Grandma Bacon gave me Grandpa Bacon’s passport with his war papers. I sent them to my Dad after Grandma passed. But I wish I kept them and I could kick myself for not asking Grandma for her Civil Service papers because she worked in the Navy Department while Wilson was President and she was a clerk in the Assistant Secretary’s office.

Her boss was a guy who you just might have heard of before…Franklin Delano Roosevelt…

Everywhere else, tomorrow is Remembrance Day, the end of WW1. As a veteran, I get real tired, real fast, of having November 11 being highjacked to slobber over Vets when everyone in Europe is acknowledging the death of 1/3 of a generation, another 1/3 of a generation who were wounded, and the other lucky 1/3 who weren’t wounded but often suffered grueling psych wounds.

I went to the Scottish National War Memorial in Edinburgh Castle on my first trip there in 2007. I walked in, looked at the dead- the sheer fucking *number* of dead recorded on the walls, Unit by Unit. and sat down and cried my eyes out for half an hour. Docents came up to me and asked if I was OK. I just shook my head and said “I had no idea what this small country sacrificed.”

I was absolutely bereft.

Happy to see the radar went from red to yellow as the storms moved into the smallest county in Texas.

Meanwhile, in Loving County, the population decreased to 64 in the 2020 census, making it the least populated County in the US. It’s an environmental disaster, with no usable surface *or* subsurface water. Potable water has to be trucked into Mentone, the only existing town.

Remember, people, especially out west, that whiskey’s for drinkin’ and water’s for fightin’.

What is SoCal property going to be worth if if the population must be cut by 75% because there is simply not enough available drinking water to support a larger population?

Oh, and West Texas is next on the list of climate refugees.

Well, we have a separate Memorial Day in this country. It would not be appropriate for us to attach this to November 11 the same way Europeans do, since our losses were so much less than theirs in the war that ended on that date. France, with less than half the US population, had 11 times as many war dead, Britain 8 times as many.
I have never been to the Scottish memorial but I have been to the Douaumont Ossuary on the Verdun battlefield. The dead are actually visible there, with the bones of about a quarter of a million unidentified soldiers from both sides piled in crypts that branch off the main corridor. The identified dead are buried in gigantic, beautifully landscaped cemeteries near by.
The Verdun battlefield is a national forest now, since the land is so blasted and cratered that it cannot be cultivated and thousands of unexploded shells are still buried in the ground there. French army EOD teams go out every so often to deal with rusty shells that have been squeezed to the surface. They will remain dangerous for at least another hundred years, maybe longer. The forest rangers still find human remains almost every week. They are cataloged and added to the ossuary.

Grandpa told me about how bad those mustard gas attacks were. Sometimes they were so bad that he had to keep his gas mask sealed to his face when he tried to sleep. He said lots of soldiers wound up with permanent lung damage from the gas.

He thought those gas attacks were the worst thing that could ever happen in a war…until the atomic bomb came along…

The Maisie Dobbs series of books by Jacqueline Winspear start with the very beginnings of WW1, and the heroine becomes a battlefield nurse. The descriptions will bring you to tears.

The author, I think, was raised by her grandparents who lived through it, and learned a lot about the time and the suffering from them. It is a very well written series; I have collected all of them on my iPad.

In the NatGeo Einstein bio-series, it’s a plot point that he’d been close friends in college with the chemist who invented mustard gas. After the war, when he found out what his friend had done, he broke off the relationship. Couldn’t bring himself to ever speak to him again. And the guy’s wife committed suicide over the guilt of her husband’s creation.

He’s going to walk. After today, I wouldn’t be surprised if the judge grants the defense’s request for a mistrial with prejudice, taking time before banging the gavel to again rant at the prosecution for thinking they could bring charges against this helpless little boy.

If you’re someone who thinks we’re headed towards another civil war, then this trial ending with a mistrial or acquittal should only grow that belief in your mind. Because it will almost guarantee that future protests will see more armed white guys acting in “self-defense.”

