What were they supposed to do with the fetus? Was it alive when she aborted and buried it? I’m missing the point of this prosecution.

Abortion after twenty weeks is illegal in Nebraska except for certain limited circumstances.

If the foetus was stillborn at home, the correct response would be to call for medical aid.

Burning and burying a dead foetus counts either as improper disposal of remains or desecration of a corpse.

I’m not sure about abortion drugs, but I don’t think they work at twenty-two weeks. More information should be forthcoming, but this would either be a stillbirth or an illegal private medical abortion.

Long story short, it appears that Amnesty International was lying when it said that Ukraine had made no effort to evacuate individuals, as well as lying about only 30% of military aid reaching its intended destination (only one party has a vested interest in military aid to Ukraine drying up, for whatever reason).

Rural areas don’t provide food to cities, they sell it to us.

We in the cities pay more for telephone, postal, and other services so that rural areas have it and not at an excessive price.

Companies in cities sell us telephone service but won’t provide vast areas of rural area cell service (captialism), Internet service is far more expensive, the post office is a national service and always has been, and many products in rural areas cost more money (or are unavailable, like the forever lack of hand sanitiser or Lysol since the pandemic started).

T-mobile doesn’t operate in the state at all.

Other companies show similar maps. If you’re not in Omaha, Lincoln, or on Interstate 80, you don’t get cell service.

Cell towers sited along other highways use directional antennas to only provide service on the highway (like the cell tower in my town: no one in town can use it unless they are on US-26).

the complex answer is that modern conservatism grew out of neoconservatism, which was actually formed by folks like Bill Crystal’s dad, who was initially a socialist/communist. They use the word “marxist” because that is a vestigial remnant from a time when marxists were the true enemy of the vanguard. They are still using language of the european intelligentsia for the lumpy redneckariat.

If I reload the post, I see the unadulterated tweet and if I unload the whole page, the issue seems to go away — I haven’t tried that much, though.

On the issue in Nebraska to restrict or ban abortion in a special session, it was not blocked by a filibuster (that would require the Unicameral to be in session).

Calling a special session requires thirty-three of the forty-nine senators to agree to call one. The Speaker of the Legislature Mike Hilger (R) was unable to find thirty-three senators to agree to it.

No, I can’t “imagine them doing this to me”, because if I were a former elected official leaving office after my term was up, I would have proactively checked with someone (up to and including the FBI) to clarify exactly what type of documents I could take with me or not: y’know, it being the goddam LAW and all……

I’ll remember that the next time I have access to a bunch of top secret classified documents.

Local boring family story about a missing top secret document.

My mother tells a story of how my father came home from work at Patuxent River NAS, saying he was in big trouble because he had signed out a top-secret document from his work to bring home, and couldn’t find it.

She went into the washer where his uniform from that day was, and it was full of paper lint. She carefully scrapped off all the lint and put it into an envelope. Included in the lint was a lucky large piece with the serial number of the document.

She says the next day the command called her and asked if they could buy her washing machine to use as a document destroyer.

Talk to them. By phone, text, email whatever. Explain to them, completely calmly, just what happened and what needs to be done to fix it. Keep calling, emailing, everything. Never lose your temper with them, don’t suggest that this was anything but an unfortunate error by persons unknown, but keep coming back until they understand that you are never going to go away.

That’s your best bet for getting them to fix this, while staying out of jail. Unless they have superiors you can give the same treatment.

Our trip to Newfoundland might be at risk. (CBC with photographs and video)

Two massive forest fires in central Newfoundland near the Bay d’Espoir Highway and Paradise Lake continue to burn out of control Monday, after growing significantly over the weekend, and communities in the region continue to stay alert for possible evacuation.

A state of emergency was declared in the Grand Falls-Windsor, Bishop’s Falls and Connaigre Peninsula areas on Saturday night, and extended to the Botwood area on Sunday. Premier Andrew Furey asked residents there to prepare for a possible evacuation.

The Bay d’Espoir Highway, which connects the Connaigre Peninsula on Newfoundland’s south coast to the rest of the island, is still closed and will remain that way until further notice.

