Texas Bans Abortion as the Supreme Court Does Nothing

This is one of the biggest reasons why many of us had such a sinking feeling when Donald Trump was elected, at a time when he would probably be able to install at least one Supreme Court justice. It turned out that he installed three.

Donald Trump installed three Supreme Court justices. Let that sink in.

And now the right wing Supreme Court is doing what they were groomed to do — tear down the Roe v. Wade decision. Starting with refusing to stop an absolutely insane Texas law that actually places a bounty on people who provide abortions: Texas Abortion Ban: What It Means and What Happens Next.

With the U.S. Supreme Court mum, a new law went into effect in Texas that bans abortions after about six weeks of pregnancy. That’s well before many women even know they are pregnant.

The law allows private citizens to sue abortion providers and anyone else who helps a woman obtain an abortion — including those who give a woman a ride to a clinic or provide financial assistance to obtain an abortion. Private citizens who bring these suits don’t need to show any connection to those they are suing.

The law makes no exceptions for cases involving rape or incest.

Yeah, what could possibly go wrong here, other than I don’t know, saying that Abbott and Paxton spouses both had abortions and someone needs to investigate what happened and why they’re covering up their own malfeasance?

My understanding is, it’s a normal civil lawsuit. Someone makes an accusation, the defense has to show up, if it survives a 12(b)(6) motion to dismiss (plaintiff has to show likelihood of success on the merits), it goes to discovery, in which case, yes, they would have to produce medical records, etc. Upon receiving a judgment in their favor, if it goes that far, plaintiffs would automatically be awarded attorney’s fees and a $10,000 cash judgment.

Okay, these points are all valid if you assume a baseline of Amercian civil liberty as encoded in the Constitution….but the core premise of the Republican Party and American “conservatives” is that the state exists only to wield force in aid of their cultural positions against the non-compliant.

If you fill in the blanks from their perspective, the hazards aren’t hazards.

For example…this law will not be enforced in ways that disrupt existing hierarchies, so snitching against someone of a high Republican caste will not produce the same response from the state as snitching on someone deemed out-caste or untouchable.

That this law will periodically cause pain and suffering to loyal and compliant members of the caste system is a win, because the general rule that the lesser must bear the cruelty of the greater is more important than any particular assertion about the limits of state action.

And vigilantism isn’t vigilantism if you believe that society has a class that is inherently entitled to be cruel and use lethal force, so long as they do so against the classes that are viewed as inherently suspect and threatening.

In any event, in addition to being incredibly venal, this is extraordinarily stupid as a political maneuver. The telecomm companies may grant the 1/6 Commission’s requests, or may insist on a subpoena, but they aren’t going to respond to blackmail. Meanwhile, the message that is even louder and clearer than the implied threat is “We Republicans are scared witless of what those phone records will show.” If there was anything that might make the 1/6 Commission more determined to get those records, this is it. Rep. Adam Schiff (D-CA) made the same observation on Chris Hayes’ show on MSNBC, though you don’t need to be a lawyer and a member of Congress to figure that out. There is clearly a lot of fire behind all the smoke.

It would never get that far; as noted in a tweet above this post, a private citizen would have no way to gather enough evidence to survive a 12(b)(6) motion. However, that’s not the point. The point is to sue people who can’t afford to hire an attorney to defend, or who would be intimidated by the official process of a lawsuit - which precisely fits the nature of the law as an anti-abortion measure, since women having abortions are vulnerable and often not in the best financial position. And suits against the wealthy and powerful, and their mistresses, would fail because of the same lack of evidence, but because attorney’s fees are only awarded on success, the number of them would decrease rapidly as people decided it wasn’t worth it to continue trying. They really seem to have thought this one out.

See. the thing that fascinates me…and makes this all hard to talk about…is that there’s this belief in hierarchy but only to the extent that they assume they are in a super-ordinate position to most other people.

They don’t even believe in one consistent pyramid-shaped order of people, just whatever is at hand that provides license by virtue of assigned superiority. Whiteness, God, Darwin, money, “Murica—they freely slide between essentialist qualities that make them superior in an opportunistic manner. It’s not belief because they don’t actually believe anything, they just decorate themselves with appeals-to-authority for the purposes of whatever rhetorical things they’re trying to get over.

