Kyle Rittenhouse Acquitted of All Charges

Law • Views: 23,582

I think this comes as no surprise to anyone who watched the trial, with a judge this blatantly biased in favor of the defendant, but here it is and it’s still maddening: Kyle Rittenhouse not guilty in Kenosha shooting.

The Proud Boys are sure to take this as a license to shoot protesters.

CL’d from downstairs

Maybe someone addressed this here and I missed it, but why didn’t the prosecution request the judge recuse himself after he demonstrated a clear bias in favor of the defense? From not allowing the shooting victims to be described that way to disallowing video of Rittenhouse saying he was there to shoot some rioters, these and other actions made this trial a farce.

While not surprising, the verdict hit me like a ton of bricks. I held out hope that some sort of justice would prevail. I weep for the VICTIMS and their families today.

In 20 minutes, I’m heading off to Teddy’s water therapy. Swimming around in a 95 degree pool with my beloved Teddy will help heal my soul.

Too bad about Auto Ordnance. I thought their fitted violin case for the Tommy gun showed real panache. Then they came out with their disgusting Trump Commemorative version. I wrote and asked them for an Al Capone Commemorative. They were not amused.

CL’d on the last thread:

re: #493 A Cranky One

Re the earlier discussions about film vs digital, I spent many hours in the darkroom. It was owned by the guy teaching me. One of his primary interests was creating archival quality prints and even back then he was complaining about the archival quality papers disappearing.

When going through my mom’s estate, we found many very old photos of previous generations and family as kids. One of my brothers (who definitely qualifies as a guru) was able to digitize and fix damaged photos. So that history was saved.

But here is the dilemma:

We had prints that were over 100 years old. I’d consider those an archival storage medium.

How archival is digital? Formats change, readers change. Will we have 100 year old photos available in the future?

Remembering that a digital image is just a long string of on/offs, it will be archival as long as we can maintain the integrity of the copied string. That would include any not-yet-invented medium. I suppose you could engrave a string onto a diamond and retrieve it.

Sometimes one can make an educated opinion known because they spent the time and money to get educated in the subject. This time that includes me. That was not self-defense because he armed himself and traveled to the incident. It shows premeditation and intent.

That whole gun possession thing is a complete mystery as to how that applied fairly. I find it ridiculous.

I submit we just got a real-world lesson in Critical Race Theory. On one hand, the slightly underage white guy that killed, shot three, one in the back walks without penalty. On the other we have Marissa Alexander a black woman in Florida who had a restraining order against her violent husband and fired a warning shot that struck no one. She was sentenced to twenty years.

IMO these two results show how uneven our justice system is. Clear as a bell.

In my military service, we were trained that killing an opponent should come as a last resort.
Part of it is practical: Corpses Yield No Actionable Intelligence (CYNAI), and being able to interrogate a battlefield enemy is often necessary to prevent future bad developments down the line.
A big part of it is morality.
Many of those celebrating White OJ’s acquittal clearly don”t get the “Thou shalt not kill” part of the book they claim to love so much.

I highly suspect though, that any employee of a Congressperson has to pass a background check and acquire a security clearance that might… prove hard, given some of the data that wasn’t or couldn’t be used at a trial. For example, the fact that he paid his friend (Black?) to buy a gun for him that he couldn’t legally do during his age.

I’m sure there are people here who know more about these processes and what is disqualifying.

A couple years ago, there was a Michelangelo drawings exhibit touring various museums. Pen and ink, good paper, 500 years old. They’ll probably last another 500 years; maybe longer, if the paper is properly treated.

Digital only lasts as long as the given format is in common use. And people have the right kind of printers, and the right kind of paper. Which so far… doesn’t seem to be very long.

Serious question in light of this mess:

Protests have always been a part of our history. But I wonder now how can we protect anyone from this? This crap of taking shots at protesters has happened before, Kent State as one example, but that wasn’t this, but it was never a “thing” to my knowledge. Everyone being armed isn’t the answer, so is a new approach needed?

Protests make it possible for people to meet and join together to fight injustices and inequality. But protests alone don’t solve these issues. It seems as though elected officials don’t honestly give a shit about protesting, so what else can we do besides flood offices with calls and mail? I’m truly worried that today will make it open season on protests. And let’s face facts here, most large protests are by definition about “liberal causes”. I personally think media outlets should be a focus here as well. Without right wing media stoking fires and encouraging violence we may not have seen what happened in Kenosha. And really, footage of that day and Rittenhouse’s prior acts of violence should be made public and used against the GOP forever. People are dead and they are offering him jobs and celebrating. They changed the rules, we don’t have to be considerate of their fucking feelings. I’m sad, disgusted and depressed.