“We’re doing our very best to try and get that Bay d’Espoir Highway open again, but the reality is the fire’s on both sides of the road, the wind’s not helping down there, and the size of the fire is increased,” said provincial forest fire duty officer Jeff Motty.

Bloomberg has an article on the (then proposed) adjustments to reporting requirements by banks, third parties such as credit cards and PayPal, and taxpayer audits.

The part I found interesting was when the IRS was originally set up, it was required to audit every tax form, starting in 1916. Predictably, by 1918 they had a massive backlog of forms going back to 1916 which had not yet been processed.

The solution was to hire more and more IRS agents to make sure every tax form was audited. Congress finally got their shyte together in 1954 and passed a tax reform act which started the targetted system of auditing small percentages of taxpayers (and originally targetted at the wealthy, corporations, and landlords, traditionally the biggest tax cheats).

Over time as Republicans gutted IRS processors and auditors, and hamstrung the IRS with ancient computer equipment, those audits increasingly fell on the poor and lower middle class.

The new bill seeks to correct all that, which is why the Libertarians are upset. The Republicans are upset because they are upset at everything Democrats do.

The proposal for better audits and enforcement didn’t originally come from the Democrats though. It came from the Treasury Department and the Fed.

re: #335 Anymouse 🌹🏡😷

Though Democratic politicians are afraid to broach this aspect of the anti-abortion movement, it is quite clear that the hard-core anti-abortionists are such because of a fanatical religious urge.

The reason they have to call a fetus a “baby” is because they want desperately to believe said fetus has a “soul”.

I’ve maintained for some time now that the core religious belief is not in a god but in a soul.

All the god stuff is added on top of the central belief.

Our number one, most dominant, and inescapable problem as an organism is our impending death. Because we humans have the capacity to abstract time and developed a language skill to differentiate the future from the past, we know we are going to die.

The way around that is to believe part of us is not going to die.

Hence the “soul”.

To tell the anti-abortionist that the colony of cells is not a person is to say said colony does not have a soul.

And if a fetus does not have a soul, then the conclusion can be that the anti-abortionists don’t have a soul either.

I have never heard a Democratic politician come out and elaborate in the manner I just did (because in fact many Democrats are also religious people.)

But this is what the fight is all about.

That, and the original fight of bringing in the Evangelicals: Backlash against Brown v Board, the Civil Rights Act, and the subsequent stripping of the tax exemptions of Bob Jones University for failure to desegregate the school.

You see parts of that today when you get judges or politicians who won’t say if Brown was correctly decided.

338
Love-Child of Cassandra and Sisyphus  Aug 9, 2022 • 1:13:53am

There are religious structures, beliefs, that have alternate ideas about life and death.

Indeed, I think the current attachment to a “soul” is more foreign to the NT than many Christians may think.

It can be argued that the idea of a soul was more important from Augustine on, in order to threaten people with the idea that they will go somewhere after death and be punished.

I think I could make a good case (and I’m sure many people already have) that the NT idea is that dead is dead. And that the only alternative to that is some magical resurrection at some future unspecified date. This goes along with annihilationism, which has made a bit of a comeback in the “liberal” churches. That is, non believers just cease to exist when they die, and believers are just non-functioning until some kind of resurrection.

It varies widely. For most of us wage slaves, they’d want to see documentation of deductions or things like that. Cough up the receipts and they go away.

Your basic wingnut small business is going to have all sorts of personal expenses mischaracterized as deductible business expenses, unreported under the table income, assets used for business mischaracterized as personal ones to avoid taxes and fees, and shit like that. Because they’re smart, see.

They insist on using the term “baby” as a form of emotional blackmail, the same reason they insist on referring to abortion as “murder.” It’s why they like to haul around pictures of aborted “babies” when they hold their protests, because the images are unsettling and are meant to give you a singular impression of what an abortion entails. If they showed you what most abortions actually result in, which is a blob of undifferentiated tissue and little else, people wouldn’t be viscerally impacted and respond negatively towards the people involved. The overall goal is to sway an otherwise reasonable person into supporting their cause by leaving them with the implication that if they are not anti-abortion, then they’re supporting “MURDERING BABIES!!!”

