trial on child rape charge (Omaha World-Herald)

TL;DR, a truck driver raped his friend’s daughter. For some reason the judge in the trial failed to dismiss the alternate juror, who wound up in the deliberation room debating the case.

An hour later, the judge realised his mistake and removed the juror. After deliberations, the jury convicted the trucker, who was sentenced to thirty-eight years.

Now the state supreme court has ordered a new trial for the trucker, as the judge apparently did not interview the jurors to find whether the alternate affected the outcome of their deliberations.

The temperature is probably not the worst problem Ingenuity will face: I’d guess the bigger obstacle to optimal performance is going to be the lack of atmospheric pressure: Even the lowlands of Mars are the equivalent of, what? 25000 feet above sea level on Earth (?). I’m assuming that prop has been designed to cope….

I saw on Wikipedia that trying to fly on Mars was like flying in Earth’s atmosphere at 34,000 m (112,000+ feet). The propeller is incredibly over-sized for the tiny 4 lb drone to account for this.

The temperature comment is because low temperatures are murder on batteries and lubricants, two of the key pieces to the drone being able to actually fly over multiple days on Mars. If it can successfully power up multiple days in a row on its own, with just solar power, there’s a good chance it can fulfill its 5-day mission duration.

For those wondering about Ingenuity: NASA tested it by putting it in a vacuum chamber at 0.6% Earth atmospheric pressure, and putting a support line under it to support 62% of its weight - equivalent to the 38% of Earth gravity that it would experience on Mars. With the level of forethought they put into that testing regimen, I’d lay good odds that if it can survive the Martian night and power up the next morning, we’ll be getting GoPro videos of Perseverance in a week or so.

The funky thing Olov (the goofy looking guy) is playing is a nyckelharpa

an old, old instrument. Basically a fiddle over a set of drone strings with a set of pushed levers against the fiddle strings making chords. It has a really cool, haunting sound, kind of like a sitar on mushrooms. Olov may be the best young player of the instrument. He pushes boundaries with pieces like this.

I know Olov, by the way. He and Catriona McKay, an old friend of SWMBO and I, have done a couple of albums together.

A lot of deep-space batteries are warmed by the nuclear decay of their MMRTG, but in general, yes - you are correct. Batteries are a lot more resilient than people give them credit for. They are used in space missions to give instant power during power-up sequences while the MMRTG provides constant energy to recharge the batteries during dormant cycles, and maintain energy levels during active cycles. Fact of the matter is, batteries have been proven in deep space, on Mars, and even as close as Minnesota, so there’s no reason they can’t work in Oklahoma or Texas.

Colorado Supreme Court Chief Justice Brian Boatright on Thursday vowed to reform the state’s judicial branch in the wake of allegations of judicial misconduct, sexism and harassment — and of a high-level cover-up intended to keep those misdeeds secret.

“Where there is wrongdoing, we will address it,” Boatright said. “Where there was an abuse of power, we will stop it. Where our policies are deficient, we will change them. We want to know the truth. We recognize the branch faces a crisis of confidence in its leadership.”

Boatright became emotional and struggled to speak at times as he addressed Colorado lawmakers in the state House of Representatives during the annual State of the Judiciary speech Thursday. He reiterated the Colorado Supreme Court’s commitment to investigating the cover-up allegations through an independent panel not controlled or appointed by the justices, and said there needed to be a cultural change within the branch.

The investigators will examine former State Court Administrator Christopher Ryan’s allegation that high-ranking judicial officials — including now-retired Chief Justice Nathan “Ben” Coats — agreed to give a $2.5 million contract to a former top administrator in order to keep details of judges’ misconduct secret.

Stronger is better because you use less, but higher THC when CBD is kept low does change the effect. It doesn’t make it scary like the reefer madness crowd claims, but it does make it a less mellow experience. It’s nice to have so many choices at the weed store rather than just getting whatever you can get like in prohibitionist states.

Erik Prince, former head of security contractor Blackwater, sent weapons to a Libyan militia leader in violation of a United Nations arms embargo.

A confidential U.N. report sent to the Security Council and obtained by The New York Times shows that Prince sent foreign mercenaries with weapons such as attack aircraft and gunboats to eastern Libya in 2019 to support Khalifa Haftar, the commander who was fighting to supplant the internationally-recognized Libyan government.

The mercenaries involved in the plot also reportedly planned to assassinate specific Libyan commanders.

Well I had a back spasm and it did nothing, neither did the 20 mg of morphine so I can’t blame the weed. it took 10 mg of hydromorphone at the hospital. Then when they released me they gave me another shot, twice. I overdosed on my way home, puking and sweating in 40 degree weather. I powered through the nausea but it was horrible.

The Sidney VA Clinic called yesterday to give me information and ask if I was having any trouble following my hand surgery.

I have not needed my pain medication, despite my hand being sliced open from the top joint of my index finger down to near my wrist.

However, I passed along I am still having difficulty and pain walking following my hand surgery. Boring details of why I can’t walk after a hand surgery behind the hide button.

