Colbert: Dr. Fauci Rips Rand Paul Over “Fire Dr. Fauci” Fundraiser, Calls Sen. Marshall a Moron on Hot Mic

The Republican Party is pro-COVID and anti-science, and they keep proving it every chance they get.

The nation’s leading infectious disease expert clashed with senators at a hearing today, taking Sen. Rand Paul to task over his questionable fundraising tactics and referring to Sen. Roger Marshall as “a moron” in a candid moment caught on tape. #Colbert #Comedy #Monologue

Useful distillation of the pro-filibuster position: if we got rid of the filibuster, elections could change what Congress passes, and that’s bad because the system is currently nicely wired for GOP priorities.

When people say, “Elections have consequences,” they don’t mean THEY should suffer the consequences.

Sadly, the best ally Repubs have had in maintaining the right-leaning state of the Senate has been “moderate” Dems like Manchin and Sinema who talk about how the filibuster keeps things “bipartisan” and inspires “debate” while ominously talking about how Repubs will just pass whatever they want if they win back the majority.

Debate means make your points to the body and try to sway/influence how other Senators are gonna vote on something.

THEN you hold the vote and the result is the result. you were persuasive or you werent.

What happens here is there is no debate.
everything simply gets blocked and stalled with no one having to say anything

And that’s what makes Manchin’s whole “tradition” bit such bullshit, that the modern filibuster is not Jimmy Stewart standing up before Congress to talk as long as he possibly can, it’s a staffer passing a memo to the Majority Leader says “filibuster” and then the bill languishing until either the majority party feels they’ve the votes to move the bill forward or it dies a quiet death without a minute of debate.

Nothing he’s done in the past year indicates that any such noises are made in anything but bad faith. The man says he’s open to changing the rules until the leadership actually starts to make moves in that direction, and then he changes his mind and insists that the rules are cool as they are.

Well, I just took a look at the California covid dashboard and statewide, cases are still rising, and the rate of rise is still rising. However, the rate of positive tests seems to have begin to level off in the last week or so (not showing in the seven-day averages yet). The state sometimes has to update these numbers after the fact, so let’s postpone the dancing in the streets (which is no fun while masked anyway), but it is a hopeful sign.

Also, in bay area counties, which are strict about masking and highly vaccinated (percentage vaccinated, unfortunately, is by zip code, so if you want it go get it yourself), the rate of new cases per hundred thousand is plummeting. Also preliminary data, but it might actually not represent an approaching train. We may hope.

This! THIS! MORE OF THIS!

Democrats gave Republicans a taste of their own medicine during a judicial confirmation hearing on Wednesday.

Senate Judiciary Committee chairman Dick Durbin held the hearing for Andre Mathis, a nominee by President Joe Biden for an appeals court seat that has historically been designated for a candidate from Tennessee, over the objection of the state’s two GOP senators, reported Roll Call.

A long-standing committee tradition known as “blue slips” traditionally given home-state senators more influence over the nomination, but Republicans used that to block some of Barack Obama’s nominees if senators didn’t return the actual slips of paper — and then ended the practice during Donald Trump’s presidency.

*snip*

Sen. Marsha Blackburn, one of Tennessee’s two senators, along with fellow Republican Bill Hagerty, complained about the maneuver being used against the GOP.

“I do recognize the president’s constitutional prerogative to nominate individuals of his choosing to serve on the federal judiciary, but we in this Senate have a crucial constitutional role to play as well,” Blackburn said. “The White House communicated with my office a total of two times on this nomination.”

I haven’t really been following the case and have no idea who this guy is, and he may be a huge asshole, but I am not sure why the judge has the authority to force him to continue working the case unless the court is picking up the costs.

Well, it’s not Judges fault the lawyers client is refusing to pay him.

This, plus, even if you are mad about it, the solution is NOT going to be, “piss off the judge really bad.” The judge is just trying to ensure that the case gets resolved, by ensuring that the litigants can’t play games like, “My lawyer just got dismissed, we’re going to have to delay for weeks while I find new representation and get them up to speed.” If the lawyer is upset about having to work for free, maybe he should just get the damn information the judge asked him to provide and then he can be allowed to get off the case.

Texas public officials can no longer promote voting by mail (but anyone else can)

It’s a new year and there are new voter laws in place for Texas elections in 2022.

It’s now illegal for public officials in Texas to promote voting by mail. So, independent voting rights advocates will likely try to spread the word. Grace Chimene is the president of the League of Women Voters of Texas.