Lara Trump: “If this is what they’re able to do to the former President of the United States, think about what they could do to you, to anybody in America.”

What sort of America is this when traitors and mobsters are no longer safe from the law?

Yes, traitors and mobsters all over America are starting to realize that they are an “unwanted minority”.

Well, let’s see if they FBI did indeed find something serious enough to indict Trump with.

First comes the search warrant, the gathering of evidence.

Then comes the arrest warrant.

Dr Lizardo  Aug 9, 2022 • 1:53:00am

Meanwhile….

Tucker Carlson is “shitting himself” over the possibility that texts between him and far-right conspiracy loon Alex Jones will leak, a source close to the Fox News star told Confider.

Carlson and the raving Infowars ranter trade text messages on a daily basis, according to two people familiar with their relationship. If made public, these sources said, the text messages would be “highly embarrassing” for Carlson.

Two years’ worth of text messages sent and received by Jones are now in the possession of the U.S. House committee investigating the Jan. 6 Capitol insurrection after the far-right conspiracy king’s lawyers accidentally sent a digital copy of all his texts to the lawyers representing the families affected by the Sandy Hook elementary school massacre, which Jones repeatedly dubbed a “hoax.” (Last week, a Texas jury ruled that Jones must pay a combined $49 million in compensatory and punitive damages to the parents of one of the schoolchildren killed in that 2012 mass shooting.)

A lot of the legal takes I’ve seen tonight have been of the opinion that given who Trump is and how powerful of a magnifying lens is about to pointed at the FBI, there’s little chance that this was all a fishing expedition meant to see if they could dig something up. They know evidence of a crime is there, where it likely is, and waited until Trump was out of the state to prevent him from directly interfering or destroying evidence.

Yep, I’m almost certain the FBI waited until Trump was in NYC to stage the raid. They know damn well who they’re dealing with.

The man in question here used to be a Libertarian, is an economist, and a business owner.

He points out how libertarianism has always been a fascist movement, with early on an actual religious arm (called “I Am” who worshipped the “God of Gold”), and has never supported democracy.

The “liberty” in libertarianism has always meant “economic liberty” (to hoard money), not “political liberty.” This is why prominent libertarians such as Milton Friedman, Peter Theil, and the Heritage Foundation keep getting caught saying the quiet part out loud (they are opposed to democracy).

He starts in his video all the way back in the late 1800s, to those who laid the foundations of the American libertarian movement. He points out some of those very people were prominent members of the Business Plot, and the real cost when you get an ideal libertarian nation such as Friedman proposed (Pinochet in Chile followed by genocide).

He also points out why libertarians have always supported the gold standard (and lately cryptocurrency), that is to take power away from government and give it to fascists.

Amongst other things, this is why Libertarians are howling so loud right now on social media about the increased employees to be assigned to the IRS over the next ten years.

One example given is the decades-long argument from Republicans and Libertarians “we don’t have enough money for X.” Another one is the myth a primarily service economy must fundamentally cause a fall in the standard of living (most jobs actually can’t be outsourced overseas, like a nurse or teacher, and a parent working outside the home is actually two jobs created: One for the parent and one for the childcare provider).

If we were able to simply collect all the taxes legally owed, we would have less need to raise taxes.

And out outdated system of accounting is based on a time when corporations had tangible assets: plant and property, offices and furnishings, etc.

Now all those things are leased and the only thing that corporations “own” are goodwill: patents and licenses. Leaves a lot more room for creative bookkeeping.

It is no coincidence that General Electric, with the largest corporate legal department in the world, pays almost zero taxes. For them, it is more profitable to hire a tax-rights lawyer than to hire another engineer or production worker.

That’s what we all want; the problem is, it’s highly unlikely that’s what we’ll get. It’s pure political calculation.