On a slightly happier note, the case here in Georgia may not turn out the same. The evidence in court is pretty damning and prosecutors aren’t taking any plea deals from the defendants so far.

Like many here, I am concerned that the Kenosha outcome is being used to legitimize, legalize, normalize and encourage rightwing political violence.

In the US social contract, theoretically, legitimacy and legality are based upon the ability to convince our citizens. Also, at least in theory, citizens are smart enough to eventually figure out when they are being bs’ed. Finally, at least in theory, citizens will get meaningful voting opportunities every 2 years.

As long as I see that social contract holding, I intend to concentrate on the morality debate side of this issue.

If the social contract is destroyed, then we are facing an entirely different set of issues and, I think, probably a multi-generational timeline.

I have to admit it irritates me when people say, “The jury has spoken” as if there’s something mystical about a jury. It’s not mystical. It’s a group of people. Sometimes they’ll be right, sometimes they’ll be wrong. It’s our justice system and it’s probably better than any alternative, but it’s not magical and it’s not always right.

Citizen K  Nov 19, 2021 • 1:39:31pm

So….I guess I picked either the exact wrong time or the exact right time to come back, after some days to breathe.

All I can say is, much like Sargent, the most telling thing isn’t the celebrations of the verdict but the celebrations of the act.

The language gives it away, they call him ‘Hero’. Not ‘survivor’, as someone might think of more if they were literally attacked the way that they claim Rittenhouse was, nor other less loaded language (you know, loaded language like ‘victim’….). They call him a ‘hero’. Not for what he survived, but for what he did, what act he committed. They’re celebrating the murders and assaults because ‘they had it coming’. And now they have their carte blanche.

You see it in the language, declaring everything similar to what happened that night, or even tamer as ‘riots’, and the people present as ‘rioters’, especially in defense of them being attacked. It’s all so they have their justification, their excuse to go on a spree at any protest that offends them, and see themselves lionized because they didn’t kill ‘people’. They killed ‘rioters’, ‘thugs’, etc. I mean….look at the bloodlust that lead to laws that legalize running over protesters if you proclaim enough ‘fear of my life’.

And before anyone asks, no, I’m not going to arm myself in response to feel safe. Guns don’t make me feel safe. Guns make me feel terrified, and ownership of a gun would make me feel even more terrified.

First, welcome back! It’s great to see you back here and contributing good points!

Second, I think that you are correct.

I agree with you that we are, and will be seeing more rightwing political violence.

I also agree that much of it may be ‘touristic’. Where people go to weaker and less capably governed areas and commit violence there.

Currently, I do think that healthier and better governed areas will be able to better control violence.

As I see it, violent rightwing groups are undermining government institutions. These groups are being supported by wealthy patrons who view weaker government as more ability to make money and gain power. And this whole movement is being led by a organized crime adjacent failed president for the same reasons. (As well as some personal psychological issues he has.)

Who funded his legal defense? He had a freaking trial advisor and and a team of lawyers that were not court appointed. Because he could afford to. All those donations just cemented the idea in his head that he was justified. His mom encouraged and supported this. Without some serious intervention he’s going to do this again. Might be some time in the next year or two or in a week. But he will do it again. I hope it follows him wherever he goes. For life.

Or he is going to try and strut his stuff somewhere else. It is known now that he is a threat. And he may end up on the wrong end of the gun next time.

109
ckkatz  Nov 19, 2021 • 1:58:29pm

A couple of thoughts…

1. There are many ways to fight to preserve democracy. To my mind, using a gun is perhaps one of the least powerful and only to be used when everything else has failed. You shouldn’t consider yourself obligated to get one.

2. If you are looking for ideas on what to do, there are some people who offer concrete suggestions.

Unfortunately, in the social media world, screaming is highly rewarded, thoughtful ideas much less so.

I would suggest that you look around and see who has ideas that would fit into your personality, character, morality and beliefs.

For personal conduct you might want to watch Timothy Snyder’s Youtube videos regarding “On Tyranny: Twenty Lessons from the Twentieth Century”. You also might want to look for good ethics leaders who appeal to your sense of justice.