Like previous surgeries on my hands, the VA put inflatable devices around my legs to prevent blood clots which later could injure me.

This time they used a different device, which consists of three inflatable rings, one set for each leg. They inflate and deflate in sequence to keep venous blood moving up the leg.

I don’t know what the hell they did with this thing, but it squeezed so hard it severely bruised my legs in the places where the rings were placed. Apparently the squeezing was too hard, injuring something sufficiently that I have severe leg pain and can barely walk.

Sidney scheduled a special appointment for me Monday with the orthopaedic clinic to take a look at my legs after my second Moderna shot.

In all the risks the surgeon went over prior to starting, “leg injury” was not on his list for “hand surgery.”

Sidney also scheduled an unrelated appointment based on my pre-op tests and to give me something to worry about.

But wait… flight times from Sao Paulo to LAX is longer than that.

This is not the first time this has happened, for this particular product.

Don’t know how Amazon does it… must have really fast jets.

Stronger is better because you use less, but higher THC when CBD is kept low does change the effect. It doesn’t make it scary like the reefer madness crowd claims, but it does make it a less mellow experience. It’s nice to have so many choices at the weed store rather than just getting whatever you can get like in prohibitionist states.

Enough food spread out enough I guess.

My feeder ran on a sort of queue system. One (sometimes two) male cardinals in the feeder along with 2-3 females. And the one male would chase the other male every so often anyways. Pile of male cardinals and remaining females in the tree nearby waiting their turn.

One snowy day I counted 13 male cardinals in the horse chestnut tree waiting. (Would have been a brilliant picture if I’d had a decent camera at the time - dots of red against the tree limbs with a bit of snow clinging to them and a nicely angled light coming in from front-left.)

I’m still playing with that Radio.garden site. (Google Earth mapped ‘radio’) There are some good stations in the middle of nowhere.

I found Radio 80000 in Munich, Germany, a sort of avant-DJ-mix station. Very interesting show on it called “Patterns Radio” with an eclectic mix that reminded me of JD Twitch’s show on NTS radio.

EDIT: I see Clyde Built Radio from Glasgow is doing a guest slot tomorrow. That might be interesting.

BTW, there was discussion during the landing of the delay between Mars and Earth. Yes, it’s somewhere between 11 and 12 light-minutes away, but at that distance, the bandwidth is a measly 8 kbps. Yeah, that’s right, NASA wishes they had your crappy 56k dial-up right now. So that’s part of the slowness in receiving high-res data, as well.

It finally dawned on me why Perry made the statement that Texans prefer outages to more government oversight: It is his fault that Texans were suffering and dying this week. The 2011 disaster and the federal report on the steps to prevent a recurrence occurred when he was governor and he didn’t care. I know that the Texas gubernatorial position is a very weak office, but if he had any concerns, he would have been pushing to get the necessary changes implemented.

TL,DR version, Republicans think they can win next year by saying that Democrats aren’t getting schools open fast enough and by making it hardr for Democrats to return things to normal by blocking their proposals, but a lot of people think it won’t work, even some Republicans.

I’m old enough to remember when the parties wanted to be judged by how they improved their constituents’ lives, not how they sabotaged their opponents.

The strangest “get along in the winter” bird, to me, is the Red-Winged Blackbird. Males aggressively defend turf in the spring and summer but when they migrate back north, the males and females come in large groups at different times.

Most years the males line the fairway along one of my disc golf courses by the hundreds, waiting for the girls, sitting wing to wing and making strange sounds.

Then, when the females arrive, unity is over!

Arturo Di Modica died at his home in Vittoria on Friday evening, the town said in a statement on Saturday. Di Modica had been ill for some time, it said.

The sculptor lived in New York for more than 40 years in New York. He arrived in 1973 and opened an art studio in the city’s SoHo neighborhood. With the help of a truck and crane, Di Modica installed the bronze bull sculpture in New York’s financial district without permission on the night of Dec. 16, 1989.

The artist reportedly spent $350,000 of his money to create the 3.5-ton bronze beast that came to symbolize the resilience of the U.S. economy after a 1987 stock market crash.

“It was a period of crisis. The New York Stock Exchange lost in one night more than 20%, and so many people were plunged into the blackest of depressions,” Rome daily La Repubblica quoted Di Modica as saying in an interview earlier this month.

He said he conceived of the bull sculpture as “a joke, a provocation. Instead, it became a cursedly serious thing,” destined to be one of New York’s more visited monuments.

There is an especially virulent strain of anti-Asian racism in goober America, dating back to the 19th century. It has been in abeyance recently, like a dormant case of syphilis, but it doesn’t take much for it to break out in all its ugliness.
I’ve often thought that this would be a different and overall better country if not for the Chinese Exclusion Act, which wasn’t fully repealed until 1943. A lot of people at the time thought so too. Cartoon from 1882 while the act was being debated.

A curious alliance of progressives, human rights activists and western business leaders fought tooth and nail against the Act the entire time of its existence, but they could not overcome the hatred and racism of the masses.