The GOP knows they need his cultists to get elected and in order to have access to his swivel-eyed loon base, the GOP needs Cheeto Mussolini himself. If Trump’s in the slammer (let’s say), that could well be enough to cause his base to sit out an election cycle or two (or maybe more, becoming completely disillusioned with voter participation) in a fit of pique.

Trump’s perverse charisma is what drives and animates the GOP’s base - and if he’s not around, they’re worried they won’t even have enough votes to get a Republican elected as municipal dog catcher.

In the last legislative session of our Unicameral, a Republican proposed a bill (which went down to defeat in committee hearings) to punish any municipality or county which tried to defund (or even reduce the budget) of police.

It was pointed out in the judicial committee more than three-quarters of the municipalities in Nebraska have no police whatsoever and there is no raging crime wave across the state.

In my county, there are three municipalities. Bridgeport (the county seat, pop. 1,100) disestablished its police department a couple years ago, deciding it was cheaper to contract with the Sheriff’s Department to provide policing in the city. Bayard (pop. 800) maintains a two-person police force. My village (pop. 124) has a marshal.

All three municipalities are also regularly patrolled by the Nebraska State Patrol (though they do not enforce municipal ordinances).

Did something happen last night? I could have sworn that I heard tens and hundreds of voices cry out in horror that something went down at Mar a Lago and the FBI did their fucking jobs and investigated a crime that occurred there.

Weird. Then these same people claimed that the FBI were politicized and that the head of the FBI should be fired and whoever hired that guy should be arrested.

Do any of these people know that Chris Wray was a Trump appointee? You doth protest too much.

Trump has broken more laws than most people can keep track of. I’ve tried my best to keep tabs on what crimes occurred, and it’s always expanding, because Trump commits crimes to cover up prior ones.

In no particular order: extortion, attempt to commit extortion (Ukraine). Emoluments (self-dealing while in office). Stolen classified info. Distributing stolen classified info (the 15 boxes taken during the move from the WH after losing election). Sedition. Attempt. Seditious conspiracy. Interfering in federal investigations. Interfering in election certification. Election fraud. Witness tampering. Interfering in Congressional investigations.

The list grows by the day, and the DOJ and FBI are expanding their scope of criminal investigations almost daily given new details identified and uncovered. Trump deserves all these investigations and the prosecution for same.

The FBI isn’t going to execute search warrants without getting a judge to sign off, and they’re not going to do so without overwhelming evidence that the warrants will identify evidence showing criminal conduct, proving criminal conduct, or supporting evidence of same. The evidenciary standards are high to secure a warrant in the first place - they’re even higher when the target of the warrant is the former occupant of the WH.

It’s not like the FBI or investigations required the former guy to pull his pants down and check the mushroom. They searched the building and opened the safe where documents could be located. They took those documents with them.

The reaction to all this is entirely predictable from Fox and the right wing echo chamber. They’re projecting like IMAX that this is somehow politicized action by the FBI, jackbooted thugs, etc., and it comes a day after we learned from Gen. Milley (via a book to be published instead of reported *AT THE FUCKING TIME IT HAPPENED*) had a conversation with Trump where Trump insisted that US generals act more like the goddamned Nazi generals around Hitler in WWII and show some loyalty to Trump - never mind that those Nazi generals launched at least 3 assassination attempts, Hitler committed suicide in a bunker, and Trump adores goddamned Nazis who engaged in genocide and war crimes.

Trump picks his lawyers based on their appearance and looks and their tv appearances. That’s why he surrounded himself with the likes of Rudy, Powell, and all the rest.

He had some NJ real estate lawyer representing him - Alina Habba. He’s picking based not on their skills or competencies, but because they’re saying stuff that Trump wants to hear - not what he needs to hear.

And his know nothing base buys all of this crap.

The warrants for the search were airtight - they’d have to be based on who the target was. All of the responses to this search warrant show that the GOP intends to politicize the hell out of the DOJ and FBI, even more than they did under Trump.

The GOP is going all in that the MAL raid was a politicization of the FBI and DOJ.

This is what they want to do, not what happened here.

This was a properly executed warrant, and they all know it. They’re scared shitless that Trump’s crimes will be exposed and prosecuted for same, and their own roles will be known and prosecuted as well.