Which is why I’m expecting this to end by Friday with the judge declaring a mistrial. Between his behavior and Rittenhouse’s on the stand, there’s just too great a chance that this could end in conviction on one or more charges. So he’s gonna put the kibosh on all that by declaring that the prosecution that he deliberately stacked the desk against acted naughty and needs to be punished by being blamed for his letting Kyle go free.

The whole thing was courtroom theater intended to try to invoke sympathy in the jury. Instead, all it did was further demonstrate just how biased the judge is towards the defense. Realistically, the prosecution should have filed for mistrial long before the defense did and should have cited the judge’s inability to be impartial as the grounds. The entire set-up of this farce was to allow the defense to protect their client by attacking his victims and the judge’s actions yesterday show if he wasn’t in on that strategy he was at least aware of it.

So Kyle will have to announce whenever he crosses state lines with a weapon to play the role of police officer and medic that he is doing so?

Media still trying desperately to pimp the “poor, dumb kid who got in over his head” angle his attorneys have been feeding them for months, rather than the wannabe “militia” member who showed up to what he thought was going to be a war zone and instead found himself getting bored because the riotous hordes were nowhere to be found. So he abandoned the property he was there to “defend” and wandered until he found some particularly violent looking assholes, provoked them into a fight, and then “defended” himself with lethal force.

There’s no way I can be convinced that, without that rifle in his hands, he would have been willing to venture into Kenosha that night to be a “medic” or a “police officer.”

re: #60 Wendell Zurkowitz ((slave to the waffle light))

And Zimmermann was a volunteer member of the Neighborhood Watch

I commented earlier about how this is so much like the Zimmerman trial, but at least in that trial the judge was clear upfront that character assassination was a two-way street. That if his lawyers wished to attack Martin’s character as part of their strategy, then the prosecution would be allowed to bring up his less than stellar history. Which is why the trial was largely confined to the facts that could be proven and leaned so heavily on eyewitness testimony.

By comparison, this shitshow has been nothing but character assassination and the judge has made sure that such is confined entirely to the victims. Hence why the defense’s entire strategy is bent towards attacking a dead man and the prosecution is left looking unprepared for a judge screaming at them for thinking to question the motives or intent of the defendant.

Right, the defense had to take the time to tell the jury that Trayvon’s folks were divorced and his dad had partial custody to explain why Zimmerman didn’t immediately recognize him. Because saying “all black folks look alike” probably wouldn’t have gone over well.

64
Targetpractice  Nov 11, 2021 • 2:37:25am

I’ve a strong suspicion that if this does end up going to the jury, this asshat is going to make a point to emphasize “intent” in the jury instructions, as that’s the one thing he’s made very sure the prosecution would not be able to prove. Evidence that is in the public domain and could easily be used to prove intent is barred from the jury and thus the defense has a major advantage when arguing that their client “got in over his head.”

A federal judge in Texas tells Governor Abbott to get stuffed over his attempt to ban mask mandates.

A federal judge ruled Wednesday that Gov. Greg Abbott’s executive order prohibiting mask mandates in schools violates the Americans with Disabilities Act — freeing local officials to again create their own rules.

The judge said the governor’s order impedes children with disabilities from the benefits of public schools’ programs, services and activities to which they are entitled.

Unfortunately, no. In a civil case, it could be re-tried, but in a criminal case, a mistrial is effectively the same as an acquittal. There are no do-overs or appeals for the prosecution in a criminal case.

An “ordinary” mistrial doesn’t prevent the prosecution from trying the case again.

ETA:

The Double Jeopardy Clause of the Fifth Amendment to the U.S. Constitution prevents the government from prosecuting a defendant more than once for the same offense. However, most of the time double jeopardy doesn’t apply if a mistrial is declared. If the mistrial was prompted due to a hung jury or if the defense requested or consented, then double jeopardy doesn’t come into play.