“They can put the information on their website — that is not illegal. What they can’t do is say, ‘Would you like to vote by mail?’ They can’t offer (it) when they’re out registering voters. They can’t give people an application to vote by mail,” said Chimene.

nah, you’re all reading this wrong

Mike Lindell has never been more confident about his plan to overturn the 2020 election: “We have enough evidence to put everyone in prison for life, 300 and some million people.” Is he planning to imprison basically the entire US population?

you have to use the gorsuch rule from last week when when the court released a ‘revised’ transcript:

The original, uncorrected transcript quotes Gorsuch as saying he believes the flu kills “hundreds of thousands of people every year.”

On Monday, however, the Supreme Court’s press office issued a corrected transcript showing that Gorsuch actually said he believes the flu kills “hundreds, thousands of people every year.”

so

“We have enough evidence to put everyone in prison for life, 300 and some million people.”

actually means 300 people plus ‘some’ million - ie a few million or so

so say 3,000,300 ‘or so’

See? completely explainable.

If the firm took the case without a sufficient retainer and payment schedule, then that’s on them. And if he took the case pro bono, which his law firm boasts about online, then he’s got even less reason to whine about poverty to the judge. Besides, at this point, I imagine the court has reason to believe that he’s totally aware of his client’s actions and is deliberately lying (even if by omission) to the court.

MUSKEGON, Mich. (WWMT) — COVID-19 hospitalizations are again breaking records in Michigan.

Muskegon Mercy Health set up a warming tent outside of the emergency room that could serve as a waiting room in periods of high-patient volume.

“The tent will only be in operation during times of highest volumes and as the need arises, and will not be in use overnight. At this time, our emergency department will not be permitting visitors,” said a spokesperson for Muskegon Mercy Health.

Capacity was at 100% this week according to the hospital, which included 140% capacity in the intensive care unit. Bronson Healthcare in western Michigan said it was also near full capacity.

Mercy Health Hospital officials estimated that 70% to 80% of the COVID patients were unvaccinated against the virus and filled up almost every ventilator.

The overall line of duty deaths are up 55%

Ambush-style murders of police officers are up more than 300% from 6% in 2020, to 19% in 2021

Last year there was a 93% jump in officers being struck and killed while outside their vehicles

COVID, contracted in the line of duty, accounted for the most officer deaths: 301

i get the idea, but c’mon

‘line of duty’ is doing an awful lot of heavy lifting

nothing in the story says how they know where specifically each of the 301 people contracted it

even if it was ‘on the clock’, did they get it from being in a car with a partner, or maybe at lunch or in the station

did they mask, distance (where possible), get the vax, etc?

re: #160 Punish Domestic Terrorists

The Senate is broken because it’s an antidemocratic institution. I don’t think it’s fixable.

The Senate is broken not just because of the filibuster, and not because it’s anti-democratic, but because:

1) It allows a minority not to block or stall things, with no way of overriding it. Countries which have an anti-democratic upper house, tend to have a way for bills to be passed ultimately e.g. multiple time-delayed attempts to pass a bill, or forcing both houses to sit together and vote together are two examples.

2) It allows a minority of the country to impose its will on the majority due to the massive population imbalance between states — much greater than it was at the time the constitution was written — from 10x population difference to 70x population difference.

3) It has far too much power — Judicial appointments, Diplomatic Appointments, Cabinet members, _many_ more appointments.

that’s part of it.
the other is that the R’s have checked out and make no apology for it.
they’re proud of it.

the business of politics is complicated.
the goal is to negotiate agreements between groups with different interests with the object of finding a common way forward. the r’s don’t want to participate.

At present only the democrats buy into this premise.

the republicans do not market any notion of democratic participatory ‘politics’.
they trade in authoritarian and dictatorial power, domination, and force of will.

“Democratic leaders have found a mechanism to enable them to bypass an initial Republican filibuster and debate the party’s sweeping elections reform bills,” Axios reports.

“The strategy is the latest example of how Democrats are seeking new ways to try to bypass Senate procedures that are blocking their agenda. But the ultimate outcome will likely be the same: insufficient support to change the 60-vote threshold needed to pass sweeping voting rights reforms.”

“This wonky process is similar to the strategy Congress used last month to quickly take up and eventually pass a debt limit increase and avoid a default.”

No one complained last month because McConnell wanted it to be passed without the GOP having to support it. If the Senate weren’t broken, the filibuster would be rarely invoked and almost all legislation would require only a majority vote — as it was last century.