No one is above the law, but the GOP thinks the law only applies to their enemies.

We also see a lot of whataboutism, claiming that Obama and Clinton should have been targets of FBI warrants for “documents” or “materials” taken from the WH. It’s all bulkshit, when we know Trump stole documents, destroyed classified documents, and engaged in wide ranging criminal conspiracies.

The thing is this, this is the thing… the boxes of materials were recovered from Mar-a-Grifto back in February. It appears that the FBI were looking for specific documents; documents that were housed in a safe, not the above boxes which were returned (perhaps missing a couple of classified items?).

Now I am just speculating (admit it, we all love to… come one, you know we do and it would be truly irresponsible not to!) but could said documents have been sold? The FBI now has evidence that they were sold. Said evidence points back to Mar-a-Grifto and little Donnie from Queens. Which triggers the search warrant. In which case Donnie is royally screwed.

Yeah, it’s speculation. But really delicious speculation for this Tuesday morning.

The thing about the “OMG politicization of the FBI” crowd is that they’re deliriously ignorant of how tough it is to get a search warrant, even for plebs like us. When the location of the search warrant is the residence of a former President of the United States, and the target of the search warrant is documents he may have in his possession, the bar to clear to get a judge to actually sign the damn thing is so high, they may as well just book him on charges. No judge is going to want to be on record as allowing a wild goose chase against any former President - let alone one who is famously litigious, and even more famously wields hypnotic power over millions of slavering idiots who would literally kill at his command.

I can’t tell if Pete is joking or not. I still haven’t gotten through his movie “The King of Staten Island.”

Pete Davidson has been in “trauma therapy” largely due to Kanye West’s attacks on social media, several sources confirmed to Page Six.

Beginning in April, “The King of Staten Island” star, 28, has been seeking help following his feud with the rapper for dating his ex-wife, Kim Kardashian.

“The attention and negativity coming from Kanye and his antics is a trigger for [Pete], and he’s had to seek out help,” an insider told People, who first reported the story, Monday.

The source stressed that, despite calling it quits last week, Davidson “has no regrets for dating Kim and wants it to be made very clear that she’s been nothing but supportive of him throughout their relationship.”

It’s the natural progression from the bullshyte claim that during the Obama Administration, the IRS was being used by him to target conservative groups for political retribution.

Some political groups on the right were examined over their tax status, but more progressive groups were (that part conveniently gets left out in the telling).

Yup. The IRS saw groups across political spectrum getting 501(c)(3) treatment that should not have gotten them; but GOPers in Congress only asked about conservative groups - completely ignoring that the IRS office that handled the applications had a process in place that rejected applications when the motivations of the individual applicants was political, and not charitable. The office wouldn’t have needed that process if they had more personnel to make decisions - the process was a shortcut - looking at names of the groups.

Nowadays, though, they probably have computers matching forms to records from banks, businesses, etc to detect any discrepancies: so if I withdraw less than my total RMD from my IRA/401ks, they will probably automatically send a letter challenging this failure or if I don’t report certain interest or dividend, they can detect that error and automatically send out a letter.

IRS has wage and income statements that are generated by the employers and financial institutions as a matter of course; much of what they do is matching those filings with what the employee/taxpayer is filing. Mismatches and fat fingering of data is one area that can trigger an IRS letter/response.

Audits are a deeper level where additional documentation is required. People who file certain kinds of credits/deductions are more likely to get an audit, including for the EITC. Millionaires, who have a lot of tax schemes and the tax code favors them generally, have more complex returns, so audits are more complicated and take more time. That’s why fewer are done. It takes time and personnel to conduct those audits as compared to the EITC audits.

