Well, I just took a look at the California covid dashboard and statewide, cases are still rising, and the rate of rise is still rising. However, the rate of positive tests seems to have begin to level off in the last week or so (not showing in the seven-day averages yet). The state sometimes has to update these numbers after the fact, so let’s postpone the dancing in the streets (which is no fun while masked anyway), but it is a hopeful sign.

Also, in bay area counties, which are strict about masking and highly vaccinated (percentage vaccinated, unfortunately, is by zip code, so if you want it go get it yourself), the rate of new cases per hundred thousand is plummeting. Also preliminary data, but it might actually not represent an approaching train. We may hope.

If I had a son with leukemia, even if I wasn’t depending upon a charity to give me FREE HOUSING while my kid was in the hospital, I’d still insist upon taking every precaution to protect his health including getting vaccinated and insisting upon masking and sanitation around him. True story - while Bill Clinton was president, I had a bumper sticker that read “Friends Don’t Let Friends Vote Republican” on my car. I never used to lock the car when I went places like the supermarket.

Quite the example of taxpayers throwing millions at companies to create jobs and businesses, and the companies doing nothing of the sort. The state didn’t have a clawback provision when the original incentives were extended to this company, so they’re now trying to claw it back because the company basically took the money and ran.

This, plus, even if you are mad about it, the solution is NOT going to be, “piss off the judge really bad.” The judge is just trying to ensure that the case gets resolved, by ensuring that the litigants can’t play games like, “My lawyer just got dismissed, we’re going to have to delay for weeks while I find new representation and get them up to speed.” If the lawyer is upset about having to work for free, maybe he should just get the damn information the judge asked him to provide and then he can be allowed to get off the case.

If the firm took the case without a sufficient retainer and payment schedule, then that’s on them. And if he took the case pro bono, which his law firm boasts about online, then he’s got even less reason to whine about poverty to the judge. Besides, at this point, I imagine the court has reason to believe that he’s totally aware of his client’s actions and is deliberately lying (even if by omission) to the court.

The Senate is broken not just because of the filibuster, and not because it’s anti-democratic, but because:

1) It allows a minority not to block or stall things, with no way of overriding it. Countries which have an anti-democratic upper house, tend to have a way for bills to be passed ultimately e.g. multiple time-delayed attempts to pass a bill, or forcing both houses to sit together and vote together are two examples.

2) It allows a minority of the country to impose its will on the majority due to the massive population imbalance between states — much greater than it was at the time the constitution was written — from 10x population difference to 70x population difference.

3) It has far too much power — Judicial appointments, Diplomatic Appointments, Cabinet members, _many_ more appointments.

No one complained last month because McConnell wanted it to be passed without the GOP having to support it. If the Senate weren’t broken, the filibuster would be rarely invoked and almost all legislation would require only a majority vote — as it was last century.

That said, there is no way to repair the Senate without a Constitutional amendment. Any body in which (theoretically — based on current numbers) 18% of the population controls more votes than 82% is seriously anti-democratic and dangerous to our nation. In practice, the results are not so dramatic because the split in ideology is spread across the country; the small states are not all Republican, the large states not all Democratic.

I found out that a photographer at the Houston Texans game on Sunday tested positive for Covid and came to the game anyway. The photographers’ work station is like a pig pen and he/she was in there as well as on the field near the players and shooting pictures of the 66-year-old coach pregame from maybe two feet away. The worst part is that this person has friends high up in team management and nothing will happen to him/her. He/she will be on the sidelines next season.

Army: The Army’s Recruiting Regulation, 601-210, paragraph 4-8b: states that any “applicant who, as a condition for any civil conviction or adverse disposition or any other reason through a civil or criminal court, is ordered or subjected to a sentence that implies or imposes enlistment into the Armed Forces of the United States is not eligible for enlistment.”
Air Force: The Air Force Recruiting Regulation, AETCI 36-2002, table 1-1, lines 7 and 8, makes an applicant ineligible for enlistment if they are “released from restraint, or civil suit, or charges on the condition of entering military service, if the restraint, civil suit, or criminal charges would be reinstated if the applicant does not enter military service.”
Marines: The Marine Corps Recruiting Regulation, MCO P1100.72B, Chapter 3, Section 2, Part H, Paragraph 12 states: “Applicants may not enlist as an alternative to criminal prosecution, indictment, incarceration, parole, probation, or another punitive sentence. They are ineligible for enlistment until the original assigned sentence would have been completed.”

Reading through what is called the “Truman Doctrine” speech to the Joint Session of Congress in 1947 in prep for a class, I came across part that seems relevant:

The peoples of a number of countries of the world have recently had totalitarian regimes forced upon them against their will. The Government of the United States has made frequent protests against coercion and intimidation, in violation of the Yalta agreement, in Poland, Rumania, and Bulgaria. I must also state that in a number of other countries there have been similar developments.

At the present moment in world history nearly every nation must choose between alternative ways of life. The choice is too often not a free one.

One way of life is based upon the will of the majority, and is distinguished by free institutions, representative government, free elections, guarantees of individual liberty, freedom of speech and religion, and freedom from political oppression.

The second way of life is based upon the will of a minority forcibly imposed upon the majority. It relies upon terror and oppression, a controlled press and radio; fixed elections, and the suppression of personal freedoms.

I believe that it must be the policy of the United States to support free peoples who are resisting attempted subjugation by armed minorities or by outside pressures.

Interestingly, the Navy Recruiting Manual, COMNAVCRUITCOMINST 1130.8F, does not appear to contain specific provisions which would make such applicants ineligible for enlistment. But as a general protocol, the Navy will not accept applicants for service as an alternative to criminal prosecution or another punitive sentence.

In a recent conversation with Mr. w, who was in the Navy a LONG time ago, (on an almost-related topic) he said the interview process was very important, to the point it could take precedence over some legal proceeding in the past.