Double jepardy is far more nuanced than that. From the Wiki

Prosecution after mistrial
The rule for mistrials depends upon who sought the mistrial. If the defendant moves for a mistrial, there is no bar to retrial, unless the prosecutor acted in “bad faith”, i.e. goaded the defendant into moving for a mistrial because the government specifically wanted a mistrial.[87] If the prosecutor moves for a mistrial, there is no bar to retrial if the trial judge finds “manifest necessity” for granting the mistrial.[88] The same standard governs mistrials granted sua sponte.

Retrials are not common, due to the legal expenses to the government. However, in the mid-1980s Georgia antique dealer James Arthur Williams was tried a record four times for the murder of Danny Hansford and (after three mistrials) was finally acquitted on the grounds of self-defence.[89] The case is recounted in the book Midnight in the Garden of Good and Evil,[90] which was adapted into a film directed by Clint Eastwood (the movie combines the four trials into one).[91]

The Inspector Rutledge mysteries by Charles and Caroline Todd feature a WW1 vet who suffers from PTSD (they called it “shell shock” back in the day)

There was a movie in the 90s called Double Jeopardy with Tommy Lee Jones and (I think) Ashley Judd. The premise was that Judds character was convicted of killing her husband or some such and served her sentence. She then found out the husband was still alive and because she couldn’t be arrested or charged for killing him again (hence the movies title), she could basically get a “free shot” to take him out for good.

Except the law doesn’t actually work like that.

It depends on if they’re willing to go after the Judge for misconduct resulting in
“substantial and irreparable prejudice to the State’s case.” Basically, they can say that he intentionally threw the case and that the mistrial was improperly granted. It is doubtful that there is any prosecutor in America, however, that cares enough about actual justice to do that.

We had pretty high inflation back in the 50s and 60s, when the executive salaries were intentionally kept as close to worker salaries through various measures. A lot of that inflation was due to workers having more money to spend than things to spend it on.

We had pretty high inflation back in the 50s and 60s, when the executive salaries were intentionally kept as close to worker salaries through various measures. A lot of that inflation was due to workers having more money to spend than things to spend it on.

Good counterargument. Could that be called “good inflation”? I don’t know.

My brother still lives in Valparaiso, the only one of six kids who stayed anywhere near Gary. The rest spread out literally from coast to coast, or in my case, to Europe..

Ah, yes, that was the nearest “large” town to us. We lived out in the country to the southwest, between Valpo and Crown Point/Merrillville. My parents moved out in 2005 to build their dream house closer to where they lived as kids; the guy who bought our house wound up burning it down for the insurance money, so my longtime childhood home now no longer exists.

From the same post

Joe Biden was dismayed by all the infighting. He said: “I’ve never seen it like this before. It’s got to stop.” Actually, Pelosi was brilliant again, as she often is. She has managed to hand Joe Biden a big victory, set Republican against Republican, and get Donald Trump to oppose infrastructure* repairs that a vast majority of Americans want, while creating millions of blue-collar jobs in the process. Is that so bad?

Why doesn’t anyone want to work anymore? I heard someone saying the old, “back when we were kids we all had jobs…”

There are the sort of jobs that young people take to earn pocket money or put into their savings for college or future ventures, and then there are the jobs that people work to support a family and to be able to afford to raise kids and provide them with a future where their children don’t have to work just to have enough to eat or to keep warm.

Just because the defense is using mistrial as a strategy doesn’t mean they’ll get it. The prosecution has been more than obsequious to the judge in this case and he doesn’t have grounds (yet) to declare his court a mess.

What this says is that having Kyle take the stand was a mistake and the defense attorneys know it. He’s about as sympathetic a presence as your garden variety thug, and an un-tailored suit doesn’t change that about his appearance in the slightest.

I think the jury will convict and the judge will be lenient.

Since the defendant will not have been found guilty, would they not be able to appeal that on the basis of Judicial Misconduct and then retry the little peckerwood?

Did a quick google and it depends. There is precedent and a legal ruling for allowing a retrial, but the rules are inconsistent and it’s never truly been declared constitutional. Some places allow it, and I know I have read about retrials after a mistrial and convictions afterwards. That’s why they’re asking for it with prejudice, just to make sure.

This judge is making all of them look bad. They need to go after him to maintain credibility.

