Mandatory that the Dr. offers is not mandatory that the patient accept.

What I don't understand is this...Is there a huge number of people who are NOT getting end of life counseling when the time comes? I have been through three terminal scenarios with family members over the years, the latest has been last month. In all cases there was a discussion with the doctor about end of life care. This discussion was not billed separately but was a matter of discussion during a visit. So why does this need to be in legislation at all? Am I missing something?

What bothers me is that dwelling on a moot issue since it's been dropped is non productive anyway. Focus on the takeaway from Medicare, Focus on higher taxes, focus on Public option.

As I would say to these congresscritters: "It's the context, stupid".

In any case, the news for me is that 0bama is starting to lose people like Nat Hentoff and even Camille Paglia through sheer tone-deafness born of hubris.

This end-of-life consultation has been stripped from the Senate Finance Committee bill because of democracy-in-action town-hall outcries but remains in three House bills.

A specific end-of-life proposal is in draft Section 1233 of H.R. 3200, a House Democratic health care bill that is echoed in two others that also call for versions of "advance care planning consultation" every five years — or sooner if the patient is diagnosed with a progressive or terminal illness.

I don't know if this is true but if it is... then I don't think it is dwelling on a moot point. I just have very little trust of the government at this point. The very inclusion of this end of life counseling is troubling to me since any doctor worth his salt already discusses patients wishes when the time comes or when it becomes the case is terminal. So I have to wonder, why this is in there?...for what ultimate purpose?

You are right...there is sooo much to quibble about in this bill. I believe this particular point is a gleaming example of just how intrusive our government wants to be in our lives.
