But the prize for most contemptible has to go to the guy who Trump actually tried to have murdered on January 6th; his craven sycophantic vice president, so obsessively hungry for power he’s still sucking up.

Well, yesterday evening before the FBI raid I was looking for songs from my old favorite group, Peter Paul & Mary when I came across this cover they performed in 1966. It got me thinking that a number of weeks ago we collected a whole bunch of train songs, there must have been hundreds of them! Anyway this is an airplane song. PP&M also covered “Leavin’ On A Jet Plane” so they were trying to make airplane songs a thing. There are far fewer airplane songs than train songs.

I am not sure this is true. The power to classify or declassify documents stems from the president to people he designates. As the law stands now the president can choose to declassify something mid conversation if he chooses. The agencies that do the initial classification gain that authority through the president and can not override him. There are pretty on point supreme court rulings on this and since the power flows from article II of the constitution it isn’t even likely congress could pass a law restricting it without bringing up serious separation of powers issues.

The rules for classification are set forth in an executive order and the executive can change those rules as he sees fit.

I doubt it, and I wasn’t making any legal pronouncement on the current situation just that the president has ultimate authority over classification or declassification. I don’t know if he has to take any affirmative action to declassify. He also has the authority to choose who to share classified information with. I think if this is all that DOJ is going at him with it will end up becoming a constitutional question that will ultimately end up before the SCOTUS and I can guess how that will turn out.

If Mitch is ready to rock, I am sure he will have no shortage of friends…and way more impressive ones than Susan Collins.

Having said that, I tend to agree with your second point. He’s clearly the target of a serious criminal investigation right this moment and he won’t shut the fuck up. He cares way more about his next golf game than the fortunes of whomever the GOP nominates as long as it is not him.

He will be a problem as long as he lives, but I think for Mitch and others the temptation to be able to snap up the 70,000 voters in the upper midwest that voted straight (R) aside from the top last time will (in addition to losing the Senate) force them into action ahead of 2024.

There were statements by several #lawtwitter lawyers yesterday that alluded to the fact that DOJ doesn’t really pursue cases of “just” mishandling classified documents; there really isn’t much point in it. If they’re going after the documents Trump took from the White House when he left, there’s most likely a bigger reason… And if they’re bold enough to go after Trump himself to investigate it, that reason definitely can’t be small.

This is the one way the DoJ could get him IMO is if they can prove after he was president he shared or sold classified information. I think they will never convict him for just having it.

That’s the conclusion I’m coming to, as well. All we have is speculation at the moment, and it’ll be quite some time before the details come out - if he’s charged, if it gets that far, all the if’s that come in between. But I’m not seeing much else that would get the DOJ out of bed to knock on the doors of Mar-a-Lago at 9 AM.

I recall he waved classified documents in front of reporters to show to “powerful” he was while president. One guess is he did that again, in front of someone at MAL, who reported it.

However, I think it’s equally likely that he sold some info and the FBI is looking to prove that.

I’m a big fan of the film “Heat.” Today, I just received “Heat 2” the sequel/prequel novel written by director Michael Mann and Meg Gardiner. Ten pages in, it’s fucking awesome.

Marc Maron isn’t for everyone, but he had a good interview with Mann a couple of weeks ago on his WTF podcast.