As a direct consequence, absolutely nothing is fixed. There is no final authority or first cause that can tell them no, and when a “no” is asserted they seek out a different authority that will say yes.

I have been around many different varieties of religious fanatic and…this is an entirely different hazard.

It’s ur-ur-fascism, people so deep in narcissism that everything is just aesthetics orbiting a core of appetite. An episteme would just slow down the rate of consumption, so they don’t have one.

i am against abortion. i want to be very clear on this. i believe every abortion is a failure of leadership and a failure of society. like my opponent, i believe the ideal abortion rate in this (city, county, state, country) is zero. where my opponent and i differ is how to get there. they want to criminalize abortion and make it illegal and punishable by prison time. they want to make a horribly desperate situation more horrible and more desperate.

but there are policies that will bring the abortion rate down, and are proven to work. i’m talking about education, access to birth control, and community health clinics. these policies work. we have the data. but teaching abstinence only, making birth control harder to obtain and closing community health clinics is not just counterproductive to the goals they claim they want to achieve…it’s just cruel.

i am against abortion. There are humane ways to reduce them in our community dramatically.

There is a massive divide developing in America right now. There are the states that actually handled the pandemic, that are progressing on civil rights, defending human sanctity and the right to vote, and are rapidly proving themselves the best places to live in our country. Then there are the shithole states, the states that are dying of COVID (or people dying in hospital waiting rooms because the ICUs are full of COVID patients), where only the elite few white American Republicans can vote, where abortion is de facto outlawed and it’s becoming criminal to be black or brown or a woman. And if something isn’t done about it, there will be a civil war within many of our lifetimes, as one side or the other eventually gets fed up at “the other guys” refusing to see their side of the issues. (I have a feeling I know who will initiate that conflict, but nothing is certain.)

Johnstown PA, site of one of the worst dam break disasters in US history - where more than 2,200 died when a dam operated by a bunch of wealthy millionaires failed after rains due to improper design/maintenance. None of the millionaires ever were held accountable. The court case found that it was an Act of God, not negligence and improper maintenance/adjustment to dam design.

Yesterday’s rainfall total was nearly 4 inches. We found the garage and basement flooded. I dried the carpet with two dozen towels the best I could and got some fans going. Hopefully the carpet down there isn’t ruined.

Today we got new gutters installed, we’ve had to put it off many times because of all the rains this summer. I hope that helps some with this mess. Our old gutters were wrecked, they were original to the house, built in 1978. More things we can’t afford, but there’s not much choice there.

Still fighting with doctors and insurance. I needed to take a break from that to clean up a flooded laundry room(not carpeted thank god,but the rest of the basement is, not so fun). , so the battle rages on.

I would adore having some fucking fun, just for a damned day to two. JFC with a bucket of KFC.

Nighttime bad weather is the worst weather.

With daylight, you have a chance of seeing storms before they hit and you’re awake.

Nighttime, we’re flying blind and relying on weather services to issue alerts and get us time to get to a safe spot.

Also…taking monoclonal antibodies while being skeptical of a vaccine—a thing that teaches your body to make antibodies—is a very weird position to hold.

Particularly if your position has otherwise been the value of natural immunity and general good health.

The storm that’s hitting Trenton is now projecting heading towards Princeton and on up to New Brunswick. That’s over 25 miles… and that’s going to affect a lot of people.

Parts of this area are also seeing torrential rains and flooding, which is on the heels of significant flooding two weeks ago.

But Europe’s data regulations are concerned way more with privacy and control of personal data.

China doesn’t give a tinker’s damn about that. It just doesn’t want people “wasting time” according to their definition. That’s what’s behind everything they are doing with the internet now. There’s nothing good about China’s reasoning, even if they do some good things in the process. It’s a stopped clock.

They don’t want _companies_ to have that much access to data.

They’ve been doing lots of things in the past few months to manipulate people’s lives.