That said, there is no way to repair the Senate without a Constitutional amendment. Any body in which (theoretically — based on current numbers) 18% of the population controls more votes than 82% is seriously anti-democratic and dangerous to our nation. In practice, the results are not so dramatic because the split in ideology is spread across the country; the small states are not all Republican, the large states not all Democratic.

My journalism professor liked to joke about the fact that whenever a reporter interviewed the friends and/or neighbors of a recently deceased person, the most common response would inevitably be some variation of: “He was a quiet man.”

JFC, send him to the military instead of jail? Good fucking grief.

Moron judge also called it “a terrible mistake, which I know personally cost the county money.”

Yeah, no—a mistake is using sugar instead of salt in a recipe. Sexual assault is not a mistake.

Also—

As Task & Purpose points out, military recruiters are under no obligation to accept anyone who doesn’t meet the standards of enlistment, “so a judge’s ruling does not apply beyond the doors of a recruiting office.”

Why would any of the services want him?

They wouldn’t. At least, not anymore. They have been taking it in the neck about ignoring sexual assaults in the ranks throughout the Forever Wars.

The question is, what does the judge do if the military, as a whole, refuses to take him because he is, in point of fact, a sexual predator. And they should refuse taking him. Too much blatant liability.

The judge should have saved everybody a lot of time and put him in GenPop for a year.

So true. They say we need 3 things for a good photograph. A worthy subject, catch the moment, and adequate gear. All phones did was put adequate gear everywhere we go. Still need the other two essentials.

The threat to American democracy springs, most fundamentally, from the social fragmentation wrought by a post-industrial economy.

Can a Judge Order Someone to Join the Military or Go to Jail?

Army: The Army’s Recruiting Regulation, 601-210, paragraph 4-8b: states that any “applicant who, as a condition for any civil conviction or adverse disposition or any other reason through a civil or criminal court, is ordered or subjected to a sentence that implies or imposes enlistment into the Armed Forces of the United States is not eligible for enlistment.”
Air Force: The Air Force Recruiting Regulation, AETCI 36-2002, table 1-1, lines 7 and 8, makes an applicant ineligible for enlistment if they are “released from restraint, or civil suit, or charges on the condition of entering military service, if the restraint, civil suit, or criminal charges would be reinstated if the applicant does not enter military service.”
Marines: The Marine Corps Recruiting Regulation, MCO P1100.72B, Chapter 3, Section 2, Part H, Paragraph 12 states: “Applicants may not enlist as an alternative to criminal prosecution, indictment, incarceration, parole, probation, or another punitive sentence. They are ineligible for enlistment until the original assigned sentence would have been completed.”

In the Army at least, enlistees are asked point blank if they are enlisting to avoid prosecution or jail time. If they answer yes, they are refused enlistment. If they lie and get caught, they can be charged with fraudulent enlistment.

Reading through what is called the “Truman Doctrine” speech to the Joint Session of Congress in 1947 in prep for a class, I came across part that seems relevant:

The peoples of a number of countries of the world have recently had totalitarian regimes forced upon them against their will. The Government of the United States has made frequent protests against coercion and intimidation, in violation of the Yalta agreement, in Poland, Rumania, and Bulgaria. I must also state that in a number of other countries there have been similar developments.

At the present moment in world history nearly every nation must choose between alternative ways of life. The choice is too often not a free one.

One way of life is based upon the will of the majority, and is distinguished by free institutions, representative government, free elections, guarantees of individual liberty, freedom of speech and religion, and freedom from political oppression.

The second way of life is based upon the will of a minority forcibly imposed upon the majority. It relies upon terror and oppression, a controlled press and radio; fixed elections, and the suppression of personal freedoms.

I believe that it must be the policy of the United States to support free peoples who are resisting attempted subjugation by armed minorities or by outside pressures.

One of my favorite shirts I bought online during Covid is all jellyfish. Wore it to a Dead & Co shirt and everyone wanted to know where it came from. Those are pretty cool pics btw.

In other news, the missus brought home a stack of Covid-19 antigen tests since I was feeling crappy the last two days…and I’m negative. Should get the PCR result tomorrow.

So, Navy?

There is no specific policy. (Same link)

Interestingly, the Navy Recruiting Manual, COMNAVCRUITCOMINST 1130.8F, does not appear to contain specific provisions which would make such applicants ineligible for enlistment. But as a general protocol, the Navy will not accept applicants for service as an alternative to criminal prosecution or another punitive sentence.

In a recent conversation with Mr. w, who was in the Navy a LONG time ago, (on an almost-related topic) he said the interview process was very important, to the point it could take precedence over some legal proceeding in the past.