But a potential Trump win in 2024 might help those dreams even at age 78 or 79. Remember this is Trump we’re talking about. Old age may not matter. Optics towards his base are everything, and proven duty to his brand of fascism guarantees at least a short term recognition even if the term is just a few years.

It is a tale of rivers diverted and dammed, of political corruption and intrigue, of billion-dollar battles over water rights, of ecological and economic disaster. In his landmark book, Cadillac Desert, Marc Reisner writes of the earliest settlers, lured by the promise of paradise, and of the ruthless tactics employed by Los Angeles politicians and business interests to ensure the city’s growth. He documents the bitter rivalry between two government giants, the Bureau of Reclamation and the U.S. Army Corps of Engineers, in the competition to transform the West. Based on more than a decade of research, Cadillac Desert is a stunning expose and a dramatic, intriguing history of the creation of an Eden—an Eden that may only be a mirage.

This edition includes a new postscript by Lawrie Mott, a former staff scientist at the Natural Resources Defense Council, that updates Western water issues over the last two decades, including the long-term impact of climate change and how the region can prepare for the future.

I recently read a letter to the editor suggesting that we drain Lake Powell upstream of Lake Meade and use the water to fill up the latter reservoir, which would give us one viable lake at over 60% capacity instead of two lakes at only 30%.

At some point, they will lose their ability to generate electricity, which will lead to even more problems in the Southwest.

This is what you’re going to get across the country, especially after the VA Gov race. They’re going to intimidate, threaten, and eventually assault and kill all for the sake of the perfect historical whitewash. And they may just fucking get it, board by board, state by state, because normal people aren’t supposed to be expected to stand up to highly organized, highly ideological, and protracted stand offs with folks who are showing willingness to kill for these values, and the authorities are useless at best, complicit at worst (look at fucking Portland where the Proud Boys essentially run the city with the help of the Portland PD).

Message to BLM: Eric Adams is not backing down.

The Big Apple mayor-elect doubled down on his campaign promise to reinstate the NYPD’s plainclothes unit a day after New York Black Lives Matter leader Hawk Newsome threatened “riots,” “fire” and “bloodshed” should Adams follow through on the move.

“I made it clear on the campaign trail,” Adams said on CNN Thursday morning, a day after the heated meeting with Newsome at Brooklyn Borough Hall.

“I’m going to put in place not the Anti-Crime Unit, I’m going to put in place a plainclothes gun unit. We must zero in on gun violence in our community. You’ve seen what’s happening when a young man, 21 years old, was shot by a 17-year-old man carrying a gun,” Adams said, referring to a recent botched gang hit that killed an innocent man in the Bronx.

Two teens were charged with murder in the police shooting that killed an 8-year-old girl at a high school football game

Two teenagers who prosecutors say started a gunfight outside a Sharon Hill high school football game that led to the fatal police shooting of 8-year-old Fanta Bility in August have been charged with murder in connection with her death…

Stollsteimer has said Fanta was struck by a bullet fired by one of three Sharon Hill police officers who were monitoring the crowd leaving Academy Park High School after the season-opening football game against Pennsbury. It remains unclear which officer fired the shot that killed her, but all three have told investigators they opened fire on a vehicle they mistakenly believed was involved in the shooting between Ford and Strand, which prosecutors said took place about a block from the stadium.

He jacked interest rates thru the roof!

No. Volcker took office in August 79 and served 8 years. He’s the one who got inflation under control by the time he left.

The inflation started before Carter got into office; remember Ford’s “Whip Inflation Now” (WIN) buttons?

I do hope Hawley will be outing all the GOP legislators who have engaged in self-abuse and fornication. Glory!

The judge is making it clear he’s not even making any attempt at not just being an impartial judge, but that he is as much of an openly partisan hack as possible. That’s how you know he’s a Republican in good standing.

I presume the judge views these things as less of “rules” and more as “guidelines”.

“Masturbating too much”? Is that a thing? I wasn’t aware there was a set limit.

A hard limit would be twenty-fours per day.