1) I don’t think it’s wasting time they’re against as much as they’ve decided they want to tank the tech companies to convince talent going into software and more into other areas that more critical to them. See also China’s recent restrictions on how long children can play video games on a day, and also moves to ban the 9-9-6 work week (9am -9PM, 6 days a week) common in tech companies there.

2) Another thing, is that they want to shore up their birth rate.
Now that they’ve gotten rid of the one-child policy and have replaced it with the “Three-Child policy”, they want to make it cheaper for families to have children, and spending big bucks on helping their students to study/cram for the Gaokao (the national set of tests used to enter China’s universities), is something they want to discourage.
So they banned for-profit educational companies.

Around 15% of Horry County Schools (HCS) student body is in quarantine less than two weeks since the start of classes during an intense surge in COVID-19 cases and hospitalizations in the area. In the first reports of the number of students in quarantine, the district recorded 6,800 students or about 15%, who are isolated due to COVID-19 exposure.

(me climbing up on my soapbox, again…)

As long as the leaders in our country refuse to openly discuss the ideological and religious beliefs that are in conflict in our society, and hide said conflict under the most ambiguous of marketing-analytical catch words, we will stew in continual confusion.

Specifically: abortion.

Anti-abortion folk are such because they think that there is magical thing called a “soul” that is either created at time of conception, or pre-existed and then inhabited the cell at time of conception.

Usually such a belief is covered under a theological blanket, that some “God” ordained the conception and such.

To accept that a zygote has no such thing (a “soul”) and is only a cell, is a challenge to the fundamental beliefs held by many (probably a majority of Americans.)

This is what the battle is really about.

Now, in the past there was a belief that the human became a “living soul” once the first breath was taken. This is probably behind the ancient beliefs that informs, say Islam, that abortion during early pregnancy is not a big thing. Because no breath was taken or could be taken.

In the old days, the breath was equated with the idea of “spirit”. This is embedded in the very language used in holy books about these topics (see: “God” breathing life into things in Genesis.)

Back to 21st century America: The religious right is fighting an ideological war against the rest of society that would rather spend their time watching sports-ball games or playing computer games.

Only those who are really affected - say pregnant women - are fully exposed to the effects that the ideological war is producing.

As an older guy I could very easily just withdraw into my hobbies and pastimes and not give one thought to some poor teenage girl in Texas who was impregnated by her creepy uncle.

But whatever conscience I have left still tells me that the theocracy that the Texas Republicans are building is wrong, just plain wrong.

I can’t do much about that (I’m not in TX, and don’t have huge amounts of money to give to campaigns in TX), but at least I can bring up the issues wherever I may land (mostly digitally these days given my reclusion from the virally loaded masses.)

Still, I so hope that someday some Democrats (or whatever party) can raise up leaders who will be able to address what is really going on in the this country.

Honestly…under my own power I find the number of games that have a operant conditioning component of “pay to make this game easier and thus more rewarding” alarming. Like, there are a lot of games that are made grindy and slow so that you’re negatively reinforced so that buying something makes the experience better…and that’s pretty fucked up: to make game more profitable, game should be less of a game.

Like, all games train you how to play them correctly to some degree, but it’s notable when part of that loop is “this would be easier with cash involved” then something is going wrong. I’m not much more found of the use of token economies…which are basically kiddy scrip…that obscure the price of cosmetic items, or the way that active consumption is incentivized through social pressure.

Like bathroom bills, this creates an environment in which the accuser has enormous power to harm the accused just through the process of accusation…far, far beyond the putative function of the law.

And that’s probably intentional, just as it is with bathroom bills. By creating a stigmatized group that deserve harm, but leaving it up to the common snitch to identify the guilty, you’re creating this shotgun spread of people that will also get policed, intimidated, and punished because they’re noncompliant with some norm that could be, in bad faith, presented as a sign of the crime.

Capitalism has no social conscience. If the wind blows a certain direction, you can be sure the companies will go that direction as well. A long time ago, companies never said a word when blacks were discriminated against because it would cost them business. Fast forward to today and companies left and right are pro-gay, pro-BLM, etc. Don’t think it’s because they’re doing the right thing. They’re doing it because that’s where their share is.