Regarding mass action, that may or may not appeal to you. If it does, look for groups whose message, goals, ethics, and approach match your beliefs.

In the end, you can take responsibility for your ethics, behavior and actions. You and those you love are the most important judges of what you believe, say and do. Not some internet rando.

It’s a journey not a destination. We are all fallible and finite creatures who (hopefully) learn and do the best we can as we go along.

I think we should look at this in the overall context of Republican violence and terrorism, MTG’s opponent forced to quit, Carlson inciting bullies to harrass people for wearing masks, threats against school boards and local officials, major media figures defending the Capitol riot, on and on. The rule of law no longer applies, the war is here. One of our two major parties is wholly committed to violence and intimidation, with millions of its degenerate followers fully committed and convinced that this is the only solution.

We need some pushback. That does not mean gun battles in the street (though it does have a salutary effect when lawless bullies end up dead). We have the advantage in intelligence, numbers and, I believe, in real combat experience. Use your heads, stay safe, and leave the performative gun waving to the traitorous enemy. Don’t even try to discourage them, their arrogant displays are akin to marching into battle in bright red clown suits with flags waving, while the other side is hiding in the bush in khaki or green.

Reminds me of a Japanese teaser I used to hear: “if forced to choose, would you eat curry that tasted like real shit or real shit that tasted like curry?”

I had a friend in high school who was programming his graphing calculator to print random things. One of these phrases was supposed to come out as, “I love buttered crackers,” but due to screen width limitations, came out as, “I love buttered crack.” Yeah, we never let him hear the end of that one.

I feel obligated to share. This is the young woman my old bandmate has taken on as a project (hoping to get a recording deal, I think). This is recorded at his Wisconsin Drum Farm studio. I think Gina was 16 when it was done earlier this year. John, my friend, is also the drummer. (I think Cory is the guitarist.)

And as Charles mentioned the Proud Boys in the first post:

For far-right groups, Rittenhouse’s acquittal is a cause for celebration

In the minutes after a jury acquitted 18-year old Kyle Rittenhouse on all counts, jubilation lit up on social media spaces where far-right extremists gather.

In one Telegram channel for the far-right Proud Boys, some noted they had taken the day off work to await the verdict. “There’s still a chance for this country,” wrote one. In another channel, a member stated that political violence must continue. “The left wont stop until their bodied get stacked up like cord wood,” he wrote.

[…]

As it played out against the backdrop of an increasingly polarized nation, experts of far-right movements say opportunists found a growing audience for their violence-fueled messaging that targets the left. Now that a jury has found that Rittenhouse acted in self-defense, those concerns are recentering on the question of whether it may embolden others to engage in political violence.

“This might be interpreted across the far right as a type of permission slip to do this kind of thing or to seek out altercations in this way, believing that there is a potential that they won’t face serious consequences for it,” said Jared Holt, a resident fellow at the Digital Forensic Research Lab at the Atlantic Council. “I worry that that might end up being interpreted by some people as a proof of concept of this idea that you can actually go out and seek a ‘self-defense situation,’ and you’ll be cheered as a hero for it.”

So…yeah. They’re taking it exactly as the carte blanche we expected them to take it as. And why not? Seems like the law says it’s open season now, so….

We’re basically at the mercies of the white majority, and they seem just peachy keen with this shit even when folks are pushing the lack of humanity in these incidents and the aftermaths in the public’s faces.

No.

The thing I noticed about Kyle during the trial is that he is obviously not the brightest star in the firmament. In fact, it seems he’s just as dumb as a box full of hammers. So the fact that Faux would take advantage in making him the hero in a propaganda film to inflame the country is not surprising, what is surprising is that they would do so using a man/child of such limited means. It’s pretty clear that if we get civil war 2.0 in the US, the prelude will be much like the prelude to the past civil war and include an equivalent to bleeding Kansas. IMO we’re real close to that, and something as small as a few Rittenhouse copycats could get us there.

I think there will be some violent reprisals but not anything organized, that is, involving anyone rational enough to really make it bite.
There are very powerful forces waiting in the wings but we need to see what the fascists do with this. Will they really treat it as a license to go on a killing spree and try to set up their feudal state by force? If it comes to that, rational forces will get involved, and, as I’ve said many times, the cosplay traitors won’t know what hit them.