I imagine when I withdrew the cash to buy my car, and when I wrote the cheque to pay for my heating and air conditioning system, those were reported since both were over $10,000. Neither has caused the IRS to ask me about those though.

what i call compliance vs substantiation

compliance is making sure the stuff on your return agrees with the info the irs has - this usually comes from 3rd party generated documents. w-2, 1099, 1098, and on and on.

substantiation is proving all your income is reported and/or that your deductions are valid

My dad was audited in the early 1990s. He and the tax lawyer he hired made it a PITA for the IRS. They were happy to hand over documents; the IRS just had to sign for each individual piece of paper…separately. In the end, a third-party tax accountant found a several hundred dollar overpayment and the lawyer was like, “do you want to pursue this?” At that point, my dad was like “AW HELL NAW.” The IRS ended the audit, nobody had to pay anyone anything except my dad was stuck with a rather large bill for the lawyer and accountant.

Oh, and to be very clear, my dad was not rich; he’d done some stock shenanigans that caught the IRS’s attention.

It was John Kelly, not Milley, who is reported to have had that particular conversation.

Let’s not forget that the persecution of Clinton was payback for Watergate. A Republican president was driven from office because of his criminal misdeeds harming our democracy; in retribution the same fate should apply to a Democrat for whatever they could manufacture (Vince Foster, Whitewater, etc, until they found Monica).

“There’s a game prosecutors play. Let’s say I suspect X committed an armed robbery, but I know X is dealing drugs. So, I write a search-warrant application laying out my overwhelming probable cause that X has been selling small amounts of cocaine from his apartment. I don’t say a word in the warrant about the robbery, but I don’t have to. If the court grants me the warrant for the comparatively minor crime of cocaine distribution, the agents are then authorized to search the whole apartment.”

“If they find robbery tools, a mask, and a gun, the law allows them to seize those items. As long as agents are conducting a legitimate search, they are authorized to seize any obviously incriminating evidence they come across. Even though the warrant was ostensibly about drug offenses, the prosecutors can use the evidence seized to charge robbery.”

“I believe that principle is key to understanding the FBI’s search of former president Donald Trump’s Mar-a-Lago estate in Florida on Monday. The ostensible justification for the search of Trump’s compound is his potentially unlawful retention of government records and mishandling of classified information. The real reason is the Capitol riot.”

Let’s say Trump is caught dead to rights. The DOJ works on their timetable and an indictment comes down at the end of the year. Trial preps go on into 2023. Maybe 2024 it goes to trial. We will never see anything like what may be about to happen.

This is a smart move: sideline Trump to where he can do minimal harm (prison) then appeal to the Trump base as being on his side and ready to pardon/release him and ensure justice against those who led the “witch hunt” against him.

Then you still get the base swinging for you and are rid of that buffoon who does not know how to get anything done, not even stage a successful coup.

The man was touring the Geldrop Castle gardens in the southeastern Netherlands when the ball went over a wall and struck him, killing him instantly, The Sun reported.

“The pendulum dropped, we saw the ball go over the hedge and then we heard a woman screaming very loudly,” said one witness.

“It wasn’t a spectator … so he didn’t see the ball coming at all.”

How about that environmental lawyer he was gonna make AG?
You know head of the whole doj.
You’d think he would be competent

Oh yeah. Forgot about him. He would go to court and make the argument that the Trump family was an endangered species… or something.

Heh. It’s not a question of finding a criminal defense attorney. It’s a question of finding a criminal defense attorney who is both competent and cool with not having a huge retainer (or not being paid at all).

Someone who wants a lot of publicity.

I’d revise and extend those comments.

Trump needs a criminal defense lawyer who is competent and cool with never getting paid, or having to sue for compensation, along with having a client who will ignore everything said lawyer asks him to do to minimize legal consequences, because the client will always think he’s the smartest guy in the room and will do anything and everything other than what the lawyer said for him to do.

I’ve seen twitter posts claiming that Trump actually filled the 15 boxes himself because he didn’t want aides seeing what he was shipping to MAL. But so far anecdotal.

Only possible if Putin or Bonesaw gave him direct orders on which documents they needed. Does anyone really think Trump would read anything and decide its value based on his comprehension of its contents?

Here’s a Wash. Post article that address that issue. I pulled the bolded sentence below out of same article.

washingtonpost.com

“Trump was noticeably secretive about the packing process, and top aides and longtime administrative staffers did not see the contents, the people said.
