It would be amusing to see a verdict like this: “We find the defendant guilty on all counts. P.S. The defense was a clown show and a complete waste of time.”

Not likely, he is only in his 40s and the average stay in prison for 2nd degree murder in Minnesota is 12.5 years. Unless he gets consecutive sentences he will be out before 60.

The maximum sentence for 2nd degree is 40 years, and the lesser charges would probably be served concurrently. Plus time off for good behavior and time served, even in the worst case he’s going to live to see the light of day.

re: #24 lawhawk

smarter than me explains why they arent the same:

Quite a few Republicans, both officeholders and pundits, wondered why Waters’ words were ok, but Donald Trump’s remarks to the crowd on Jan. 6 were not. These folks are either ignorant or dishonest, because the legal distinction is crystal clear. Beyond Trump’s words being considerably more direct and inflammatory, the key is that such egging on is only illegal, and is not covered by the First Amendment, if it encourages imminent lawless action. So, for example, “There’s Bob standing over there. You should shoot him,” is illegal. “Someone should shoot Bob sometime,” on the other hand, is ok. This was established in Brandenburg v. Ohio.

I would expect sentencing to be right around average. They’ll undoubtedly try to offset the viciousness of his crimes with the fact that he was a police officer (even if he was a shitty one who had been reported, but never disciplined, numerous times). Appeals will definitely be interesting, and I’m sure Congresswoman Waters will be brought up, and that’s what I’m most anxious about, as a non-legal expert.

I think it is worth celebrating that a cop murderer in the US was actually found guilty of his crime, since that is still a depressingly rare thing.

From a broader point of view, it is true that much work needs to be done to make it routine rather than depressingly rare for criminals in positions of power (like cops who commit crimes) to face justice.

I’m kinda torn on his mentality, and I’m sure at some point someone will ask him and we’ll know for sure. On the one hand, he’s arrogant enough that I think he could’ve believed he would get off. On the other hand, the state made a great case, and literally everybody (except for the assholes) was rooting against him. He had to know he was the bad guy and was unlikely to be viewed favorably by a jury of mixed race and gender.

Since we know there are quite a few number of people killed by cops each year, how many times has a white cop been tried for killing a white person? I seriously don’t know.

They don’t get convicted either, to wit, the murder of Daniel Shaver by a Mesa PD cop in 2016.

Given the way the rabid right wing has been discussing this trial, they expected him to fight that he was “just following proper procedure,” and they aimed to make the argument that convicting him would have a deleterious effect on the ability of police to do their dangerous job.

A judge ruled Tuesday that the City of Buffalo must reinstate the pension of Cariol Horne, a Black police officer it fired after she stopped a white colleague’s chokehold on a handcuffed man in 2006.

In his ruling, New York state Supreme Court Judge Dennis Ward cited the deaths of George Floyd and Eric Garner, two Black men killed in police custody, to show why it was right for Horne to act.

“The Floyd case as well as another notable case in New York, concerning Eric Garner, both involved multiple officers who either did nothing or actually assisted the officer applying the physical force, even while the individual was crying out that he ‘could not breathe,’” Ward wrote.

Horne responded to a call to help her colleague, Gregory Kwiatkowski, during an arrest. When she arrived, she found the arrestee, a Black man, already in handcuffs and saying he couldn’t breathe as Kwiatkowski put him in a chokehold, according to court records. She forcibly removed Kwiatkowski and stopped the chokehold, records say.

Horne was reassigned following the incident and ultimately fired in 2008, a year short of the 20 years of service needed to receive a full pension.

Oh, he is supremely corrupt, as they all are. However, Trump didn’t have a habit of hiring people who weren’t personally loyal to him - especially toward the latter end of his reign of terror. Barr is an authoritarian, no doubt, and if there’s one thing I think he might take a stand for, it’d be the right of the police to do whatever the fuck they want.

I literally, 30 minutes ago, watched one of Clemson’s finest blow through a stop sign in my neighborhood. When I had heard they were waiting for 90 minutes to anounce the verdict , I had feared they had acquitted him or even had a hung jury and the city was putting police into place, to put down any justifiable emotionally charged protests that would have occurred.

I’m glad I was wrong.

There was no doubt when they came in after 12 hours that it was going to be a guilty verdict. If it were a hung jury, there would have been a couple of times where the judge would have told them to try to work it out. If it were a hung jury, they would have spent a week deliberating. 12 hours means they knew he was guilty and they just wanted to get one more free lunch out of the state.

The body cams for his accomplices didn’t show much because they weren’t focused on him. As for his own body camera, it probably didn’t have the best view of the man under his knee, though the audio probably could’ve been used.
